where students are reacting to the news. >> this is where the university is once again planning a vigil for one of its students. nicholas leslie, the second student in recent weeks to die in a terrorist attack. nick was just 20 years old, a junior at uc berkeley, planning to study business. he was in nice, france with 85 other students for a campus study abroad program. he and friends were out celebrating bastille day when the attack happened and he'd been missing since. university officials, u.s. officials, french officials searched for him for the last several days. then today the fbi confirming nick's body was found. nick is one of 85 people killed in the nice attack. they're stunned to learn another cal bear taken at the hands of terrorism. >> shocked i guess. we have 35,000 students on campus and like of all the possible campuses in the u.s., we have berkeley students. so it hurts because we're all

latest from louisiana. >> reporter: cell phone video captured the gun battle between gavin long and police in baton rouge sunday. >> shots fired. officer down. fire from the building. >> reporter: police say the suspect opened fire at a gas station less than a mile from police headquarters. officers were responding to a 911 call of a suspicious person walking with a rifle. >> absolutely unspeakable heinous attack on law enforcement here in baton rouge. the violence, the hatred just has to stop. >> reporter: an eyewitness live streamed the shooting on social media. >> he has a mask on looking like a ninja. >> reporter: as shots rang out, law enforcement took cover behind their cruisers. police say three officers and the gunman were killed in the shootout. president obama expressed his condolences and condemned the

attack. >> nothing justifies violence against law enforcement. attacks on police are an attack on all of us. >> reporter: tension has escalated following the death of alton sterling, a black man killed by white police officers in baton rouge nearly two weeks ago. video of his death sparked protests nationwide. days later five dallas police officers were killed in an attack. the motive for this latest shooting on police remains unclear. don champion, cbs news, baton rouge, louisiana. >> three other officers were wounded in that shootout. one in critical condition tonight. in a statement, california attorney general kamala harris called the shootings a heartbreaking tragedy and a grave reminder of the dangers that peace officers face every day. congresswoman nancy pelosi added a call for unity, saying together we have to act to end the division that leads to violence in all our communities. the tragedy in baton rouge has police departments here in the bay area on high alert. devin fehely continues our

coverage from san jose. >> the prevailing mood among law enforcement is one of profound sadness and simultaneous profound frustration and anger that they've been targeted yet again with deadly results. >> reporter: outside san jose police headquarters a community support is at large but a sad commentary on how common police shootings have seemingly become, the fading tributes to the five fallen officers in dallas have not yet been cleared away when a fresh tragedy would take their place in the public's eye. >> there are a lot of folks out there trying to protect us right now who feel they're under siege and genuinely under siege. >> reporter: san jose police went on high alert, doubling up officers on patrol for extra protection. they stopped the practice earlier this week. after baton rouge have decided not to resume it full-time. a spokesperson did release a statement clarifying the department's position, saying they had not received any credible information of threats, while adding our officers have the ability to work two-person

patrol cars if they wish. >> officers are in the line of fire on a daily basis in cities throughout the country. >> reporter: the police officers association condemned what they described as the latest cowardly ambush. they also called on political leaders to increase funding for a department that has in recent years been understaffed and overworked. sam liccardo says the murder of the officers in baton rouge is a tragic reminder of the dangerous and all too often deadly job that police officers perform every day. >> the reality is this is a very dangerous job. these folks are doing everything they can to protect us. as president obama said, an attack on a police officer is an attack on all of us. >> right now the department's policy is that officers, it's left to their discretion if they want to ride one or two to a patrol car. there's no word on how many officers have elected to double up while on patrol. in san jose, devin fehely, kpix 5. flags at the state capitol in sacramento are flying at half

staff for the fallen officers. they were last lowered nine days ago in honor of the officers ambushed in dallas. a walnut creek police officer and a k-9 are both in the hospital tonight after a hit-and-run suspect rammed a cruiser head on. it all started about 10:00 last night when the driver clipped a pedestrian on wooden drive. when an officer caught up with him at parkside drive in hillside avenue, things took a turn. police say the suspects slammed right in to the police cruiser, leaving the officers seriously injured, then stabbed a police k-9 that chased him in to the bushes. officers had to use a taser and a bean bag gun to take him down. >> it was very dark. the subject was hiding in bushes and at various times our officers, depending where they were standing, some officers could see certain things that maybe another officer couldn't see in a different area. >> the officer and the k-9 are expected to be okay. so is the pedestrian. the suspect, 33-year-old rolando gonzalez, is facing felony charges including assault with a

