good morning from the studio 57 newsroom at cbs news headquarters in new york. i'm meg oliver in for anne-marie green. the senate rejected repealing the health care. handing a stinging defeat to president trump. three republicans included john mccain voted against the skinny repeal but a measure few supported. it was the senate's third attempt to repeal and replace the affordable care act this week and the future of republican efforts to replace obamacare are unclear at best. we go to washington for the latest. >> reporter: good morning. you're right the future of the gop efforts is unclear. by extension the future of health care remains unclear. republicans will look to their democratic friends how to fix obamacare and this may be the final coming together moment that people are hoping for.

a crowd of obamacare supporters outside of the capital building cheered after learning attempts to repeal obamacare failed. bernie sanders joined them and called it a big victory. >> tonight was a victory for the american people, a victory for 16 million people who would have been thrown off the health care. >> reporter: the vote was 49 to 51. after seven years of trying to undo the affordable care act, mitch mcconnell said it's time to move on. >> this is clearly a disappointing moment. imagine many of our colleagues on the other side are celebrating. >> we're not celebrating. we're relieved that millions and millions of people who would have been hurt by the three proposals put forward will at least retain their health care. >> reporter: the key moment of an all night session came from

senator john mccain. back in washington shortly after being diagnosed with brain cancer. he was the third republican to vote no killing the measure. mccain defended his vote on twitter afterwards saying the skinny repeal fell short because it fell short of our promise to repeal and replace obamacare with meaningful reform. president trump responded in a tweet. three republicans and 48 democrats let the american people down. as i said from the beginning let obamacare implode then deal. senators susan collins and senator murkowski were the other two no votes joining senator mccain. the senate adjourned until monday. they will consider the nomination of a circuit court judge. the future of health care remains unclear. even as the president pushed to advance a bill to replace obamacare the white house is

embroiled in a very public and nasty west wing war. late yesterday the bad blood spilled over in an explosive ladened threatened interview given by the president's communications director. >> reporter: newly appointed communications director anthony scaramucci implicated reince priebus as the source of leaked classified information about his finances, though it now appears that information is publicly available. in an interview with "the new yorker," he said he's paranoia. scaramucci also went after chief strategist steve bannon with language more fit for the out house than the white house. i'm not steve bannon. i'm not trying to suck my own expletive. we spoke to scaramucci and he described this interview as an unforced error a rookie mistake of candor.

his sentiments colorful and vulgar as they are would come to no surprise to reince priebus or bannon both who opposed his hiring. for the first time attorney general jeff sessions reacted publicly to presidential criticism over his decision to recuse himself from the russian investigation. >> well it's kind of hurtful but the president of the united states is a strong leader. >> reporter: fearing mr. trump might fire sessions or robert mueller who was handling the investigation, south carolina republican lindsey graham issued a blunt warning. >> if jeff sessions is fired there will be holy hell to pay. any effort to go after mueller could be the beginning of the end of the trump presidency unless mueller did something wrong. >> reporter: republicans told the president not to fire sessions during the august recess. when a successor could sidestep senate confirmation.

overwhelmingly passed the measure. three days ago it easily was passed by the house aimed at punishing moscow for interfering in the 2016 election. it bars the president from easing penalties against russia unless congress agrees. the nation's top military leaders say for now they will allow transgender troops to remain in uniform until they are ordered otherwise. on wednesday president trump tweeted he will not accept or allow transgender people to serve in the military but a tweet is not an order. >> the entire force, entire chain of command will always has, will today and will tomorrow and always should treat every single soldier, sailor, airman, marine, coast guard with dignity and respect for the service to our nation. >> the white house says guidance on how to implement the president's policy is still being worked out. >> overseas today at least 39 people are hurt in a crash in a

spanish commuter train. it happened during a morning rush in bar certificate lona. the train smashed into a buffer in the city. one person was seriously injured. the thrill ride that came apart at the ohio state fair was inspected just hours before wednesday's deadly accident. one rider a teenager was killed and seven others were injured when the fireball ride flu apart. ma manufacturers told fairs around the world to stop using it until the cause of the malfunction is determined. the man charged with killing his wife on a cruise ship off the alaskan coast said he did it because she wouldn't stop laughing at him. the fbi searched him and he said my life is over. no bail has been set. next hearing is scheduled for august 10th. no rain is forecast in western missouri today as the region works to recover from widespread flooding. roadways were under water and

homes flooded. firefighters and police used boats to rescue stranded motorists and homeowners in the kansas city area. in some areas there was five feet of water where there shouldn't be. police released body cam video from the deadly car crash last month involving venus williams. it shows an officer approaching williams to see if she's okay. williams entered the intersection but stopped when a turned in front of her. police tell her the right-of-way but lost it and just got stuck in a bad situation. the passenger in the car that hit williams, a 78-year-old man died two weeks after the crash. coming up on the morning news, early football retirement. baltimore ravens john urschel quits the game at age 26. and white house welcomes first responders in the congressional shooting are honored.

