the law. but as kpix 5's maria medina reports, the mayor of santa clara isn't backing down. >> we are holding them accountable. >> reporter: it's a play many are watching closely with santa clara mayor lisa gillmor playing offense. >> we have no knowledge of it. we have no involvement of it. >> reporter: and the 49ers playing defense. the team is accused of spending taxpayer money on maintaining and operating levi's stadium, a clear violation of voter- approved measure j. >> if you -- the 49ers management company would just give us the information that is required under the agreement, we wouldn't have any issues. >> reporter: last night during the city council meeting, the mayor warned the 49ers to hand over the financial documents auditors need to finish their job or city leaders would take the drastic step of taking away management from the 9ers. >> why haven't those documents been provided? >> those documents have been provided. >> reporter: 49ers spokesman bob lang says they invited auditors to get the documents needed almost a month ago, documents they don't want made

public because it could hurt event negotiations and the profit the city makes from them. >> we have yet to hear a response from the auditors to set up that meeting. >> reporter: what do you say to that? >> that's a very small part of it. we don't need to know how many bottles of water beyonce drinks. what we want to know is what are the expenses and revenues that should be flowing to the city of santa clara. so that's a diversionary tactic. it means nothing. >> reporter: the mayor says the public owns levi's stadium and nothing should be confidential. >> it shouldn't have gotten to the point where it's constantly being debated in the media. >> reporter: i asked the mayor, what's the point of the 49ers keeping financial documents from them if they are in fact doing so? she said she believes it's because the team recently asked to lower the rent by $5 million and they don't want to show the city just how much they're making here. at levi's stadium, maria medina, kpix 5. >> the mayor is giving the 9ers one week to hand over the documents to auditors or she says she will move forward with taking away management control from the team. breaking news in orinda where the fbi is conducting a

search at a home on moraga way. so far the fbi is only saying that it's serving a federal search warrant on a cyber matter. it has to do with a case outside of the area and there have been no local arrests. we'll bring you any new developments as they come into the newsroom. new at noon, a bay area woman says that she was a target of a hate crime while hiking mission peak in fremont. she says that when she got back to her car, the window was broken and a nasty note was left inside. a fremont city councilman posted the note to his facebook page calling the woman out for wear a hijab and said that this is our nation. the woman reported the note to east bay regional parks. fremont police say that they contacted the victim. they say that they are saddened to learn that this happened in the community and will help with the investigation any way they can. new at noon, a minnesota police officer is charged with second-degree manslaughter after he fatally shot and killed philando castile during a traffic stop back in july.

the prosecutor says officer her rand no yanez had no reason to to use deadly forth. it was streamed live on facebook by castile's girlfriend in the car with him along with a young child. castile told the officer he had a gun when he approached the car but evidence shows he never went for it. officer yanez will appear in court on friday. san jose fire investigators are trying to determine what started a two-alarm fire that destroyed a duplex overnight. the fire began at about 12:30 this morning on cypress avenue in the valley fair area. three people and one pet got out of the home safely but at last check a second pet was still missing. the red cross is helping the victims. tuition hikes could be in the works in california's two public university systems. kpix 5's anne makovec looks at how much more uc students may have to pay. >> reporter: the possible tuition hike could amount to about $300 per year for undergraduate students starting next fall. the uc board of regents began a

two-day budget discussion with talk of raising undergrad tuition for the 2017-2018 school year. >> just want to make sure that the administration would use those funds and help me out. >> we want to hire more people and provide more student services. >> reporter: but a survey found many uc students have more serious needs to be met. four in ten lack consistent access to high quality healthy and varied meals. >> it's a lot to take on to someone who is also focusing on trying to get to work on time, get to school on time, getting classes, getting -- >> reporter: a uc spokesman says nothing is official yet but that any increase would be covered by financial aid for three-fourths of students. >> the vast majority of our undergraduate students and our graduate students would not be affected by this. >> reporter: officials are also considering increases in tuition for out of state students of 5% and a possible 5% hike in the student services fee. >> for a lot of students, i

know it will actually be like a big factor contributing to whether or not they choose to dom berkeley. >> reporter: a decision on any tuition hike wouldn't be made until january. at uc-berkeley, anne makevoc, kpix 5. >> the california state university system is also considering tuition increases. the proposal calls for an extra $270 a year for students at the 23 csu campuses. the in state undergraduate tuition at csu schools is currently $5,400 a year. there's a big showdown in court today that could put protective custody positioned golden state warriors arena -- that could put the proposed golden state warriors arena in jeopardy. they have to prove they didn't violate environmental laws. the state got a construction permit and a decision on an appeal is expected in weeks. a donald trump transition team says it's making progress following some changes. vice president-elect mike pence

not be in stockholm. bob dylan. the swedish academy announced today he told them that he wishes he could receive the prize personally but other commitments make it unfortunately impossible. the singer-songwriter's website doesn't list any tour dates beyond this month. the academy does require that dylan give a speech within 6 months after the ceremony. time now for a check of our weather with julie watts in for roberta. >> we didn't get much rain this time around but guess what, we did get -- we are getting a little bit of snow. here's a live look at "sierra at tahoe." we have been seeing some snow flurries from time to time many ski resorts hoping to open this weekend. and take a look at doppler. right now in the sierra, not a lot of rain in our neck of the woods and we zoom into the sierra and we have plenty of snow -- some impressive cells here with a rain-snow mix. and then some snow flurries up there right around the lake today. as we make our way throughout the day this will taper off and over the next couple of days, more of this!

sunshine is what you can expect, blue skies over the golden gate. yes, we are on the chilly side today. the cool side if you will breezy with plenty of sunshine. temperatures are running in the upper 50s throw 60s throughout the bay area this midday. and we will warm up into the low to mid-60s for the warmer spots but not much warmer than that. a cool air mass in place behind the cold front that passed through, that is keeping temperatures cool today. and we are keeping it a little unsettled but as you will see futurecast is now taking any rain chances out of the forecast. so for the most part sunshine, not going to see anything in terms of rain until this weekend. that's when we get the next weather system. so here we are friday 3 p.m. we remain dry but take a look at this. look up north. we see showers move in overnight friday into saturday morning. this is just the beginning of this system which will move through and right now, looks like it will bring widespread rain off and on saturday, sunday, maybe even unsettled

weather into monday. so many of us will see a wet weekend at least parts of it anyway. in the meantime, we'll be dry for a couple of days. so breezy and cool today, sunny and mild for the rest of our workweek. and then this weekend once again does look wet at this point. high temperatures today, not that high at all, on the cool side of average, topping out in the upper 50s along the coast, low to mid-60s around the bay, and low to mid-60s for the warmest spots inland. 63 san jose. livermore maybe some 65-degree temperatures some spots in the east bay and that's probably about as warm as we'll get today, certainly on the cool side. sunset tonight, 4:57. sunrise tomorrow morning, 6:53. and a look at the overnight lows. now, this is really going to be the big weather story. i do think we'll see temperatures dip down into the 30s for some spots. could even see a little bit of frost in some of those wind sheltered locations. so something to be mindful of tomorrow morning. grab a jacket as you head out the door. but sunshine for tomorrow afternoon and again on friday, as temperatures warm into the upper 60s near 70 degrees. and then rain chances back in
