presumptive g- o-p nominee.. donald trump.. has picked indiana governor mike pence.. to be h breaking news on the campaign trail. sources telling cbs news that donald trump has picked indiana governor mike pence to be his running mate. good afternoon, i'm kenny choi. >> i'm michelle griego. cbs news' weijia jang is live in cleveland with the latest

developments. and weijia, trump wants supposed to make this announcement until tomorrow. >> reporter: you're right. but a gop source tells us that in fact indiana governor mike pence will be his pick. and pence will add a significant amount of experience to the gop ticket. for weeks trump said he wants someone who can help him work with congress. pence was a congressman for 12 years before becoming governor. he can also help calm some of those republicans who are still skeptical about trump. a gop official tells cbs news that donald trump will choose indiana governor mike pence to be his running mate. pence and trump spent time with their families in indiana on wednesday. >> a man that's going to be a great president, a man who really can tell a lot about a person when you get around their family. >> reporter: more than two- thirds of potential trump voters say who he picks as a running mate will impact their vote. and the race between trump and

hillary clinton is now a dead heat. the latest cbs news/new york times poll shows clinton and trump tied at 40 points each. she had a six point lead in june. candidates typically lay low during the other party's convention as a courtesy. but clinton is scheduled to deliver a speech in ohio on monday, the opening day of the republican national convention here in cleveland. >> you have to see this guy. oh, i don't know what i said, ah! >> reporter: the clinton campaign is spending millions on a new ad that will run in key battleground states including ohio. it shows children watching some of trump's more controversial statements on tv. clinton makes clinton is in washington, dc today. there is one important gop leader who approves aspens as trump's pick for vp. house speaker paul ryan said

it's a good choice especially to energy conservative republicans. my develop? >> weijia, a new cbs poll shows 86% of voters have never even heard of pence. how will that play out? >> reporter: 86% say they don't have enough information about him to even make an opinion about whether they like him, how this could impact their vote. but that will change. tomorrow, trump and pence are scheduled to make their first campaign event together in new york city. i'm sure they will make a huge effort to get as much out about him as possible. >> thank you, weijia jang in cleveland. the "new york times" reports one-time football star tim tebow is set to speak on the final day of the republican national convention. other guest speakers include pro golfer natalie [ indiscernible ] , former new york mayor rudy giuliani and sillicon valley billionaire peter thiel.

justice ginsberg regrets criticizing donald trump. the 83-year-old justice called him, a faker on tv. yesterday trump called on her to resign. pundits say the harsh critique was surprising coming from a sitting supreme court justice. today she release a statement saying, quote, judges should avoid commenting on a candidate for public office. in the future, i will be more circumspect. breaking news in east san jose. there's been a shooting on king road and tear buena. one person is injured. we don't know how bad. but police have closed the intersection to investigate. we'll have more on this story this afternoon on our website, cbssf.com. taking live look outside from our camera in dublin, just one part of the bay area experiencing unseasonably warm

temperatures even hot! we are talking triple digits. >> this hazy scene in the south bay prompting concerns over air quality today. let's get over to roberta gonzales. >> thanks. good afternoon. when we see the haze and it has been lingering across the santa clara valley since sunrise this morning, a lot of it is attributed to the east bay fire that was burning in the very dawn hours today that was now -- now, i should say, is out and firefighters did a great, great job efforting that fire. right now we have that haze and therefore we do have a "spare the air" day effect -- in effect for this afternoon. san jose now at 81 degrees. livermore at 92. santa rosa at 84. it's a hot day inland. what we need is a good breeze to blow out the pollutants, the ozone, and really not seeing that inland. sure, along the coast at 12- mile-per-hour winds it's calm in fairfield. if you take a look at our scale here, it is the east bay, south bay, two pictures we just saw with the haze, that's where we

have the unhealthy pollution at the surface. we have a full report coming up. back to you. >> all right, roberta. of course those dry hot windy conditions are a concern for firefighters some of whom are mopping up after a brush fire in the east san jose foothills. kpix 5's maria medina on what may have started it. >> reporter: this is what firefighters were dealing with, open space with a lot of dry brush and they say this could have been a recipe for disaster. the flames ripped through the hillside of the sierra vista open space reserve. >> both sides of the road extending in both directions over the hill and then downhill slope. >> reporter: firefighters put out the grass fire before it grew to 7 acres and say they found a roman candle firework in the parking lot just feet from the flames. >> at this time of year we're as you suspicious of fireworks. and so that's something we look to rule out. because of the size of the road, the height of the fuels and no wind, a fire on both side, it's suspicious. >> reporter: they say the fire

could have ended much worse. the concern, winds would push the fire toward alum rock park and dozens of homes where people were still sleeping at 3 a.m. >> there's a lot of heavy vegetation in there. and fires always move faster uphill. >> getting to the fire was the first challenge. although they got several calls about the bright orange light, it took some time to find the fire. >> one of the earlier responding engines noticed it was over towards this area. >> reporter: a close call for nearby homes and now firefighters hope if fireworks did spark the grass fire, the lesson is loud and clear. >> playing with fireworks kills people and destroys property as well as the safety of the responders to try and protect it, so -- >> reporter: because it's hot and dry out here today, firefighters say they will be patrolling the area all day to make sure those hot spots don't flare up. in san jose, maria medina, kpix 5. new at noon, oakland police hope surveillance video can help them solve a homicide

