news conference in san francisco. >> reporter: yeah. and the news conference is just about to start. they are announcing a new lawsuit on behalf of the millennium tower homeowners association one of several pending lawsuits right now over sinking and tilting of the luxury tower. homeowners, the developer and government agencies are battling over san francisco's millennium tower, a luxury high- rise that has sunk at least 16 inches since its completion in 2009. another lawsuit now pending alleges millennium partners withheld information about the extent of the building's settlement from home buyers. and also names the transbay joint powers authority accusing it of improperly building on the adjacent property and contributing to the damage. the tower has what's called a prescriptive design which means it strictly follows current building codes without determining whether they will work. as a result, no study of the soil under the site was required. the city says the building is

safe to live in as is. again, we are to hear more from the lawyer on the suit by the homeowners association. we'll have more on that at 5:00 and 6:00 on kpix 5. anne makovec, kpix 5. we are following breaking news out of san francisco's oceanview neighborhood. officers responded to a shooting at broad street and plymouth avenue. a woman reportedly has life- threatening wounds and two men are also hurt. all have been taken to local hospitals. right now a search is on for a suspect and traffic remains closed in both directions on broad street. >> then i heard pow. and that first guy got shot. i didn't see him go down. i thought it was a cherry bomb. then pow pow pow pow pow pow. i jumped up and went in the back of the van. >> broad street is closed in both directions and muni has rerouted the m oceanview light rail line as well as the bus

line. breaking news in alameda county. part of redwood road has crumbled. this section is closed off right now blocking all access between castro valley and oakland. you will need to use alternates. this afternoon a south bay water district is holding a special board meeting to talk about the response to last month's floods in san jose. yesterday the board chairman said the city had all the information and warnings necessary but failed to act. chairman said: th of evacuations.. and caused 73- million dollars in damage. mayor sam liccardo says the city acted late b >> last month's floods forced thousands of evacuations and cost $73 million in damage. the mayor says the city acted late because it relied on erroneous projections from the water district showing the creek could hold more water before overflowing. the mayor also said in a statement, quote, this is not the time for bureaucratic finger-pointing, particularly

since the city has repeatedly accepted responsibility for fixing the problem." police in fremont say someone broke into more than 20 cars at a condo complex at via papillon on monarch terrace. investigators say in each case at least one suspect shattered car windows and rummaged through belongings. police didn't say what was stolen. a former hayward police sergeant is scheduled to be sentenced this afternoon for cheating a police informant out of more than half a million dollars. michael beale was found guilty earlier this month of nine felony counts of grand theft. police say he defrauded a woman who has mental illness. he faces up to eight years in state prison. a woman is under arrest in washington after refusing to stop her car for police and then almost hitting several u.s. capital officers. weijia jang reports. >> reporter: police with assault rifles patroled the capital wednesday morning after

a woman nearly ran over several police officers and hit a squad car. a brief pursuit followed. >> the vehicle was stopped at washington and independence avenues southwest. during the attempt to arrest the suspect, shots were fired. however, but no individuals why injured during the arrest. >> reporter: so far police have not released any information about the suspect in custody. officers say the investigation is in its preliminary stages. >> this incident appears to be criminal in nature with no nexus to terrorism. >> reporter: the area near the crime scene remains closed off but police say the u.s. capitol complex is open to the public. weijia jang, cbs news, washington. this afternoon, the house intelligence committee's investigation into russian interference in the presidential election is in disarray. democrats are calling on the committee chairman to step down. craig boswell has the latest from washington. >> reporter: the white house insists it didn't try to stop former acting attorney general

