and he still has partial paralysis on the side of his body from the shot to his head. >> police have not named the officer, but friends and family tell us he is 25-year-old kevin downings, a two-year veteran of the san francisco police department. he was shot friday night responding to a disturbance call at the lake shore shopping center. officers shot and wounded the suspect during a brief chase and then a standoff. officer downs comes from an sfpd family. his father was a cop and is now a teacher and officer downs runs a nonprofit that helps military veterans. thank you. now to the storm watch and some crazy video from the open coliseum leaking like a sieve this afternoon just before the raiders and chiefs took the field. this video was shot in the visitor's tunnel, and you can see the water appears to be dripping on some electrical wires. scenes like this have become pretty common at the aging oakland coliseum lately. the ongoing issues are a big reason why the raiders and as are trying to leave town.

>> conditions on the field were pretty much just as bad as players slipped and slid their way across the torn up turf. the praise looked more like a polo field by half-time. we'll have the results of the game a little later. let's take a live look at the conditions outside. the tide keeps creeping up. that's why coastal flood advisories are posted along the ocean shoreline on usually high tides and rip tides remain a threat at the beach through tomorrow. as for the rain the kpix 5 high- def doppler shows scattered showers now. there are still a number of cells in the south bay and a new wave of rain heading into the north bay. that will spread south tonight. rain totals show bigger numbers in santa clara county with more than an inch in mountain view and redwood city. livermore picked up an inch and a quarter. half an inch for san rafael and 65/100 in santa rosa. the rain has been hitting

the south bay hard all day. in san jose strong winds toppled this tree as the rough weather rolled through. it was one of several to snap in the storm. >> i live up in the mountains, and i had to break a bunch of limbs so i could get out. other than that no power outages. >> many welcomed the weekend storms but for some it meant canceled plans. we spoke to one kid whose soccer game got rained out. >> well, the other team didn't show up, and the refs weren't there so. >> and you were supposed to play, what, soccer. >> yeah, soccer. mm-hmm. >> so you got there. you're ready to go and then what? what did they say to you? >> we just got a call from the coach that it was canceled, so yeah. >> kind of a bummer huh? >> it's okay. >> hopefully he'll get to play next weekend when sunny skies are expected. the biggest concern in the south bay right now, the loma fire burn area in the mountains, sheets of rain have been pouring down there all

weekend. officialsnow say the scorched soil particularly vulnerable to floods and mud slides. a flash flood alert is in effect until 11:00 tonight. the fire broke out last month and burned about 4500 acres. a lot of the runoff is making its way into the bay area reservoirs. here's a look at the stephens crook. it's got plenty room for the rainfall. at oakland, raiders fans swapped their jerseys for pan chos, sweatshirts and raincoats as they streamed into the coliseum. jessica flores shows us fans are trying to get the most out of the home games in oakland. >> it's clear to see on a day like this there's not much that would keep fans from a raiders game, but i did speak to many fans who say if the team moves to vegas they wouldn't travel there for a game. >> gray skies, wet weather, raider nation still coming out in full force, and though the

rain didn't dampen spirits, the talk of the raiders leaving oak and sure did. >> would you go to games in las vegas if they did move? >> no. probably not. it's not in oakland. >> i'll be honest, i wouldn't go to vegas to watch a game. yeah. just wouldn't. >> we got the raider nation we come rain, snow, we are here. so they need to stay in oakland. >> the nevada deal would provide 750 million tax dollars to help build the team a new $2 billion stadium off the vegas strip. in oakland city leaders have said they don't want to pump taxpayer money into a stadium to keep the team in town. >> are you willing to pay more taxes to keep the raiders here? >> i would, but you know, the community has to step in also. >> still, the raiders owner mark davis says the team will be staying in oakland for at least the next two years while the dome stadium gets built in nevada, and that's buying enough time to keep fans

