of the rumored features. new at noon, police in antioch are investigating a house fire as a case of arson and hate crime. investigators say that someone spray-painted a racial slur and a swastika on the home and threw molotov cocktails setting fire to the roof and bushes early dr. morning on mccormack -- early this morning on mccormack court. not much damage to the home and no injuries. a break in the investigation into monday's shooting death of a pregnant woman and her unborn baby in san pablo. this man was arrested, 21-year- old luis morales after a dramatic standoff in vallejo this morning. he was taken into custody around 3:30 soon after climbing to the roof of an apartment complex on via vista avenue. authorities are still looking for 21-year-old duarte. they believe he may have driven morales away from the scene of

that deadly shooting. police say the victim 18-year- old a was pregnant. the confrontation between her, a friend and a group led to the shooting. a professor who remained on the job after sexually harassing a student, maria medina with how the university is responding. >> reporter: the san jose state university president is responding. but so far this morning, she is not responding to our media requests through a spokesman. she sent a message last night to faculty and students and some students we spoke to today say the letter didn't explain what those allegations are. according to a "mercury news" investigation, a professor who taught counseling education sexually harassed a student last year by repeatedly asking her if she was single. he stayed on the job as the head of his department for several months after the campus investigation concluded his comments were inappropriate

raising concerns about how the university handled it. last night the president sent that message saying in part, quote, dear campus community, the actions alleged and related issues enumerated in news coverage are troubling. we are looking into them. we'll learn from them and we will take appropriate systemic actions based on what we learned. >> i really didn't know what they were talking about. >> reporter: would you like the president to explain going on? >> probably yeah. i don't know a lot of people know what's going on. i haven't heard anyone else talking about it. >> would you like to know if a professor is being accused of sexual harassment? >> probably. it's weird if it was one of my professors. >> reporter: the president spoke to the paper saying they did learn from how the situation was handled. meanwhile, the professor stepped down days before the academic year according to the "mercury news." his bio is still on the university website. maria medina kpix 5. a former uc-berkeley law school dean who resigned amid claims of sexual harassment is

back on that campus as a faculty member. the university says that sujit choudhry is not scheduled to teach this year but will be on campus working in his office. sujit choudhry was suspended after a former assistant filed a sexual harassment lawsuit. she claimed he hugged, kissed and touched had ever for months and said that the school did nothing to stop it. some law school students plan to hold a meeting this week to discuss their concerns. on capitol hill this afternoon, a local law enforcement is introducing a bill aimed at stopping universities from retaliating against survivors and witnesses of sexual assault. congressman jackie speier of san mateo county hopes that the bill will encourage more people to report such crimes. the california highway patrol is searching for two suspects after a crash involving a chp vehicle. it happened about 1:00 in morning when the chp tried to pull over a green honda. investigators say the honda was going the wrong way when it crashed head on into a chp vehicle on and off ramp at

interstate 580 and park boulevard. the suspect got out of the car and jumped on the road and fled. the chp officer was treated for minor injuries. later today, the man suspected of starting last month's devastating clayton fire in lake county will appear before a judge. damin pashilk is expected to enter a plea. he faces arson charges and lighting dozens of other fires dating to july of last year. last month's clayton fire in lower lake destroyed 175 homes and burned 4,000 acres. in a couple of hours the santa clara county committee will hold a special meeting to discuss the future of its jail system. committee members will talk about recommendations related to oversight of jails. it's in response to last year's death of an inmate who was allegedly beaten by correctional deputies. county jails are currently controlled by the sheriff's department. other oversight models will be part of today's discussion. a plan to open more central california land to oil drilling

and fracking is now in limbo. yesterday, a federal judge tentatively rejected a plan for more than 1500 square miles of land. fracking involves high pressure mixtures of water, sand and chemicals to extract oil and gas. the judge said the bureau of land management needs to do more studies on potential environmental effects. a stalemate in congress is delaying funneling for zika virus -- funding for zika virus. nancy pelosi urged republicans to pass a funding bill. >> cdc is on pace to virtually exhaust all of the zika domestic response funding by the end of september. cdc director tom frieden has said the coverage is bare. basically, we are out of money. we need congress to act. >> the roadblock in congress deals with the provision to defund planned parenthood. meanwhile, house speaker paul ryan says that democrats are being unreasonable about their expectations. >> give me a break on this

thing. we passed a $1.1 billion bill for zika which was the level agreed to in the senate. we did the responsible thing. we did it before the july 4 recess. i think they are just being wholly partisan with those endless filibusters. >> nearly 17,000 americans are infected with the virus. that includes about 1600 pregnant women. to the race for the white house. donald trump and hillary clinton are focusing on the military, veterans and foreign policy this week. trump is making the case for and expanded military while clinton suggests trump is unfit to be commander-in-chief. weijia jang reports. >> reporter: donald trump wants to expand america's military but he doesn't want to send soldiers to fight foreign wars. >> i believe in a foreign policy based on our national interests that focuses on american security and regional stability. >> reporter: they will both

participate in a forum focused on veterans tonight. according to a new nbc news poll trump holds a 20-point lead over clinton with military and veteran voters. but clinton is more trusted with the use of nuclear weapons. >> he is very loose in his talk about nukes. he says he doesn't care if other countries get them. doesn't know why they haven't been used already. >> reporter: republicans continue questioning clinton's use of a private email server while she was secretary of state. trump says the controversy is worse than watergate. >> our foreign enemies were in a position to hack our most sensitive national security secrets. >> reporter: jason chaifetz is asking the u.s. attorney in dc to find out why a computer specialist deleted secretary clinton's email archives in march, "after" a congressional subpoena had been issued. >> the fbi resolved all of this. their report answered all the

questions. the findings, um, included debunking conspiracy theories. >> reporter: all but one of the emails was already turned out over. weijia jang, cbs news, the white house. >> the "dallas morning news" is calling clinton the only serious candidate in the race. this is the first time the newspaper has endorsed a democrat in 75 years. new at noon, the nfl commissioner is making its first public comments about colin kaepernick refusing to stand during the national anthem. roger goodell said, i support our players when they want to see change in society. on the other hand, we believe very strongly in patriotism in the nfl. i personally believe very strongly in that. enter quote. kaepernick first refused to stand for the anthem during a preseason game last month. since then, he decided to kneel. the attention has caused sales

online. san jose police hope that security video will bring them new leads in a home burglary. they say on may 25, this man walked into the garage of the home on willow street and stole two road bikes. the suspect appears to be in his 30s. he had a chin strap beard with a goatee and wore a watch and a wind band. all eyes on wall street will be on apple on the day of the big iphone 7 launch. right now, apple stock is just slightly up. this is a look at the big board on wall street. the dow is down about 14 points. scientists may have discovered a sort of fountain of youth. it's in a region of italy where people live longer and healthier than ever before. seth doane takes us there. >> reporter: afternoon really is a place where you can find

. camera 12 cinemas announced it new at noon, the show will soon be over for a theater in downtown san jose. camera 12 cinemas will be closing this thursday. it's one of the oldest continuously operating businesses in downtown. originally it opened as camera one. the cinema has been featuring foreign and independent films since the 1970s. ticket sales are under way for the golden state warriors preseason game in san jose. the game against the sacramento kings will be on october 6 at s.a.p. center. warriors and sharks season ticketholders can get tickets starting today. tickets go on sale to the
