>> mason: the astros carry houston from the depths of despair to the top of the world. this is the "cbs evening news." >> mason: and this is our western edition. good evening. i'm anthony mason. they had no idea what they were walking into. tonight, cbs news has new details of the october ambush in niger that left four american soldiers dead and their bodies stripped. they were part of a larger force of u.s. and nigerian troops on a reconnaissance mission near the border with mali, where islamic terrorists are known to travel. at some point, their orders changed and the soldiers were forced to camp outside for the night. the pentagon has said little about what happened next, so our debora patta went to the ambush site in niger for answers. >> reporter: the village of tongo tongo is so remote, our nigerian military escorts had

trouble finding the road to get there. this is where the 12-member 13erican team and 13 nigerian soldiers stopped to get supplies. villager adamou bubaker told us he saw three or four armed men on motorcycles approach the u.s. convoy. he was so nervous, he walked 25 miles to speak to us at another location. "we thought that if it was just a few terrorists, the soldiers can kill them easily," he said, "but we didn't know there were so many more of them waiting nearby. it was a trap." race the isis fighters had managed to lure the troops away from the village, their numbers multiplied and suddenly, they were under attack. you can still see the bullet casings that were left over from the intense shooting. the burnt-out shell of a school, blood-stained bushes, and empty boxes of ammunition are all that's left now. bubaker told us there were at least 60 attackers armed with machine guns and rocket-

propelled grenades. the fighting lasted over two hours. when it was over, he said he saw the bodies of three american soldiers slumped near their vehicle. all three were stripped of their uniforms. but it would be two days before children from the village discovered the fourth body of sergeant ladavid johnson, about half a mile away. it's still not clear how johnson tht separated from the rest. this soldier would only talk if we concealed his identity. "he had been stripped of his uniform," he told us. "his hands were tied and they'd shot him in the head." the pentagon would not comment. omere is still some confusion over why this american team had their mission extended, and what exactly their assignment was. sit either way, it meant that they camped out overnight in dangerous territory, and that, anthony, might have alerted the extremists to where they were. >> mason: debora patta with some

onmarkable reporting tonight. nigerian forces were so concerned about security in that village, they would only allow onbora to stay there for 15 minutes. t. have breaking news tonight. sources tell cbs news, new york city police have brought prosecutors new rape allegations against hollywood mogul harvey weinstein. jericka duncan has the latest. >> reporter: actress paz de la huerta says in october of 2010, harvey weinstein offered to give de la huerta a ride home to her new york city apartment after a party because the two lived in the same neighborhood. she says weinstein insisted they have drinks. the pair eventually ended up inside her apartment. that's when she alleges weinstein took off her dress and forced himself on her. i spoke to her by phone. >> he pushed me on the bed, he unzipped his pants and it happened all very suddenly. >> reporter: more than a month later, she claims she confronted weinstein at the four seasons in los angeles, because she says

weinstein kept calling her. on december 23 of the same year, she says weinstein showed up in he lobby of her apartment. they went upstairs, and de la huerta alleges he raped her a second time. de la huerta has been in romerous films and starred in hbo's "boardwalk empire." >> i want to see what it looks like-- on her. >> reporter: the allegations by de la huerta follow more than 50 sexual harassment accusations made by women against weinstein. manhattan's district attorney's office tells cbs news that they have assigned a senior sex crimes prosecutor to investigate this case. weinstein has not commented on the latest accusation, but has repeatedly denied allegations of non-consensual sex. de la huerta says at the time of the alleged second rape, she had inen drinking and was in no state to have consensual sex. anthony? >> mason: jericka duncan, thanks. house republicans rolled out their tax overhaul plan today.

they say it will cut taxes for middle-income earners. but democrats say, no, some will get a tax increase. esief congressional correspondent nancy cordes now en what is in the plan. >> it's what they promised, and it's a great product. >> reporter: g.o.p. lawmakers were jubilant today. >> it's extraordinary. >> reporter: extraordinary? >> extraordinary. >> reporter: after party leaders unveiled an ambitious set of tax cuts worth $1.5 trillion or ypre. >> the typical family of four $1ll save $1,182 a year on their taxes. >> reporter: the plan would slash the number of individual tax brackets from seven to four. the top rate would remain at to.6%, but it would only apply to households making $1 million or more. lde median household making $60,000 a year would see its rate drop from 15% to 12%. >> we are giving them a big, beautiful christmas present in

the form of a tremendous tax cut. >> reporter: and republicans say there is more. they want to double the standard deduction to $12,000 for individuals and $24,000 for married couples. they also want to expand the child tax credit from $1,000 a year to $1,600, and repeal the alternative minimum tax. but democrats noted that the po.p. proposal would also eliminate deductions for student loans and medical expenses, and it would slice the mortgage n duction cap for new homes in half, from $1 million to $500,000. >> what they give you with one hand, they take away with the other. >> reporter: 401(k) contribution limits and charitable giving deductions would remain essentially unchanged. the most lucrative cuts would go to u.s. businesses, including a permanent reduction in the corporate tax rate, from 35% to 20%. >> we are focused on increasing paychecks in a major way.

