yep, i'm lost. movie-goers... shots fired at theater... a customers told to take cover... live from the cbs bay area studios this is kpix5 news. a frightening night for some bay area moviegoers, shots fired at a theater and customers told to take cover. good evening. i'm brian hackney. >> and i'm juliette goodrich. it wasn't the type of action that moviegoers were hoping for, tonight the chaotic moments after a shootout outside a popular east bay movie theater. kpix5's joe vazquez is outside the theater right now. >> reporter: it was a frightening night here in concord, investigators still on the scene. they say the who he thing began with a disturb -- the whole thing began with a disturbance from a man who claimed to have a gun. >> we've got one down with a gunshot wound. >> reporter: gunshots rang out behind the branden theater around 6:45 p.m. >> it was a male with a gun who

was in the main lobby. >> i heard like a bam, like a boom. >> reporter: an ambulance rushed the man to the hospital. his wounds are not believed to be life threatening. police say there was some sort of disturbance that led to the shooting. they will not elaborate on the details. >> the suspect ran out of the theater. the security guard chased after him. at some point the suspect threatened the security guard saying he has a gun and he's going to shoot him. >> reporter: was the suspect armed? >> we did not locate a firearm at this time, no. >> reporter: at first police were worried it might have been an active shooter situation, so as a precaution some moviegoers were ordered to evacuate. others were told to take cover in place. >> one of the attendants came over and told us that we should hide and run towards the back of the theater, so we did. >> reporter: he told you to hide? >> yeah. they said specifically you guys need to hide and i was like okay. so we started running towards the back of the theater and they were like okay, so just go

do whatever. >> reporter: investigators were questioning the security guard at police headquarters. they say he is cooperating with the investigation. live in concord i'm joe vazquez, kpix5. muni says things are back to normal tonight after somebody hacked into its system. it meant free rides for customers over the weekend. kpix5's cate cauguiran joins us live in the newsroom with new details on a possible motive. >> according to reports from the sf examiner, the alleged hacker demanded $73,000 from sfmta. say good-bye to free fares for now. the sfmta metro fare gates and ticket kiosks are back up and running. the computer system was confirmed to be hacked friday and after that the transit organization deliberately opened up the fare gates and offered free rides. >> at that time we had very little information. so we took the step to open those fare gates so there wasn't any possible transaction situations that could impact

our customers. >> reporter: sfmta claims no rider information was leaked and the hacks did not affect any services. >> we're moving forward to make sure that we're returning all systems back to normal. >> reporter: but the question still stands who was behind all this? the san francisco examiner was able to contact the alleged hacker. the hackers said they only were doing it for the money and to make sure sfmta secures its computer system before they hack again. >> it's very possible and highly likely that these hackers went after low hanging fruit. they went after something that they felt was pretty easy to hack. >> reporter: kpix5 security analyst and former fbi assistant special agent in charge jeff harp called this an opportunistic hack. >> and it could have been through some sort of phishing scheme they used through an e- mail account. once they do that they create a backdoor into muni's system and can lack into the account. >> reporter: stmta is not

releasing any more detail than it's currently investigating. a source showed kpix5 this picture of what popped up on employee computer screens. it read you hacked. all data encrypted with contact information for a key. jeff's advice for mta riders, check what personal information may be linked to your clipper card. even though sfmta said no rider information was compromised, it's better to be safe than sorry. cate cauguiran, kpix5. three people are in custody all allegedly connected to an ocean drug smuggling operation. they were spotted on the shore at nuevo state park in san mateo county. the coastguard had been tracking the boat. i.c.e. agents and san mateo county sheriff's deputies were waiting when they came ashore. we asked our surety analyst about the smugglers' tactics. >> these people operate in volume because they know at some point in time they'll get caught, but like everything else if you push enough volume, you'll end up getting some of your product through.

>> two years ago another band of smugglers abandoned their boat and 1,000 pounds of pot at pescadero beach when their get- away car got stuck in the sand. well, it's the end of the thanksgiving weekend, lots of people heading home tonight from the long holiday. here are the red lights heading out toward livermore on 580. according to tripadvisor, nearly 50 million traveled for the holiday, about 1/3 fly and another 63% drove. passengers arrived at sfo today and said their trips went smoothly. >> the flight was like any other flight. there were lots more people because it was the holiday season, but i just did some homework and sleep just like any normal flight. >> security treated us good. we didn't have no problems. it was smooth. yeah, just glad to be back home, though. >> the faa reported no major delays at u.s. airports.

