higher rates for people with preexisting conditions but only if the state sets up high risk pools to help with the cost. >> oh no, it is still in there, but the insurance company can charge you whatever you want. you have cancer, oh, that will be $100,000 a year for your policy. >> reporter: democrats say republicans are rushing to pass the bill without waiting for the independent congressional budget office to assess the impact of the plan. >> what's the rush? wait a week and get a cbo score. why is that such a radical idea? >> reporter: republicans say something has to be done because they claim obama care is broken. >> that is why we have to make sure. they don't even have healthcare. >> reporter: the house bill will have to go through considerable changes in order to get the 51 votes needed to pass the upper chamber. immediately after the bill passed here, republicans shuffled into buses headed to the white house where the

president tweeted there will be a ceremony in the rose garden. but, as lawmakers left here, they faced hundreds of protesters who were shouting at them shame, shame, echoing democrats like nancy pelosi who calls this measure a moral monstrosity. we are live on capitol hill, weijia jiang, kpix5. within the last hour, we have learned jury deliberations are underway now in the case again case against the man who is accused of kidnapping and murdering sierra lamar. >> reporter: this case we have been watching for five years is now in the hands of 12 men and women here in san jose. a lot of the case is built on circle evidence. the burden of proof is on the state. the defendant in this case garcia-torres is charged in the case of capital murder in the case of sierra lamar.

chef disappeared on her way to school in morgan hill in 2012 and her body has never been found. the prosecution really tried to highlight the forensic evidence including her clothing fibers found in his car, her hair on a rope in his trunk and his dna on her jeans. the real challenge for the prosecution is that there is no body and there is no crime scene, but today, the prosecutor said i do not have to prove to you the manner in which miss lamar died. just that the defendant is the cause. now, we got a chance to hear from sierra lamar's father outside of the courtroom here today. >> it has been a long trial. it is just the blink of an eye compared to how much time we haven't had sierra with us. so, it is not anything. now, we wait. and, we pray and we hope for justice for sierra. >> reporter: garcia-torres is

also accused of trying to kidnap three other women in 2009. the defense says while they may have been botched robberies instead of alleged abductions, the defense does not want that to weigh in on the jurors' minds for the sierra lamar murder case. the defense has also repeatedly tried to cast doubt on the dna evidence saying it may have been tampered with. they suggested that sierra lamar was unhappy at home and simply ran away. the defendant has pleaded not guilty to all charges though he has never spoken in his own defense. anne makovec, kpix5. >> what do we know about the jury, anne? >> reporter: it is seven women and five men. most of them middle-aged. i could only count three i would really consider younger jurors. and, they were listening very intently throughout this three- month trial. i also noticed that every time that we took a break that the jury was able to leave the courtroom, that the defendant tried to make direct eye contact with each one of them.

maybe hoping to make some sort of personal connection knowing that his fate is in their hands. michelle? >> anne makovec live in san jose. thank you. right now, investigators are on the scene of a deadly shooting in san jose. we are told one of the victims was shot by the police. officers were first called to the scene last night outside a home on lauraville lane. when they arrived two people were already dead. and an officer-involved shooting occur. an adult male suspect was killed by police. it is unclear what led up to either shooting. but the officer who fired has been placed on administrative leave. in san francisco, investigators are also looking into a deadly shooting at civic center plaza. we are told a man in his 20s was shot around 3:00 this morning. part of civic center plaza was closed off a couple of hours but it has since reopened. one witness tells us what happened after he heard the gunshots. >> i heard the gunshot. and then everybody jumped. and i was staring off into that direction already. like, i had seen a friend kind

of walking up in that direction. i heard the pop and everybody hit the ground an i saw him. >> a man who knew the victim says he was homeless and trying to find a way to provide for his family. a group of students is suing albany school district after it went after the kids for posting racist memes. jessica flores has more in albany with the dispute. >> reporter: four albany high school students says the district violated their constitutional rights. they say school officials had no right to discipline them. a violation of their first amendment rights. that is what four student plaintiffs are calling their school suspension. the lawsuit says albany unified school district accuses the students of circulating racist posts to social media. pictures of mostly african- american female students edited with nooses around their nets.

