live from the cbs the bay area studios. this is kpix news. tragedy, new details on the people killed in the deadliest fired -- fire and the city. >> we are covering it. the death toll is up to 33 with the fire that tore through a warehouse friday night. investigators believe that that number will rise.>> we have live coverage tonight. cate cauguiran is at the scene. >> reporter: as you mention this is around the recovery operation. officials have told us that

they brought in additional detectives to make sure that the work gets done quickly but carefully. tonight, we spoke exclusively with the criminal investigation team on the scene. >> people want answers now. from our perspective, we have to take every step one step at a time. to make sure that we are not missing anything. >> reporter: 33 dead and the shares office released seven names of the victims. >> we have delivered the unacceptable and horrific news of losing a loved one to seven of our family. >> reporter: tonight we remember donna kellogg, her family tells us that she was a freewheeling culinary student. and electronic music artists, and passionate musician who played in a bay area fan. travis huff and ardis who was

called the warmest and the sweetest person. david klein who just graduated last year. sarah coda who friends called compassionate and -- sarah hoda and gomez hall. to attend to the victims and their families, that is our moral obligation, to put the bulk of our resources, right now on that most important task. so far, investigators have only been able to go through 40 percent of the warehouse. is more victims are recovered and identified there will be more heartbreak. >> when we started this investigation and you would've said we had 33 victims we would not have believed you. we have no idea how many more in their. >> reporter: it is too early to call this a criminal investigation. she has deployed an arson task

force to work alongside of the federal investigators and the fire department. >> the product that is being taken out of the building is being preserved in a very secure way so that we can go back and know that what we are looking at is in the state it was when the fire occurred. >> reporter: investigators told us today, in addition to going through the rubble there planning on searching the trailers that people reportedly lived in inside the warehouse. reporting live in oakland back to you.>> three uc berkeley students are among the dead. they have not been heard from since the fire. >> the warehouse was a 24 hour artist collective where artists

could sleep work and live. >> reporter: they get emotional tonight, the two women believe that they may have been the first ones to see the buyer a wrapped inside the warehouse.>> i was asleep in the back and i woke up to smoke and the entire wall was on fire. >> reporter: carmen lived at the warehouse and she escaped only with the clothes on her back. >> i was dreaming when i put on my coat. i feel like i woke up on the sidewalk and then seeing -- everything everything orange, this orange wall of fire, i don't know it felt like seeing a monster.>> reporter: 15 feet of flames. being hit in the face with black smoke and i was blinded

by it. she lived inside as well and escape the flames.>> everyone get down get down as low to the ground as you can and getting people out. then getting outside and realizing that nobody was there. >> reporter: she sprinted to the firehouse a block away. carmen said that overwhelmed residents tried their best to tame the flames. >> people tried to put it out with [ null ] -- with fire extinguishers. we had fire alarms. it's like the out of fire a huge fire with a water pistol.>> it was pitch black. you could not see where the exit is, -- >> it is awful.

is awful anytime there is a tragedy like this and we should honor those lives that were lost. it's not about placing blame on anybody that was there. it is tragic.>> reporter: the two women are still suffering they only left with what they were wearing. they survived and so many people did not.>> this is the man who headed the artist collective. some people are blaming him for the fire. we did some digging and here is the man behind it. >> reporter: the emphasis is on the victims right now. trying to bring closure to the loved ones but who is responsible for this horrific tragedy? and certainly, investigators will want to speak with the

and mika are at a hotel safe. many people blame tim for the tragedy. he and his partner were warned that the building was unsafe especially with three children. the photos before the fire show the ground floor filled with beds, tapestry, wood structures, rescue workers referred to it as a tinderbox and there were no sprinklers and the bottom floor was elaborate that may have prevented escapes. the only exit was a rickety staircase that collapsed and trapped dozens.>> he did not request a required permit for friday night's party and we

were unable to reach them for further comment.>> one woman we spoke to said that she knew him and try to convince him that the warehouse was not safe.>> i, on several occasions, i stood right in front of the building is set, derek, this is not safe and your kids are in danger to you. his attitude was that i was being hysterical. >> i feel a tremendous sense of guilt. i wish i would've scream louder. >> we are told that law enforcement had spoke to him but it's too early to talk about criminal charges.>> the red cross is helping people that were affected by the fire. 2425 e. 12th street, they have an assistant center. you can call the number on your screen. 510 238-5121. we will continue to bring you updates.

around four- thirty this morning..police say the suspec -v in the front for people are behind bars and police are looking for four more suspects. around 4:30 am the suspects smashed our rented suv into the store on university avenue. they grab as many electronics as they could in one minute. they abandoned sub along with another car -- suv along with another car.>> the vehicle was probably disabled as a result of ramming into the business. and they were forced to abandon it. but we are speculating on that.>> police arrested the 19- year-old, and another 19-year- old and two juveniles. there wondering if the group had anything to do with eight other recent burglaries at apple stores? she was sexually

assaulted, she was walking from the downtown berkeley bart station and fought back. investigators are looking for a man with a black baseball cap. protesters of the dakota access pipeline are celebrating following months of demonstrations. they are rejecting the current construction route. here with the latest. >> reporter: hundreds of protesters cheered after hearing the army corps of engineers, announcing they will not create an easement for the dakota access pipeline. >> we make it or break it. i guess, we made it.>> reporter: the tribe and is supporters claim that the pipeline will threaten the

mobil. just in, a federal judge said that michigan must begin its recount tomorrow at 12 noon. a separate recount proceeding is happening in wisconsin and jill stein is pushing for one in pennsylvania. back to our top story, the deadly fire in a warehouse. the city of oakland had that holding on its radar. the neighbors have said it has been a long-standing problem. >> reporter: neighbors say this is been an unsightly eyesore. a source of frustration and deepening sadness. >> the neighbors are calling and consol about the trash, you know, if they would stay on top of the stuff, this could have been prevented, i think. >> reporter: neighbors have complained in early and often about the conditions, the months and years before friday.

>> it is too late now. it is a tragedy. i should have complained more.>> reporter: the trash outside was likely a small hint on what was going on inside. >> every day you would see junk. you would see use pianos and pieces of equipment, furniture. >> reporter: and fat, -- in fact, inspectors were brought november 17th into the space. they hit a roadblock and inspectors cannot get inside. neighbor said that was a missed opportunity. >> there were multiple complaints and i do not understand why they had the door shut. >> reporter: they were wondering why took tragedy to shine a spotlight on living conditions later? >> they should have had that place boarded-up in my opinion.>> and oakland city councilmember says it's only a matter of time if the city does

not step up. every weekend, they collected garbage off the street including around that warehouse. he says he has spoken to the owner before any said that plenty of other buildings lack permits as well.? you know, there is a complaint about several cities. that is a city property. there are people -- >> you know, there was a complaint about a. there were people living inside. >> you cannot say how many buildings or businesses are living without the proper permits. we will switch gears and talk about the forecast. there is rain developing later in the week. and the cold snap, that is still happening. tuesday and wednesday, the numbers will be in the low 50s. tomorrow, we will have a mixture of some and clouds. -- son and clouds. cold air -- sun can cold air.