sally yates from testifying to congress about national security adviser michael flynn's conversations with russian's ambassador to the u.s. >> we encouraged them to go ahead but to suggest in any way, shape or form that we stood in the way of that is 100% false. >> reporter: cbs news obtained this letter from the justice department to the attorney representing yates. it warns that there is a limit to what she can reveal in her testimony and that she needs to consult with the white house. the same day she received this letter. the chairman of the house intelligence committee devin nunes canceling her scheduled testimony. >> the timing certainly raised questions about whether the white house preference had a lot do with changing where this investigation was headed. >> reporter: chairman nunes, who worked on the trump transition team, went to the white house last week to view reports he says shows intelligence agencies collected information on trump transition team personnel. >> he had met with people who are cleared to discuss classified information regarding a review that conductching that's how it

works. >> reporter: senate democrats on the intelligence committee say congressman nunes didn't need to go to the white house to view the reports. >> there's a story yet to be told about where this intelligence came from. did it come out of the white house? >> reporter: the senate intelligence committee will hold its first hearing into russian interference tomorrow. craig boswell, cbs news, capitol hill. the latest cbs news poll out today shows 59% of americans surveyed believe it's likely that trump associates him proper communication with the russian government. the white house press secretary and a fox news host are taking criticism for demeaning comments about two black women. sean spicer made his comments while talking to a journalist. >> it seems you're hell bent on the image you want to tell about this white house - [ simultaneous speakers you were asking me a question and i'm going to answer it, which is is the president.

lookout for two makeup thieves. they say these two women stole a bunch of cosmetics from the concord avenue on new at noon concord police are on the lookout for two makeup thieves. they say two women sold cosmetics from the walgreens on concord avenue sunday afternoon. when an employee tried to stop them, he pushed her aside and got away after stealing cosmetics. new rankings are out and several bay area counties are among the healthiest in the

state. kpix 5's maria medina looks at the factors putting san mateo county in the number one spot. >> if i miss a day, i'm guilty. so i have to go to the gym. >> reporter: meet carl martin, now guess his age. how many times would you say you exercise per week? >> three to four. >> reporter: his age in just a few seconds. we met carl and his wife, maria graciela on the way out of the gym. they say exercising is priority and work out every other day. >> and how do you feel when you exercise? >> oh, my gosh, just feel alive. >> reporter: and he says notes surprised the county he lives in, san mateo, is now ranked the healthiest county in our state. >> it's amazing. even in redwood city. the gym -- i haven't been there but my wife has been there and it's always packed. >> we're proud of of this acknowledgment. >> reporter: the san mateo county health system deputy chief says there are many reasons why they are number one including economic prosperity. >> income and wealth affects opportunities for health and it

customer trust after recalling its previous model because of exploding batteries. new video this afternoon of a great white shark off the california coast. it was spotted swimming about 1400 feet off the manhattan beach pier and near some surfers today. this is a juvenile shark about 8 to 10 feet long so don't be scared, roberta. >> yeah. 8 to 10 feet? okay. all right. i won't be scared at all. won't get into the water just as of yet, though. all right. speaking of water, it's getting choppy due to the increasing winds out there. small craft advisory now in place just outside the gate. good afternoon. this is a view -- can you see the flag on the fly just outside pier 9? the winds are picking up out of the northwest. we have westerlies blowing up to 21 at sfo. this is a gorgeous view. wow! isn't that lovely? you can see all the way to mount diablo. a little sea haze out there.

temperature-wise, we are at 70 in redwood city. livermore now 68. san jose 69. winds again continuing to blow out of the northwest 10 to 20. right now they are fluctuating around north to northwest at 8 in redwood city, 13 half moon bay, westerlies in san ramon. now in napa at 7. winds get gusty later on tonight due to this right here, it's a weak disturbance but it's on approach. we have a pressure gradient difference it's banks up against the ridge of high pressure dominating our weather right now. we have a little bit of light rain around the northwestern section of the state of california and it's churning up our swells. we have sneaker waves onshore and rip currents. beach hazard statement in the yellow area to monterey bay. high pressure in command but low pressure will provide us with increasing clouds throughout the night. did you see that go by very quickly? in the overnight hours, between about 2 and 5, 6 a.m., a
