it does feel pretty good. >> this morning's eye openering is presented by toyota, let's go places. welcome to cbs this morning, norah is off today. i'm gayle king with bianna goi g golodryga and vladimir duthiers. we have breaking news from washington for you. president trump's former national security adviser michael flynn will plead guilty this hour to lying to the fbi about his contacts with russia's u.s. ambassador. >> the retired general is the highest ranking official so far to be charged in special counsel robert mueller's investigation. paula reid is outside the federal courthouse where he will appear, paula, good morning. >> good morning. this is the second and arguably most significant cooperating witness robert mueller has secured so far in this

investigation. in the next hour, michael flynn will come here to federal court where he will plead guilty to making false statements. now, that is a relatively minor charge when you consider all the information about him and his business dealings that has been presented to the grand jury. sources have confirmed to me that at least half a dozen witnesses have gone before the federal grand jury to testify and provide evidence about mr. -- about mike flynn's business dealings. that opened him up to many charges, relating to failing to register and failing to disclose a lot of those, potentially very serious charges. the fact he's coming here to federal court to only plead to making false statements, this suggests that he is po pen chully providing the special council with incredibly valuable information. >> he was certainly a member of the inner circle. how worried should the white house be, do you think? >> well, they consistently say they're not worried, even when we started to get some hints and some clues that this was coming, specifically when flynn's lawyers stopped sharing

information about the investigation with the white house. they said yeah, it could be a plea. they didn't seem worried. but they should be concerned because this is someone who would have a lot of potentially very valuable information for special counsel. he would have been someone who would have been sitting in at a lot of meetings at the beginning of the administration. all of these crucial decisions he can now discuss potentially with robert muler. >> to be continued for sure, thank you, paula reid. senate republicans are scrambling to save their tax bill after it hit a stumbling block over deficit concerns. the legislation appeared to gain momentum yesterday. but a study showing the massive tax cuts would add $1 trillion to the annual deficit brought it to a halt. >> a handful of republican deficit hawks are hesitant to support the bill. senate aides delivered pizza as lawmakers debated into the night. the debate is set to resume at this hour. nancy cordes is on capitol hill with the new timing for the tax overhaul. nancy, good morning. >> reporter: good morning. well, republican leaders are hoping to hold a final vote today but they are still making

changes to win over the holdouts. arizona's john mccain is now a yes, but others want tweaks. after independent number crunchers found that the tax plan won't pay for itself as promised. >> economic consulting has been about as accurate as those late-night psychic hot lines. >> reporter: most republicans shook off the findings of the bipartisan joint committee on taxation, which is projecting that economic growth from the gop tax plan would only cover about $400 billion worth of the $1.4 trillion cost. >> i think the jct scoring is highly questionable. >> reporter: a few gop deficit hawks like tennessee's bob corker began looking for ways to cut the bill's price tag. >> would you vote? >> we're still working. >> reporter: one idea, to scale back the bill's generous

15-point corporate tax cut. >> kill the bill! >> reporter: protesters rallied against the bill while the senate debated it inside. democrats argued the plan's cost isn't the only problem. >> it will enrich the very wealthiest americans. it will temporarily help the middle class, but the middle class tax cuts expire. >> reporter: but many republicans say it's better to move ahead with an imperfect plan than wait and lose momentum. >> you just can't fail. i mean, this is just unacceptable for the republican party to have the house, the senate and the white house and not be able to reform the tax code, that's just unacceptable outcome. >> reporter: he and other republicans argue they can still make changes to the plan after it passes when senate republicans and house republicans work to meld their two very different bills, a process that the president wants wrapped up, vlad, by christmas. >> nancy, thank you. stocks are losing ground as the senate debates the tax bill.

for the first time, the dow jones industrial average started the day above 24,000. the dow gained 331 points yesterday. the most in one day since march. president trump appears to be ready to shake up his national security team. cbs news confirms that top white house aides have signed off on a plan to remove secretary of state rex tillerson. his most likely report is cia director mike pompeo. tillerson is scheduled to have lunch at the white house today with the president and defense secretary jim mattis. mr. trump declined an opportunity to end the speculation about tillerson yesterday. chip reid is at the white house with more on the timing of the personnel overhaul. >> reporter: well, good morning. the white house insists a shake-up at the state department is not imminent but as has been evident for quite a while, the relationship between the president and his secretary of state is strained, and now a replacement plan is in place and it's been approved by white

