to follow their immigration enforcement. california is the first to file a lawsuit when it comes to protecting sanctuary cities. >> [indiscernible] your neighborhood, you do what my mom and did. i'm a son of immigrants. we want to protect you. >> the message from attorney general javier is loud and clear. his office did not agree with the federal government withholding money from sanctuary cities. the department of justice said they would not pay cities millions if they don't follow immigration enforcement. >> no one should be telling that officer, that deputy sheriff how to do his or her job from washington, dc. >> baseria says $28 million can be gone with $5.5 million for san francisco alone. >> it's a low blow to our men and women who wear the badge, for the federal government to threaten

searching for the people behind a drive-by shooting that sent five people to the hospital. sandra osborne -- >> my little ones are running and she's an 8 year old. she didn't know where to go. >>reporter: last night around 10:30, alma who can't want her face shown was watching tv with her family when they hearded what sounded like fire -- when they heard what sounded like fireworks. >> it happened so fast. we heard a car. >> san jose police say a drive-by shooter sent a crowd of 20 people gathered outside along vista glen drive. >> my understanding is they were participating in a vigil for some people that had died in a traffic collision. >> neighbors say a group has been gathering at this makeshift memorial all week. and the mom who is next to where the shooting took place says bullets went through their privacy fence and into a storage shed in their backyard. police say all five of the

people taken away by ambulance have non life-threatening injuries, but now people living nearby are afraid something like this could happen again. >> it's scary because we've been here six years and never saw anything like this. >> in san jose, sandra ones byrne, kpix 5. >> san jose police say it's possible they were multiple shooters. they haven't identified suspects or the vehicle used in the drive-by. starting today, the main entrance to the downtown barkley bart station is closed for construction. it's part of an improvement project totaling $7.6 million. it's -- during the construction, the escalator between the street and concourse levels will be out of service for six months. by early next year, an arch glass covering is set to replace the circular metal and glass structure that's been at the station for 45 years.

powerful mud slides and heavy flooding killed hundreds of people in sierra leon. cell phone video captured brown mud water rushing through city streets. the red cross says many of the victims were asleep when a mountain slide collapsed during dozens of homes. at least 200 people have been killed but the death toll is expected to rise. a southern california man is asking police and social media users for help to track down a -- last thursday, a woman driving a bmw on the 10 freeway near rialto was sideswiped by a speeding infinity. her car spun out of control and got pinned under a big rig. the infinity took off. her son posted images on facebook and pleading for the public to contact police with any information about the driver of the infinity. amazon is offering a refund to customers who unknowingly bought counterfeit glasses to watch the solar eclipse

here is fresh grosser tony tantillo. >> there's a ruby cherry. it's a fantastic cherry with a lot of sugar and the texture and the bite and a little on the crunchy side. look how beautiful they are. do you see the beautiful color like a cherry, light yellow, dark yellow. the pinks, the reds, and they're fairly large cherries. when you bring them home, selection look for that very carefully and make sure the cherries are nice and bright. very important. make sure there's no liquid in the tray because if there's liquid, that's a sign there is decaying cherries in there and that you don't want. when you bring them home, in the refrigerator. they have a high sugar content to store them at two to three days at the most. the ruby cherry, i love cherries of any variety. they taste so good. i'm tony tantillo, eat fresh and stay healthy. hum, a small tip.
