washed out... and hillsides are sliding down... wi now at 11 a reservoir spills over its banks. hillsides are sliding down. with california still recovering from the last storm. another one is right on its heels. good evening. i'm juliette goodrich. >> here we go again. a live look outside, clear and dry right now but just wait. later in the day a much different story on sunday. we've already got flood watch is posted for tomorrow night through monday night throughout the entire bay area with heavy rainfall coming. river flooding possible. gusty winds will develop. debris flows, power outages, like i said here it comes again. pushing out of the pacific northwest. through the bay area rain and wind persist through monday. so we've got to keep our eye on

light rain that develops early tomorrow. most of the day tomorrow will be okay. the heavy and steadier rain begins tomorrow night and flooding potential develops as rain continues through monday evening. meantime some bay area roads washed out because of the storms. gaping holes and now with more rain on the way, kpix 5's cate cauguiran shows us the scramble to get ready again. >> reporter: caltrans has crews working around the clock doing emergency repair work. right now we are on highway 37 which is currently shut down to the public. >> we have a lot of areas that are heavily impacted. >> reporter: storms passed forced caltrans to shut down a major section of highway 37. but the work continues. >> we are currently paving and grinding 24/7. continually doing filling with lightweight materials to minimize settlement in the area. >> reporter: highway 35 is another major area of concern.

caltrans teams spent yesterday assessing the work that needs to be done in anticipation of more rain. >> we put in place some rails as well as some traffic controls. we're looking at that area working even with the residents in the area. trying to contact them to get a dialogue going. >> reporter: for them it's a twofold operation. construction and maintenance. first priority is safety. caltrans says a major issue, people stopping by repair sites and getting in the way of critical work. >> people want to see something but it would be great if they could stay out and make sure they are safe. >> reporter: with impending storms there may be a possibility that crews will have to stop work and that would be for the safety of the people on site. and for the people who live in the area. on highway 37, cate cauguiran, kpix 5 news. a rare sight. the anderson reservoir is overflowing for the first time in 11 years.

kpix 5's jackie ward has more on the rushing water getting a lot of attention. >> reporter: this is the talk of the town. and it's not hard to see why. people have been here gawking at it all day taking videos and pictures before it takes a turn for the worse. it is an incredible sight to see up close and personal. this outlet has been open for weeks and it was a bustling destination. at one point we couldn't find a spot to park in the parking lot. everyone waiting to see what happens. the anderson reservoir water level has surpassed capacity. six inches above the rim of the spillway. before even more storms are expected to bring a lot more water to this area. keeping this outlet open and pumping out 400 cubic feet of water per second is one of the only things they can do in an effort to keep the water level as low as possible. until the storm hits, the water district says there's not much that people who live in this area can do to prepare for it.

all they can do is get sandbags ready and move valuables in low- lying areas to higher spots in their home. in morgan hill, jackie ward, kpix 5. crews are busy draining a small town. rising waters in front of roads and homes, happened in the town of maxwell early this morning 70 miles northwest of sacramento. alisa becerra spoke with one family who decided to brave the storm. >> reporter: sherry acevedo has to wade through ankle high water just to get to her front door. >> i was a little freaked out. they were evacuating her street. >> reporter: we caught up with sherry feeding livestock. she and her husband, four kids, two dogs three puppies and a cat live on north and elm just feet from the creek on masse well that crusted at 2:00 a.m. and poured into her neighborhood. she watched her neighbor evacuate. >> we could see the water was up to their knees.

they had bags on their back. and later to williams. >> reporter: sherry's family decided to ride it out. >> there was three feet of water surrounding the perimeter of my home. two feet of water in my garage and water coming up through the vents in the bottom of my floor. >> reporter: they watched the water riding and marked it on this flowerpot. >> the water line when the water came. and then this is the second and this is the third. so the water leveled out at this depth. >> reporter: just inches from the front door when they saw the water receding, they realized they were safe. they were lucky. the same can't be said for others. floodwaters poured onto i-5. track was raised in -- traffic was reduced to one lane in each direction during between maxwell and williams. a 10-mile stretch. now, farther north heavy rain

flooded this walmart parking lot in willows and glenn county. crews were busy working to drain all the water this afternoon. at least one vehicle got stuck. the damage -- more than four inches of rain since yesterday. >> a water main break and a flood at a historic cemetery. three large oak trees came down this morning. at the valley cemetery dating back to 1835. led to a water main break that intricate -- inundated the cemetery grounds and it took more than an hour to shut off the water. one of the most powerful storms in years has left behind a path of destruction. at least five people are dead after heavy flooding, mudslides sinkholes and strong winds in the area. a few people are lucky to be alive after they were caught in the storm. one woman got caught in a giant sinkhole in studio city. it swallowed her car and one other. engineers say the hole is stable but it could take several days to fix. >> there goes the car. there goes the car. >> reporter: the 20-foot hole

opened up last night. the first car plunged through it. firefighters were able to rescue her just minutes before a second car fell in. my car kept turning upside down. and i just was like i got to stay calm. i felt the water coming up and i opened the door and i climbed out. it's a miracle. thank you god. >> reporter: the driver of the second car was able to get out. update from oroville dam where fears of a spillway failure led to a big evacuation. crews from the state department of water resources are building a special barge that will carry machinery to dredge debris and sediment that accumulated below the main spillway. experts keep reducing the flow on that main spillway which has serious damage from erosion. lake level dropped more than 45 feet and repairs continue on the auxiliary spillway which was in danger of failing. a fiery crash in dublin.

