of highway 13. all of these lanes were closed. only one lane on the northbound side remains open. around 2:40 this afternoon, this tree came crashing down. across all southbound lanes of the highway and on top of a car the driver was the only person inside the vehicle and he was calm and uninjured when they got to him. he couldn't fit through a window so a chp officer and good samaritan rescued him. >> had to break some branches and miraculously there's no injuries. the driver is truly blessed. [ inaudible ] >> reporter: the driver stepped on the brake. he was checked on the scene, was cleared and then taken to the bart station at his request. as you can hear a lot of action happening here behind me. [ extremely loud background noise ] >> reporter: the department of

transportation is trying to clear the debris quickly and safely. chp is estimating that all the roads are back open around 6:30 or 7 p.m. tonight. in piedmont, jackie ward, kpix 5. >> could sure hear them working in the background! in san francisco traffic is diverted off the great highway due to the flooding. the road is shut down right now between lawton and juda. no word on when it might re- open. drivers are being asked to avoid the area altogether. and there is some escaping the rain at least. even as we show the low that hit us with more than 2 inches of rain today. it's now heading south. the heaviest downpours slamming into the sierra at this hour pushing into the south bay flat-out rain this afternoon giving way to scattered showers. not much left. up north, not much left. in fact, we'll have a chance to drain and dry tomorrow. but there is more on the way. so is the forecast in a few minutes. tonight the lights are back on in the east bay after widespread power outages. at one point, more than 40,000

customers in berkeley, oakland and emeryville had no power. a separate outage briefly stranded a bart train on the tracks near balboa park. . [ chainsaws ] >> more power problems in the north bay. pg&e crews had their hands full as well after trees toppled on power lines in santa rosa and sebastopol. no major outages reported. but some roads were blocked. others were completely flooded making it dangerous for drivers to get through. it's a dangerous combination of wet roads and alcohol. that may be to blame for this fatal wreck in san mateo. one person died and three others were hurt when a disabled vehicle set off a chain reaction crash near 101 and highway 92 overnight. >> it appears we have two collisions that happened at this area. there's a strong possibility that the rain played a role. >> another possible factor, alcohol. one of the drivers who survived is under investigation tonight for dui. and in oakland a couple of

cars got into a crash on eastbound 580 right before the highway 24 split. one came to rest facing the wrong way. no word on any injuries. it is now one week since the deadly oakland warehouse inferno that killed 36 people. tonight investigators still don't know exactly how it started. da lin was there as they combed through debris in the rain searching for answers. >> reporter: the weather was far from ideal for atf agents. it rained most of saturday. at times, the agents struggled with taking measurements in the rain. they spent most of the day in their mobile command unit drawing up a diagram of the inside of the warehouse. they are reconstructing the scene before and after the fire to try to pinpoint the cause. they know it's not a refrigerator as previously speculated. so they are checking other appliances. outlets and power cords also. as atf agents cleared out their equipment, we are getting a better view of how artists and

musicians lived here before the fire. these were some of the propane tanks they used to heat water and cook food. a bike placed right next to what appears to be an rv. a couple of fire extinguishers near the front entrance. and a badly damaged staircase between the first and second floors. >> as an artist, i wanted to come out and give the families a tangible thing that they could relate to or connect with. >> reporter: several south bay artists placed pieces of art near the warehouse. >> we built a cement block and we posted the tree into the cement block and made stainless steel heart leaves with the names of the dead. >> reporter: and several miles away, at eli's mile high club, a phraser to help survivors who are now homeless. people dropped off bikes and clothes. >> the people that need a lot are, you know, the survivors and the familiar there's were in ghost ship. >> something good coming out of a tragedy, you know, just seeing people -- seeing all the love. >> reporter: back at the scene,

atf agents say by sunday, they should be done with creating a diagram of the warehouse. we're not sure if the rain will delay that timeline. in oakland, i'm da lin, kpix 5. we have just learned the bells at grace cathedral in san francisco will toll 36 times tomorrow in honor of the victims. that's at 12:30 p.m. donations have been pouring in for the victims' families. the gray area foundation for the arts has raised almost $600,000. the founder knew six of the victims. >> this is being felt not only here in the bay area but also in other parts of the world as we're seeing artists' spaces getting shut down. these sorts of things taking place. and i doubt that anyone that lost their lives would want this sort of impact to be, um, rolling out. >> reporter: there are dozens of benefits being held all around the world including many here in the bay area. and we have a list on cbssf.com. and we'll have continuing coverage of the warehouse fire on air and online at cbssf.com.

