[ screaming and crying ] [ punching ] >> stop! >> reporter: the four minute video ends with the victim's screams but it starts -- >> get away from me! get away! [ crying ] >> reporter: with the woman pleading to former nfl player ray mcdonald to leave according to the woman's attorney. the driver can be heard trying to calm her down. >> leave me alone! [ sobbing ] >> we're leaving. >> i find that video one of the most horrifying i have seen in 46 years of practicing law. >> reporter: robin is the woman's attorney.

she says the video and pictures of bruises on her face and legs obtained by kpix 5 show a history of abuse at the hands of mcdonald. >> she just wanted to document what her condition was but there were many, many other occasions when he had bruised her. >> reporter: she says the video from may 2015 when mcdonald used the key to get into the apartment he rented for his child and girlfriend. police would later charge him with domestic violence and false imprisonment. but a grand jury never indicted him. and the charges were dropped. why do you think she felt the need to record this moment? >> oh, that was definitely self- defense because the fact is battered women simply are not believed. >> my arms, what are you doing? >> reporter: the couple now going through a custody battle over their child. and robin fighting for a win for her client. she fears the justice system may favor a sports celebrity

[ screaming and crying ] >> stop!! >> reporter: what you don't see in the video is mcdonald allegedly lunging for her. this week they are asking for an emergency stop of visits between mcdonald and his son because they say that mcdonald has a dog that has a history of violence. live in san jose, maria medina, kpix 5. mcdonald is due in court next month in a separate case. he was indicted last year in that case in the alleged rape of an intoxicated woman at his home back in december of 2014. mcdonald's attorney is trying to suppress cell phone video and surveillance video from the night of that alleged incident. at least one of the suspects accused in a christmas eve murder at a target in hayward is expected in court this afternoon. police say two brothers stabbed tyrone griffin to death in the

toy aisle right in front of his kids. griffin's family says he was attacked after asking the two men to turn down some inappropriate music on one of their phones. >> when you see a child there and christmas eve people were shopping and you want to play some provocative music that's inappropriate, just turn it down. just turn it down. like my husband's life could have been spared. >> police have not released surveillance video from the target store. the suspects have been identified as 22-year-old frankie archuleta and 25-year- old jesse archuleta. they are expected to face murder charges. the search is on for suspects who allegedly rammed into a hayward police patrol car before leading deputies on a high-speed chase. investigators say three suspects broke in a motorsports store and when police arrived, they rammed into their patrol car with a stolen u-haul. police chased them down interstate 880 and into west oakland where the suspects ditched the truck. officers were able to catch and arrest the driver but the over two us is -- other two suspects

got away mangled metal that's all that's left after a wrong-way crash in san jose. it and around 3:30 -- happened around 3:30 this morning on southbound 280. this car overturned on the shoulder of the freeway. police say the driver lost control going against the flow of traffic. no word on the condition of the victims. investigators are now trying to figure out what happened. a series of earthquakes in nevada jolted people out of bed hundreds of miles away here in california. two 5.7 quakes struck within minutes of each other near a thorn around midnight followed by a -- near hawthorne about midnight followed by a 5.6 an hour later, felt in tahoe and central california. >> i was sitting on my bed watching tv and i felt my bed move and i was, okay, it felt like an earthquake. it like freaked me out kinda. >> no major damage was reported. new photos and video from north lake tahoe show flames

tearing through a homewood mountain resort. the fire was responded to at 3 a.m. three different fire departments worked. no one was hurt. the popular ski resort is closed for the day. it's not yet clear what caused the fire. and new at noon, secretary of state john kerry just made his pitch for peace in the middle east. craig boswell reports it was a speech that israel criticized before it was even delivered. >> reporter: secretary of state john kerry laid out his vision for peace in the middle east. >> the two state solution is the only way to achieve a just and lasting peace between israelis and palestinians. >> reporter: but kerry's plan is not likely to be welcomed in israel after the u.s. recently chose not to veto a united nations resolution condemning israeli settlements in the west bank and east jerusalem. >> the vote in the united nations was about preserving the two state solution.

