moments before kate steinle died. jose ines garcia zarate admitted to accidentally killing kate steinle on pier 14 in san francisco. he says he picked up something wrapped in a shirt and it turned out to be a gun that then went off but prosecutors argue he pointed the gun at her and pulled the trigger. the bullet ricocheted before hitting steinle. the jurors have for mitosis. first-degree murder, second- degree murder and involuntary manslaughter or not guilty. >> the battleground of this case will be the level of intent. the intent of this man when he had the gun. is this an act of recklessness, criminal negligence or is it depraved heart? is it a deliberate indifference toward human life? >> another flashpoint, the gun was stolen from a truck of bureau of land management agent. the immigration debate gave

this national attention. garcia zarate had been deported back to mexico five times and was wanted for a sixth deportation at the time of the killing. when the defense finishes closing arguments the prosecution will make its final push and then the case is in the hands of the jury. live from the newsroom anne makovec, kpix 5. a california assembly man who represents the san fernando valley will not seek reelection and will resign as majority whip. the decision is in response to a study story that the times will publish in which six women accuse him of sexual harassment. it is reported that he put his hands in a woman's blouse at an after work event. prompting an apology from the democrat. he said it is because of my deep commitment that i have made the decision to resign from the state assembly and immediately resign my

leadership position. i am suspending my campaign and will not run for reelection. let's take a live look outside. rain and dark clouds in the north and east bay. we are tracking it all. >> we are all lit up on the doppler especially to the north. let me zoom in and show you the heavy rain. here across santa rosa along highway 101 it is coming in from the north. we will continue to see more of these areas for the next couple hours or so. these areas of yellow are about .25 inches per hour. it is a quick moving system but these are moving quickly. highway 29 is expected to see a little bit stronger rain but it does look like it is very light right now. very little happening across napa county but it could pick up shortly as well as sonoma. there is more from ukiah moving

down further toward the north bay. right now near sears point 37 getting some heavy rain and across the oakland area we have a very light drizzle. just enough in berkeley to possibly cause you to use those windshield wipers but the south bay is all clear. south bay not expecting much rain at all. as far as totals go we are looking at .1 inch for healdsburg. novato looking at 1/4 inch. i will track your futurecast coming up. a north bay wildlife preserve is opening today for the first time since the wildfires. cambi brown talked with park officials. >> if you go on the safari it can be deceiving because the grass is starting to grow back. behind here you can see the charred hillside and how close the fire came. what does the process look like

now? >> now that we are opened we just want to bring in guests. we are sold out for thanksgiving but we have plenty of space for people to come visit. we have some areas to clean up still. we are in good shape though. >> you chose not to evacuate the animals and luckily none of the animals were injured and they were able to put out some spot fires with two fire engines on scene. i am happy to have these three hour tour for people. they will not be opening the tents until march because of the smoke. they want to get the smell out of the tents and then people can stay. it is very popular in the summertime. i'm cambi brown. a man in custody in connection with a fatal stabbing from last night outside of the san jose city limits at a home on fairway drive in allen rock. the sheriff department says the

suspect and the victim were roommates. deputies do not believe anyone else was involved. police in concord are investigating a suspicious death at a hotel. around 10:00 last night they received a call of a woman being assaulted. when police arrived they found her in her room unresponsive. the woman died at the scene. police were unable to find the 911 caller. deputies are on the lookout for a car tied to the caller. police are investigating what happened when the small plane crashed into a home. the plane took off from the help or airport yesterday. the pilot headed back to the airport shortly after takeoff but crashed into the garage of a home on evelyn avenue. three people were on board. a student, passenger and instructor were all injured. nobody on the ground was hurt. the search is on for missing boater south of half

should suspend him. oakland mayor libby schaaf tweeted oakland loves marshawn lynch let's suspend donald trump instead. nfl players have been sitting during the us national anthem as a way to protest police brutality and racial inequality. >> marshawn lynch had been protesting for a long time. he is respecting the people in mexico. i am a veteran and i know he is not doing it to disrespect veterans. >> so far, officials say they will not force players to stand for the anthem but the president continues to make the controversial protest one of his signature issues. >> he should do his job as a president and not get involved in sports. >> so far this year president trump has tweeted three dozen times about the anthem protest. is unclear if lynch will respond.

in oakland i'm jessica florez, kpix 5. president trump announces increased sanctions against north korea. he calls it a step that is long overdue. >> today the united states is designating north korea as a state sponsor of terrorism. it should have happened years ago.>> the president referred to north korea as a murderous regime. mr. trump says the president has repeatedly supported international terrorism. north korea will join iran, sudan and syri on the list of state sponsors of terror. nebraska regulators approved a different route for the keystone pipeline days after a massive leak. the decision removes the last hurdle to the $8 billion oil pipeline project. the pipeline developer plans to review the decision and opponents plan to appeal. one of the nation's most well known criminals is dead.

charles manson died of natural causes at a kern county hospital. the 83-year-old was in prison for 50 years. danielle nottingham looks back at his past. >> before 1969 few people had heard of him. then came the two day rampage in southern california. manson was convicted of ordering the murders of at least seven people. one of them was actress sharon tate. the wife of roman polanski. manson believed the killings would help bring on and apply ballistic -- apocalyptic race war. manson was born to a 16-year- old mother in cincinnati. he grew up in foster homes and by the time of the murders had been in and out of prison for much of his life.>> i have been watching you.>> in 1986 charlie

timeslot. okay, taking a look at the big board, the financial markets show that the dow is up. uber wants to make it easier for customers to find their drivers. it is a new device called the beacon. customers can select a color and then a beacon in the color will glow on the pickup vehicle windshield. one of several new tools meant to improve service in crowded areas. >> that is a great idea. someone thought my car was uber and they got into it. let's talk about the forecast. we have the darker clouds in san francisco and we are starting to see some drizzle around parts of the bay. here is the high definition doppler and you can see the colors the dark greens and yellows bringing down bigger raindrops across the north bay. so, santa rosa into san helena

starting to get stronger cells and the same with calistoga. the 128 looks to be pretty wet if you're headed toward the north bay. for the next couple of hours we have the rain. napa with lighter showers and american canyon with a decent amount of rain that coming down. a lot of this is moving fast out of here. it looks like there is just a drizzle across the east bay just past oakland but now things are winding down and san ramon looking at a drizzle. the south bay dry and clear as most of this stays north of the golden gate bridge. it is a warm system so we are not getting any snow. here is the futurecast until about 2:00. santa rosa and north bay could get more rain and by 4:00 things are winding down with more clouds lingering from the system and by later tonight things should clear up. for tuesday we expect partly sunny conditions. as far as the rain totals go,