new at 6:00, a santa clara police officer is under arrest tonight on felony domestic violence charges. 34-year-old officer daniel bird was off duty when he was taken into custody early this morning following an incident at his home. there's no word on what allegedly happened but officers say the female victim had visible injuries and they say that she and bird had been dating. this seven-year veteran was booked foot santa clara county jail. now he is on paid leave. tonight in san jose, police are searching for the driver who hit and killed a pedestrian and then took off. the victim was found in the street near east heading and north 15th streets around 3 a.m. but the driver of the car took off. paramedics were unable to revive the victim. he died at the scene. so far there's no description of the hit-and-run vehicle or the driver. a busy san francisco intersection is back open tonight after a big water main break but the repair work is not done yet. 30-year-old pipe blew early yesterday morning at 4th and howard flooding part of the moscone center garage. crews worked all day and night

you can have it for $649. at macy a pend dance $120 original price on sale for 30. this $250 liz claiborne bag at j.c. penney. great prices, right according to the city attorney it's in all the cases he cited this is lawsuit against macy's j.c. penney, sears, and kohl's, they are not price decreases. they have thousands of examples of these four major department stores lying. what people think is a big discount is not. >> it leads people into believing that they are getting a deal they can't pass up. >> reporter: he said that washing machine was never priced at $1,179 for the mandatory three months as required by law. nor was the handbag, nor the dress nor the necklace. and it goes on. >> i think it's a common practice. >> it probably is. >> you're not getting a sale. >> do you ever feel that you have been had?

>> sure. >> what are you going to say? >> they said nothing so far. >> reporter: and the four companies had no comment when we asked for one. >> i want what i'm supposed to get. >> they just marked it up to mark it down. >> yeah. i think that's not nice. >> hm. well, j.c. penney and kohl's have been through this before settling previous class action lawsuits over the very same complaint. well, imagine covering all your energy needs with wind and solar power. that's what google wants to do. kiet do says that's what they are promising to do by next year in fact. >> reporter: to put it in perspective, in one year, all of google's office buildings and data centers use about as much power as all of san francisco use in a year. that's about 2.6 gig watts. the company will get the vast majority of that renewable energy from wind power. but they will also buy electricity from giant solar farms like one in southern california. part of what's making this responsible wind and solar have gotten a lot cheaper. google says over the past six

years, wind prices have dropped 60%. and solar has gone down by 80%. for technology companies, it makes switching to renewables a no-brainer. the company released a chart showing they would buy about as much renewables, as a.m. songs, the department of defense, microsoft and facebook combined. the next time you watch a silly cat video on youtube, consider this. 400 hours of videos are uploaded to youtube every minute. and google carries out trillions upon trillions of searches every year. that creates the mother of all carbon footprints. next year it will be reduced to zero. in livermore, kiet do, kpix 5. >> apple, walmart and general motors have announced plans to get 100% of their electricity from renewable sources. back to the storm watch now. a steady rain for most of the day asty trickle of riders rushed -- as a trickle of riders rushed to catch their trains at fruitvale bart station. if you are not careful the rain

could make you sick. new at 6:00, jackie ward on the poisonous problem popping up all over the bay area. >> reporter: everyone knows california needs the rain. the mushrooms love it. and my collie loves mushrooms. >> the downside is that we also have poisonous mushrooms come up. >> reporter: this invasive mushroom species is known as death cap and is the reason seven people have been hospitalized this past week. >> people don't eat outside their confidence and knowledge level. so there's a lot of wonderful delicious wild mushrooms. but it's not knowledge we're born with. we have to learn. >> reporter: she says we are right in the middle of death cap season. death caps aren't native to north america. they were brought to monterey where they implanted themselves into the wild. these mushrooms and mushrooms of any kind are illegal to forge -- illegal to forage in

the east bay. >> it's important to prevent poisoningsle telling people not to pick mushrooms doesn't work. >> reporter: distinguishing between them is hard. debbie recommends contacting a mushroom identifier before eating something you picked. >> that's a death cap? >> no. there you go. light showers remaining in the south bay. north bay, pretty much gone. light rain is being reported at the airport in san francisco. and light rain in san jose. so it's below the sweep of the radar up there on mount umunum. as we look at the roadbed of the golden gate bridge, the numbers now in the 50s. it will get down into the 30s in santa rosa tonight with clearing behind this front. we'll get a break from rain as the front heads out of the bay area and we briefly have a resurgence of high pressure. but very brief as you're about to see. in the meantime, we'll do it by the numbers. a little bit more than an inch in oakland. that's pretty good. .85 hayward. kentfield in marin county, almost 2 inches of rain. and .66 in santa rosa. futurecast shows it heads south and the sun comes out -- the sun will come out tomorrow ♪ and we'll have a nice sunday