officials say a man lost control of his pickup truck and pick -- flipped over. just before 8:00 on interstate 680. the driver was ejected before it burst into flames. he was arrested for dui. tonight a berkley middle school teacher is taking a stand against critics after she made national headlines for supporting a violent rally at uc berkeley earlier this month. kpix 5's andria borba shows us why she's not backing down. >> reporter: yvette doesn't stand much taller than this toddler. the diminutive middle school teacher has become the white- hot center of the fight against fascism. you might remember half her from a physical confrontation with neo-nazis at the state capital. or more recently when she appeared on fox news. >> this is about the lives of real people. >> reporter: defending the violent demonstrations against milo yiannopoulos.

it was that appearance on fox that led to calls and e-mails to berkley unified calling for her to be fired. >> you are a middle school teacher. >> we stand up together to make sure that we aren't injured. >> reporter: a national organizer for by any means necessary, bam. taking a stand against president trump and what they see as a burgeoning fascist movement in the u.s. >> what we mean is to build a new civil rights and immigrants rights movement to take collective united action and also to defend ourselves when racists try to violently attack us. >> reporter: on the campus that birth the free speech movement the goal is to make yiannopoulos doesn't make another appearance. >> if there is a convention of mass murderers on this campus, and their aim was to train other people on how to be mass murderers, we would think that it was in the public safety and good to have that convention shut down. >> reporter: with the promise of more confrontation in the future.

>> they will be defeated in the streets of berkley as well. >> reporter: at cal, andria borba, kpix 5. the fbi has been called in to help solve a grisly mystery. human remains were discovered near point ray station last night. no word on identity or the cause of death. sheriff's investigators are treating it as a homicide. there is no danger to the public. a half-dozen people were detained after a four-hour standoff on treasure island today. started with reports of an armed robbery and led two suspects holed up in a home. officers finally located the suspects. five juveniles and a woman. they did not find a gun and investigators are still trying to sort out whether those -- whether there was a robbery. the battle to save obamacare is getting a jumpstart. democrats organized the national day of action and held rallies in san francisco. house minority leader nancy pelosi told supporters to contact friends and republican

district. one woman said obamacare saved her life by providing treatment for substance abuse. >> had i not gotten that care, i would not have had those years of productivity and possibly not even those years of life. >> other bay area democrats held rallies as well. look -- eric swalwell held a discussion in san leandro and barbara lee hosted an event in oakland. thousands of people gathered in florida for an appearance by president donald trump. he was there to rally supporters but okay miss opponents came out in force too. we have the president's message at the campaign style appearance. >> the president of the united states can -- >> reporter: after a month as commander-in-chief, president trump relished his return to campaigner in chief sticking to the familiar themes at the so- called make america great again rally in melbourne florida. >> it's now been one month since my inauguration.

trump administration. >> reporter: filling the position has been a challenge. robert harward turned down the post after the white house rejected his request to hire his own staff. cbs news learned that the administration is no longer considering former cia director david petraeus after he voiced similar concerns. cbs news melbourne, florida. president trump plans on issuing a new executive action on immigration in a matter of days. that's according to homeland security secretary john kelly. the original order that was blocked by federal judges was designed as a temporary pause. kelly says the president has a chance to roll out a new plan that ensures no one is caught in the system. however any new order is likely to be challenged in court. a bizarre security breach leaves a man dead at honolulu airport. the man forced his way through security checkpoint in the

airline terminal. he was quickly detained. then became unresponsive and later died at the hospital. authorities say he was not armed. no word yet on the cause of death. islamic cleric from egypt convicted of plotting acts of terror in new york city has died. or are -- omar abdul rahman was known as the blind shake. lead him to the bombing of the world trade center in 1993. he was found guilty of guiding a separate conspiracy. he died today in a federal prison serving a life sentence. he was 78. the woman at the center of the roe v. wade ruling has died. reporter roxana saberi looks back at the life of a woman whose lawsuit changed reproductive rights in the u.s. >> reporter: norma mccorvey died of heart failure in texas on saturday according to a journalist close to her. in 1969 she was pregnant for a third time when she tried to have an abortion in texas. where the procedure was illegal

except to save a woman's life. she sued under the pseudonym jane wrote. in 1973 the supreme court ruled that the constitution protects a woman's right to have an abortion until the point of viability. about 24 weeks into pregnancy. mccorvey revealed her name in the 1980s and became a hero of the abortion rights movement. but later she changed her views. >> born-again christian. >> reporter: spoke out against abortions. >> i started talking to the women. before they would go in for their abortions. after they would come out. and it was the same thing over and over. they all regretted it. >> reporter: efforts to overturn the 1973 ruling are heating up. with the election of antiabortion president donald trump and republican congress. >> as much as i'd like to see roe versus wade overturned, i don't know if it will happen in our lifetime.