deadly weapon and harming a police dog. in san jose the search is on for the vandals who cut down nearly two dozen newly planted trees in one night. they were planted by a volunteer group called our city forest. and late last week someone sawed down a whole row of trees they had just planted a few months ago along meridian avenue. >> this is the worst vandalism we've ever come across. i don't even want to give it the word vandalism because it seems more like -- it's a crime. it was done intentionally. >> the volunteers plan to plant new trees in the same spot. in the meantime they're asking anyone who may have seen the vandals in action to give them a call. still to come, tensions running high ahead of the gop convention in cleveland. why there's nothing police can do to stop people from bringing guns. he played an important role in the fight for civil rights. right in our own backyard. how a former kpix anchor is honoring a bay area pioneer

where the republican national convention kicks off tomorrow. but tonight we've learned: there's nothing po to keep guns away security is tight in cleveland tonight where the republican national convention kicks off tomorrow. tonight we've learned there's nothing police can do to keep guns from the venue. heightened security is visible all around the quicken loans area. cars are being checked while local police and the secret service are out in force. because ohio is an open carry state, there is no way to stop protesters demonstrating nearby from bringing their guns. the police union is calling for a temporary citywide ban while the convention is going on, but governor john kasich says he cannot arbitrarily suspend constitutional rights. >> i'm not asking for a change in the law. i'm asking for some common sense. having people with open carry, whether you're a protester or whether you're a supporter of trump or anybody in between is

very, very dangerous and irresponsible. >> donald trump will address the convention on thursday. tonight he and running mate mike pence give their first joint interview on 60 minutes. that's coming up after this newscast. our political analyst melissa caen is in cleveland tonight. look for her reports starting tomorrow here on kpix 5. he's a berkeley civil rights pioneer whose name you might not know yet. but tonight he's finally getting the recognition he deserves, and john ramos shows us a familiar face from kpix worked long and hard to make it possible. >> reporter: the corner of sacramento and ashby in berkeley was closed today for a party honoring a man who is no longer living and who most people here didn't know. >> were you aware of who byron was before you came here? >> no. i think our parents did but not

us. >> reporter: william byron rumford was a pharmacist on this block when he became the first african american from northern california elected to the state assembly. once there, he coauthored the so-called rumford act, banning discrimination in housing that would later become part of the federal civil rights act. >> he made it possible that any of us can live where we want legally if we have the resources. it was monumental. >> reporter: rumford was the quiet type, and the memory of his contribution has faded with time. a group of neighbors, commissioned artists, and former kpix 5 anchor dana king to create a bronze statue of the civil rights crusader. king worked every day for months on this labor of love, and says like a parent, it's a little hard to let it go. >> until then, i'm still carrying him. i feel like it's just not done yet until this sculpture is unveiled. i know that's crazy, right? >> reporter: that's why this moment meant so much to her.

[ applause ] >> reporter: so byron rumford has returned to his old neighborhood. still pretty quiet, letting his accomplishments speak for him. the purpose of the statue is to remind those who live here that greatness doesn't have to be loud. it can come from ordinary people in ordinary neighborhoods. in berkeley, john ramos, kpix 5. >> the sculpture sits in the traffic median across from byron rumford's old pharmacy. organizers of the project say it's only the beginning. they'd like to create more memorials to celebrate south berkeley's proud civil rights history. >> good to see dana again too. is she talented, wow. a gloomy san francisco morning couldn't keep thousands of people from lacing up their shoes for the annual a.i.d.s. walk. walkers raised nearly $2 million to fight hiv. for many it is an emotional day, but they say it's also inspiring to see the community come

keep an eye on the bottom right of your screen.. incredible video out of half moon bay. keep in mind on the bottom left hand of your screen as a humpback whale will come leaping out of the water right next to this person paddleboarding. viviana guzman was understandably startled but stayed on her board. her friend also had a camera rolling and caught the close encounter from another angle. just incredible. viviana tells us she attracts the animals by playing the flute for them. apparently it works. bay area thinkers, doers, and dreamers are out on the sacramento river delta this weekend in a floating city. there are no organizers, no tickets, no rules. kpix 5 don ford tells us what

