believe started the bear fire. it is the same man that they had previously arrested for looting in the fire zone. here is his picture. he is now facing six counts of arson including enhancement for injuring firefighters in the process. 54-year-old marlon coy who actually lived near the fire zone. sheriff's officers say he had a dispute with some people who lived on diane way, which is where the fire started on october 16th. and investigators say that there were three other people who were with him at the time that he started the fires who identified him as the arsonist. >> all of those men told us that while they were there with marlon coy in the bolder creek area below 475 diane way, they witnessed him lighting this fire, spread, and then became bigger and caused what we are now calling the bear fire. >> reporter: the bear fire burned 400 acres near boulder

creek in the santa cruz mountains. it was fully contained finally yesterday 10 days after it began ripping through rugged terrain. hundreds of people evacuated their homes for several days. at least two homes and several outbuildings burned down. and 13 firefighters were injured fighting this fire. three seriously injured and one in the hospital this afternoon. now, coy was arrested not long after the fires broke out accused of looting stealing $15,000 worth of jewelry and bicycle. the sheriff says when they found him,est riding the bicycle and -- he was riding the bicycle and had all the jewelry in his backpack. now he is facing arson charges. his bail is set at $800,000. live in santa cruz, anne makevoc, kpix 5. on the fire watch down in southern california, 200 homes in riverside county are in danger now because of these flames. a wildfire just south of lake

elsinore doubled in size overnight forcing more evacuations. it sparked yesterday and it chewed through 700 acres already in the mountains. at this point, no homes have burned. it's not clear what caused the fire. new at noon, a major legal victory today for a san francisco couple who claimed they were wrongfully evicted from their home more than 2 years ago. kpix 5's jackie ward reports on their record verdict. >> reporter: today is a really good day for husband and wife plaintiffs. they just won a $3,528,000 settlement for harassment and wrongful eviction. dale and his wife martha are officially millionaires. but this experience has taken its toll on them. >> i would probably rather have my life back than any award, which was our home. >> reporter: after 2.5 years with their landlord, the sister and their company, the family is thankful it's over.

>> i feel so relieved. here, i feel like i miss my home. that was my home. and i can't go back in time. all the pain that we suffer there. >> reporter: gail had lived at 71 hill street in san francisco for 21 years when the woman bought the property in 2014. shortly after that purchase is when a, quote, pattern of harassment and decrease in basic housing services started. >> they had a business plan with tactics of intimidation, harassment and retaliation towards the rent controlled tenants, long-term tenants. >> reporter: steve mcdonald's the couple's attorney, says in 2014 the landlord bought a number of buildings. more victims could be out there. >> hopefully this will send a message to other landlords that it's not it's harm that can be done to people just to monetize their units a little bit more to squeeze the more money out

of them. it's pretty dehumanizing. >> reporter: earlier this year, the san francisco city's attorney's office received government penalties of $2.7 million against the same landlord. at city hall, jackie ward, kpix 5. a fire that tore through a kfc restaurant in san jose this morning is being called suspicious. that's after firefighters learned the flames started in the dining area, not the kitchen. the fire was first reported around 4:30 a.m. at the kfc on copley avenue. investigators are also looking into reports that something was thrown through a window seconds before the fire started. life is starting to get back to normal after the wine country wildfires. after nearly three weeks, students from 13 santa rosa schools are back to class. kpix 5's jessica flores asked some of the students how they are doing. >> reporter: this is one of 13 schools welcoming back students today after the fire forced santa rosa city schools to close for nearly three weeks. but today isn't about picking up where students left off.

it's about pick up the pieces and pushing on. at pinier high school today the lesson plan is more focused on the heart than the mind. about moving forward after disaster. one student writes, moving forward to me is staying calm when i hear sirens. another student writes, it's about helping out. for so many, moving forward is getting used to a new normal. >> it feels kind of [ indiscernible ] [ crying ] it was weird come my aunt's house. >> reporter: leslie's home is one of thousands that burned down in the fire that ripped through santa rosa. she is one of at least 80 students at the high school who lost nearly everything. >> things are going to be different from now on. it's been hard. >> reporter: as doors re-open across santa rosa city schools, counselors will help students cope. the principal says teachers will work out how to make up for the three weeks of lost school time. >> it's wonderful to see you. >> reporter: but right now,

they are focused on providing emotional support to those who need it. >> sometimes it's a quick hug. sometimes it's a chat on the side. sometimes, i'm ready for an assignment, can i please start doing that? they are ready to meet what students need. >> i feel like i have gotten a lot of love, a lot of support from people i don't -- i didn't even know. >> reporter: today this school, a hub for learning of a different kind. one of comfort and community. santa rosa city schools will provide free meals to all displaced students. an additional 11 schools re- open on monday. for a list of openings, visit our website, cbssf.com. click on "links and numbers." in santa rosa, jessica flores, kpix 5. tickets are now on sale for a concert benefiting the victims of the wine country wildfires. metallica, dave matthews band and others are performing at the november 9th event. it's raised more than $6 million for victims already and every penny made from the