that's what we were standing up for. israel's future is a jewish and democratic state living side by side in peace and security with its neighbors. >> reporter: it's not just israel opposing secretary of state john kerry's ideas for peace in the middle east. president-elect donald trump is also criticizing the obama administration. >> probably going to take quite a different position on things like israeli settlements on the west bank or whether the u.s. embassy ought to be moved even whether there ought to be a two- state solution within the palestinian state. >> reporter: wednesday morning, president-elect trump tweeted we cannot continue to let israel be treated with such total disdain and disrespect. they used to have a great friend in the u.s., but not anymore. the beginning of the end was the horrible iran deal and now this u.n. stay strong, israel. january 20th is fast approaching. craig boswell, cbs news, the state department. a jerusalem housing authority signed off on a new settlement housing in east jerusalem yesterday. the committee approved construction of a four-story building for jewish settlers.

meanwhile the obama administration is close to announcing measures against russia for allegedly interfering in the u.s. election. the "washington post" reports economic sanctions and diplomatic censure may be on the table. officials say that russia hacked democratic organizations and targeted state elections systems in order to help donald trump win the white house. russia denies involvement. president-elect donald trump has made two more appointments to his team. julianna goldman reports that his choice for homeland security secretary may be welcome news for republicans who want to see a tougher approach towards russia's president. >> there's no doubt in my mind that russia hacked into our political systems. >> reporter: senators lindsey graham and john mccain believe the president-elect will have to acknowledge russia's efforts to interfere in the u.s. elections. >> i think he will be presented with the overwhelming evidence, change his view. >> at the hearings we're going to put sanctions together that hit putin as an individual and

his inner circle. >> reporter: they may have an ally in the trump administration. thomas bossert has an expertise in cyber issues. he will be considered equal to the national security adviser general michael flynn. according to a state from the trump transition bossert will focus on domestic and transnational security priorities while flynn will focus on international security challenges. >> the time is now. >> reporter: following last week's u.n. security council condemnation of israel's west bank settlements, mr. trump has announced a new international negotiator. jason greenblatt a business lawyer with mr. trump for 20 years was also a campaign adviser on israel. the president-elect said greenblatt has a rift of negotiating substantial complex transactions on my behalf. something that may appeal to republicans like lindsey graham. >> i'm very encouraged that under president trump, israel is going to get a better deal.

now. new numbers are out showing how much americans spend on healthcare based on their medical conditions. diabetes was the most expensive with people spending $101 billion on diagnosis and treatment. spending for heart disease reached $88 billion. and for low back and neck pain, $87 billion. the research was published in the journal of the american medical association. and a new study finds hospital intensive care units are being overused. icus typically deliver the most expensive invasive care in the hospital. ucla researchers looked at about 800 hospital stays and found more than half of the patients actually may not have needed that level of care. several million americans suffering from tremors making simple tasks difficult. but marlie hall shows us the new treatment may give them a steadier hand. >> reporter: alexandra says it takes an unsteady hand to

appreciate a steady one. >> this is the new and improved imperfect hand. >> reporter: the 52-year-old woman suffers from essential tremor a neurological disorder that causes involuntary shaking. she says it's affected every aspect of her life including her work. >> taking a glass of wine or sparkling water from a tray at a party, being able to take a picture with my iphone, just so many basic, basic things. >> reporter: alexandra was one of the first patients to receive a new fda-approved treatment for essential tremor. a doctor from weill cornell medical college says a noninvasive device targets the part of the brain causing the shaking. >> what it does is allows to us send ultrasound waves to specific spots in the brain and actually change the way the brain functions. >> reporter: patients have reported a nearly 50% improvement in their tremors. the procedure can only be done on one side of the brain so alexandra chose the right sides of her brain because she is left-handed.