hopeful that the team will reach a deal here. >> this is like one of the oldest stadiums in the nfl. they need something to, you know, for the fans and for the team as well, but the city of oakland's got to step up. we've got plenty of money in the bay area to make this happen. >> in oakland, jessica flores, kpix 5. >> the raiders relocation is by no means a done deal. they need approval for 75% of nfl oners to make the move. more than four years after sierra lamar vanished without a trace, the man accused of kidnapping and killing her is going to trial. jury selection is slated to begin tomorrow in the murder case against 25-year-old garcia torres. he's accused of abducting sierra back in march of 2012 adds she walked to the school bus stop. her body has never been found but investigators say they do have dna evidence linking garcia torres to her disappearance. police in santa cruz shot

and killed a man this morning after they say he attacked them with a rake. around 3:30 this morning officers say they received a call about a man banging on the door of a home threatening to kill everyone inside. when they arrived and tried to arrest him, that's when he grabbed a rake and started swinging. first they tried a taser. the incident now under investigation. sonoma county sheriff's diddens are investigating a triple shooting south of sebastopol where one of the victims died. it happened around 8:00 last night on southbound 116. one man died at the scene, two others were rushed to the hospital to be treated for gunshot wounds. in berkeley a man is in critical condition after being shot near the cal campus. police found the 35-year-old victim lying in the street near dana and haste last night. so far no arrests, but they say the shooting was not random. meanwhile, police are warning about an uptick in armed robberies near the campus. there have been at least six in the past week.

the victims all reported being held up at gunpoint, but no one was hurt. and in emeryville, police are warning about a spike in smartphone thefts. they say pedestrians are being targeted as they walk down the streets distracted by their devices. police are advising people to be more aware of their surroundings and avoid texting while walking. this driver was not distracted by a smartphone when he slammed into this store in san leandro. instead he was running away from police. nobody was hurt in this accident, but the fire department did have to be called in to rescue the two passengers in the stolen suv. the driver build out. he only made it a few blocks -- bailed out. he only meat it a few blocks. the story behind this bizarre attack on a bay area b.a.r.t. station. >> and the wet weather isn't stopping these bay area veterans from hitting the roads. why this 500-mile bike challenge is one smart part of

this station agent booth in san leandro. later... wor police say they have a suspect in custody for smashing up this station agent booth in san leandro. later workers used tools andlywood to cover up the openings. no one was in the booth at the time and no one was hurt but there was a lot of broken glass to clean up afterward. right now it's not clear what motivated the attack. in san francisco pg&e crews are investigating reports of a loud pop and smoke coming out of one of their manhole covers. the call came in just before 3 this afternoon on 10th street in the south of market district. pg&e is calling it an underground equipment failure, but they're still checking it

out. meantime, drivers are advised to steer clear of the area. a 25-year-old sailor has been arrested on suspicion of dui after his pickup truck plunged off san diego's coronado bridge killing four people below. nine others were hurt when richard anthony sapolio lost control of his pickup truck and landed in the middle of a bike festival that was underway at the base of the bridge. >> i could see a car flying up in the air. it looked like super man had just lifted up a car from on the bridge and threw it right off the bridge. >> sapolio who was stationed at the coronado naval base also suffered major injury. in the 75 years after the golden gate bridge opened the bodies of 1600 suicide victims have been pulled out of san francisco bay. now more police officers will soon be patrolling the golden gate bridge trying to stop suicides. five more officers have been hired specifically to keep an eye out for people who might be about to jump.

that brings the total number of officers patrols the bridge to 22. officialssay so far this year there have been nearly 140 successful interventions on the span and they say the officers watching the walkways are to credit. as for that suicide net that they've been trying to install below the bridge, it's on hold after the bridge board discovered it has only half the money needed to build it it was hoped it could be finished by 2020. bids for the construction contract are due in january. the road to recovery for wounded veterans can be a long one and anything but smooth, but today a group of bay area heroes decided to hit that road together. john ramos shows us. >> some might see today's rain as a spoiler for a good bike ride but these intrepid souls have a different word for it. >> it's a mental challenge, and it's a physical challenge. >> that's what the california challenge is all about, a 500- mile trek for wounded warriors