sade's daughter one of the victims. >> a noose around her neck and all of that. >> reporter: it claims the posts are protected political speech. >> this is a hate crime. you don't have a first amendment right to promote a hate crime against a group of people based on their skin color. >> not a right to discriminate against anyone. >> reporter: albany high school participated in a number of rallies and meetings. speaking out against the teen boys actions. the superintendent valerie williams spoke to us back in march. >> we want to send a strong message that we don't accept this. >> reporter: but after being punished, the teen boys are also suing for emotional distress. they say the school put them in harm's way a number of times citing a voluntary meeting where a demonstrator hit two of the disciplined students leaving scrapes and bruises. but the parents of the victims say their teen girls are the ones who are suffering. >> and what do you hope happens to the boys? >> i hope they get expelled and they should. >> reporter: four students are sueing the district for an

unspecified amount of damages. they also want the district to clear their records. in albany, i'm jessica flores, kpix5. >> and we reached out to albany unified school district and are still waiting for a response. and taking a live look outside. if you head outside, you will notice it is a lot cooler today. but look at that shot. so beautiful roberta gonzales. >> it certainly is. and the ten record high temperatures we established yesterday, that is over. and, this is why. take a look at the live weather camera at the golden gate bridge. we are socked in. we have been all morning long. the flag is on the fly indicating a westerly flow. cannot even see the top of the towers of the golden gate bridge. and the towers are about 746 feet tall on the golden gate bridge. the fog bang is over 800 feet deep. in san francisco, 57 degrees. cooldown begins now. yesterday, 82, san francisco, today, 65 degrees.

>> it grew very fast. we are looking to hire between 35 and 40 this year. >> reporter: the industry here is growing seven times the state economy. and paying twice median wage. >> for decades, the story has been when you graduate from a montana college, you have to leave the state in order to get a high paying job. that is no longer the case. >> this is a cbs news special report. good day. there is a celebration going on at the white house at the moment. the president and house republicans bussed over from the capitol after they give him his first major legislative victory today. they passed the bill to repeal and replace obama care. with one vote to spare. and not a single democratic vote in support after the bill. the bill will now go to the republican led senate and the senate will likely have an extensive rewrite of the bill and then the two bills will have to be reconciled so we

have a long way to go yet. we hav ea long way to go yet, but this was a big step. >> reporter: a catastrophe averted. people say if the house republicans have not narrowly passed this obama care repeal, much of the president's ensuing legislative agenda would have been jeopardized. a hugely important president trump legislative item. here comes the president. >> and as the president and the vice president come into the rose garden, let's listen in.

for the party. they are doing it for this country. because, we suffered with obama care. i went through two years of campaigning and, i'm telling you, no matter where i went, people were suffering so badly with the ravages of obama care. and, i will say this. that, as far as i'm concerned, your premiums are going to start to come down. we are going to get this passed through the senate. i feel so confident. your deductibles. when it comes to the ridiculous deductibles. this nonexistent thing i heard about. i don't think you are going to hear so much right now the insurance companies are fleeing. it has been a catastrophe. and, this is a great plan. it is a repeal and a replace of

obama care. premiums will be coming down. deductibles will be coming down. it is a great plan, ultimately, that is what it is all about. we knew that wasn't going to work. i predicted it a long time ago. i said it is failing. and, now, it is obvious that it is failing. it is dead. it is essentially dead. if we don't pay lots of ransom money over to the insurance companies, it would die immediately. so what we have is something incredibly well crafted. i tell you what, there is a lot of talent standing behind me. an unbelievable amount of talent behind me. that i can tell you. am i doing okay? i'm president.

can you believe it? i don't know. i thought you needed a little bit more time. they always told me. more time. but we didn't. they work so hard. an they worked so long. and what i said, let's do this. let's go out, just short little shots for each one of us. and, let's say how good this plan is. we don't have to talk about this unbelievable victory. it wasn't unbelievable so we don't have to say it again. but it will be an unbelievable victory when we get it through. if they don't talk too long, the first list, we will let the folks come up and say whatever you want. but we want to brag about the plan because this plan, really. uh-oh. well ... yeah. we may. but, we are just going to talk

