hospitalized after they were hit by a train before a scheduled gig in oakland. kpix 5's anne makovec joins us live from oakland, where the accident has stunned fans of "tower of power." anne. >> reporter: yeah. the two are recovering here at highland hospital this afternoon. [ jackhammer noise in the background ] >> reporter: everybody is cautiously optimistic about their condition after they were hit by a capitol corridor train last night. ♪[ music ] >> reporter: this is the "tower of power" earlier this week performing at yoshi's in oakland, the same venue that two band members were headed to when they were hit by an amtrak train last night. it was going about 25 miles an hour. bassist marc van wageningen who was filling in with the band and drummer david garibaldi one of "tower of power"'s founding members. the two were walking from their waterfront hotel near jack london square to yoshi's for a gig that started at 8:00.

it was just after 7:30 when they crossed the train tracks, first waiting for one train to pass, and then being hit by a second train going in the opposite direction. >> we don't know if they didn't hear the train or -- we don't know how the tragedy happened. >> reporter: yoshi's as manager came out and called 911. >> the band is, you know, emotionally destroyed. >> reporter: last night the leader of "tower of power" emilio castillo went to see them in the hospital. he said dave's head and face were swollen and bruised but he was lucid and expected recover. marc was in intensive care came through surgery well and were waiting to do further testing. ♪[ music ] >> reporter: the band was formed in oakland in 1968. they played at venues and have die-hard fans all over the world. last night, pop star sheila e. tweeted, please pray for my friends. the "tower of power" members hit by a train in front of

yoshi's in oakland. as far as the investigation into this accident, we're waiting to hear back from union pacific railroad which has jurisdiction over the railroad tracks. live in oakland, anne makevoc, kpix 5. floods now health hazards. maria medina is in hollister where they are being told, don't drink the water. >> reporter: one day after the storm moved out officials began knocking on doors here handing out bottled water warning people their well water could be contaminated. this person and his neighbors on lovers lane are trying to get back to their lives after this week's storm flooded hundreds of acres of farmland, stranding livestock and damaging homes. >> at 3 a.m. i was woken up. >> reporter: the rising water that took over his street and the crews who rescued nearly 50 people were something john had never seen. his family has lived here for a long time. >> just turned cars. >> reporter: it was that strong. >> and deep, yeah.

>> reporter: now san benito county workers fear sewage and agricultural runoff, pesticides and anything else from the flood could have gotten in their drinking water. and the pacheco creek flooded and broke the levee. >> i guess you can't boil it, either, that's what i heard. you can't even boil it to drink it. >> reporter: about 100 homes may be affected including lovers lane where john lives. as the clean-up continues, they know there's another round of rain just around the corner. >> my grandparents live down there. i have several neighbors here. so if they have anything -- any problems, we'll help each other out. >> reporter: the water could be so contaminated that people are being told not to even give their livestock water. there's no timeline on when the water could be safe again. in hollister, maria medina, kpix 5. the san benito county workers say that one well is still under water. they plan to go door to door to give updates to homeowners until they believe that the water is safe to drink again.

it's a welcome break at the russian river. floodwaters are receding in guerneville and monte rio where dozens of homes were flooded and hundreds were evacuated. the river peaked at nearly 38 feet about 6 feet above flood stage. in the say, the slopes are coated with fresh powder in the sierra after the storms rolled through earlier this week. this is a view from the ski lift at sugar bowl. it old back up today. this weekend sierra ski resorts hope to bring in big crowds but beware, i-80 is open but chains are required. new at noon, san jose police are investigating a deadly shooting in the east foothills. this marks the city's third homicide of the year. it happened just after 6:30 this morning near mount pleasant road and columbia drive. that's right across the street from robert sanders elementary school. as police arrived on scene, they found a man who had been shot. he later died at the scene. no arrests have been made. and the motive for the shooting is unknown. a man beaten by a police officer is suing san francisco and the officers involved.

the suit claims that brandon search son's civil rights were violated during the incident back in december of 2015. simpson was facing gun possession charges but they were dropped after surveillance contradicted prior testimony by one of the officers. today a judge is expected to rule whether the man known as the pillowcase rapist should be recommitted to a state hospital. christopher hubbart was declared a mentally disordered sex offender after several rapes in the bay area. over decades he has been in and out of prisons and state hospitals. today's decision is in response to violation of release. a driver in arizona is being called a hero after he saved the life of an ambushed state trooper. the vicious attack happened yesterday off a remote interstate west of phoenix. the state trooper edward anderssoh stopped to help at an accident scene and as he was laying out flares on the freeway a man pulled up and opened fire striking the officer in the shoulder. the suspect then got out of his

car and started beating the officer. >> the suspect is getting the better of the trooper and on top of him striking the head on the pavement. >> officer down! officer down! come in, please! this is a civilian! >> reporter: another driver saw what was going on and shot the suspect. the hero driver then called for help and even ordered a helicopter to transport the officer. the suspect died and the officer is in serious but stable condition. donald trump is blasting a report from a former british intelligence officer that contains unverified allegations about the president-elect. mr. trump took to twitter today calling the british man behind the report a, quote, sleazebag. he also hammered home the point that he believes that u.s. intelligence released the documents even though they know they are false. comey briefed trump last week

but didn't detail the allegations in the 35 page report. >> democrats are going to say if you were public about your concerns about hillary clinton's emails, why weren't you equally public with your concerns about russian hacking and potentially help to the trump campaign at the same time? >> the director of national intelligence says that the report was not produced by the u.s. intelligence community and doesn't believe the leak originated there. house speaker paul ryan is softening his stance on deporting illegal immigrants. trump's campaign promise came up last night during a town hall meeting. >> if you are worried about some deportation force coming knocking on your door this year, don't worry about that. >> ryan supports trump's promise to withdraw federal funding from sanctuary cities. san francisco is one of about 300 cities labeled as a sanctuary city. the cities are policies to protect illegal immigrants. a heartfelt letter penned by the bush twins to sasha and malia obama is going viral.