an reporter: congressman kevin brady of texas is the bill's cuief author. the bush tax cuts didn't lead to growth or higher wages or more jobs. in fact, quite the opposite. so why are you so sure this will be different? >> a complete redesign of the code. we're not just putting higher octane fuel in an old clunker of hetax car. we proposed to drive a newer tax nr that can compete and win against any country in the world. >> reporter: a handful of republicans are already raising objections tonight to the mortgage deduction changes, and the elimination of a deduction for state and local income taxes. and republican leaders, anthony, may have no choice but to negotiate, because in order to get this bill through the house and senate, they are going to need nearly everyone in their party to vote yes. >> mason: nancy cordes at the capitol. thank you, nancy. new york city began putting up concrete barriers today to prevent cars from entering the bcycle path where a terrorist

in a truck mowed down ddestrians and cyclists. eight people were killed, a dozen injured. michelle miller has new video of the arrest. >> reporter: this is the moment terror suspect sayfullo saipov was captured by new york police. the newly released cell phone video begins right after saipov was shot by 28-year-old officer ryan nash as he tried to flee after using a rented truck to drive down a west side bike path. he drove for a mile, killing eight, before crashing into a school bus. >> oh, my god. >> reporter: police found knives and notes praising isis inside the truck, and according to court documents recovered two cell phones. a law enforcement source tells cbs news, authorities tracked the numbers on the phones and have linked them to sympathizers of a radical cause who were already on new york police radar. the source says saipov made

calls to some of those numbers the day of the attack. >> there's no point thinking about the "what ifs." >> reporter: five days before the attack, london-based graphic designer damian erskine and his girlfriend were inside saipov's uber car for an hour. he picked them up at newark airport. >> obviously you don't get to know someone in an hour, but you ont a vibe from someone, and there was nothing that would give you any sense of, obviously what was to come. >> reporter: sources close to the investigation say an associate of saipov who they were looking for, mukhammadzoir kadirov, has now retained a lawyer and is set to be questioned by authorities nmorrow. anthony? >> mason: michelle miller, thanks. : esident trump put himself right in the middle of the saipov case and may have made things more difficult for federal prosecutors. here's chief white house correspondent major garrett. >> reporter: two days after the k,w york terrorist attack, president trump made clear he is ready to sentence the indicted suspect.

"should get death penalty." this was the president yesterday: >> and we need strong justice, much quicker and much stronger than we have right now. because what we have right now is a joke and it's a laughingstock. >> reporter: tweeting about the death penalty this early in the case could complicate matters for justice department prosecutors. does the president have any utntencing authority? >> no, he does not. >> reporter: john wood is a former u.s. attorney. >> it gives the defense attorneys an argument that the jury pool has been tainted and their client can't get a fair trial. ane second way it can complicate things is, you could have somebody on the jury who is anti-trump, and so it could -ttually have the opposite effect of what he intended. >> are you going to pardon paul manafort? >> thank you. >> reporter: the president also faces another potential legal pitfall: robert mueller's investigation of his campaign's dealings with russia. today, his former campaign chairman, paul manafort, and

deputy campaign manager rick gates appeared again in federal court, both under indictment for money laundering and making false statements. allies of the president say mr. trump is bothered by the publicity around the investigation but does not fear being charged himself or being impeached. the president maintains there was no collusion between his campaign and russia. sam clovis, the trump campaign co-chairman implicated in the russia investigation, today withdrew his nomination to a top science post at the agriculture department. also, mr. trump's son-in-law, jared kushner, has turned over to the special council's office to the special counsel's office documents related to his role in the firing of f.b.i. director james comey. rrthony. >> mason: major garrett at the white house tonight. thanks, major. tripadvisor, one of the most popular travel websites, is accused of deleting customer reviews that raise red flags about potential dangers. tony dokoupil now has looked into this. >> he grabbed me with his arm,

the target? the brand new i-phone ten. thieves swipe hundreds of the kpix5 news begins with a bold heist in a bay area mall, the target? the brand-new iphone 10. thieves swiped hundreds of the pricey apple phones right off a delivery truck. good evening. i'm allen martin. >> i'm veronica de la cruz. new at 6:00, some thieves couldn't wait for tomorrow's release. they grabbed a shipment of phones set for an apple store. kpix5's susie steimle is live at the stonetown mall in san francisco where this theft happened. susie? >> reporter: veronica, this is exactly where at the stonetown gallery that robbery took place. it was on the loading dock of this macy's here. a ups driver pulled up to deliver some packages to macy's. he was inside for about 15 minutes. that's when thieves broke into his truck and took all of those iphones. police still haven't made any arrests.

>> i observed three unidentified suspects who are wearing hooded sweatshirts exit a white dodge van. >> reporter: police want your help tracking down three suspects who took off from the stonetown galleria in a white van yesterday morning around 11 a.m. they made off with hundreds of stolen iphone 10s that were supposed to be delivered to the apple store here. >> it appears that the suspects knew what they were looking for. >> reporter: police say at least 300 iphone 10s were stolen from a ups truck. at a minimum the iphone 10 retails for $1,000. so the thieves made off with $300,000 in merchandise. tomorrow is the much anticipated release of the iphone 10 and the apple store was stocking up. it's the phone that boasts facial recognition technology and an improved camera that can mimic professional quality photos. police believe the suspects were tracking this truck. when the ups drive went inside
