monday. they are told to ignore one factor on a lot of people's minds, the national immigration controversy. they are focusing specifically on the moments before kate steinle died. jose inez garcia zarate is a 45- year-old homeless mexican in the country illegally when kate steinle was shot in july 201515. steinle was walking with her father when she was hit in the back by a sungle bullet that had ricocheted off the pier. the prosecutor says he was playing russian roulette. the defense says it was an accident that garcia zarate found the gun on the pier wrapped in a piece of cloth, picked it up and it fired accidentally. >> intentionality is the question. why did he do it? was it an accident? was it absolutely recklessness with disregard for human life or something he did intentionally by focusing on miss steinle? >> reporter: the gun had been

stolen from a u.s. bureau of land management ranger's vehicle several days earlier but no evidence links garcia zarate to that burglary. the jurors have a few possible charges to convict on here. first- or second-degree murder or involuntary manslaughter. also not guilty, of course. live in san francisco, anne makevoc, kpix 5. a bay area father spent the past six months in federal immigration custody but is now released on bail to spend thanksgiving with his family. [ crying ] >> hugo mejia walked out of this federal immigration center near sacramento last night and into the arms of his family. immigration authorities arrested him in may avenue tried to apply for a construction job on travis air force base. he has no criminal record. he had a 10-year-old

deportation order. >> i'm happy. i'm going to see my family again. it's important. look at me. i'm hard worker. you think i am a criminal? you see my face. you see my record. i'm not a criminal. i just want an opportunity to stay here. >> he wants to return to work and stay in the country where he has lived for the last 17 years. a rescue mission is under way after a u.s. navy plane crashed with 11 people on board. eight crew members are found and in good condition. the c2a transport went down into the philippines sea southeast of japan. japan's defense minister says an engine malfunction is the cause. the c2 crashed while returning to the uss ronald reagan as u.s. and japanese forces took part in naval exercises. new at noon a former sports doctor for the u.s. women's olympics gymnastics team pleaded guilty in a sex abuse case involving athletes.

laura podesta reports he will spend 25 years behind bars at least. >> reporter: he pleaded guilty to charges including sexual assault, the charges read aloud in a michigan courtroom. >> do you acknowledge, were you in a position of authority over her and used your position of authority to constructively coerce her to submit to penetration? >> yes. >> reporter: he admitted to molesting seven underaged girls over more than a decade. all but one of them were gymnast. >> these victims were all too young to consent, correct? and you knew that, both of those? >> yes, your honor. >> reporter: under the plea deal in michigan, naser will spend a minimum of 25 years in jail. but the judge could go much higher. the former usa gymnastics team doctor also worked for michigan state university. some of his victims said others need to accept the blame for fostering a predatory culture that went unchecked.

[ indiscernible ] you have yet to take responsibility for what happened on your watch. >> reporter: in an instagram post olympic gold medalist gabbi douglas said he sexually abused her, as well. naser still faces countless lawsuits in neighboring michigan counties and sentencing on federal child porn charges. >> his sentencing is january 12th. three cbs employees have now come forward saying they experienced sexual misconduct by former "cbs this morning" co- host charlie rose during his time at the network. cbs news fired him yesterday after eight women told the "washington post" he had harassed them. kenneth craig has the latest from new york. >> reporter: former "cbs this morning" cohost charlie rose is facing new allegations of sexual misconduct.

this time, by three cbs employees. they spoke on condition of anonymity. one says she is not ready for details to become public. another claims rose groped her rear and the third says he grabbed her inappropriately and whispered sexual innuendo in her ear. our cbs news communications officer issued a statement saying: >> reporter: on "cbs this morning," co-host gayle king addressed the scandal. >> i never in a million years thought that we, charlie rose, cbs, would be involved in this story in this way that we are. but i also think we're not shying away from reporting it. >> reporter: cbs fired the news icon tuesday a day after the "washington post" detailed claims of harassment by eight women who worked for or wanted to work for his long-running pbs show. pbs also fired him. >> you want to say anything to those accusers, the people that's accusing you of all these wrongdoings? >> it's not wrongdoings. >> reporter: his comment monday night was at odds with an

earlier statement in which he said, i deeply apologize for my inappropriate behavior. i am greatly embarrassed, low added, i do not believe that all of these allegations are accurate. kenneth craig, cbs news, new york. president trump is blowing a lifeline to embattled alabama senate candidate roy moore. the president said he doesn't want the seat vacated by attorney general jeff sessions to go to a liberal democrat. even if that means supporting a republican candidate facing "claims" of sexual misconduct. the president says that doug jones, alabama's former attorney general, does not share his agenda. >> i could tell you one thing for sure, we don't need a liberal person in there, a democrat. roy moore denies it. that's all i can say. >> moore meanwhile inches to deny the allegations against him. alabama's special election is december 12th. still ahead, fallout from uber's massive data breach. what's next after the company failed to report hacking for more than a year.

