is live and tell us how -- tallahassee. >> reporter: irma has passed through most of the state of florida and it appears to be on its way out but officials are still stressing the risks are not over, that we are not yet in the clear. here you can see conditions are wet and we are feeling the occasional wind gusts. most has been spared especially when you consider what we have seen and other parts of the state. historic flood waters are raging through the streets of downtown jacksonville. bringing whitecaps. >> reporter: it pushed the st. seen before. >> it is bad now, it will continue to get worse. >> reporter: nearby atlantic beach is taking a beating from peers winds and floods. most roads are impassable for anyone who tried to write up a storm on the barrier island. rain from irma started falling

in tallahassee monday morning, evacuation orders were voluntary here but for the look at the road, many people left town. hurricane irma made landfall in the florida keys early sunday, evacuated residents waited in line to get back home. >> we are trying to get in and we are not able to. >> reporter: irma weekend as it tracked north but still punished many people. irma was too much for some boats left in marinas in miami, residents in naples were out to check the damage. >> we have been through a couple hurricanes before but nothing like this. >> reporter: cleanup is now beginning in some areas and will likely be days before the full extent of the damage is added up. some residents are breathing a sigh of relief that irma was not the catastrophic storm that many feared.

as irma moves north out of florida, into georgia, a new threat for residents there, georgia is under a state of emergency and already more than 100,000 people are without power. we know the federal government is stretched thin because of hurricane harvey, how they help victims of irma? >> reporter: the president has promised the full extent of the power of the federal government in helping florida but as we know, fema has been stretched thin from its undertaking and helping hurricane harvey victims. the u.s. house and senate has passed aliens of dollars in relief were harvey victims -- billions of dollars in relief or harvey victims, the money is for harvey, irma will need its own package. heavy winds and strong waves are hitting georgia, the

woman who shot this video had evacuated from palm coast florida and driven north. she is staying in jekyll island where the power went out last night. the california attorney general is going after the trump administration over the decision to end the daca program. we are in the newsroom with the new legal action. >> reporter: california filing a lawsuit against the federal government plan to end daca. california is the state with the most at stake in this debate. one in four people protected by the program live here in california. these are undocumented immigrants who came here as children, the trump administration announced it would and protections for so- called dreamers last week. giving at six months to take effect. enough time for congress to change the law to allow dr. to stand -- stand. they have sued the government to block the program to end it. stopping the program is unconstitutional and violates daca rights to due process and their privacy since they

release personal information with the understanding that they would be protected. >> i am doing what i think i must do for the 49 pill you -- 49 million people in california, there is no state that would be more economically impacted by the unconstitutional and illegal termination of the programs in california. >> the university filed suit against the trump administration last friday with its own reasoning. they have already admitted immigrant as students given them spot and universities, made investments in their future. earlier this summer the attorney general sent a letter to president donald trump urging him to maintain it but he has been under a lot of pressure by the attorney general and a handful of conservative states who also threatened to sue the federal government if they did not stop the program. we will see what congress does, next. strong winds in the south bay knocked over trees and downed power lines this morning

leaving residents in the dark. sandra osborne has a look at some of the cleanup.>> reporter: this is just one example of some of the damage overnight, wins uprooted this redwood tree , snapped a power pole and took down a power line, many people are calling the socket because it fell this way and not on top of this home. neighbor stopped to take pictures after waking up to no power entries down, from strong winds overnight, they had never seen the winds blow that hard. they said the damage was to to power poles, which will need extensive repairs. cleanup began after sunrise in this neighborhood. overnight the experience included gusty winds, with a large number of power outages. before a live shot we saw sparks showering down from a live powerline caught entries near

university avenue and myrtle street in san jose. busy firefighters doused the trees with water after power was cut off. >> these trees right here, you could hear them going back and forth and swing. >> reporter: local businesses were without power, even mcdonald's had to wait to open. they say they had a large number of calls in south bay last night as a reminder they say never approach a power line and always assume it is active. it really was a frequent storm that took over overnight, surprised a lot of people. you can see the lightning strikes right now across the pacific ocean this morning. this was lit up, especially south of monterey you saw how it roared through. now it is a remnant to the west of us but there will be more

activity, that is why we have this chance of thunderstorms and showers in the forecast. look to the south of san francisco north of la, there is a low off the coast and it could come in to our region so we will be tracking restaurant the afternoon hours, most likely going to bring us some rain tonight into tomorrow, wind gusts have calm down compared to what they experienced overnight. parishioners of an antioch church are helping to clear debris after it caught fire. they call it suspicious, firefighters say it started in a shed before spreading to the building. it is unclear if the fire is related to other recent fires in the area, the district responded to five vegetation fires yesterday, they were reported between 5:30 pm and 11:30 pm last night. officials say the fires are also appearing to be suspicious. it has been 16 years since the worst terror attack on morials e being held across

ring the bell three times for the last alarm. after a moment of silence, firefighters read the names of each of the 343 firefighters killed at the world trade center. >> this year especially today is a little bit more somber for us because we lost a beloved member of our department yesterday morning roughly around the same time in the line of duty. >> reporter: battalion chief passed away in the line of duty after returning to the station from a fire call. >> it's a little bit extra emotional. a lot of things happened with the organization. >> reporter: another reason today is to impact is because two bay area search and rescue teams have been deployed to help with hurricane harvey and hurricane irma. they are the same type of teams that were sent to new york after 9/11 to help with rescue operations at the world trade center.

scheduled to vote on a new round of sanctions against north korea and they could be the toughest to date. the latest draft resolution removes a call for a full oil embargo on the country. concessions were made in order to get china to agree to vote yes. they say they will make the u.s. pay a heavy price of the measure is passed. they are ready to respond with measures of its own. taking a look at the financial markets, the dow is up big, stocks rising sharply up to hundred and 60 points the dow around 22,000. researchers from five uc campuses are forming a consortium and working together in the fight against cancer. the uc president made the announcement a short time ago, the issue hits close to home for napolitano who was diagnosed with cancer earlier this year.>> i know the value of making new advances in what is available to patients. i know it on a personal level but i also know that that is the kind of care we want to have