concert at at&t park will go to them. tickets start at $49 and the best seats will be donate to first responders, volunteers and families affected by the fires. bart says the free rides are over for fare cheaters. the agency says it's cracking down on people who jump in without a ticket. starting next year officers will board bart trains and ask every person for proof of purchase. if you can't provide it, you will be fined $75 the first time it minors charged $55. not everyone is on board with the new policy. >> a lot of homeless people that ride the trains so it's like you know they ain't got no fare. i think it's a waste of time. >> it's not about catching every person who fare evades. it's about reducing the fare evasion and also sending the message that the free ride is over. >> bart officials anticipate this new policy will bring back 8 to $11 million each year.

bart says fare evasions costs 15 to $25 million every year. new information about the murder of president john f. kennedy is out. the national archives released thousands of previously classified documents about the assassination. but as seth lemon reports, a decision to withhold some of the documents could fuel even more speculation. >> reporter: the new jfk documents are revealing undisclosed information about that fateful day in november of 1963. >> president kennedy died at 1 p.m. central standard time. >> reporter: but it was the murder of alleged assassin lee harvey oswald that really kicked off conspiracy theories. the documents showed the fbi knew of a possible threat against him. fbi director j. edgar hoover wrote a memo saying the night before oswald was shot, a man called saying he was a member of a committee organized to kill oswald. the fbi reportedly contacted dallas police, who assured them adequate protection would be

given. but this was not done. the full extent of what the government knows about the murders is unknown because of a last-minute decision to withhold some of the documents. president trump agreed to give the cia more time to review documents which it claims could still compromise national security. president trump tweeted about his decision saying, there will be great transparency in the end and he hopes to get just about everything to the punt the decision to keep some documents secret is sure to fuel more speculation and conspiracy theories. 61% of americans already do not believe the government's story that lee harvey oswald acted alone. seth lemon, cbs news, the white house. >> the president has given national security officials 180 days to review the remaining documents. spanish flags are now being removed from buildings in catalonia after the parliament voted hours ago to establish an independent catalan republic. thousands of people celebrated

talks to buy insurance company "aetna"... for more than 66-billion dollars. it's a huge deal in the health world. cbs is reportedly in talks to buy insurance company aetna for more than $66 billion. the deal would merge one of the nation's largest pharmacy operators with one of its oldest health insurance providers, cvs. a union would give cvs more leverage in price negotiations with drugmakers. amazon's latest earnings report soared beyond expectations. from july until september, amazon says its revenue rose 34% to $43.47 billion. [ laughter ] >> that's almost $2 billion more than analysts expected. shares of the company were up 30% for the year. >> people were expecting three cents a share in earnings and they reported 52 cents. a lot of this is just sales growth, record revenues and a nonholiday quarter. >> experts also say that profits from whole foods, which was bought by amazon, was only

"spare the air" again today. east bay south bay unhealthful levels of pollutants in the air trapping them so "spare the air" yet again. sunny warm today temperatures inland falling tomorrow. that sets a cooling trend moving into the bay area. but right through halloween, it will be sunny and mild. this weekend boo at the zoo in san francisco. 62 degrees if you are going to head there by the great highway. and in oakland, ditto! warmer there 72 degrees. looking good. forecast highs for us today in the bay area:

but there are also some safety reminders... if you're taking them of course, it can be fun to dress up your pets for halloween but there are also some safety reminders if you are taking them out among the trick or treaters. our pet expert dr. jill chase m, mos of r vieweriss re might remember that i love halloween, probably one of my favorite days of the year before you we have to be careful because chocolate is toxic to dogs and cats. dogs love it. it's not good for them. be mindful of that. and also, another thing is if you take your dog out with you when you go trick or treating remember to make sure they're

well lighted because it's so dark out and drivers may not see them. and especially owners who like to let their dogs walk on those expander leashes. the drivers will see the owners but not necessarily the dogs. so a lot of reflective material so the dog is seen well. finally reminder again about the fact that black cats, there are unkind people out there and black cats for some reason are sometimes not treated well on halloween so i would keep your black cat inside the house just to be careful. >> those are good things are to keep in mind. what about costumes? i have a black miniature poodle who is going to be sven from "frozen." i think bode would be a better -- >> that's a great question. i actually enjoy dressing up the dogs, you know, as long as they can move in their bodies but i had an owner say to me just recently that she doesn't dress her dog up because she hasn't gotten his okay. [ laughter ] >> and you know, i -- i think it's cute. i think it's great to dress them up. >> okay. so it's okay? >> yeah, i think so.
