service. and during his accnc speech slammed spurious nationalism. good morning from the studio 57 newsroom at cbs headquarters here in new york. good to be with you. i'm anne-marie greene. the senate is set for a key vote this week to clear the way for tax reform. president and majority leader mitch mcconnell say they're on the same page. they had lunch together and they held a joint news conference. the show of unity would belie some very public tension. also the president is being called out for comments concerning his predecessors and fallen u.s. soldiers. seth lemon is here in new york. good morning. >> reporter: good morning. president trump attempted to affirm his alliance with leader mcconnell calling them long time friends now closer than ever. it's a necessary perception at a critical time because the senate does vote this week on a budget and that sets the stage for tax reform, something many republicans see as make or break after several failed attempts to

reform health care. >> there was hardly a topic president trump didn't touch with reporters at the white house monday afternoon but before addressing any of them he assisted alongside mitch mcconnell that after months of back and forth bickering the two are on good terms. >> despite what we read we're probably now i think at least as far as i'm concerned closer than ever before. >> we have the same agenda. we've been friends and acquaintances for a long time. >> on tax reform, the president said it will get done by the end of the year. next week he plans to announce an economic development bill and will declare a national emergency regarding opioids. but the comments that instantly started drawing the most backlash, his claim past presidents didn't reach out to the families of fallen soldiers as he does. >> if you look at president obama and other presidents, most of them didn't make calls, a lot of them didn't make calls. >> reporter: former obama aides immediately shot down that

assertion. former attorney general eric holder who treated along with this photograph saying stop the damn lying. you're the president. i went to dover air force base and saw him comfort the families of both the fallen military and dea. president trump made the comments in response to questions on why he hasn't yet made a public statement regarding the four berets who were killed in an ambush in niger two weeks ago. president obama had not called grieving families and mr. trump seemed to soften his tone and walk back his comments and saying obama probably did sometimes but he did it -- but adding quote, i didn't know. >> seth lemon here in new york. thank you so much. well, a high ranking north korean official says nuclear war may break out on the korean peninsula at any moment. north korea's u.n. ambassador

warned that the situation between north korea and the u.s. has reached a touch and go point. he claimed the u.s. plans a secret operation to remove north korean leader kim jong-un from power. president trump is reconsidering the nomination of congressman tom marino as the nation's chief drug czar. mr. trump's second thoughts were prompted by reports by cbs news and the washington post that he played a key role in weakening federal authority to stop opioid distribution. west virginia senator whose state was hit hard by the opioid epidemic says the 2016 law needs to be changed. to be changed. >> they made it and camouflaged it so well that all of us, all of us were fooled. nobody knew. >> west virginia democrat says he's horrified that a bill everyone approved made the epidemic worse. >> there's no oversight now. that bill has to be retracted. it has to be repealed. >> reporter: the law sailed

through the senate last spring. >> those in favor say aye. >> it had the backing of the justice department. it was sponsored by members of both parties so no one in congress thought to question it. >> it's not unusual for something like this to roll through without much fanfare. >> missouri democrat introduced a bill to repeal last year's law. >> how realistic is that? >> i think it's realistic. i do sense that there is a bipartisan kind of we've got a crisis attitude about opioids now. >> one of the bill's authors marsha black burn said via a spokes person, if there are any unintended consequences from this bipartisan legislation they should be addressed immediately. but utah republican orrin hatch defended the law. and the $177,000 in donations he got from the drug industry while he was pushing it through. >> heavens no. my campaigns run about

$10 million and frankly, frankly, i don't know who contributes to it at all. >> now some democrats are urging the president to drop his nomination of the bill's chief author, tom marino, to be the nation's drug czar. >> it's like putting the wolf in charge of the hen house. >> reporter: many lawmakers are still trying to figure out why the dea and department of justice dropped their initial opposition to this bill. that would have been a big red flag before a vote and it's a sign that even some in law enforcement didn't understand how this bill might tie the dea's hands. cbs news, capitol hill. thanks to cooperating weather fire crews in northern california report more progress in the battle against wildfires. calmer winds aided fire crews, but at least 41 people have been killed since the fire started. many were allowed to go home yesterday.

tom andrews returned to devastated santa rosa and found his home had survived. >> it was disbelief, you know, and just feeling like the luckiest guy on earth. you know, i can't believe -- i mean, total destruction 50 feet away. you know, and to have our house still standing here. >> authorities don't allow residents to return until utilities are restored. rain is forecast for later this week. and ahead on cbs this morning. we're in santa rosa with the story of one family's efforts to survive the raging wildfire. army sergeant bergdahl faces life in prison when he is sentenced later on this month. he pleaded guilty to desertion and endangering his comrades yesterday. he was captured and held by the taliban for five years after walking away from his post in afghanistan in 2009. at least two americans were wounded trying to rescue him. bergdahl said he didn't believe the u.s. would search for one private.