of more than 57 million customers and drivers. cbs reporter carter evans looks at how uber handled the breach. >> reporter: uber decided to steer clear of federal regulators when it learned of the widespread hack in 2016. instead of reporting the incident, the multi-billion- dollar company chose to pay hackers $100,000 to delete the stolen data. it's not known whether the hackers followed through. the technology reporter broke the story bloomberg. >> if it was deleted, it would be fine. >> reporter: hackers also got 600,000 license numbers from uber drivers. in a statement, uber says, its outside experts hasn't seen any location that history, bank

account numbers, social security numbers or birth dates were downloaded. >> this incident will give customers pause. >> reporter: at the time of the hack, uber was already under investigation for privacy violations while dealing the troubled tenure of travis kalanick. uber's new ceo wrote: none of this should have happened and i will not make excuses for it. we are changing the way we are doing business. >> it's going to take time to clean things up. he needs new leaders and change the culture. that's a big project. >> reporter: carter evans, cbs news, los angeles. uber says it took immediate steps last year to secure the data and it sees no evidence of fraud or misuse tied to the incident. a security officer and executive were fired in connection. walgreens is trying to cut down on robberies in its stores. the company has installed time delayed safes in its pharmacies

in several states to protect the medicines that thieves target. walgreens says that criminals are less likely to rob a pharmacy when they know that they will have to wait for a safe to open. >> it's a time delay safe so the pharmacist once they activate the safe the safe stays locked for several minutes. they cannot get into it. they have no control over that. this allows the police enough time to respond to catch the criminals. >> not all the chain's pharmacists are on board with it. some say thieves may not believe they can't control how long it takes to open the safe and may harm the pharmacist to get them to do it. let's check the big board now and see how the markets are doing. you see the dow is down about 58 points. today is the last full trading day of the holiday week. the market is closed tomorrow for thanksgiving and friday is a half day. new at noon kids in east oakland will be able to practice their basketball skills on this brand-new court thanks to the golden state warriors. it was unveiled about an hour

today, expected good weather conditions. in atlanta, chicago, houston, should be fine. rain in the forecast, temperatures for the low 50s, boston rain, could impact travel. denver and houston nice and sunny and temperatures are in the upper 60s for denver, l.a. mid-90s. look at our highs today from across the nation. so los angeles expected to break more records today. seattle, portland, also this is warm, warmer than where they should be. and it looks like all of that cold air is right here. minneapolis, chicago, detroit, really feel for them. temperatures down near the freezing mark. 39 degrees for st. louis but what a contrast but makes comparing it to the desert southwest about a 60-degree difference from you in southern california. so if you are heading that way, there's high pressure still and that means that warm weather will stick around through thanksgiving and also for us, we are going to stay warm through the weekend. all the rain is going right towards washington and oregon. so they may see some flooding, several inches of rain back to back hitting them with storm

cbs reporter d at what it costs 30% more people will fly this year for the thanksgiving holiday over last year. 28.5million passengers will fly over the 12 days. we look at what it costs to go home for the holiday. >> reporter: today is one of the busiest travel days of the year. the tsa is expected to screen more than 26 million people during the 12-day thanksgiving travel period. consumers are paying around 23% less for flights this year. that's a good thing. a roundtrip flight is around $157. the cheapest since 2013. but car rentals are up 34% from last year. 89% of people will be driving. the highest thanksgiving gas prices since 2014 is averaging $2.54, up 37 sense from last november. according to aaa, the worst time to travel is between 3 and

that's it for k-p- i-x 5 news at noon. ell, today's tip of the day is going to be fall honeydew in the market right now. still domestically grown in the market and they are delicious. but selection and storage are very important this time of year. well, i get it all the time, but maybe more important now. when you buy it, make sure it's creamy colored to a matt green but creamy and they will feel sticky when they're ripe. heavy for their size, that means they have a small cavity and that's what's important. when you bring them home, you want to store them on the counter. a lot of times the honeydews on the counter not in the refrigerator because on the counter they will continue to ripen and continue to get more sugar content unlike just about any mixed melon.