it's all about. >> reporter: it looks like something from the movie water world. boats of all kinds, all shapes, even boats with floating unicorns. the main attraction is called ephemeral island. >> groups of people come together and spend a week out on the water. >> reporter: located in the deep delta just west of stockton, the only way to get there is by boat. and boats in the core island are connected by a series of floating sidewalks. most folks here are actually silicon valley professionals. >> these are people that are self-educating themselves constantly. then when it's time to party, it's time to party. >> reporter: but in between party and play, there's a lecture series by business leaders. >> what are you going to be speaking about? >> i'm going to speak about the future of our ocean. discussions at the policy level, the state, and federal level

of mist. we have fog and low clouds that will be moving in in the night from the morning hours. plenty of sun in concord. cool coast. sea breeze is going to keep the inland areas cool through thursday. things will heat up through the weekend. between now and then we're unusually cool. it will be a nice evening for the as to take on the astros tomorrow night. partly cloudy skies. game time temp, 63. sum it up, fog and low clouds will clear to the shoreline tomorrow. the shore itself remains fairly shrouded in low clouds. a cool shoreline too but the 90s will be back by thursday lingering in to friday. at least close to 90 inland. overnight lows tonight, mid 50s will do it. sun up tomorrow morning. 2 minutes after 6 a.m., forecast highs, look how far below average we are. concord will be 9 degrees below

average. san jose, 7 degrees off the mark. still a nice day for a monday. temperatures will be in the mid 70s for much of the south bay. over on the peninsula, low clouds will be on the shoreline. high temperatures in the east bay. fixated corridor, upper 70s. a little bit farther east, brentwood, mid 80s. the exception, the rule tomorrow will be unusually cool weather including the north bay, just mid 70s, closer to the shoreline, cooler than that. extended forecast, we'll go with stratus quo. the usual low clouds in the morning and sun in the afternoon, finally getting a little bit of a warming trend as we head in to friday and saturday and sunday when it will be hot again. hot all the time, mr. glenn. >> oh, yeah. coming back with the as and the giants, moving pictures. giants, boy, and a long ball game in san diego. the giants at this point, they'll settle for any game they can put a w next to.

atop the leaderboard, combined golf up top. and the open is now shut. phil mickelson and henrik stenson on top of the leader board, they combine for 14 birdies. mickelson, a runner-up, that's the movie i've seen 11 times before. mickelson was shooting for his sixth major championship win. second british. down a shot in the beginning of the round. how do you like this one? beautiful. a tap-in birdie to leapfrog stenson for the lead. 10 birdies. none better than this. over 50 feet away at the 15th. wow. gave him a two-shot lead on mickelson with three to play. a 65 by mickelson couldn't catch him. ended the round with this one. another birdie. final round, record tying. 20 under par for the championship after an 8 under 63. mickelson finished second in a major for the 11th time. 17 under par.

baseball. giants. what now? no hit today for almost seven innings. no answers at san diego. you'd think 13-game winner johnny cueto would help stop the bleeding, but boy, did the padres get to him. christian bethancourt, back away and gone. a second deck number. cueto allowed four runs in five innings. jackson, a no-no in to the 7th until conor gillaspie took care of that one. three-run homer. giants down 4-3 just like that. bottom of the inning, solarte just inside the foul pole. goodbye. that was as the padres finish off the sweep. 5-3 the final score today. back in oakland, starting pitcher had to leave after a blister on his finger. second pitcher got drilled by josh donaldson. stayed in the game but left after the inning. so oakland lost two pitchers to injury in the 1st inning.

wow. as down 3-1. bottom 6. venture to yonder alonso found a big hole, a gapper. brought home two. top 9, two outs. the former a donaldson came through. a go-ahead two-run double. blue jays made it stick. they won 5-3 to avoid a sweep. we are your nascar station, huh? a lot of left turns in new hampshire. despite leading 38 of 301 laps. matt kenseth cruised to a second win of the year. but, but, but after further review they inspected his car and it did not pass inspection. the results of that will be announced later in the week. for the moment, he's enjoying causing a smoke and those wheelies headed to victory. >> bright yellow car there. >> sports final coming up later on tonight.
