let's get to philadelphia for day three of the democratic national convention. jamie yuccas reports from there live. what can we expect today, jamie? >> reporter: michelle, if the rehearsals are any indication, there's going to be a lot of music happening tonight. right now the house band is rehearsing with special singers and earlier, we had a sneak peek of lenny kravitz. we'll have speakers on gun control, gun violence and also veterans affairs. but really tonight is about president barack obama laying out his legacy. then he will talk to the american public about how he thinks hillary is the only one to continue his proposals. >> reporter: emotions spilled over as senator bernie sanders moved to seal the nomination. >> i above that hillary clinton be second as the nominee of the democratic party. >> reporter: with that, clinton smashed through the gender barrier as the first woman to lead a major party in the race

for the white house. bill clinton turned on the charm with a deeply personal testimonial for his wife. >> you should electric her because she will never quit when the goes gets tough. she will never quit on you. >> hello, philadelphia. >> reporter: the nominee herself tuned in by satellite. >> we just put the biggest crack in that glass ceiling yet. [ applause and cheers ] >> reporter: here, hillary clinton's running mate did a test run ahead of a speech tonight that will put him in the biggest spotlight yet. virginia senator tim kaine stepped up to the convention stage as the current vice president -- as did current vice president joe biden. after last night's focus on victims of gun violence members of law enforcement will have their turn including a former police commissioner charles ramsey. >> how do we bridge the gap between police and community that exists in some communities? >> reporter: it will be an important tonight for president barack obama, the featured speaker. the white house says the president has stayed up late into the night fine-tuning his case as well as his legacy.

the white house tells us that after that roll call, president obama did call bernie sanders and thanked him for trying to unite the party and get behind hillary clinton and also to congratulate him on his campaign. michelle. >> thank you. kpix 5 political analyst melissa caen is at the convention and will bring us live reports later today. after much debate oakland city council members have unanimously passed a ballot measure for an independent police commission. it will be put before voters in november. kpix 5's anne makovec breaks down what it means for the embattled police department and the community. >> reporter: it's no secret, the oakland police department has had several big scandals this year and throughout history. >> this really balances accountability with independence. >> reporter: if voters approve it in november, an independent police commission would have the power to fire a police chief and subpoena records. the city council's unanimous

people after 75 speakers last night. >> i still believe we are fundamentally misunderstanding the moment that we're in, in this city. >> reporter: some oppose the part of the plan that would allow the mayor to appoint three of the seven people on the commission saying politics would get in the way. >> we don't need any more hugs. we don't need any more barbecues. what we need is justice. >> reporter: but mayor libby schaaf says she will be accountable for the members she chooses. >> so this still continues to hold that chief elected official's feet to the fire for how the police department is performing while still giving a majority of the seats to an independent commission. >> reporter: some say creating a new commission doesn't go far enough. you're not hearing us. we're talking about the bloodbath and the abuse and the torture and the torment and the corruption that is that gang in blue with badges that you all continue to support. >> reporter: if voters approve it in november, this would

replace oakland citizens police review board which makes recommendations on disciplinary actions to the police chief but doesn't have any real teeth. anne makovec, kpix 5. >> the mayor has already allocated a million dollars in her june budget to get the commission up and running. we are learning new details this noon about a pittsburg man who died after a struggle with police. a lengthy criminal record. police say 32-year-old humberto martinez led them on a chase yesterday afternoon and then ran into a home on hillview drive, where he used to live. when officers caught him, they say he actively resisted and even bit an officer on the hand. they used a taser which proved ineffective. eventually other officers arrived on the scene and handcuffed martinez. they say he then became unresponsive. martinez later died at the hospital. no word if he had any medical conditions. police say his history includes terroristic threats, assault with a firearm, and it domestic violence. he has served time in prison

and had an outstanding felony warrant for drugs. a san francisco police officer has been arrested for illegally owning and manufacturing an ar-15 assault rifle. officer thomas abramson surrendered this morning. the 18 year veteran thomas abrahamsen is on unpaid administrative leave. firefighters fought a fire of a big rig that crashed this morning. drivers swerved around the debris on the northbound 880 off-ramp on davis street. it won't re-open until 8 p.m. the eastbound on-ramp will open

