down. >> reporter: the defendant sat stonefaced as all of guilty verdicts were read. we were not allowed to bring a camera in the courtroom, but you could hear gasps as the trial five years in the making comes to an end. antonin garcia torres found guilty of capital murder in the case of sierra lamarr. he is now eligible for the death penalty. >> it's like reliving the nightmare going through the trial but much worse with the gory details. >> her mother skipped over much of the proceedings but came to hear the verdict today. >> i'm surviving because of faith. >> sierra disappeared on her way to school in morgan hill in 2012. garcia-torres was arrested two months later. the forensic evidence, his closing fibers in her car, her hair on a rope in his trunk, and his dna on her jeans. the challenge for the prosecution, her body has never been found. >> it's very difficult to say

what is most telling. >> he was also found guilty of trying to kidnap three women in a safeway parking lot in 2009. most of his family members left the courtroom without speaking to reporters but i did catch up with one well on facebook live and she still believes he is innocent. >> it's very sad. very unfortunate situation. >> after a three-month trial, the jury of six men and six women deliberated for less than two days. >> there will never be closure. the grief will always be with us. >> sierra's father hopes for the death penalty. sierra's mom only said this. >> i'm glad to hear that there is a great possibility he will never be released and do this to another person, another child. >> the hope is that now that he's been found guilty, perhaps you might reveal where her body could be found. search crews will be out

looking again this weekend. >> we are not giving up until we bring her home. >> next up, the penalty phase. the same 12 jurors will meet here next tuesday at 9:00 a.m. to decide his fate. and east bay doctor has been arrested and accused of sexually assaulting a female patient. contra costa county detectives arrested the 36-year- old. he's a family medicine doctor and member of the health physician network. his office is located on treat boulevard in unincorporated contra costa county. investigators are asking anyone with information to step forward. today about scheduled on a measure that would require city council to approve any new police surveillance equipment. it's been under discussion since the surveillance center was announced back in 2013. that would allow police to monitor feeds from city traffic cameras, license plate readers, and cameras at public schools.

the vote will take place tonight at 6:00. oakland city leaders getting tough on tobacco, specifically flavored tobacco. jessica floor is on the new legislation they are proposing this afternoon to keep fewer young people from getting hooked. >> reporter: honey, blueberry, grape, countless flavors you will find in tobacco products, but not for long. in oakland, that's if two councilmembers have at their w products band being the fruity products are eye candy for kids meant to get them hooked on tobacco. >> strawberry, then all, this and that. >> there's already a federal ban on food flavored cigarettes, but other products are allowed. councilmembers will introduce their legislation banning the flavored products in the city

today. the clerk won't go on camera, but he does tell me off-camera that the majority of those using and buying flavored tobacco products are not young people. she says they are in their 40s and 50s. >> cigarette shop owners say there could be unintended consequences from banning the product. >> people with backpacks out on the street that are not regulated. a black market is going to exist. is that the way we want to go? >> the band of flavored tobacco products in your schools. kpix 5. today city council considering immediately putting into effect and ordinance that prevents tenants from being evicted without reason. the council recently approved a policy that put an end to know cause eviction but at least nine tenants claim they have been handed eviction notices

since that ordinance got the green light. now the mayor and multiple councilmembers agree and urgency ordinance was to prevent preemptive efforts. they take up the issue today at 1:30. the trumpet minutes routing -- administration announcing heavier weapons. they are effectively fighting the state in northern used area. the fbi looking for a way to correct the record. director james comey gave dramatic testimony last week about his decision to reopen the investigation into hillary clinton's e-mail. kenneth craig reports the fbi is now saying there may have been some inaccuracies. >> reporter: testifying before a senate panel last week, fbi director james comey spoke for the first time about his decision to go public 11 days before the 2016 presidential election about its investigation into hillary clinton's e-mails.

details from reagan national airport outside washington dc. >> reporter: a ban on electronics devices larger than a cell phone could be expanded on transit sites headed -- lights added to the u.s. the current ban is people traveling from airport. the expansion would apply to people flying out of europe and the uk. u.s. officials began discussing an additional electronics ban following the laptop bombing of a somali airliner last year. the transportation security administration issued a statement saying, we have not made any decisions on expanding the electronics man, however, we continually assess security directives based on intelligence and will make changes when necessary to keep travelers safe. airlines are working with the government to discuss the issue, but they have expressed concerns about the potential impacts to passengers, especially business travelers. >> eight hours uninterrupted by phone and be able to just be

n-f-l star aaron hernandez because he committed suicide while his appeal was pending. the former new england patriots play new details, a judge has cleared the murder conviction for aaron hernandez because he committed suicide while his appeal was pending. the former new england patriots player hanged himself last month in his prison cell while serving a life sentence for murdering oden lloyd. a suicide note from hernandez to his fiancie saying, your rich , was also released in court documents. the note is relevant because lloyd's mother filed a civil wrongful death suit against hernandez.

the girl is recovering and expected to be okay. crews searching trails in yosemite to find a navy serviceman who's been missing nearly a week. he was last seen wednesday. he was staying at housekeeping camp and authorities say he had been going on hikes by himself. a chp helicopter joins 30 people and trained search dogs. he works at the navy medical center in portsmouth virginia. we plan to fly there from the bay area but never showed up at the airport. water officials in california say they've had to borrow $500 million to fix the

damage to spillway. the department of water resources says it took out that line of credit as well as fargo. so far it's been 67 million to fix the broken spillway which forced thousands of people to evacuate their homes this winter. president trump did declare a major emergency over the spillway crisis. now the state will reportedly seek reimbursement for 75 percent of repair costs from the beds. today marks the start of fire season. the urge people to be vigilant about trimming vegetation. forecasters who track wildfire danger say the heavy rain and snow this past winter may delay major fires until july or august. they also warned that rain has created a lot of vegetation drying out and could feel those fires. some changes are on the way. >> we will feel and see the wind again as early as tomorrow. hi, everybody. take a look at this threat now. toward the bay waters, a little

an area of low pressure to the north of us. it enhances the marine layer. this marine layer tomorrow morning for the commute will be well into the bay with cooler air mass aloft. then it surges inland. at least a good 50, 60, even bumping up against the sierra foothills. increasing the wind. temperatures taking a nose dive 10 to 15 degrees. a little better by thursday but the winds ushering the pollen around. 60s, 70s, and 80s. 60s, had to the coast, 80s, even almost 90, head toward discovery bay. by the time the sun comes up tomorrow we will have seen the return of the formation of an enhanced marine layer. it is going to be overcast and cool tomorrow for the commute.