first responders who were hurt during the alexandria baseball shootings are honored at the white house. five officers received medals of valor yesterday from president trump. the officers took down the gunman who opened fire last month on a congressional baseball team as they practiced. baltimore ravens john urschel announces an early retirement. and a setback for gay rights. those are some of the headlines on the morning newsstand. the "new york times" reports that the trump administration is reversing an obama era ruling on gay rights. the justice department says a major civil rights law does not protect workers from bias based on sexual orientation. the court filing contends that only congress can expand the law's reach. the crash for military refueling plane prompted the grounding of the entire fleet.

15 marines and a sailor died earlier this month when a kc-130t went down in mississippi. the crash is unsolved. the "baltimore sun" says an nfl lineman quit football because he's concerned about head injuries. 26-year-old john urschel is pursuing a doctorate in mathematics at m.i.t.. researchers said a brain disease was found in 110 of 1110 football players they studied died. the first lady of voice acting has died. rocky the flying squirrel was among the dozens of cartoon characters voiced by june foray. the show became an animation legend. she recalled by not being impressed with the concept. >> they told me they had an idea

nasdaq finished 40 points lower. a disappointing quarterly profit report sent amazon stock plunging. it recovered to finish down less than a percent. amazon posted a profit but a drop of 77%. sales are up for the online retail giant but the cost of business has increased. amazon spent money on new warehouses and data centers. delta airlines is moving to increase its overseas presence. they are buying a 10% stake in klm group. it will offer travellers more options. air france will buy a stake in virgin atlantic which delta is a major investor. air b n b launched a partnership with naacp. local naacp chapters will work with air b n b to educate residents of the economic

here's a look at today's forecast in some cities around the country. an invention by the great uncle of a disabled toddler is helping hundreds of kids worldwide. kenneth craig meets the family behind bella's boom bug. >> reporter: 2-year-old bella is getting around in ways her parents never thought possible. bella's home made wheelchair is giving her mobility for the first time. >> she's happy to be free to do what she wants. >> reporter: bella was born with spina bifida, a birth defect of the spine that has left her with no feeling below her knees. >> every where we went we had to carry her. >> reporter: that's when bella's great uncle got involved. using a plan he found online he constructed a wheelchair using a

our top stories this morning, early this morning the senate rejected a pared down measure to repeal parts of obamacare. three republicans voted against the so-called skinny repeal, dealing a blow to president trump. senate majority leader mitch mcconnell said he's disappointed but it's time to move on to other issues. and president trump's new communications director anthony scaramucci has declared war on the west wing. in a no holds bar interview laced with foul language scaramucci called out white house chief of staff reince priebus, daring him to prove he is not a leaker of information. scaramucci also blasted chief strategist steve bannon. austin, texas is considering pulling the police department's

entire fleet of ford explorer suvs off the road. more than 120 are already out of service. the concern is possible carbon monoxide leaks. >> i can't breathe. >> reporter: this sergeant is one of 18 austin police officers who now have been treated for carbon monoxide exposure. after driving their ford exemployerer cruisers. >> i don't remember if i hit a curb. or if my head hit a window and i woke up. i remember swerving to miss a head-on collision. >> reporter: he's now suing ford. >> i realized i needed help. something is wrong. i had no idea it was carbon monoxide poisoning. >> reporter: police believe exhaust that contains deadly carbon monoxide is seeping into police cruisers. the city has installed detectors in all 439 of its exemployerers. in california a police officer appeared to pass out behind the

wheel of his exemployerer and slammed into a tree. since that crash departments across the country have installed carbon monoxide detectors in their cruisers including the kansas highway patrol where one-third have registered high levels of carbon monoxide. >> it's concerning to us. >> reporter: this lieutenant -- >> we want to make sure we're confident that we're giving our people equipment that they can get home safe at the end of the day. >> reporter: federal regulators say they are investigating the problem but offered no updates in over a year. the nationgtional associaton of police organizations sought answers in march but said ford never responded. but the automaker has known about the problem since 2012. in a statement ford said it has a team working with law enforcement and regulators to solve problems as they are reported. coming up on "cbs this morning," we'll go to mexico for more on the state department's warning to vacationers about potentially tainted alcohol and why some doctors there say tourists are drinking too much.
