live from the cbs bay area studios, this is kpix 5 news. a courtroom battle over zoning laws comes to an end. the multimillion dollar lawsuit against the academy of art was just settled. it could have an impact on other prime real estate in san francisco. good afternoon. i am anne makovec in for kenny choi. >> i am michelle griego.

we are following breaking news. german media reporting multiple injuries in a crowded christmas market. this is a live look at the scene. a truck has slammed into a crowd. german police believe it was intentional. we know many people are hurt. there are reports at least one person was killed. the video we are watching -- we do have some video that shows people lying in the street with the ems crews working to treat them. we will continue to follow this story and bring updates. new details after a multimillion dollar settlement involving housing in san francisco. kpix 5's jackie ward is outside the academy of art university which has agreed to pay the city $60 million. >> reporter: the city attorney's office calls this the biggest settlement in san francisco history in a code enforcement case. city attorney says the academy

of art risk asking for forgiveness instead of at first asking for permission. this agreement took months to reach in this fight has spanned across a decade. the academy of art university will pay $20 million in past penalties and fees. this deal will also require the academy to provide at least 160 units of affordable housing valued at an additional $40 million. it will be 18 months before the units are converted from illegally set up dorm rooms to apartment units people can live in.>> this was housing the san franciscans desperately needed in the midst of an affordable housing crisis. now, through our efforts, this company has finally agreed to be part of the solution rather than a major contributor to the problem.>> less than an hour later, the academy's lawyers held a press conference of the road. they're pleased with the agreement but they believe there is one major detail that is getting lost in all of this and that is the fact that the academy applied for proper use changes for its buildings in

2007. their attorney believes the academy has been demonized for nine years.>> the academy has resolved its outstanding issues in a way that makes it a very good neighbor in this community. one thing that i learned is how desperate the situation for affordable housing is in the city of san francisco.>> reporter: the academy is the largest drive it accredited art and science university in the nation. 8700 students in 2000 artist and staff in the city. 33 buildings will be authorized now. no one from the academy was at the press friends -- west conference. -- press conference. in san francisco, jackie ward, kpix 5 news at noon electoral college members are meeting to cast their ballot to officially elect donald trump as the next president. 55 members in california are

voting. a met with protests outside of the capital this morning. demonstrators want the electors to vote for candidates other than trump. they're push as part of a nationwide campaign to block his path citing russian influence in the election. protesters are marching outside several state capitals. here is a look at what is happening in madison, wisconsin. here is austin, texas in phoenix, arizona. many people marching, chanting and holding signs. the signs read "vote your conscience." >> reporter: despite all the protests across the country, to try to convince electoral college members to vote for anyone other than donald trump will not work. mr. trump is set to become the next president of the united states. we are also learning that one of the electors in maine tried to switch his vote to bernie

sanders. bernie sanders is going to get at least one of the electoral votes from that state but now we are hearing that it was improper and it might not work out for him.>> reporter: voters the electoral college are casting their ballots for president. >> all 11 votes have been cast for donald j trump. >> reporter: president-elect donald trump won 306 electoral college votes on election day. it takes 270. it takes 272 win. -- 270 to win.>> reporter: some have been urged not to go for trump. an outside group paid for this television ad featuring celebrities asking you mentors to vote their conscience. >> it is about democrats that can't accept the outcome of the election. it is about delegitimizing the american system. it is not going to work.>> reporter: 29 states have laws requiring electoral college voters to vote the way their

state voted. in other states, they are free to change their mind. so far, texas elector chris super and is the only electoral college member to publicly say he won't vote for mr. trump. >> i think this is the first time in america's history where we have someone who is clearly unfit for office. >> reporter: donald trump spoke out against those pushing electors to change their mind. he tweeted "if my many supporters acted and threatened like those who lost election are doing, they would be scorned and called terrible names. the electoral college is expected to elect mr. trump president.">> reporter: a joint session of congress will officially certify donald trump as the 45th president of the united states on january 6. his inauguration is set for january 20. the first lady shares her thoughts on her eight years in the white house tonight in a special interview with oprah winfrey. she also talks about her

the bullets hit. the shooter, wearing a suit and tie wages gun in the air shouting his allegiance to the prophet mohammed and pledging to carry out jihad. he also reportedly shouted about aleppo and that syria will pay for its cruelty. the ambassador seen here with vladimir putin during a visit to turkey was rushed to the hospital but later died. the lease shot and killed the gunman who had fired at least eight shots and smashed photos in the exhibit as people ran for cover. the mayor of ingres said the assailant was a turkish police officer. russia has supported the syrian government in its long and bloody civil war putting the kremlin on the opposite side of turkey's position. moscow called the shooting a terror attack and said it is in contact with turkish authorities. riley carlson, cbs news, london.>> the ambassador's wife was reportedly hospitalized after learning of her husband's assassination. russian tourists in turkey had been advised against leaving their hotel rooms as a

precaution. it was a bitter cold morning in many parts of the bay area. people waking up to frost on their windshields and plants. some folks spotted sitting in their cars trying to warm up the engine. chp says what you see outside should inform how you drive.>> if you start to see frost on your windshield and on the side of the road, you need to be aware of what is going on. that frost often creeps up on to the roadways. >> chp says it is critical to take the time to scrape your windshield and defrosted the windows completely to make sure that you can see in all directions before you hit the road. elizabeth wenger in the traffic center tracking how low temperatures were today. >> reporter: they got below freezing in many spots. you had to scrape the frost off the windshield this morning. here is how it looks in the east bay. lots of sunshine.