house chief of staff john kelly. >> 3, 2, 1. >> reporter: president trump officially rang in the holiday season and a new year may bring big changes to his cabinet. >> do you want rex tillerson on the job, mr. president? >> he's here, rex is here. >> reporter: tillerson was at the white house thursday and the president suggested that meant his secretary of state was still on the job. his spokeswoman dismissed rumors a change was imminent. >> when the president loses confidence in someone, they will no longer serve in the capacity that they're in. >> reporter: but cbs news confirms there's a plan to put cia director mike pompeo at the state department, replacing him with either retired vice admiral robert harwood or arkansas senator and trump loyalist tom cotton. >> i'm proud to be representing the people of arkansas. >> would you like to be cia director? >> i'm very proud to be representing the people of arkansas. >> reporter: cotton denied that he was looking for a new job. but the president has

disagreements over foreign policy with his secretary of state, who, for example, opposes the president's desire to recognize jerusalem as the capital of israel. and the handling of tensions with north korea boiled over just a few weeks ago. >> we just disagree on a couple of things. sometimes i'd like him to be a little bit tougher. >> reporter: that after reports that tillerson has become frustrated with the president and had even referred to him as a moron. >> i have never considered leaving this post. >> reporter: the reorganization would continue the president's trend of appointing former military officers to important white house posts. harwood is a former navy s.e.a.l. and cotton served in iraq and afghanistan. >> oh to be a fly on the wall in that lunch, chip, thank you. the president call tls it a travesty of justice. a san francisco jury find a five time deported mexico man not guilty of murder. he was charged with killing kate

steinle in 2015. this case stir upped a fierce national debate over illegal immigration. john blackstone is in san francisco with the latest. good morning. >> reporter: good morning. outside the courtroom, kate steinle's killing was all about illegal immigrant and sanctuary cities like here in san francisco. but inside the courtroom, the only thing at issue was whether steinle's shooting was intentional or just a tragic accident. following the not guilty verdict, defense attorney matt gonzalez condemned the way the case had been politicized by president trump and attorney general jeff sessions. >> and they may themselves soon avail themselves of the presumption of innocence and beyond a reasonable doubt standard and so i would ask them to reflect on that before they comment or disparage the result in this case. >> reporter: about three hours later, president trump tweeted a disgraceful verdict. no wonder the people of our country are so angry with illegal immigration.

the killing became a centerpiece of donald trump's presidential campaign. >> another victim is kate steinle. gunned down in the sanctuary city of san francisco. >> reporter: kate steinle was walking with her father on a san francisco pier when the 32-year-old was shot in the back. soon after, police arrested jose innis garcia aradi, an undocumented immigrant who had been deported to mexico five times. he recently had been released from the san francisco jail. under sanctuary city policies, had not been turned over to immigration authorities. in court, however, defense attorneys argued garcia zarada found the gun under a bench on the pier and it fired accidentally, bullet ricocheted and hit steinle 78 feet away. garcia zarada is not a free man. he was found guilty of illegal possession of a firearm. that could put him behind bars for up to three years.

and he also faces deportation again. >> john, thank you. we have new information this morning from a criminal investigation of disgraced hollywood producer harvey weinstein. jericka duncan has been following the story since it broke. good morning. >> good morning, gayle. cbs news has learned the manhattan district attorney's office informed people involved in the case they're not looking to move forward in the investigation centered around rape allegations against harvey weinstein. those allegations were brought forward by an actress who says weinstein raped her twice in 2010 while inside her new york city apartment. the new revelation would be a stark change from just last month when the new york police department announced the allegations were credible as they gathered evidence for a possible arrest warrant. the d.a. also recently appoint add senior sex crimes prosecutor to the case but when we reached out for official comment, the district attorney's office told us as this remains very much an

active investigation, we will decline to comment. now, the actress's lawyer responded to the news reporting, telling cbs news the d.a.'s office has copious amounts of evidence and no reason to delay indictment. they urged the district attorney to convene a grand jury by the end of next week or expect the protests to begin. harvey weinstein has vehemently denied any allegations of nonconsensual sex. >> it does seem to be a big change with no explanation. >> it does. i actually just interviewed the district attorney on wednesday. we were talking about an unrelated story but he said this was an active investigation, so to hear that they may not be going forward with this now is definitely new. >> you're just hearing from her attorney right now. >> absolutely, just got a statement this morning. >> all right, jericka, thank you. russell simmons is stepping down from the company he founded after a second allegation of