about an hour from now tomorrow, cyber monday, and many major retailers still have more holiday shopping deals to offer. online sales tomorrow could hit more than $3.3 million, 9% better than 2015, and about 27% higher than 2014. ironically those all black friday through cyber monday discounts mean individual shoppers are spending less overall. analysts predict the four day weekend will see a 3.5% decline per person. the number of people shopping for sales is up more than 10% from a year ago. when all the numbers are added up, this year's holiday season could ring up $117 billion. a soggy weekend for shopping around the bay area and we aren't out of the woods yet, mostly but not completely. the kpix5 hi-def doppler is picking up the next system on the way. the widely developing scattered showers are developing from the sierras to the foothills of san

francisco and it could affect the morning commute, but there's not much in it. we'll have all the details what happens next later in the broadcast. it is a race against time to find a missing couple believed stranded in the snow in el dorado county. rory and susan halter were last seen yesterday morning near wentworth spring road and icehouse road. they went four wheeling and got stuck. the call for help to the 911 dispatcher got disconnected. rory managed to text his family today before losing cell service. >> if anyone has any information that maybe they overheard a conversation when they went out to breakfast this morning as to maybe where they were going, any help would be appreciated to narrow down the search area. >> police say they'll have a better idea tomorrow where rory was when he sent those text messages. in the meantime search and rescue teams have been combing the area from the ground and air but so far no luck. five days of searching

turns up no sign of two escaped inmates from the santa clara county jail. deputies are now gathering surveillance video from nearby businesses to help find rogelio chavez and laron campbell. the men cut through jail window bars and rappeled from the second story window using bed sheets. hundreds more homeless beds opening up in the south bay. santa clara says its winter weather perhaps kicks in tomorrow adding an additional 400 beds. the gilroy armory in sunnyvale offers hot showers, two meals and day and medical care. a rash of weather related accidents overnight including this one involving dozens of cars, the cht says an axle was left in the lanes of northbound 880 near brokaw road. some 30 drivers hit that axle leading to blown out tires and front end damage. the only good news is nobody was hurt. benicia police released this surveillance video of a man brandishing a gun at the bottom of the fifth bar early this morning.

the man fired several shots in the air and then at customers. two men were hit but are expected to be okay. the shooter got away. people in el sobrante gathered for a vigil and fundraiser tonight following a murder authorities call a hate crime. several men robbed, beat and shot 28-year-old william sims earlier this month. then they left him to die along appian way. tonight more than 200 people showed up in a show of support for the dead man's family and to raise money for their funeral expenses. many are upset what appears to be a hate crime with deadly consequences happened in their community. >> it's very disappointing especially when you have someone that kind and gentle and who would give you the shirt off his back. it's very disappointing. if just shows us that we have far long way to go as far as becoming one in our community. >> a richland man is under

state's presidential vote. the recount comes at the time election officials in wisconsin will meet to try and set a timeline for a recount of that say the presidential vote. the recount comes at the request of green party candidate jill stein and it now has the support of hillary clinton's team. today president-elect donald trump tweeted to criticize the recount. his former campaign spokeswoman took to the air waves. >> the idea that we are going to drag this out now where the president-elect has been incredibly magnanimous to the clintons and obama is pretty incredible. >> probably almost every election there's a recount. no one expects profound change, but there's nothing wrong going

kpix5. >> concord police have assigned a detective to that case. proposed new rules aimed at lawyers generating some objections, the california bar association is considering a ban on attorneys having sex with clients. it's currently against the rules to coerce a client, but this would cover consensual sex as well. this is the first time in 30 years ethics rules for lawyers are being revisited. flags in havana are at half staff at a week of mourning for fidel castro is set to again. the revolutionary leader died friday at the age of 90. many cuban americans are now wondering how his death will impact their future. >> reporter: cubans prayed for fidel castro as workers prepared for tributes in havana's revolution plaza sunday. thousands are expected to start attending public ceremonies there monday. castro died friday. he ruled the communist nation nearly 50 years. cubans are observing nine days of mourning.

even going through our parents' story. >> reporter: cuba's president raul castro said he'll step down in 2018. >> fidel castro's ashes will be interred next sunday following a public memorial. an 8-month-old baby was thrown 25 feet from a car crash and landed safely between the bars of a storm drain. it happened friday night in arkansas. a big rig clipped this car causing it to flip over. family members inside told first responders the baby was thrown from the vehicle and they couldn't find her. firefighters searched the area when all of a sudden they heard a noise coming from the storm drain. >> yeah. we pulled this hey pulled this ha -- hay back from the grate and the 8-month-old was sitting up looking up at us waiting for us to pull her out. there had to be some kind of divine intervention for her to wind up being okay the way she

was. >> the baby suffered only a crash. the child's car seat was not properly installed. >> she sure looks unaffected by the whole thing. glad it had a happy ending. tonight we've got some showers on the way for the bay area and not going to be much more than a street wetter, maybe .1-inch of rain in the north bay, lesser amounts in the south bay. there's plenty of moisture on the backside of a low headed inland and east of the bay area, but that low pressure that is inland, high pressure builds behind it, enough moisture for showers tonight but a mostly sunny day by tomorrow afternoon. we'll deal with most of those showers in the wee small showers between midnight and 6 a.m. look at the approach to the bay area, if it only always looked like that, we'd be in so much better shape, low 50s now for much of the bay area. daytime highs tomorrow will only be 6 to 8 degrees warmer than where we are now. storm totals over the weekend