overseas now, iraqi forces have pushed back american backed kurdish forces out of the city of kirkuk. the curds claim kirkuk even though it was outside their autonomous region. celebrations broke out as iraqi forces moved in last night. a kurdish vote for independence last month raised tensions. the u.s. is calling for negotiations. in syria now, u.s. backed kurdish forces are on the verge of retaking the isis strong hold of raqqa. isis considered it its capital. isis used the stu square to carry out public beheadings. officials expect the city to fall within a few days. the coast guard says the fire is out on that oil rig in louisiana's lake pontchartrain. there was an explosion on the gas transfer platform sunday

hope of earth, for the sake of some half baked spurious nationalism, cooked up by people who would rather find scapegoats than solve problems. >> mccain received the liberty medal from former vice president joe biden, a long time friend. a state of emergency has been declared ahead of a visit by an alt right leader in florida and a plea in a deadly smuggling case. those are some of the headlines on the morning newsstand. the san antonio express news reports the truck driver in a deadly immigrant smuggling operation pleaded guilty yesterday. authorities say james matthew bradley junior was driving a sweltering semitrailer in july packed with at least 39 immigrants. police found the truck in a walmart parking lot in san antonio where the temperatures topped 100 degrees that day. ten immigrants were found dead. boston.com says a company that makes football helmets

vows to fight a concussion lawsuit filed on behalf of the late new england patriots tight end aaron hernandez. lawyers for hernandez refiled the lawsuit yesterday. hernandez killed himself in prison, an autopsy revealed he had cte a brain disease found in people who suffered repetitive brain trauma. florida governor rick scott has declared a state of emergency ahead of appearance by richard spencer. spencer is scheduled to speak at the university of florida on thursday. he was part of a deadly white supremacist rally in charlottesville in august. it allows local law enforcement and state agencies to provide extra security. fortune magazine says several online retailers have stopped selling a controversial anne frank costume.

it featured a beret, dress and satchel. faced with growing public pressure stores pulled the costume yesterday. it comes months after amazon stopped selling the costume. and china's first space lab will soon come crashing back to earth and nobody knows where it will hit. china says it's lost control of the 8-ton lab which was launched six years ago. most of it is expected to burn up during reentry in the next few months but scientists say some pieces weighing more than 200 pounds could crash into the surface. still to come, cosmic fireworks. astronomers detect a massive collision between two neutron stars.

have ever witnessed such an event. the explosions create massive amounts of gold and platinum. on the money watch now, ford fends off a recall and cruise ships return to the caribbean. diane king hall is at the new york stock exchange with that and more. good morning, diane. >> reporter: good morning. well, the center for auto safety wants ford to recall 1.3 million explorers due to concerns about exhaust fumes. ford says not so fast. last friday the car maker said it would inspect and repair explorers at no costs to our owners. ford says the suvs are safe in response to the center for auto ford says it is confident about its current methods for quickly identifying and addressing potential vehicle issues. here on wall street stocks posted modest gains with all three major indexes closing at record highs. the dow rose 85 points. the s&p added 4, the nasdaq gained 18. yellen is scheduled to meet with donald trump thursday. yellen's current term ends february 3rd.

the president has said she is one of several candidates he is considering for the central bank's top job. netflix says it plans to spend $8 billion on original programming next year. the video subscription service hopes to make its library 50% original by 2018. netflix spent 6 billion bucks on original content and added 5 million new viewers during the third quarter. it now has 109 million subscribers worldwide and cruise lines plan to return to st. thomas and other caribbean islands next month. it's been less than two months since hurricane irma caused significant damage in the caribbean followed by hurricane maria. cruise ship visits in particular are a major driver of the caribbean economy. >> i'm sure those tourism dollars will go a long way towards rebuilding a lot of those islands. thank you so much, diane. >> thank you. still ahead, in full swing, golfer tiger woods gets the okay

discuss the ongoing protests during the national anthem. it comes as the league yesterday endorsed a bipartisan justice reform bill in congress. a league spokesman said the nfl was supporting the measure which among other things reduces mandatory minimum sentences for low level drug offenders. tiger woods is one step closer to playing golf again. his agents say that woods is swinging a driver without pain and doctors have cleared him to practice without limitations. woods had fusion surgery on his lower back in april. that was his fourth back surgery in 19 months. woods hasn't played golf since he withdrew from a tournament in february because of back spasms. coming up on cbs this morning, former news anchor gretchen carlson started a conversation on work place harassment when she sued the chairman of fox news. she tells us why she believes

our top stories this morning. president trump and senate majority leader mitch mcconnell held a joint news conference. the president says he and mcconnell are closer than ever. the public show of unity follows several months of sniping between the two men. their meeting comes as the senate votes on tax reform. something republicans view as a must-win battle following a loss on health care. and president trump says he's reconsidering the nomination of congressman tom marino to be the nation's drug czar. cbs news and the washington post report marino played a key role in legislation that helped fuel the opioid epidemic. gun control advocates acknowledge the expanded background checks that they would want to see in place would not have prevented the las vegas

massacre. but last week they went to court to try and make nevada enforce the background checks that are already on the books. >> question one is solely gun control. >> reporter: last year the nra spent more on a nevada ballot initiative than any congressional race. fighting a proposal to expand background checks including at gun shows. gun control advocates spent twice as much. >> close the background check loophole. >> reporter: and won a narrow victory. but nearly a year later the law is not being enforced. state and federal officials are in a standoff on who does the background checks on private gun transfers. so at a reno gun show just days after the deadliest shooting in las vegas -- you're a private seller? >> yeah. >> so there's no background checks? >> no, we're good to go. >> reporter: every town for gun