very clear outside. this morning, the lows were in the 20s. santa rosa came in at 27. same with livermore. those were some of our coldest spots. napa was below freezing. san francisco and oakland, that is where we had a frost advisory. temperatures were on the mild side compared to the rest of the bay area. let's check those numbers right now. it looks like things are warming up. all the freeze warnings and frost advisories have been canceled. we are seeing 40s and 50s. this justin. the judge in the controversial case involving stanford swimmer brock turner has been cleared of any wrongdoing. santa clara county judge aaron persky was vilified by victims rights groups after he sentenced turner to six months in jail for sexual assault. the california commission on judicial performance ruled this morning there was no evidence that persky displayed biased in the sentence. persky is still the target of a national recall campaign.

more bay area headlines. a lot of people's holidays packages spilled out onto i-680 in danville this morning. a big rig leased by the u.s. postal service collided with another vehicle and overturned just before 3:30 am. the driver was killed and this is the mess left behind. most of the southbound lanes were closed through the morning commute. another fatal crash in the south bay. a woman pushing a shopping cart was killed crossing the lawrence expressway at cabrillo avenue at about 6:30 am. the driver of a pickup that hit her state at the scene and is cooperating with their investigation. still ahead, the clock is ticking. what you need to know to make sure you don't get find in the new year for not having health insurance. the last-minute mail rush is on. have you sent all your holiday cards and gifts? the deadlines you will need to know for those packages to get to their locations on time. cracking down on charging station hogs. the action tesla is planning to

we want to return to our breaking s the show... we are continuing to follow breaking news in berlin. we want to return to our breaking story from the top of the show. this is a live look at the center in berlin where a truck has plowed into a crowded christmas market. cnn is reporting multiple people died. at least 15 injured. this is a live look at the scene. apparently this is a market in the center of the capital city of germany. this market is put on every year. more than 100 market stands are out there. christmas booths as well. this

center has a lot of people in it at this time. we're just getting word that german police believe it was intentional. the driver is still at large on the video we are monitoring shows people lying on the street. emergency crews are attending them. we will continue to follow this story and bring you updates as we get them. and healthwatch, you now have a little more time to find health insurance. the covered california deadline has been extended until midnight tonight. this is in order to align with a new federal deadline for healthcare.gov. president-elect donald trump vowed to repeal the affordable care act but it has not deterred people to sign up. more than 196,000 people have signed up during the current covered california open enrollment period. today is expected to be the busiest mailing day of the year for letters, cards and holiday packages. according to the u.s. postal service, it will also be there busiest online day. overall, the postal service anticipates 750 million packages will be delivered this

holiday season. that is 12% higher than last year. make sure your deliveries arrive by christmas, here is what you need to know. tomorrow is the deadline for first-class mail. wednesday is the deadline for priority mail and friday is the last day for priority mail express. this afternoon, millions of americans are in an extended deep-freeze as arctic air in subzero wind chills shatter records from coast-to- coast those frigid and icy conditions are blamed in about one dozen deaths on the nation's roads and highways. several flights have been canceled and also delayed. here is a live look at the sierra where the snowpack has been building the last few weeks. great news for ski season. elizabeth wenger is in the weather center tracking our forecast. >> it was definitely a cold one today. well below average in some of our inland locations. the valleys got very cold.

definitely jacket weather out the door. some temperatures are below average. they will stay that way all afternoon. right now, you can see we are mainly in the 50s. a couple of 40s out there. santa rosa has been a cold spot all day. satellite and radar shows this weather story. a ridge of high pressure is firmly in place. it is keeping us high and dry. we will not see a major rain event in the next several days. a few high clouds are possible off and on over the next few days. plenty of sunshine. that is what we will see. temperatures about 5 degrees below average today. another clear and cold night tonight with some frost possible. the week is looking mainly dry and mild. by midweek, things start to turn around and we see temperatures more seasonal. it felt really cold out there for a while now.

ny took to it tesla cracking down on drivers who hog power stations. the electrical company took to its blog to make the announcement. drivers who failed to remove their car within five minutes of filling up on power will be charged $0.40 per minute.

right now, stations are free to use but tesla recently announced that starting the new year, drivers will be charged a small fee. airbnb is looking to add a new flight booking tool for its customers to use. this comes as the san francisco- based company looks to complete with priceline and expedia. bloomberg reports that airbnb is considering buying an already established online travel agency or licensed data from a provider. let's take a look at the big board. the dow jones is up 22 points. we will be right back. ,,,,,,,,,,,,,,,,,,

people are dead and as many as 15 injured at a crowded berlin christmas we are following breaking news in berlin, germany. we are hearing nine people are dead and as many as 15 injured at a crowded berlin christmas market. a truck driver intentionally drove into the annual market in the center of the city. it is attended by thousands this time of year. the driver is still at large and investigators at the scene are calling it an act of terror. we will continue to follow this story and have more tonight at 5 and 6. thanks for joining us for kpix 5 news at noon.