out of it before things cloud up sunrise tomorrow night. nevertheless, a fairly nice day tomorrow. scattered showers tonight in this stormy looking background. clear and dry tomorrow. dry start monday. the rain returns late monday and tuesday looks like a good rainmaker, as well. flood warnings posted by the truckee river with low-lying flooding so careful out in the sierra. 49ers playing the new york jets. vern will opine about the technicalities of the game but i can tell you it will be partly cloudy and cool with temperatures in the mid-50s tomorrow. a lot of ice skating around the bay area as per usual this time of the year at the embarcadero. at union square. sun for walnut creek on ice. san rafael sunny. san jose clearing temperatures in the upper 50s tomorrow. should be fun skating. heading out, should be dry over most -- well, dry but partly cloudy. overnight lows tonight, santa rosa down to 36.

37 at livermore. 43 in the city. daytime highs tomorrow we'll all be in the 50s. and we should be sunny with some high clouds coming over from time to time especially late in the day. rain develops again on tuesday. wednesday and thursday on-and- off rain. by the weekend it looks like we are clearing out. but stay tuned on that. the numbers all week will be in what's typical for december. the readings will be mostly in the 50s in the daytime. it will be chilly at night with temperatures getting down into the 30s. so it's chilly, people are hungry and there's a solution and juliette has it. volunteers handed out coats and hot soup to the needy today in the south bay at grace church in downtown san jose. volunteers came together for many different groups. they helped people pick out coats that were sorted by size. it's an especially pressing need for those who do not have stable housing. >> they need the coats and so they each get the coats they need but we have socks, scarves, gloves and hats and so we try to make sure they get

was night it was raining teddy bears. 6,000 of them were tossed on the ice after the spokane chiefs scored their first goal of the game. it is a holiday tradition for the team. the teddy bears will be given to families in need across the spokane community. >> cool idea. other feel good news. a special honor this weekend for a san francisco woman who devoted her life to saving dogs. sherri franklin's muttville dog rescue found homes for more than 4,000 dogs so far. tonight she is in new york being recognized as one of cnn's top heroes of 2016. [ pause ] >> 20 years ago, i started dog walking at my local shelter. >> ready to get sherri. >> i'm so ready. >> i noticed that the older dogs weren't getting adopted. >> hi, sherri. are you ready to come home? >> watching these old dogs pen

get him out. southbound lanes have been shut down at moraga avenue for four hours but they hope to fix it shortly. >> falling trees took out two power poles in sonoma county. no outages there but there was major flooding on the roads. it's slow going on the great highway in san francisco tonight. traffic is being diverted in some spots due to standing water. >> and a week after the deadly oakland warehouse fire, federal agents spent another day combing through the wreckage for the cause. yesterday they ruled out a refrigerator as the source of the fire that destroyed those live work art spaces. 36 people died. now they are looking at other electrical items that were located in the same area. doesn't we don't know who is on the hook when it comes to lawsuits. >> but we discovered the city of oakland may not have to pay a dime. how does that work? well, california law protects it from liability. so while a city might be sued for something it did, it can't be sued for what it didn't do. especially on private property. >> for more than 100 years the

california government code has said, and this applies to this tragedy in oakland, that there are a host of things you can't sue us for. you can't sue us for doing a bad inspection or not showing up. >> the city admitted no building inspectors had been inside the building for 30 years and there are no records that the fire inspectors were ever there. the warehouses used by artists in oakland are part behalf keeps the arts community thriving but neighbors who aren't part of that scene often see them as a nuisance. kpix 5's john ramos shows us how the tragedy is heightening the tension. >> reporter: at a press conference in downtown oakland the owners of everett and jones restaurant tried to appeal to the city to provide safer art spaces. they did it by.ing out the building next door called salt lick that frequently hosts nonpermitted music events. they didn't quite go over as planned. >> y'all are on the witch hunt, okay? we're still grieving our friends. our friends aren't even in the ground yet! >> reporter: carl patrick and a number of other people took

