he defiantly refused to endorse trump during a prime time speech. weijia jiang is covering the convention in cleveland. good morning, weijia. >> reporter: good morning, anne-marie. ted cruz came out and soaked up a one-minute long standing ovation when he first appeared on stage but that warmth quickly turned frosty when he delivered what sounded more like a stump speech for himself and he refused to endorse the man who beat him. in fact, he only mentioned donald trump's name once. day three of the rnc was supposed to be all about vice presidential nominee mike pence. >> i accept your nomination to run and serve as vice president. >> reporter: but the indiana governor as moment became overshadowed by bad blood between donald trump and formal rival ted cruz. >> stand and speak and vote your conscience. vote for candidates up and down the ticket who you trust to defend our freedom and to be faithful to the constitution. >> reporter: the texas senator was enthusiastically booed

during his speech for failing to endorse the billionaire. >> god bless the united states. >> reporter: the jeers quickly turned to cheers as trump entered the arena. he later brushed off nonendorsement as no big deal via twitter saying i saw his speech two hours early but let him speak any way. hillary clinton used cruz's own words to capitalize on the moment, urging people to vote their conscience and choose her pin november. cruz's last stand comes one day before trump takes center stage in cleveland tonight. reaction to delegates was mixed. >> if this guy wants to save his political future, he has to come to the table but it was an embarrassment. >> i think he gave a message that was clear, but he also gave a message that wasn't forced, so i think it was well said. >> reporter: ivanka trump is

expected to stress union -- express unity tonight, before her father accepts the gop presidential nomination. politico is saying cruz is speaking to the reaction saying i had to speak the truth. it's going to be an interesting couple of days. the chips will fall where they may. cruz's supporters seem to be betting on his political future. hundreds greeted him chanting 2020, the year of the next presidential election. >> so interesting. weijia jiang in cleveland, thank you. as we reported, trump knew cruz refused to endorse him beforehand but he let him speak any way. cbs news contributor bob schieffer says the trump's ticket may have stepped on its own toes. >> did the trump party step on their own message tonight? >> well, i think -- i mean, for mike pence, that is kind of the tragedy here. he made a very fine political speech. but all of the stories tomorrow, all of the commentary is going to be about -- about -- about ted cruz getting booed off the stage, because he told people to vote their conscience.

if the republicans didn't want him to say that -- they had the speech. why didn't they tell him not to appear? again, i don't understand who is kind of running this thing. >> why did they let ted cruz on stage? >> well, that is the part that remains something of a mystery, but we see this great divide now and the disorganization of the republican party. >> if it looks like hillary clinton has stayed out of the spotlight during the convention, her social media team has been working overtime as speakers have taken the stage over the past three nights. the clinton campaign has tweeted rapid responses to speeches and complimentary quotes her opponents said about her not so long ago. last night, mike pence was no exception, saying in 2005, i think hillary clinton is an enormously appealing individual. this is one of the most admired, not only women, but public people in america. it's widely reported that hillary clinton could announce her running mate as early as

tomorrow or saturday. clinton will be campaigning in florida prior to the democratic national convention which begins monday in philadelphia. it's believe the short list includes virginia senator tim kaine and agriculture secretary tom vilsack. but "the washington post" reports that there has been no final decision made. a supporter of donald trump is being investigated by the secret service. al baldazaro is former marine and also a new hampshire state representative. he said hillary clinton should be shot for treason. he was referring to clinton's handling of e-mails. the trump campaign says that mr. trump does not agree with baldezaro. donald trump opponents plan more protests today outside the republic national convention. >> get back! >> yesterday, a flag burning resulted in the arrest of 17 people. police charged in and extinguished the fire. there was pushing and shoving. two police officers were slightly injured.