a little bit about the plan. how good it is. some of the great features. i want to thank paul ryan. he has worked so hard. and i was joking. i said, you know paul, for the past week, i have heard paul ryan doesn't have it. it is not working with paul ryan. he is going to get rid of paul ryan. then today i heard paul ryan is a genius. [ laughter ] you know, the groups have all come together. we have the tuesday group. we have so many groups. we have the freedom caucus. and they are all great people. we have a lot of groups but they all came together. really paul i would say in the last three or four days, especially in the last day, i see mark and kevin and i see so many people. jim. we just have developed a bond. this has really brought the republican party together. as much as we have come up with

a really incredible healthcare plan. this has brought the republican party together. we are going to get this finished. as ynoput our tax plan this. the biggest tax cut in the history of our country. the biggest since ronald reagan. now it is bigger than that. also, pure tax reform. so, we are going to get that done next. and, this really helps it. a lot of people said how come you kept pushing healthcare knowing how tough it is? don't forget, obama care took 17 months. hillary clinton tried so hard. really valiantly in all fairness to get healthcare through. didn't happen. and we had no support from the other party. so i just want to introduce somebody to say a few words who has really been treated unfairly. but it no longer matters

because we won. and we are going to finish it off and we are going to go into a lot of other things and we are going to have a tremendous four years and maybe even more importantly, we are going to have a tremendous eight years. but, we are going to start off with just a great first year. and paul ryan, come up and say a few words. congratulations on a job well done. >> as we continue to look in on the white house rose garden and speaker of the house paul ryan takes the podium, i want to go to john dickerson, our chief correspondent and anchor of face the nation. the president just described the house bill as "very, very incredibly well crafted" but it is not likely to be seen that way by the senate. >> no. it is not. and that was the sales man donald trump out there trying to basically build a picture of the legislation. a sense of momentum. a sense of republican unity.

a sense of its greatness. it was crafted in, you know, legislation is an ugly business. and this proves that it can be ugly. this is a victory for the president in the house. the challenge in the senate will be of course that there are a numberover senators who want to see the obama care protections retained to make sure people don't lose coverage or that the cost of coverage doesn't grow so high that they essentially lose coverage. the president didn't mention how many more people would be covered. he talked about cost, but not that more people would be covered. another thing of note was that paul ryan, for the president to heap such praise on paul ryan is a real distance and a real sign of working together with the house speaker. trump ran against paul ryan for much of the campaign saying he had broken faith with the voters and was highly critical of paul ryan.

he could have abandoned him when this first got into some trouble. he did not. this moment if nothing else is a testament to how in sync president trump and paul ryan are. >> now, when the major bills are proposed, john, the congressional budget office analyzed them and informs the congressman or senators as to whether, as to what the spending will be. and, as to how the impact of the bill will come forward, they didn't wait for that this time. the last time they tried to get this bill through, the congressional budget office said 26 million americans wowed lose their health insurance. they didn't wait for the analysis this time. >> that's right. in part, because the analysis would not have been favorable. and the argument they make is they are fundamentally changing the way healthcare works. since they are not forcing people through an individual mandate to get healthcare, that the score from the congressional budget office, the accounting from the

congressional budget office will always show people losing lots and lots of coverage. their argument is they will gain coverage through the benefits of the way the market works here. but it is a bad idea to have a big ugly bad political number come out when they are trying to build momentum for this legislation. but, it does undermine some of the deal making. congressman fred upton who got extra money put in the bill to protect people with preexisting conditions was frank when he said i don't know if the extra money will help to solve the problem. this is something republicans insisted on when obama care was making its way through congress. you had to know what was in it to have a clear view of how to vote for it and what you are doing in the name of the voters who sent you there. they do not have that clear view. >> and so, this bill passed the house today with no democratic votes, the origin obama care passed with no republican

votes. looks like you can either have a republican healthcare plan or a democratic healthcare plan. but there seems to be no compromise. the key thing to pay attention to is president trump suggested this had just happened in eight weeks. this is as they said, a three- phase process. and the third phase of the process is a piece of legislation about healthcare that would require 60 votes in the senate. it would need eight democrats. that's a tougher hill to climb than the one he has now. the fight he has now. the senate overpassing this first phase of healthcare. so, this is really just the beginning of the first phase of a three-phase process. so, there is still a long way to go. >> the insights of john dickerson. john, thank you very much. so, a first step, but a big step in the house today as the obama care repeal and replace bill passes with one vote to spare. there will be more about this
