t was on a trainin now at noon. we're following breaking news. a military spy plane has crashed in northern california. the plane was a u-2 on a training mission and crashed right after taking off from beale air force base. two pilots were on board. both parachuted out of the plane before impact. the plane went down in the sutter buttes mountains about 55 miles north of sacramento. and you can see the crash started a small grass fire there. we are going to have more information on this story coming up. but first, right now, terror suspect ahmed khan rahami is in custody facing five counts of attempted murder of police officers. good afternoon, it is tuesday, september 20. i'm michelle griego. kenny is out on assignment. right now, prosecutors are weighing additional charges over the bombings in new york and new jersey as they learn more about the suspect and what might have motivated him. brook silva-braga joins us live from elizabeth, new jersey,

where rahami lives. >> reporter: good afternoon. it's a busy afternoon outside the rahami family home. the father came out several times and on one occasion started to talk about his son. the father of terror suspect ahmed khan rahami stood outside the family's home this morning and said he called the fbi two years ago. [ inaudible ] >> reporter: investigators are now piecing together clues about his 28-year-old son and what might have driven him to bombings in new york and new jersey over the weekend. sources tell cbs news they have recovered a handwritten note and notebook. the writings reveal he was radicalized. they are going to look at friends, family, records, social media, his phones. the suspect was on the run for 50 hours before he was arrested in a shootout in new jersey. investigators say he left a trail of clues including fingerprints and dna. his face was captured by surveillance cameras near the bombing in manhattan, which

injured 29 people. he is a naturalized citizen born in afghanistan. he traveled recently to afghanistan at least three times and at least once to pakistan. here in new jersey, he lived in this house in elizabeth just upstairs from the family's chicken restaurant. the rahami have clashed with the community over noise complaints and accused the city of anti-muslim sentiment in a law enforcement that was later terminated. he had surgery after the shootout and is not cooperating with law enforcement. he is being held on $5 million bail. they spoke with his father in 2014 after a domestic dispute with a brother. in the case where a neighbor overheard the father call his son a terrorist. the fbi followed one him. but when they spoke to the father, he said he didn't mean it. it wasn't true. and the fbi couldn't find any other evidence he was a terrorist. live in elizabeth, new jersey, brook silva-braga kpix 5. terrorism and immigration both taking center stage on the

campaign trail. donald trump spoke at a rally in florida and said he doesn't like that ahmed khan rahami will face the u.s. justice system. >> he will be represented by an outstanding lawyer. >> boo!! >> his case will go through the various court systems for years. and in the end, people will forget and his punishment will not be what it once would have been. what a sad situation. >> rahami was born in afghanistan. he is a naturalized u.s. citizen. later, trump told fox news's bill o'reilly the u.s. has a lot to learn about vetting foreigners. hillary clinton drew a sharp contrast with trump. >> i'm the only candidate in this race be who has been part of the hard decisions that take terrorists off the battlefield. >> the latest national poll shows clinton is up five points over trump in a four-way race

with a libertarian and green party candidate. today the ceo of wells fargo was on capitol hill to say he is sorry. kpix 5's anne makovec has the latest details on the scandal rocking the san francisco-based bank. >> i think we all know that not every team member will do everything right every day every minute. >> reporter: the wells fargo ceo was in the hot seat after thousands of his employees created millions of fake bank accounts on behalf of unknowing customers then moved money to the accounts without permission. all to boost their sales numbers. the allegations go back to 2009. >> if i could turn the clock back, and i have thought about this 1,000 times, of course i wish i would have done -- we all wish we would have done something more earlier. we didn't get on this fast enough. >> reporter: he spoke this morning to the senate banking,

housing and urban affairs committee denying that staffers were directed to create fake accounts. he promised that the bank will contact every affected customer. >> there is no question with some of our customers, we have violated trust and we have to work hard to reearn that. >> reporter: regulators fined wells fargo $185 million earlier this month, some 5300 employees were fired, and the bank says it will end all sales targets for retail banking employees by the end of the year. one lawmaker says this whole situation bolsters the argument by wall street critics that the nation's largest bank should be broken into smaller institutions. in san jose, anne makevoc, kpix 5. new at noon, san francisco's city attorney dennis herrera formally subpoenaed the developer behind the sinking millennium tower. kpix 5's jackie ward with what he wants to find out specifically and how the

