the department of justice revealed its 94 findings and 272 recommendations at a press conference that's still going on. the u.s. attorney said that after completing the review, it's clear that the san francisco police department has tremendous work ahead of it to meet and exceed the national police standards. the assessment was broken down into five areas of the sfpd including use of force and bias in policing methods. ronald davis of the justice department explained that there are significant deficiencies across the board. one recommendation is that officers are given stun against as all alternate to lethal force. and they need to improve how they track use of force. they didn't find proof of racial bias by officers. it concluded that black drivers are stopped more frequently than any other race. white drivers are least likely to be searched. >> we found the majority of use of force in general -- not the majority but at least 34% were people of color. >> reporter: these numbers may not be completely accurate. right now, the police department needs to collect more data to do a proper analysis. the justice department says this is a major disparity that exists and they have agreed to start collecting that necessary information. so this means this process is far from over. the department of justice will bring its experts back to san francisco after enough data is gathered to do a more thorough use of force analysis. we'll have details at 5:00. in the newsroom, jackie ward, kpix 5. san jose police are searching for a suspected thief. they have set up a perimeter in the area you see there on your map near clarice drive. they first got a report of a man stealing from a business on tully road and he fled into a neighborhood, jumped fences and forced his way into two homes.

they have that area evacuated as they search. another bay area college athlete is accused of sexual assault but officials will have a hard time charging him. san jose state university and the d.a.'s office are investigating a water polo player accused of raping two women at an off-campus party on labor day weekend. they are not naming the suspect because he hasn't been charged. the victims came forward to report being assaulted. the student left the country. >> it's sad because after the whole brock turner thing there was a huge uproared and just everywhere you looked and it was made apparent that it's not okay. >> we have learned that the san jose state student is a freshman and you will remember stanford swimmer brock turner made headlines when he served a three months sentence for sexual assault. a possible exclusion for the affordable housing crisis in the south bay nearly $1

billion to low-income housing but first voters need to say yes. kpix 5's maria medina is in san jose with a city leader pushing for measure a. >> reporter: in just a few weeks santa clara voters will vote on a measure to tackle two issues, homelessness and housing crisis. today the san jose mayor visited what's known as the jungle, a homeless encampment in the south bay to push for measure a. it's a $950 million affordable housing bond that would be broken up like this. $700million toward low income and homeless. and the rest for first time home buyers and loans for those who live outside the county and want to move closer for work. measure a would also build 2,000 homes mostly for the homeless like veterans, seniors and the disabled. so where exactly is this money going to come from? the county would charge homeowners almost $13 per $100,000 of their property value for the next 30 years. what would you say to those people who don't want property taxes to go up again? >> we are paying for

homelessness whether we want to or not. we estimate that a homeless individual on the street who is a high user of public services, for example, the jails, the hospitals and so forth, is costing us about $60,000 a year. >> reporter: if that same person was housed it would cost $20,000 so the public would save a lot. in san jose, maria medina, kpix 5. >> if passed, an independent citizen oversight committee would make sure the money is used as promised. oakland police are looking for the suspects who robbed a couple at gunpoint. it happened on 33rd avenue and 16th street. this is surveillance video. the two victims were celebrating the 78th birthday of the husband when the suspect attacked them outside a restaurant. police say that they got away with the wife's purse and jewelry. just in, the man suspected of killing two palm springs police officers has been charged with murder. prosecutors announced the

charges against 26-year-old john hernandez felix less than an hour ago. they say he used an assault rifle to gun a male and female officer through a closed front door. they were responding to a domestic disturbance at the suspect's home. hernandez felix could get the death penalty. to campaign 2016, donald trump has declared his independence from republicans who abandoned him after a tape of some comments was released. meanwhile, the clinton campaign says trump's allies may be working with russians to hack democratic emails. cbs reporter craig boswell reports. >> reporter: donald trump is campaigning in florida, the battleground state is a must- win if he hopes to become president. >> if i don't win it will be the single greatest waste of time, energy and money. >> reporter: but with less than four weeks to go trump is attacking republicans who withdrew support from his campaign after video surfaced

showing him using crude language towards women. [ inaudible ] >> reporter: trump told bill o'reilly he is down with house speaker paul ryan and other republicans who have abandoned him. >> i wouldn't want to be in a foxhole with a lot of these people. that i can tell you. >> but mccain is a brave man. >> including ryan. >> he is a brave man. >> by the way including ryan. especially ryan. >> i got that. >> reporter: there are 331 governors and congressional republicans of that group, 87 or more than a quarter are not endorsing trump. the clinton campaign has its own problems as the media is sifting through hacked emails from campaign chairman john podesta. u.s. intelligence officials allege they came from russia. >> russia's interference in this election and their apparent attempts to influence the election on behalf of mr. trump is i think a -- should be of utmost concern to all americans. >> reporter: he pointed out that trump confidante roger stone tweeted in august, trust

me it will soon be the podesta's time in the barrel, before the hack became public. the trump campaign denies any connection to the russians. >> the salt lake tribune has endorsed hillary clinton saying donald trump is unfit to be president. major rivers in north carolina will be at flood stage for the rest of the week because of all the rain from hurricane matthew. volunteer firefighters are using a truck to ferry people who higher ground. the mass searches are over for now. now teams are responding to calls to check out specific addresses. the governor has a warning for residents. >> whether you're walking or riding in a car, do not get near the water. it will kill you. >> north carolina's governor says that there have been 19 storm-related committees that state, most from drowning.