case. kpix 5 reporter lisa chan on the early-morning incident and plea to business owners. >> unfortunately, we lost another life early this morning. >> reporter: just after 4 a.m., the oakland police department shotspotter was activated. it alerted them of gunshots in the area of 35 that and san pablo. when officers responded, they discovered a male victim in his 30s in the street who died from several gunshot wounds. >> we're asking businesses, we're asking residents, to check their video surveillance system. they may have captured prior doing or after the crime. so we are reaching out to the community. >> reporter: police want to figure out what led up to the shooting and if there was an argument or confrontation before it happened. right now, they are talking to witnesses and hoping something was captured on nearby surveillance cameras. the oakland police department spokesman says so far, there have been 34 homicides this year at the same time last year 43. she emphasized anyone with

there have been at least 20 shootings.. some of them fatal.. since november. by monday, more than a dozen there have been at least 20 shootings along highway 4 in pittsburg some fatal since november. on monday, more than a dozen cameras will watch highway 4. in recent weeks, several east bay mayors have been pushing state officials to get funding

for cameras along the freeways in the area. it's now up to caltrans to ease congestion on 101 at the peninsula. there will be express carpools lanes in the county up to the san francisco city line. mtc official voted to shift nearly $9 million to get the project rolling. swerving single-digit salutes and serious threats are nothing new on the nation's roads but as cbs reporter jamie yuccas tells us, the bad behavior is much more common. >> reporter: after an argument, a driver in florida ran over joe on his motorcycle breaking his leg. >> i think people need to understand the depth of their actions. >> reporter: in colorado, police say a motorcyclist shot at a couple's car after being cut off. many drivers say they see road rage whenever get behind the wheel. >> just creates a lot of hectic and hazardous situations for other drivers. >> reporter: in a new survey from aaa, nearly 8 in 10 u.s.

drivers reported engaging in angry and aggressive behaviors over the past year. 51% say they purposely tailgated. 47% yelled at another driver and 45% of drivers say they honked at someone. aaa estimates nearly 6 million drivers have either bumped or rammed another car on purpose and 7 million have gotten out of their car to confront a driver. >> i think we are definitely surprised at how often it's occurring and to tell you the truth, a lot of times we look at these numbers and people tend to underreport. >> reporter: male drivers and drivers between 19 and 39 were significantly more likely to engage in aggressive behaviors. but even this woman admits to losing her temper. do you ever get mad behind the wheel? >> sometimes. >> reporter: she lives in new york. drivers in the northeast are more angry than other parts of the country according to the survey. jamie yuccas, cbs news, new

york. supporters of a proposed soda tax filed reports. they are upset about this television ad against a november ballot measure for the 1-cent per ounce tax on sales of sugary drinks. supporters say the opponents' tv ad is lying by referring to as a grocery tax implying it goes beyond sugary drinks new at noon, the 68th prime time emmy nominations are out. >> the announcements made just hours ago in los angeles. >> our first category is outstanding lead actor in a drama series. and the nominees are: >> some of those nominated including kyle chandler of blood lines, mr. robot, better call saul and others and kevin spacey of house of cards racking up nods in the

category. >> kevin spacey, that's a good one. overall's hbo's "game of thrones" leads with 23 nominations. the people versus oj simpson and fargo got 22. among the snubs, lady gaga, outlander and the final season of cbs' acclaimed "the good wife." the awards show airs september 18. time for another check of weather with roberta. >> what a beautiful view this time around from the transasia airways looking towards the coast, where it is not clear. this is a typical weather summer pattern looking towards the golden gate bridge. it's a compressed deck of clouds surging under the golden gate bridge wrapping around to angel island trying to make tracks towards alcatraz. meanwhile we have clear skies inland at 92 degrees in livermore. 62 degrees in san francisco. we have dropped 2 degrees in san francisco in the last hour because of west-northwest wind

at 12 miles per hour. 16 in the oakland area. winds are flat inland. and because of that, the ozone is causing a real big problem as far as your air quality is concerned. other notable temperatures corked the weather watcher all in the east bay bill at 90. jerry in antioch reports 91. and brentwood paul smith says, hey, it's hot, 90 degrees. hazy sunshe, ozone level is really high in the eastern portion of our bay area as well as the south bay the recipient of some of the lingering smoke from that east bay fire earlier this morning. we have the thin overcast at the coast, additional warming today inland. and we have yet another "spare the air" day in effect for tomorrow making it 3 straight days in a row. we started off clear at the coast this morning then saw the surge of the area of low clouds and fog go north out of the salinas valley. we are going to see an enhanced marine layer later on because of an area of low pressure coming to the bay area. marine layer gets thicker all

the way through sunday. 63 degrees monterey bay. otherwise, 20 degrees warmer in the high sierra. currently it is in the 70s. 102 sacramento. our numbers like this: slightly cooler tomorrow with thicker marine layer, seasonal through wednesday. but you're going to feel the difference over the weekend inland once that marine layer has that wind-driven to the east and to the north. >> all right, roberta. thanks. taking a look at our financial markets, on wall street, record closing highs on tuesday and on wednesday looks like it could be a third straight day. the dow at 18,521 up 149 points. a north bay boy and budding chef gets a once-in-a-lifetime chance. he is cooking for the first lady. what he is whipping up at the white house today.
