immigration reform. they walked stoically into the courtroom to hear the opening arguments for the trial of jose ines garcia zarate. >> it could be an accidental shooting. >> reporter: his lawyer said the client was handling a handgun he found wrapped in a t- shirt under a bench on the pier when it accidentally fired. >> he didn't know the object he touched had a gun in it and does not bear criminal responsibility. >> reporter: prosecutors said that jose ines garcia zarate was recklessly pointing the gun at people and it belong to a bureau of land management ranger who reported it stolen from his car a week before kate steinle was shot. >> he has a second grade education and obviously has some mental health issues. >> reporter: he had been deported five times and then landed in jail on marijuana charges that were dropped and he was released, despite a request from immigration officials to hold him and he is now charged with second-degree murder. the maximum sentence is 15 years to life in prison. the jury is made up of six men and women including three legal

immigrants and the trial will last about one month. anne makovec, kpix5. the worst of the wildfires is over in wine country and they say at least 250 square miles were burned, an area five times the size of san francisco. in napa and sonoma county, the tubbs fire is almost fully surrounded with 94% containment and the nuns fire is 90% contained with crews having control lines around 80% of the pocket fire near geiser bill and 90% of the atlas fire, mostly mop up. it's a sign of normalcy in napa county, with all public schools reopening. reporter jessica flores reports on which schools are welcome to in manning students again. >> reporter: officials said at least nine staff members had their homes damaged in the fire

but it's not clear how many students were displaced. doors are open at napa valley unified school and the spirit is stronger than before. >> the smoke was thick and unhealthy. >> reporter: schools were forced to close for two weeks. today, they welcome back 18,000 students and athletic teams resumed games this week. >> we are glad to be home. the air quality was bad. it felt like cabin fever, just going crazy inside. >> they are considering ways to make up for the lost class time. >> we will help with college applications since we missed two weeks. >> they are providing free lunch to anyone who needs it without requiring paperwork and each school will have mental health services to help students cope with the disaster. >> we want them to have time to

alameda county deputies said victor alvarez was arrested in oakland, accused of carjacking a man in san lorenzo last week. they said the victim was warming up his pickup truck and went inside and a moment later, alvarez was behind the wheel. the victim tried to stop him, but was run over and was the father of two young children. he died last thursday. a shooting on a bay area freeway, i-380 near el camino real near san bruno. authorities shut down traffic for for hours. the gunman shot at several vehicles and one was carrying three people. in that car, the driver, believed to be in uber driver, was struck by a bullet. >> fortunately, this suspect -- he sustained non-life threatening injuries. >> chp officers are trying to identify the shooter and locked down a motive. meanwhile, lanes are open to

drivers. san ramon police are looking for a man wanted for exposing himself to kids. police are releasing these sketches. they said it happened earlier this month and police believed he drives an older dark gray ford taurus the man -- said an. call san ramon police if you recognize the suspect. the house of representatives gets back to work. the biggest item on the agenda, consideration of the budget. mola lenghi explains why president donald trump urges house members to move quickly. >> reporter: president donald trump urged house republicans on a conference call on sunday to quickly pass the budget bill pushed through the senate last week, so they can move to tax reform. he told the lawmakers -- we are on the verge of doing something very, very historic. >> i call it tax cuts. it is tax reform, also, and will be the biggest cuts ever in the history of this century. >> reporter: the white house

her husband's death and the highly scrutinized phone call she received from president donald trump. megan oliver has the latest. >> reporter: myeshia johnson said she was hurt and t after speaking with president donald trump last week. her husband was one of four soldiers killed in an ambush earlier this month in niger. mrs. johnson said the president couldn't remember his name. >> i heard him stumbling on trying to remember my husband's name. that hurt me the most. if my husband is out here fighting for our country, and risking his life for our country, why can't you remember his name? >> reporter: the 25-year-old widow confirmed the accounts that president donald trump said her husband, la david johnson, knew what he signed up for and that she was upset by his tone of voice. she complained she has not been allowed to see her husband's body and has been told nothing about his death. >> i don't know how he got killed or where he got killed, or anything. >> reporter: in an early morning to eat, president donald trump said the conversation was respectful and that he knew johnson's name from the beginning. it's not his first dustup with

breaking news in lakes county. right now, there is a possible active shooter in the clearlake oaks area. they are reporting the suspect could have more than one handgun. law enforcement has ordered residents in that area to shelter in place and we have just gotten a report that the suspect is in custody. we are learning the details of what exactly happened, but the suspect is in custody after reports of active shooters in the clearlake oaks area. we will stay on top of this and bring the latest when we get it. bart is making commuting a bit easier. an app called car pull program scoop. you can park anywhere for free and they tested the program last month at the san bruno station and called it a success. they said carpooling has increased where this is available. look at the big