in it they say the transition from the white house to civilian life can be hard but the best years are ahead. roxana saberi reports. >> reporter: the twin daughters of president and laura bush wrote a letter to the obama girls full of reflections on the past and advice for the future. jenna and barbara bush have had eight years to adjust to life after the white house. their published letter to the daughters says you're about to join another rarified club, one of former first children, a position you didn't seek and one with no guidelines. sasha obama is now 15. malia is 18. the age the bush sisters were when they moved into the white house and into the glare the national spotlight. they made headlines with their partying as college students. now in their 30s, they are able to look back with humor. they wrote to the obamas to enjoy college, most of the world knows we did. malia heads to harvard in the fall. she was in tears this week when her father had a special message during his farewell

violated the constitutional rights of residents for years. new at noon a new justice department report states that chicago police have violated the constitutional rights of residents for years. the report finds that the department allowed officers to use racial bias against blacks. officers are also accused of using excessive force and shooting people who didn't pose an immediate threat. attorney general lynch says that the year long investigation lays a difficult but necessary groundwork for a safer chicago. new at noon, republicans in congress are moving forward with a plan to dismantle obamacare. a procedure vote was approved this morning even though there's no replacement plan yet. the bill orders senators to come up with a plan by january 27 to fully repeal obamacare.

a final vote in the house is expected this afternoon. republicans are under pressure from president-elect to repeal obamacare as quickly as possible. experts are making progress in pinpointing the cause of a bad odor that swept through san francisco and richmond. experts have now ruled out ship and oil spills as sources but are still trying to find what caused it. several people called and complained for two days about the rotten egg smell last month. crews are now focusing on nearby landfills, waste water plants, and the chevron refinery. the marijuana industry is getting a boost from some big name celebrities after voters legalized pot in the state. stars like whoopi goldberg, rapper snoop dogg and musician melissa etheridge are introducing their own marijuana brands are labels and logos. in addition, some law firms and marketing agencies are promoting new pot related services like helping marijuana sellers brand their products. >> time for a check of weather with roberta.

>> we have the abundance of sunshine from the coat to the bay and peninsula into our inland areas. good afternoon, isn't this a spectacular view? one of my favorite weather features happens to be with the passage of a cold front and look at what it did! it dumped snow on top of snow and this is the scene right now at kirkwood. actually, this morning. those were the first trackers. they got out there bright and early. but at the very tip-top windy conditions at elevation 8,000 feet and it feels like a blizzard up there with the blowing snow. live weathercam looking out towards the bay bridge this afternoon but we have unlimited visible. the sky is blue. barely a breeze at this time. winds will pick up out of the northwest 5 to 15 later this afternoon but it is brisk. it's chilly. temperature only at 49 degrees in oakland. 51 in santa rosa after dipping down to 36 degrees early this morning. haven't seen any kind of temperatures in quite some time because we had the warmer a all associated with that atmospheric river. remember it was balmy when it

was raining and yesterday the cold front came through. now bright blue skies unlimited visibility. but we have more rain in the forecast, not for the holiday. see this fetch? is goes all the way back to the hawaiian islands. this is a blocking ridge of high pressure. this was over the bay area winter after winter after winter leaving us with drought conditions. it's back for now until the area of low pressure knocks it out of the area. today, right now, at this time, 44 going up to 52 in fresno. it is 31 going up to 32 degrees on the south and north shore. we have snow flurries in the sunday forecast. that's it. 55 today monterey bay. your tahoe forecast getting away on this friday, currently again, we're talking about temperatures in the 30s. over the weekend in the 30s, as well. it's going to be a brisk cool time in the high sierra with rain arriving by tuesday snow

the year. if they have had to be outside give them shelter to keep them warm and dry. if the dog is normally indoors and has in nice big coat, one of the things that happens is their fur on their paws keeps them protected especially during snow. i think right now i'd like to talk about snow. that would be good. so it's better to acclimate your dog to snowy weather. you can't just take them out. it's not a good idea to just stand around. you want to walk with the pet and then come back in as soon as possible. if you do have a pet that doesn't have this nice beautiful, you know, fur coat, then make sure that they wear some sort of protective coat that covers their abdomen so they're protected. >> what about the rain? so many of our viewers are dealing with the rain now and pets. >> well, so, um, i -- i kind of am old school. i tend not to use raincoats for my own dogs but i know people like to do that. and there's no harm in doing that. it certainly keeps them drier when you get home. but unless it's super freezing cold that's not as big a problem. but i have learned something