beginning at the veteran's hospital in palo alto and ending up in santa monica seven days later. a group called ride to recovery created the annual event nine years ago to help physically and emotionally disabled veterans by getting them out on the road. >> when they get on a bike, they have freedom. they're out in the open. they feel good, depression leaves them. >> carlos of san jose is battling ptsd with the help of his wife and service dog, but he says the first time he did the ride he was feeling alone in his suffering. >> and once you share stories, you kind of like want to embrace each other and i got you, you got me and a bond you can't break. >> i was in a really dark place when i got out. it was really difficult to readjust, so when i started riding with this group, it just made all the difference in the world. >> and with that this band of brothers and sisters began the challenge of their long distance adventure, but they

probably would have preferred a little drier weather, especially those traveling closest to the pavement. >> i mean i'm freezing and i get just pummeled with rain from the road to the wheels of the bikes in front of me. it's okay. i understand the rest of the week is going to be beautiful, so i'm not really worried about, you know, one rain day. >> it's not easy, but they've been through a lot worse, and each of them paid a price for it, but they've learned that the road back from those dark places is not one you can travel alone. in palo alto, john ramos kpix 5. >> unlike a lot of organized bike rides, the california challenge is not a fundraiser. it is meant to directly help those who ride in it. all right, we will see if things improve as they head south. it should because that low pressure's heading east finally, and it will be replaced by sunny and warmer weather by midweek. in fact, a little bit sooner than midweek. in the meantime we've got rain to deal with tonight. you can see on the high-def

doppler this loop shows another band of showers beginning to work its way through santa rosa and into the north bay and also widely scattered showers over the south bay as well. let's head down to the south bay and see what the latest is, while santa rosa is reporting rain at 6:00 tonight, mostly cloudy skies at the airport in san jose. look at that, it marches down through petaluma novato. the flash flood watches we've got posted through tomorrow afternoon, some aspects of this advisory anyway, they give us the high tides, unusually high at this time of year. there's a rip tide, and it's all being ushered in by low pressure that is off the pacific northwest, more showers on the way tonight. some will be lingering tomorrow, so a rogue shower or two. the general tendency is for things to begin to dry out, high pressure to slowly begin to build in. this is fascinating.

you've probably never been to anderson peak in the mountains above big sur, not easy to get to. easy to get to salinas, only picked up 10/100 of an inch of rain. anderson peak is almost 45 miles away. it picked up almost 60 times as much rain. that's the benefit of lift, ladies and gentlemen. you just squeeze the moisture out of the clouds, by the time it gets to salinas not much left. as we look at the bay bridge with kind of a ragged sky behind it, as we approach sunset, concord, 65 degrees. oakland the same. we're all in the low to mid- 60s. and on the futurecast you can see the showers move through tonight, tomorrow morning, north bay a few scattered showers, and those are work their way through the rest of the bay area in the early going on monday, but the focus tomorrow will be north bay for much of the rest of the bay area it's going to be beautiful. all of this has rinse out the atmosphere for the first time this season. the visibilities will be crackling clear. it would be great to go to the

top of mount diablo. they say you can on unusually clear days, which we'll be getting on monday and tuesday. after a few more showers tonight we'll get dense fog forming overnight. and we'll be drying it out by tuesday. mid-80s on friday with plenty of sunshine in the bay area. overnight lows, the low 50s with a few cooler spots at santa rosa and fairfield. average numbers well below average. you know, october should be one of the warmer months of the year closer to the shoreline and we're going to have to wait until the end of the week for that. meantime, tomorrow almost everybody is between 65 and 70. south bay will get clearing and sunshine later in the day. over in the east bay, the number near 70 degrees, and again, clearing and sunshine. north bay not so much. more clouds in the north bay and more showers the first half of monday, and then we'll slowly dry it out. nurse in the mid to upper 60s. around lake port and ukiah and clear lake, a few showers, and then we'll get sunshine in the