or even in my grandchildren's lifetime. but it will happen. >> reporter: though mccorvey won the case she ultimately did not have an abortion. and gave her baby up for adoption. mccorvey died at an assisted living facility at age 69. roxana saberi, cbs news, new york. the countdown for the next launch resumes tomorrow morning. today's launch was scrubbed over concerns about an engine nozzle. the spacecraft named dragon is set to lift off from the same pad that americans used to fly to the moon a half-century ago. the mission will deliver 2.5 tons of supplies to the international space station. it is among the most difficult decisions a grieving family must face. picking a cremation service. consumer what reporter julie watts investigates a worst-case scenario and questions why one company is still operating without a license in california. >> this is a picture of jake. >> reporter: lisa kolten treasures these photos. her son died at 22 while skiing in boulder. she says what happened after

that devastating loss made the unbearable situation worse. >> i wouldn't wish it on my worst enemy. >> reporter: they searched the web to find a local service. they settled on heritage cremation. advertised as family-owned and operated trusted cremation services. a service they wish they hadn't trusted. >> horrifying. >> reporter: there were invoice errors. the company referred to jake by several different names including the williams family and sarah white. then phone calls went unanswered. they were charged extra fees and the unthinkable. jake's ashes went missing. >> they lost track of him for a week. >> reporter: forcing the grieving mother to return home without her son. there are dozens of similar complaints and scathing reviews online about heritage mixup and ashes held for ransom. the better business bureau issued a warning about the company in colorado. unlike most states it does not require a license. >> they are not here. >> reporter: however an

unannounced visit revealed no one from the company actually works there. turns out the most trusted cremation services in boulder is also the most trusted in san francisco, san jose berklee palo alto and the list goes on. they serve as a buddy broker collecting upfront fees from grieving families then subcontracting actual services to local funeral homes. >> they are misrepresenting themselves as a local business. >> reporter: the california cemetery and funeral bureau says they receive numerous local complaints about heritage which is operating without a license. they issued a cease and desist but when we called the company, they were still clearly operating. and assured they were licensed here in the state. >> what can you do for a company that is knowing your cease and desist and is still operating? >> there are further actions being looked at. >> reporter: california is one of five states that has taken recent action. the father-son duo behind

heritage has a long history. the elder joseph was arrested in 2002 for operating a crematory without a license and bringing bodies to lynn university for embalming practice without the permission of the families. his son tony was barred from the funeral business for 10 years. >> you do work for the company? >> reporter: tony told us he had no comment but previously told our miami affiliate the company will continue to serve families. something two years after her ordeal continues to torment lisa. >> i can't stand the thought of another parent going through this. >> reporter: the california bureau advises against searching for services online. they suggest asking a local trusted funeral home for recommendations for things like cremation services. they also advise you always check the company has a valid license by searching the bureau website. in the newsroom, julie watts, kpix 5. now to the weather. new video of a funnel cloud.

you can see slowly forming in the sky there. another perspective shown the funnel cloud looming in the distance in that shot. wet winter has brought a brownish color to san francisco bay. you've noticed storms have sent sediment from the sierra and soil from the central valley into rivers in that end of the bay. people taking part in a plunger for special olympics fundraiser say they noticed the colors. but they didn't mind. cold temperatures out there too. you don't have to take a plunge into the bay. stay tuned. light rain moving in tomorrow. and then it turns heavy by this time tomorrow night. bay bridge things look okay. partly cloudy skies. concord at 50, san francisco at 50 as well and santa rosa 48. on the kpix 5 high-def doppler, a few echoes lighting of the

radar. mostly on the north coast. much of it not hitting the ground. as we pick up light rain first tomorrow, and deeper low moves on the way from the gulf of alaska and the river of moisture coming from the tropics will be moving straight toward central california. los angeles got smacked but good yesterday. the storm track shifts to the north. rain and wind, light for most of the day tomorrow as you can see. futurecast shows sunday morning could be a heavy step in the north bay but much of the area gets away sunday. which is cloudy skies. the day goes on more light rain bay wide. four in the afternoon the focus shifts to the south bay. and then look at what happens sunday night and monday. rain coming down pretty good at times. then all centered over the bay area as the day goes on and continues to rain on monday. that means levels of water in the rivers is going to spike by monday night. that's why there's a flood watch posted tomorrow through monday night. high wind alert for the bay area. winter storm watch tonight turn into warnings in the mountains