sexual assault. her movies include "the mummy" and "rachel getting married." the daughter of a director and granddaughter of singer lena horn. anne marie green is here with how these new claims affect simmons' business empire. >> reporter: although he says his memory of the encounter differed from her, he acknowledge heard feelings of fear and intim days and decide to give up control of his companies because he didn't want to be a distraction. writing in the hollywood reporter, jenny lumat says russell initially offered her a ride home in his car but instead brought her to his new york city apartment and forced her to have vex sex. i felt dread and disorientation, she wrote, i wanted to go home. i said i wanted to go home. matt beleny is the hollywood reporter's editorial director. >> this was clearly a traumatic and intimidating and harrowing experience for her. she was locked inside this car

and didn't really have a choice about what happened to her. >> reporter: hours after lumat went public with her accusation -- simmons brand took a hit. hbo announced he will not appear in the new series all def comedy and was removing his name from the show. as the co-founder of def jam recordings, he helped turn public enemy, the beastie boys and ll cool j into stars. his business empire now includes a yoga studio, energy drinks, a fashion label and film and television production. he appeared on cbs this morning in july. >> i like to give people the loyalty. >> reporter: on thursday, simmons said while i have never been violent, i have been thoughtless and insensitive in some of my relationships over many decades and i sincerely

apologize. she says she came forward after simmons denied forcing another woman to have sex with him. a model said simmons forced heard to perform oral sex when she was in his appareartment wh she was just 17. simmons says everything was consensual. >> anne marie, thank you. meantime, a former nbc top executive disputes a report that managers knew about matt lauer's sexual misconduct. jeff zucker who hired lauer for the "today" show says he was unaware of the problem. the current nbc president addressed the issue yesterday. >> there was never a complaint about matt. there was never a suggestion of that kind of deviant predator behavior, not even a whispe of it, nothing like that. >> "variety" quotes several women reported to the network

which fell on deaf ears. saying current nbc management was never made aware of any complaints. lauer faces allegations ranging from lewd comments to indecent exposure and sexual assault. he put out a statement of apology, saying, quote, some of what is being said about me is untrue or mischaracterized, but there is enough truth in these stories to make me feel embarrassed and ashamed. >> the longest serving current member of congress faces growing pressure to resign over sexual harassment claims. congressman john kenniconyers i accused by at least two former staff members. the 88-year-old democrat denies any wrongdoing. house democratic leader nancy pelosi says conyers should go. >> the allegations against congressman conyers as we have learned more since sunday are serious, disappointing and very credible. it's very sad. the brave women who came forward are owed justice. >> conyers' attorney says the

acquittal of an undocumented immigrant, in a san francisco murder trial. good morning, it's 7:26. i'm kenny choi. president trump is upset about the acquittal of an illegal immigrant in a san francisco murder trial. jose ines garcia zarate was only found guilty of being a felon in possession of a firearm in the kate steinle killing. the president had used the case to justify his proposed border wall and crackdown on sanctuary cities. this month marks one year since the deadly ghost ship warehouse fire in oakland. there will be several memorials for the victims starting today. stick around; we'll have traffic and weather in just a moment.

morning. here are three things you should know. final vote on the senate tax overhaul bill could happen later today. senate republicans are working to save the bill after it suffered setbacks over how much it could raise the budget deficit. if the senate bill passes, gop lawmakers hope to quickly reconcile it with the tax bill that passed last month. you may recall. they want to have the final version of the tax plan on president trump's desk ready to sign by christmas. >> hawaii will test cold war era nuclear sirens this morning because of north korea nuclear fears. the test will take place on the first day of each month to make sure everyone knows what to do during an attack. if a missile is launched toward hawaii, people there will have less than 20 minutes to take shelter. >> this has been freaking out a lot of people who have american airlines tickets. american airlines and its pilot union are at odds over how many holiday flights will be affected by a software glitch. america mistakenly allowed thousands of pilots to request

time off during the last weeks of december. the union saying the number is in the thousands. american says it does not expect to cancel flights. >> a lot of pressure on that airline. the father of a missing florida teenager is blaming himself after she disappeared with a high school soccer coach almost one week ago. police say 17-year-old kate lynn frisina and 27-year-old ryan rodriguez are driving north and may cross the border into canada. meg oliver is in lake city, florida, where she spoke to the teen's mother. meg, good morning. >> reporter: good morning. christina and rodriguez were last spotted sunday night at a pawnshop in fayetteville, north carolina. the teen's mother is emotionally drained. she told me this is the longest she has gone without speaking to her daughter. why do you think she left? >> i don't know. we've gone over that question in our minds 1,000 times since this

she's seeing the change as women train in gyms, get set to drive and become more integrated. but there are still limits. holly williams in jeddah, saudi arabia, to show us how society is changing. holly, good morning. >> reporter: good morning. saudi women face some very big challenges, including the male guardianship system, which means they need a male relative's permission to travel overseas or get married. but things here are beginning to shift. if you think that saudi arabia women are all oppressed, shrouded and weak, you probably need to see this. >> we're not victims. we are not victims. we are strong. >> reporter: hallah runs the fight like a girl boxing gym in jeddah. she has a passion for combat sports. are you pushing for total equality? >> i mean, as much -- yes, that would be great. but is there total equality for women and men around the world?