exception to the message and disrupted the gathering. >> i do think it was not the right move. um, to hold a press conference but i don't think -- i don't think that they are on a witch hunt against anybody. >> reporter: but tensions in the warehouse districts of this city are running high as the mayor vows to prevent such a tragedy from recurring. >> we will learn from this tragedy to make oakland safer. >> reporter: but for those who frequent performance venues like salt lick, there is a fear that safety is being used as an excuse to shove them out of the spaces they have created and that fear is turning to anger as in this nasty racist email sent to the owner of everett and jones. carl says he is not really surprised. now that eviction notices are being served all over the city. >> it's infuriating. people are angry and i think that our opponents, the people who want to take over our spaces are wasting no time in exploiting this tragedy. >> reporter: the ghost ship

warehouse hit this city's arts community like its own 9/11 raising fears real and imagined and like 9/11, limiting the freedom that many here once enjoyed. in oakland, john ramos, kpix 5. >> now to the trump transition. as the president-elect downplays russia's alleged role in getting him elected, wendy gillette reports an oil executive with close ties to russia is leading the field for secretary of state. >> reporter: president-elect donald trump's transition team is disputing an intelligence assessment that russia tried to influence the u.s. presidential election to get mr. trump elected. the news was reported friday night by the "washington post" after the cia shared the secret assessment with a group of u.s. senators. the transition team released a statement saying, these are the same people that said saddam hussein had weapons of mass destruction. the election ended a long time ago. >> the transition team and trump himself are going to view this through a partisan lens

regardless of what the results are and are going to say this is an attempt to delegitimize his win. >> reporter: saturday, mr. trump met with exxonmobil ceo rex tillerson for the second time. cbs news has learned tillerson is mr. trump's top candidate for secretary of state. >> he is a great man. we'll see what happens. >> reporter: an announcement could come as early as next week. the president-elect left his home here in trump tower early saturday afternoon for a little down time to enjoy one of the country's great college football rivalries. the president-elect sat for part of the army-navy game in the box of west point graduate david urban. he also spent time in the box of retired marine lieutenant colonel olive north an annapolis graduate. he gave an interview to cbs sports. >> just love the armed forces, love the folks, the spirit is so incredible. >> reporter: mr. trump also said he was neutral on the outcome of the game. wendy gillette for cbs news, new york. >> so far mr. trump has not

formally offered rex tillerson the secretary of state job. he rose to prominent through exxon's russian energy business before becoming ceo. >> reporter: concerns continue about what the trump administration may do on immigration. jackie speier held a town hall meeting on the issue today in east palo alto. she has been getting phone calls including some from people who are illegal. and they came here with their parents. she hopes president trump won't split up the families. >> he has made some conciliatory comments in the last few days which basically suggests that he has no intention of having young people who are here because their parents came here, that somehow they should be kicked out. and certainly, if you are not going to kick out the young people, you shouldn't be kicking out their parents. >> tonight some parents say they are so afraid of what will happen when president-elect donald trump takes office they won't let their children visit the bay area from mexico.

kpix 5's betty yu explains. >> reporter: they were supposed to perform traditional mexican dances at three shows in the bay area next spring. but after donald trump's victory, this group of middle and high school students from oaxaca cancelled their trip to palo alto. >> i think it's fear of a mom or dad thinking that it's their child up here and they are 4,000 miles away and what's happening here is something that they have no control over. >> reporter: bob wins slow president of the neighbors abroad a nonprofit that acts as a liaison to palo alto's sister city of oaxaca. the dance troop school sent this letter canceling the trip saying the parents don't know what had happen under the new government and are not prepared to risk sending their child. >> of course they know palo alto is a safe community. but this overlay of the recent election has created a lot of doubt. >> reporter: the proceeds from ticket sales would have raised

about $10,000 u.s. to benefit an orphanage in mexico. neighbors abroad is also uncertain about whether it will send palo alto students to oaxaca as part of the cultural exchange. >> our presidential election shouldn't affect programs of the arts. >> reporter: in palo alto, betty yu, kpix 5. >> after keeping tabs on california politics for nearly 7 decades the san francisco- based field poll is shutting down. the announcement comes less than 2 years after the death of founder mervyn field. he established the poll in 1947. since then the nonpart sin poll has done more than 2500 telephone surveys on everything from the governor's race to presidential picks. it will stop operations in early 2017. and still to come, the storm may have rained on their parade. but it couldn't dampen that are enthusiasm. we'll take you out to a soggy santa claus. >> and how a simple q-tip could soon help police get a lot of stoned drivers off the roads. ,,,,,,,,,,,,,,