as hillary clinton's lead continues to grow. a pair of national polls out this weekend show that hillary clinton is ahead of her republican rival donald trump. >> but the two surveys differ significantly on just how big clinton's lead is. a washington post abc news poll has trump trailing by just 4 points that's within the margin of error. an nbc news wall street journal poll gives clinton nearly triple that lead with an 11 point edge. >> our own battleground tracker shows clinton is also gaining ground in the swing states. both candidates took the day off from the campaign trail today to prepare for their final debate. brook silva-braga showed us that that left the running mates to carry the questions. >> tim kaine went table to table sunday rallying support for hillary clinton at a miami diner. >> florida's close and there's so many other close states. we have to assume that's the

case and i think it will be the case right up to the end. >> the latest tracker shows clinton with a slim but growing lead over donald trump up 46 to 40 thanks to much stronger support among women than a month ago, now up with that group by 15 points. trump has been fighting a growing list of allegations of unwanted sexual advances. nine women have come forward. trump denies the accusations. >> you have phony people coming up with phony allegations with no witnesses whatsoever. >> on twitter sunday trump wrote election is being rigged by the media in a coordinated effort with the clinton campaign by putting stories that never happened into news. on meet the press trump's running mate was asked if the campaign would accept the outcome of the vote. >> we will absolutely accept the results of the election, but the american people are tired of the obvious bias in the national media. that's where the sense of a rigged election goes here. >> clinton's motorcade left her home sunday afternoon headed for a round of debate prep.

haram were reunited with their parents. they gathered in the capital city. it took the parents days to get there. they traveled from a remote town. the initial abduction took place more than two years ago. the girls were released thursday. but nearly 200 girls are still being held captive. nigerian official say they're working to secure their release. >> still to come, a story more than 40 years in the making as the first of its kind community center opens in san jose. >> and a new push to help low wage workers in one bay area city, but it's not necessarily about money. because she doesn't know that it kills 40,000 californians... every year. because she doesn't understand what cancer is. because she can't spell emphysema. because she is a butterfly, who fights fires. because she is my daughter, and the surgeon general says that raising tobacco taxes... is a proven way to make sure she never smokes.

official vietnamese community center, new at 6, a story four decades in the making. today san jose opened its first official vietnamese community center funded with money -- our kiet do is there with the historic moment. >> for the vietnamese community it may be a modest home, but it's their home. today was the grand opening of the temporary vietnamese

american community center. the first city funded space of its kind. council members tam nguyen and nam nguyen worked to -- there is a multipurpose room, a kitchen, and some office space. all this comes 41 years after the first vietnamese refugees settled in san jose. >> and this victory center i can say is a symbol of a partnership between our community and its government to make the san jose the greatest city of the multicultural and diversity. >> state senator came from southern california where there's also a large vietnamese population. >> we envy and we are extremely jealous. >> the push now is to raise enough money to build a permanent vietnamese center that rivals the iconic japanese friendship garden or the $31 million mexican heritage plaza. there's talk the next community

center will cost somewhere in the neighborhood of $15 million. >> we can make this happen, but we also recognize it's not going to happen with public dollars. we're going to have to reach out in the community. >> on this historic council member tan nguyen said it best. >> i feel like you have a home before you have a life. that's what we believe. we must have a home first. >> emeryville could soon be the second city in california to adopt what's known as a fair workweek. on wednesday city leaders will consider requiring a large retailers and fast food companies to give their employees consistent work schedules with the same hours every week. workers would also get their schedules two weeks in advance making it easier for them to budget, plan child care and work around second jobs. san francisco and seattle already have similar policies. >> also happening this week, a push to quiet down noisy smart trains in marin county.

weekend. in portland streets turned into rivers as several inches of rain flooded parts of the city. seattle has had more rain in the past three days than it's had in the past three months. that same wet weather is helping firefighters get a handle on a destructive blaze burning near north lake tahoe. the wildfire has destroyed more than 20 homes since it broke out on friday. mandatory evacuations are still in effect, but the rain has been a huge help for firefighters. the fire is now 20% contained. most people throw away pumpkins after halloween, but in new york they do it a few weeks early. >> here we go, 3, 2, 1! >> thousands gathered in the town of clayton for the fifth annual pumpkin chunkin festival. the speed and distance of each toss is recorded. >> i actual got the idea from