not yet. so hopefully eventually yes, and hopefully my lifetime. >> reporter: there are big changes in saudi arabia. women are joining the workforce in record numbers. and next year they'll finally be allowed to drive after more than two decades of protests. by saudi standards, the country's new crown prince muhammad bin salman is a reformer. it's not just women who feel more liberated. take a look at saudi arabia's stand-up comedy scene. in this ultraconservative islamic kingdom, they still find plenty to laugh at. though this is no democracy and there are red lines. >> sex and religion and trump -- >> politics? >> yes, exactly. >> reporter: his comic influences are american. dave chappelle, kevin hart and chris rock. >> i think from chris rock.

one count of willfully and knowingly making false statements to the fbi. four days after the inauguration flynn was questioned by the fbi and the special counsel's office says he lied about conversations he had with former russian ambassador sergey kislyak. flynn told fbi agents he did not talk about sanctions with sisley yak. the plea deal signals flynn has provided significant information that mueller is willing to put aside more serious crimes. flynn is now the second to plead guilty. the other, george papadopolous, served as a policy adviser for trump campaign. the campaign chairman paul manafort and his associate rick gates pled not guilty to charges including money laundering. this is not the end of the special council investigation. it is ongoing with several more people still under scrutiny, including donald trump jr., carter page and jared kushner. >> jeff, thank you. the senate is back at work right now on its tax overhaul.

they're trying to pass the legislation while they're writing it. the problem is tax legislation is incredibly complex. the careening effects of tax changes on the deficit and economy are complex, so once you change something it affects something over here. nevertheless, they're trying to do this, get it voted, get it done by the end of the day. it is a bit of a rush. >> if you had to call the game right now, what would you say? >> i don't call the game, gayle because -- >> i said if you had to call the game, john dickerson. >> i don't know. i mean there is extraordinary pressure to get this done, to get something done. and so i think when we've seen that kind of pressure act in the past, lawmakers find a way to get it done and then they end up having to live with the results of things shot through in that kind of pressure environment. >> but republicans have dismissed these types of reports from non-partisan groups, the cbo in particular, and other issues when it came to health care they're starting to do it now. so the of is it goiis it going needle at all? >> it gives some pause to some

senators. even if the report from the joint committee on taxation had not been as troublesome as this one was, the two senators holding it up, senators from tennessee and arizona, have old-fashioned republican fears about the debt and deficit. if the theory of this case is cut taxes to get economic growth going, their argument is we for a long time argued that the debt and deficit actually hurt growth as well. so you can't on the one hand try to help growth with this if on the other hand it is hurting growth by creating a larger debt and deficit. so they're not -- this isn't crazy talk. this has been long-time republican orthodoxy. so in that sense what the joint committee on taxation said helps their case, but really doesn't -- isn't central to it. they're arguing something republicans have argued a long time. >> a bigger problem for them now that the trigger mechanism is not being allowed by senate rules, correct? >> that's right. trigger mechanisms, this idea we'll basically change things in the future if it doesn't turn out to go forward the way the authors of this tax plan say, they're hard to craft because

they can have down side effects on the economy. also, by the way, what happens is when you get to the trigger point everybody says, never mind, let's get past the trigger. so it is very hard to create this kind of thing and there are economic reasons you wouldn't want to create it anyway, which give opponents a substantive reason to be against what corker and flake are trying to do. >> john, let me ask you about this. as you know cbs news learned that chief of staff john kelly has seen a plan and approved a plan to replace secretary of state rex tillerson with cia director mike pompeo. is tillerson dead man walking and how difficult must it be to do his job? >> i'm trying to think back of an instance in which you had a coordinated effort by an administration to say, here is your hat, what's your hurry. i mean they are showing him the door publicly, which means, a, obviously it undermines him because the secretary of state has to speak for the president. so obviously he is not speaking for the president because the entire rest of the administration it seems, bailsed based on the way this has been