developer is responding today. jackie. >> reporter: michelle, the city attorney is trying to determine if millennium partners told its prospective buyers that this luxury tower was sinking before the buyer started investing thousands and millions into their units. in a statement released this morning, san francisco city attorney dennis herrera says he hashes quote, serious concerns that disclosures required by state law did not contain information about the settling of the property. millennium tower has sunk at least 16" and tilted about 2" since opening just 7 years ago in 2009. an engineer hired by millennium homeowners found the tower will continue to settle at one inch per year and estimates it will sink up to 15 inches further into landfill. in a press conference, one of the millennium founding partners insists this building was constructed the right way and they had an engineer look at 301 mission who said the

tower is perfectly fine. >> that desight the settlement that's occur -- despite the settlement that's occurred, the building is 100% safe. that report has been or will be turned over to the department of buildings. >> reporter: millennium partners chose a concrete platform as the structural foundation for the tower with piles driven approximately 80 feet deep in sand. there are 400 residential units in the bill from $1.6 million to $10 million, plus. so you can tell that the millennium partners were not happy about this ongoing situation. but their anger was mostly directed at the transbay joint powers authority. one partner went so far as to call their behavior reckless. so clearly this battle is far from over. we'll have many more details on tonight's newscasts. in san francisco, jackie ward, kpix 5. san jose homicide detectives are looking for leads after a man was found shot to death near los lagos golf course. police found the body about 1

a.m. while responding to reports of a person lying on the sidewalk along lone bluff way. no suspects have been identified. it's san jose's first homicide in nearly four weeks, but the 36th of the year. an unusually high number for the city. san leandro police say they now have a man in custody in connection with an attempted kidnapping. this is the suspect sketch that was released not long after the attack on july 28. police said at the time, a man pepper sprayed a woman and dragged her toward his car on washington avenue. a passerby managed to stop the abduction. police plan to release more details of the arrest at a news conference about an hour from now. a preliminary hearing is under way for two defendants accused of killing a canadian woman in golden gate park. morrison lampley and lila scott alligood are charged with the 2015 murder of audrie kerry. their former codepartment sean

angold pleaded guilty to killing 67-year-old hiker in marin named steve carter. more coming up at 5:00. right now, the santa clara county board of supervisors is holding a special meeting to hear a report on the status of county jail reforms. the death of an inmate last august allegedly at the hands of guards led to a blue ribbon commission that recommended more than 100 improvements. sheriff's deputies in marin county will have to wear body cameras starting today. the department is handing out 85 cameras. back in june, the board of supervisors approved a five- year agreement with taser international. it doesn't come cheap. the first year of the program is set to cost about $205,000. the san francisco giants lost last night. they are slipping out of play- off contention. and now there's the matter of a controversial post on the giants' official twitter page. it read, mr. bumgarner gets kk key kay for the third time tonight it was supposed to mean

giants pitcher madison bumgarner struck out the los angeles key kay hernandez three times. readers were quick to point out the kkk initials and the missing accent mark over the e in her nanz's first name making it look like an anti-semitic slur. that post has since been deleted. now we want to get more details and the military spy plane that crashed in northern california. the plane had taken off from beale air force base near yuba city this morning and minutes later went down into the mountains known as the sutter buttes. reporter macy jenkins is near the crash site. mazewhat can you tell us? >> reporter: this is u-2 dragon lady plane. it went down about 9 a.m. the two pilots were ejected from the plane. we don't know how they are doing. i'll show what you we can see

right now. there is a scorched area at the top of this ridge and we have seen fire trucks going in and out of this area very far off in the distance. that's where we believe that the plane went down. now, we do have some visuals of the fire raging across this ridge. it happened earlier this morning just about 2.5 hours ago. the fire ripped across this brush. it is very dry out here and so that is what we're looking at. when we were over there earlier this morning, we did talk to a battalion chief and they were ushering us out of the area and all the media and people that were watching this take place. they said it wasn't safe. they weren't sure what was actually on board. it could be some kind of hazardous material. it's too early to tell. they moved us 1,000 feet up wind or down wind. they didn't want us in the area. but right now we know that that plane took off around 9 a.m. and went down just minutes later over here on the ridge in sutter county.