135,000 people in north carolina still have no power. many power poles and power lines got swept away by floodwaters. heartbreaking loss for the giants last night. the cubs dashed our dreams of having the giants continue their even year world championship streak. the giants were actually winning game 4 of the nlds until the 9th inning when the cubs scored four runs. [chuckling] final score 6 -5. it was a roller coaster of emotions for fans at at&t park. >> it hurts. but still proud of them. they fought hard. that's all you can ask for. >> before the game a giants fan thought he could use a little voodoo on the cubs buy bringing this goat to at&t park. it was supposed to be a reference to the billy goat curse but the curse is dead along with the giants' even year magic. today warriors fans will get a rare behind the scenes look at the team as they prepare for the upcoming season. they are holding an open

america... and tens of thousands more around the world. the problem: if the car isn't in park... the ble can toyota is recalling 94,000 hybrid priuses in north america and tens of thousands more around the world. the problem is if the car isn't in park, the parking brake cable can disengage and the vehicle could roll. if you have the sedan from 2016 and 2017, toyota dealers attach a clip to fix that problem. let's take a live look at wall street. the dow is currently up 40. the number of teenagers involved in deadly car crashes is rising. for the first time in nearly a decade, new federal data shows that a 10% increase from last year has occurred. kris van cleave looks at teen driving mistakes. >> reporter: donovan was about to be a senior at high school. while out with friends his girlfriend was speeding, lost control and hit a tree. donovan wasn't wearing a

seatbelt. he was ejected and killed. >> i can't even describe what it felt like in that moment to be standing on the crash site looking down at a yellow tarp knowing that my son was under it. >> reporter: almost a decade later speeding is the top mistake teens make behind the wheel. the nearly 14,000 fatal crashes involving teen drivers over the last five years, more than 4200 involved speed. >> i think one of the kind of disturbing things is that it's not getting any better. >> reporter: tara johnson from aaa says they found parents were often more guilty of bad driving than the teens. 65% of driving instructors complained parents were worse at teaching their children to drive than a decade ago. >> when parents set stricter rules for their teens before they get behind the wheel, those teens typically have less crashes. >> reporter: after speed, the most common mistake teens make is distracted driving. >> like this. texting. >> reporter: for that violation, christian castellano got a ticket.

>> do you text and drive a lot? >> normally no because my mom got on to me when i first started driving and so after that i quit doing it and then i was running late. >> reporter: the third big mistake is not properly scanning the road for hazards. this teen didn't see a car running a red light. >> stop, hit the brakes! >> reporter: kris van cleave, cbs news, rockville, maryland. new research funded by ford finds that one-third of teens are waiting until they are 18 now to get their driving licenses and then they are not subject to graduated licensing laws that place limits on young drivers. the laws have been credited with reducing teen crash risk by as much as 30%. progress for crews battling the creek fire in napa county. they are putting out hot spots near the fireline. it started monday night near dry creek road. it's about three miles west of yountville. about 65 acres have burned. the fire is 90% contained. full containment is expected tonight. the cause of the fire is still

under investigation. first check of weather. here's julie watts in for roberta. >> yeah. you know, we are going to keep an eye on the fire. we have rain coming. the bad news is when you have burned scarred areas and you see as much rain as we'll get up north by friday, actually by the end of the weekend, we could start to see some problems in terms of mud slides, mud flows, things along those lines. we'll keep an eye on that. back here closer to home, we are looking at clouds outside in san francisco. we have sunshine clearer skies when you get away from the coast and away from the bay. 68 in concord. 64 in livermore. 67 in san jose. it's going to be cool today. temperatures staying cool. a sun/cloud mix but definitely on the cooler side of average. rain thursday night up north, friday most of us and then unsettled through the weekend. the best round of rain that is going to be friday and for most of you during that friday morning commute. here is where it is all coming from, this area of low pressure out in the pacific heading our way bringing with it a ton of

moisture for us. this is really going to help to bring us some soaking rains. timing it out in futurecast, at 5:00 on thursday night, here's thursday evening commute, we are starting to see showers in the north bay and for the northern portion of the state but the heavier rain comes through the north bay friday around midnight thursday night into friday morning. and then it sinks south just in time for that friday morning commute. here we are friday at 7 a.m. where we'll see locally heavy rain. concerns of ponding and flooded roadway especially low-lying areas considering there's likely a lot of debris out there right now. also, slick roadways because you have oil accumulation. this is going to be the first good soaker we'll see so it really will be a tough morning commute. by friday noontime, though, most of the rain will have passed through most of the bay area. we'll still see lingering showers and unsettled through the weekend but just from this first round of rain, the one that passes through the front friday, we are looking at up to 1.5" for some north bay locations probably closer to

.3" in the south bay and an inch in pacifica. high temperatures today, we are going to stay mild. we are in the low to mid-70s for the warmest spots inland. 60s around the bay. and low 60s along the coast. and the extended forecast shows that we have a little something for everyone in it today. here's a look, you know, today we are dry, tomorrow increasing clouds, friday really going to be the soaker and then staying unsettled through the weekend likely drying out early next week. >> i'm excited.