a trump staffer says she was responsible for melania trump's speech. the campaign now admits contained passages from michelle obama's speech. in a statement, trump staff writer meredith mciver took responsibility for the plagiarism incident. over the phone, ma lawn that trump read me some passages from mrs. obama's speech as examples. i wrote them down and later included some of the phrases in the draft that ultimately became the final speech. mciver said she offered her resignation which was refused. donald trump said everybody makes mistakes. coming up on "cbs this morning," we will speak with eric trump, one of donald trump's son. congressman mark takai is being remembered for his commitment to his country. he died yesterday at the age of 49. he had been diagnosed with pancreatic cancer last october. takai, a veteran of the war in iraq, served in the statehouse for 20 years before being

elected to congress. a special election to replace him will be held in november. an appeals court ordered changes to texas strict voter i.d. law. the law requires texas residents to show one of seven forms of identification when they vote. the federal court ruled the law discriminates against minorities and the poor. the obama administration had the justice department fight the case. election experts testified that blacks were three times more likely than whites to lack the acceptable i.d. a police shooting is under investigation in florida. the man who was shot is the caretaker of an autistic man. cell phone video shows therapist charles kinsey on the ground with his hands in the air. his patient was sitting in the street playing with a toy truck. kinsey, who is black, says he was obeying police orders and asked the officers not to shoot. >> i stick out my hands and i say, no, i just got shot.

i'm saying, sir, why did you shoot me? and his words to me, he said, "i don't know." >> kinsey was shot in the leg and no weapons were found at the scene. travelers booked on southwest airlines are being warned to check their flight status before heading to the airport. problems yesterday forced them to cancel flights nationwide. they delayed flights nationwide. passengers were being checked in manually last night. a tracking service says southwest cancelled 400 flights and delayed 2,000 more. temperatures today could tense people to open fire hydrants. a heat wave will broil most of the u.s. east of the rockies. this will be the nation's hottest day in more than four years and things keep on sizzling right through the weekend. coming up on the "morning news." charges dropped. two chicago prisoners walk free after spending decades behind bars for a murder they did not commit. and billionaire mark cuban drops by stephen colbert's late

>> reporter: good morning. stocks finished higher on wall street following more strong earnings reports. both the dow and the s&p averages all set all-time highs. the dow gained 36 points and s&p finished nine points higher and nasdaq rose 53 points. dollar shave club is a subscription razor service has been purchased by unilever for a reported $1 billion. that is the largest acquisition of a start-up. dollar shave has 190 employees and more than 3 million customers. it was started in 2011 and it doesn't make any of the products it sells and has yet to turn a profit. airbnb has hired former attorney general eric holder to deliver a world class anti-discrimination policy. airbnb has been stung by complaints of discrimination and racism by its hosts. the company says tackling discrimination is the greatest challenge it faces. tesla ceo elon musk unveils part two of the company's master plan.

tesla plans an electric compact suv and heavy truck and large passenger vehicles. musk also wants to provide solar power to consumers and he reiterated the company's intent to work on true self-driving cars. google has launched a new app that takes users to museums around the world. the arts and culture app lets viewers visit more than a thousand museums in 70 countries. users can search a key word for a particular piece of art and scroll through art by time and browse by color. virtual tours are also available. uber is partnering with a satellite imaging company to help drivers find their riders. the uber is joining forces with digital globe which provides high-end resolution aerial photos to companies like apple and google. digital globe says uber drivers will use technology to help drivers and riders better identify each other and improve pickup locations. that can be frustrating. >> yeah. anything that makes it more efficient, i guess, is pretty good. jill wagner at the new york stock exchange, thank you so much, jill.

here's another look at this morning's top story. at the republic national convention last night, ted cruz was shouted down when he refused to endorse donald trump. >> stand and speak and vote your conscience. >> in a tweet, trump said it was no big deal. he knew cruz would not endorse him and let him speak any way. outside of the convention center, business has been less than brisk for local store owners hoping for a windfall. julianna goldman reports from cleveland. >> reporter: the few blocks around the security perimeter feel like a typical convention. vendors selling flags and restaurants crowded with delegates, media, and republican officials.

but across the rest of this town? it's a different story. several blocks away, employees at newly opened coastal taco say the supposed rnc economic boom has been a bust. >> we sent people home. take the night off. >> reporter: managing partner aaron clyde said they staffed up extended hours, apparently unnecessarily. what were the expectations? >> high. it's going to be great and this huge windfall and it hasn't been. in fact, it's been a little bit of a ghost town. >> reporter: heightened security concerns that donald trump's controversial candidacy turned away millions of dollars in corporate sponsorship and that meant fewer parties rented out restaurants, and less cash for businesses and employees. but a big windfall was never in the cards, according to cleveland host committee ceo david gilbert. >> this is not going to plan everybody's retirement. >> reporter: he says the committee expects between 200 to 250 million dollars in direct spending. >> we would love for everybody