coordinated, is saying he's not long for this job. so you have to wonder then kind of, okay, why not just get it over with. it also is extraordinary when you look back and think about one of the arguments for the president was that he came from the world of business. i don't think you would have this situation in the world of business, where you just let a secretary of state kind of twist in the wind like this. so the -- if there's going to be a change, it probably needs to happen soon because real things are happening. the north korea issue is heating up. >> but did he have a chance after he called -- reportedly called the president a moron? did he really have a chance after that? >> i don't know. that obviously was not great -- great for him, but one of the things this president has allowed, at least from his secretary of defense and others, is people with strong opinions to voice them. that, on the other hand, is part of where the clash has been between the president and his secretary of state. >> you voice them and then the word embattled comes before your name. never a good sign. thank you, john, very much. sunday on "face the nation" john talks to republican senator lindsey graham, white house

"the atlanta journal constitution" reports on a study that finds your home is probably making you sick. the national institutes of health found 90% of homes have three or more detectable allergens. some common ones include pets an mold. 73% of homes have elevated levels of at least one allergen. >> "the washington post" reports president trump plans to shrink two national monuments in utah more than expected. documents indicate the president will reduce the bear's ears national monument by 85%. he's expected to cut the grand staircase escalante monument nearly in half. his decision will be announced monday. presidents barack obama and bill clinton created the two monuments. environmental groups and local

the senate floor yesterday. a key part of the plan is cutting the corporate tax rate from 35% to 20%. supporters say that would create substantial economic and job growth but not everybody buys that argument. bloomberg "business week" editor megan murphy is with us for more. i was only half kidding when i said a lot of screaming going on. >> the trillion dollars will lead to consternation. >> many republicans are saying ignore that report, the math is wrong. but this was a bill that was expected to be deficit neutral, supposed to help the middle class. who does this really help the most? >> there's no question that this bill in its present form in both the senate and the house is a massive transfer to the wealthy. you can look through any of the provisions in terms of taking the corporate rate down, the individual rate down, we could go on and on. the problem they face now is on two fronts. one is at a prkt cal level as we discussed. their own independent projections show it's not going to be able to pay for itself.

in fact, it's a trillion dollars short over the next ten years. and only taking gdp up projected 0.8% over the next ten years. that's not nearly enough to pay for the bill. on a theoretical level, they face the problem that so many economists just don't believe that what we call trickle-down economics, cutting the top rate of tax for corporations for individuals does enough to stimulate economic growth and in fact doesn't address the central conundrum in america, which is that wages just aren't rising among middle class and working class families fast enough. >> so a major selling point for supporters of the plan is the reduction of that corporate tax rate. also ceos from pfizer and coca-cola say they would pump the returns, the fi argument will companies use money they're get back to pump, into investment and expand job growth, invest in companies and manufacturing. the problem is the evidence shows that that actually doesn't happen. what it shows is we see debt

paid down, share buybacks and more money going to top executive pockets in the terms of more incentives. what we've seen in the last several decades not just in america but other countries is it's boosting the lowest people on the rungs of society that stimulate faster economic growth. this bill if you make under $30,000 you're going to be paying more in taxes. the people who earn the least in this country will be paying more. the people who make the most are going to be paying a lot less. >> if it passes the way they expect it to, the republicans today, is this really the victory they are predicting it will be? >> republicans feel like they need to get this done. they don't have a lot of legislative accomplishments to show as we know. the problem is this risks being a real albatross for them. it is deeply unpopular and doesn't fit into the dynamic we face in terms of populism. people are feeling left out of this recovery, that their wages aren't increasing fast enough and their opportunities are decreasing. i'm not sure this bill acrosses those central questions. there's big risk republicans

>> reporter: when you would work during the week on a bet that you knew was going to kill like the curtain rod and went with the wind, how did it feel sort of in the moments before you went before the audience with it? >> oh, well, i knew that was going to get a huge laugh. i said, this is going to be one of the greatest side gags in the history of television, and it is. >> reporter: and it is. >> and that costume is in the smithsonian. >> that gown is gorgeous. >> i saw it in the window and i just couldn't resist it. >> reporter: everything i see from the show, those old sketches, seems to hold up. is that what accounts for people's attachment and affection for this show? >> i think -- i think so. it certainly showed that we were having fun, and the reason i think that we have lasted -- here we are 50 years and we're celebrating a show that started 50 years ago. that's pretty wonderful. it is as fresh today as it was then. ♪ that you're for me