my daughter. she went to a farm where they were throwing pumpkins. i thought that looks like a lot of fun. five years later this is what we evolved to. people really like throwing pumpkins. >> it is a lot of fun. when you almost hit the boat a couple times. >> in case you're wondering, and brian i know you are wondering, the fastest pumpkin launched at 140 miles per hour. >> poor little pumpkin. my grandma would say they're wasting that food out there. >> everybody had a good time, nobody was hurt. that's the important thing. tomorrow morning we're going to be waking up to some sunshine in the bay area for the first time in wheel. there will be patchy dense fog around not only tomorrow morning but in the wee small hours tonight. if you're heading around, the streets will be slick and the fog will be thick. have a care during the morning drive, still got some showers to contend with. high-def doppler shows that band of rain in the north bay getting ready to move south into southern marin and across the peninsula. south bay is gets a chance to dry out. there will still be a few

showers you can see down there. a little bit down there between 152, between gilroy and castroville. in the north bay we're looking at those showers that are scattered all the way from just south of point reyes up through novato. it will all move south in the next few hours. we're not out of the woods yet. we picked up rain in the last 2 hours, more than an inch in livermore. an inch and a half in oakland, three quarters of an inch in san francisco, san jose just a quarter of an inch. in the north bay not bad but not as much as parts of the east bay. 2/3 of an inch in santa rosa and half an inch in santa rafael. really, those become more of a threat later in the season when things become saturated upon saturation, and then the landslides really start to happen, but it never hurts to bend a wary eye towards the

skies and toward the land when you do get the first rains of the season. more showers on the way for tonight, but not really for tomorrow. we'll have a lingering shower or two for monday, and then high pressure is going to nose its way in over the west coast by tuesday. as we look live towards the bay bridge, beautifully lit up. concord, livermore, oakland all in the mid-60s right now. 61 in santa rosa. futurecast shows the showers blow through. tomorrow morning the shower threat shifts up to the north bay. so generally tomorrow it will be a little bit wet north of the golden gate bridge. the rest of us get a chance to dry out. then we will have plenty of clouds around tomorrow. by 10:00 tomorrow night, things will change. barometers will slowly begin to edge up. look what happens on tuesday and wednesday, severely clear as we go to an offshore push, maybe the last one of the season. that does happen in october. the numbers will be coming up by the latter half of the week. a few more showers tonight, dense fog forms overnight.

we'll be drying out on tuesday. we will be in the mid-80s by friday. overnight lows tonight. sun up at 7:21 a.m. forecast highs for tomorrow still below average. almost everybody will be between 65 and 70 degrees. south bay will be in the mid to upper 60s, 69 in mountain view. over in the east bay the numbers will be near 70 degrees with partly cloudy skies. up in the north bay the number with some lingering showers in the north bay tomorrow will be in the mid to upper 60s. extended forecast things are going to change. partly cloudy skies, tomorrow lingering showers, partly cloudy for tuesday, and look at wednesday, thursday, and friday. we're in the 80s to near 80 degrees right around the bay. pretty good beach weather. can you believe that? we'll be in the bay area by wednesday, thursday, and friday. so we'll finally get a chance to dry it out a little bit. we have more ahead, the latest on sports and on the casino story is something you've really got to see. it's unbelievable. we'll have it after the break. ,,,,,,,,,,,,,,,,

but, who knew? o public talk a brand new casino is in the works for the bay area, and it's a big one. >> but who knew. there has been no public talk about it, even city leaders say they were caught off guard. here's kpix 5's emily turner with a story you'll only see on 5. >> a day when most megaprojects are submitted for rigorous government and environmental permits that usually take years to get, we went to find out how, why, and when did this megaproject get so far along without the public knowing anything about it. >> casinos usually make a lot of noise, but one plan for this plot of land has barely made a peep. it would go here inside vallejo city limits where interstate 80