soon. avoid the area. >> left northbound 880 and collided with a concrete dividing wall and came to a rest before becoming fully engulfed in flames. >> the cause of the crash is under investigation. the driver died in the fire. to the wildfire burning in monterey county one person has died. an on-call dozer officer was killed this morning. the fire has also destroyed 20 homes. another 2,000 are threatened. more than 3,000 firefighters are working to contain the flames. terrain is making access to the fire difficult. it's 10% contained. firefighters in l.a. county are having a bit more success. a wildfire near santa clara is 40% contained while many evacuations are still in effect. some homeowners are allowed back into the area. 38,000 acres have burned. today prosecutors dropped all the remaining charges against baltimore police officers connected to the death

of freddie gray. gray was fatally injured last year while he was handcuffed and shackled but left unrestrained in the back of a police van. a judge had already acquitted three officers who were charged in the case. three more were awaiting trial. the charges against them were drop today. the prosecutor gave no details on what led to the decision. but she says she stands by the finding that gray's death was homicide. an additional 23,000 security officers are out in force in france after the latest isis-inspired attack and today, we are learning more about the men behind it. two men murdered an 85-year-old catholic priest yesterday. one of them grew up in northern france. he had been arrested under french anti-terror laws for trying to join isis in serious previously. mourners are gathering outside. the victim was a priest for more than 60 years.

the man who shot president reagan in 1981 and ordered to be released full time from the mental health hospital where he has lived for decades. the latest developments from cbs reporter weijia jang. >> reporter: john hinkley, jr., will soon be headed to his mother's house in williamsburg, virginia, where he will live full time. >> mr. president! >> reporter: hinkley tried to assassinate president reagan in 1981. he said he wanted to impress actress jodie foster. three others including press secretary james brady were also hit. hinge his was found not guilty by reason of insanity. he has been undergoing psychiatric treatment since then. the release comes with many conditions including hinkley must continue his mental health treatments in washington, dc and in williamsburg. he is not allowed to talk with the media. and he is not allowed to google himself. research weapons, porn or his victims. sandra cokersberger worked at the hospital where he was

treated. >> i don't think they should fear him because i don't think, you know, um, that he is a danger to anyone. >> reporter: when hinkley comes to dc for treatment, he will not be allowed to come here to the hilton hotel, the scene of the shooting. and he will required to give authorities his exact route from his home to the hospital. hinkley is also forbidden from going near any president, vice president or highly elected officials. >> from now until the day john hinkley dies, the secret service will be a part of his life. >> reporter: hinkley has had music therapy as part of his treatment and has expressed interest in recording an album. weijia jang, cbs news, washington. >> hinkley's release could come as early as next week. still ahead on the broadcast, tesla's biggest bet yet. the massive new battery factory coming up. >> they were so popular in the testing phase they are now being served at more than 200 mcdonald's restaurants only in the bay area starting today. so what are they?

huge plumes of smoke into t new at noon a fire is ranging in a pallet yard near lincoln in placer county sending smoke into the air. tons of pallets are providing fuel for the flames. the fire is burning near thunder valley casino. clean-up may continue through tomorrow. starting today, mcdonald's will be offering a gilroy garlic fries at 240 restaurants around the bay area.

>> i'm hungry now. the golden arches tested them in may and people were lovin' it. kpix 5's maria medina reports from fremont. >> reporter: after months of waiting, the first batch of garlic fries is cooked, whipped up and ready to serve. how do they taste? >> good. >> good. >> reporter: as of today, 240 bay area mcdonald's restaurants now serve garlic fries including this one on fremont boulevard. and the garlic, well, it's made locally in gilroy, of course. >> nothing but the best. garlic fries. >> reporter: the fast food chain tested them out in a few restaurants in the south bay a few months ago. they were so popular, they sold out for a couple of weeks. >> got one from the owner. >> pretty good. >> reporter: bay area foodies love their garlic breath but what about the rest of california or even the country? mcdonald's says the garlic fries were just meant to be a local treat at least for now. >> i would come back to buy