and highway 37 meet. >> we were stunned. we were stunned. >> daniel keen is vallejo's city manager. >> this is not the first time there have been proposals to establish casinos in vallejo or in the vallejo area, but we didn't know that it had progressed this far. >> it's the scott's valley poe mow indian tribe's $700 million project, and it's already in the pipeline. >> our goal is to have a homeland for our tribe. our tribe's been landless for 150 years at a minimum. >> the tribe says they met with the city in january, but the city leaders say they just found out about the casino in july, and now the city says there is nothing it or even the state can do to stop it. that's because indian affairs are between the tribes and the federal government. >> it just strikes us as an effort to intentionally exclude the city and any other parties who might have concerns, legitimate concern about this. >> here is how such a big

project was off the radar. in march of 2015 the scott valley band of poe mow indians struck a deal with integrated resort development llc, a las vegas based casino development company. by the fall of 2015, the tribe identified the parcel of land and in january of this year filed a claim with the federal government to have it declared their native homeland. they asked the bureau of indian affairs to decide by september 5th of this year. then in august the tribe filed paperwork for the most sensitive part of their plan to build a casino. it's that paperwork that triggers notifications of the local and state government, but in the meantime integrated resort development had already purchased the plot in march of this year, and in july already agreed with the tribe to finance, develop, and construction the gaming facility on it. >> was there ever the intention to mislead the public or to withhold information until the very last minute about the casino, about the plans, about what was going to go on that

land. >> no, there was never any intention to mislead or to do that. >> there's nothing illegal about the way the tribe is handling this, but it is unorthodox, usually the paperwork filed to reclaim the land is filed at the same time as the paperwork asking to put a casino on it. these they filed separately, and the part that doesn't require a public comment was filed eight months before these were. in the history of the indian gaming regulatory act, the bureau of indian affairs says that has only been done four times. >> the tribe says it was to avoid unnecessary legal costs. for them and the city, but they say they now recognize that might not have been the best option. >> you can't put the genie back in the bottle to say if we could go back in time and say, hey, we want you to know this is happening. this is happening. >> so maybe you would have done it differently in retrospect? >> yes, definitely. >> but the applications are in and the plans are awaiting approval from the bureau of

indian affairs. they include a 400,000 square foot casino with a hotel and spa. a family entertainment center would follow, which could include a movie theater, arcade and bowling alley. it would also include tribal housing and headquarters for the 128 adult member tribe currently based in lake county. >> there are offices in lake port to where this piece of property in vallejo is 90 miles have you justified that? >> i believe that it's not really a justification to us just because we know where we've been, where we're from. >> the tribe argues their claim stems from the 1851 treaty at clear lake where the tribe's predecessors cedeed their lands. the keen says this casino is the first time they've ever shone any interest in this city. >> has this tribe had anything to do with vallejo at all? >> not to my knowledge. this tribe is not one that

appears to have any connection. in fact, they appear to have had their historic connection to an area 60 miles from here. >> the tribe also has an office in concord and provided this map showing 25 tribe members living within a 36-mile radius of the property. non-tribal members in that radius have their concerns. >> i didn't know. i didn't know. you're the first person that actually mention it had. >> sal rides his horses right next door where eventually a casino parking lot could border the barn. >> it will affect me big time, especially because i enjoy riding my horses every single day in the mornings, afternoons. a casino here, i think that will go away. i don't want it lose that. >> he's not alone. >> three congressmen, senator feinstein, sonoma county, the city of vallejo have all written letters to the bureau of indian affairs expressing their concerns. they feel like you guys pulled fast ones. >> if they knew our history, they may not be so angry with the things that they're saying.

>> so in response the tribe sent its own letter to the bureau saying they, quote asked that the city's request be denied because public comment including input from local governments is not part of the restored land's process. >> you have people telling you where are you from, who you are, and being a tribal person in california it's been that way for a long time, and a lot of our history that we're taught here isn't correct. >> so for now, the city of vallejo's best hope is for the fed's to reject the claim to the land. if the feds approve the land claim vallejo and the public would be able to weigh in on that casino. it's worth noting this isn't the first time this tribe has tried to build a casino in the east bay. in 2004 the tribe tried to reclaim a plot of land 20 miles away in richmond and build a casino there as well but the feds denied a claim on that land. >> emily turner thank you. it's an emotional topic and
