>> that's the "overnight news" for r tuesday. it's tuesday, december 19th. 2017. this is the cbs morning news. an amtrak train goes flying off an overpass at 80-mile-per-hour causing fatalities and injuring dozens in washington state. now investigators are trying to piece together what went wrong. today's the day for the republican tax reform vote and it looks like victory is close at hand. and placing blame. the trump administration says north korea is responsible for the cyber attack that crippled hundreds of thousands of computers around the world.

good morning from the studio 57 newsroom at cbs news headquarters here in new york. good to be with you. i'm anne-marie greene. the national transportation safety board says preliminary data says the amtrak train that derailed was going 80 miles an hour in a 30-mile-per-hour zone. at least three people were killed as it hit a new bypass just south of seattle. more than 70 were injured when 12 train cars and a locomotive jumped the rail, some cars falling to the road below. immediately after the derailment, the conductor called for help. >> we were coming around the corner to take the bridge there over i-5 and we went on the ground. >> is everybody okay? >> i'm still figuring that out. we got cars everywhere and down on to the highway. >> the ntsb says it's not known what caused the train to derail

and it's too early to know why it was going so fast. kenneth craig is in washington with the latest. good morning. >> reporter: good morning to you, ann marie. still a massive scene out here and this is where it all happened. take a look down the interstate here. you can see that crumbled mess of a train that we now know was going 50 miles an hour faster than it should have been. >> investigators trying to figure out what caused the train derailment in washington state that killed at least three say they have recovered the event data recorder from the rear of the train. the national transportation safety board says information so far indicates speed may have played a role. >> preliminary indications are that the train was traveling at 80 miles per hour in a 30-mile-per-hour track. >> reporter: this was the first trip for the new seattle to portland route. one local official seems to have predicted just a few weeks ago that something like this would happen.

don anderson had been very vocal at a city council meeting earlier this month warning of the dangers of utilizing freight rail tracks for a high speed passenger rail line. but the tracks have been upgraded so officials weren't concerned about derailment but rather bringing a fast moving train so close to pedestrians and cars. 13 of the cars went off the tracks at an overpass, some tumbling on to interstate 5. >> the train just started to -- seemed like go off on its side and then all of a sudden it went dark and stuff started flying around. >> reporter: investigators say it may take months before they know precisely what caused the accident. >> the highway behind me came to a stand still when this all happened yesterday morning. it is still closed right now and will likely be shut down through the morning commute. >> thank you so much, kenneth.

amtrak's president says an automatic speed check technology called positive train control was not in use on the stretch of track where the derailment occurred. debra hearseman explains. >> it was really too early to tell if positive train control could have prevented this derailment because we don't know what caused the derailment. positive train control is really a backup to the human being. the engineer in the cab could be distracted or incapacitated. positive train control is gps based technology that knows if trains are going to collide with one another or if trains are speeding over what's permitted in that section of track. ahead on cbs this morning, we'll get an update from a member of the national transportation safety board on the scene of the derailment. and now to washington where it appears this morning that the republican controlled congress is on the verge of passing

sweeping tax reform legislation. the house is expected to vote today followed by the senate. nancy has more. >> most main households will see their taxes go down. >> reporter: there are now few obstacles standing between the $1.4 trillion tax plan and final passage. a pair of gop holdouts declared their support and the first major independent analysis found the bill would drive up taxes for only 5% of taxpayers next year, an improvement from previous versions. the tax policy center determined that taxpayers making between 50 and $90,000 a year would save on average $900 or 1.6% of their after tax income. the top earners would see a larger savings of 3.4%. on average, about $51,000. >> it's still the case that over time the tax cuts will generally

get smaller and smaller. >> reporter: tax expert says one area where republicans fell short -- >> i've a form the size of a postcard. >> was their promise to make the tax code simpler. >> it's introducing a lot of additional complexities. >> so we're not going to be able to do our taxes on a postcard? i think the postcard is out. >> controversy simmered over a deduction added to the bill at the last minute. analysts say it would primarily benefit commercial real estate investments. like president trump or bob corker. >> the benefits are larger the more income you have. >> so if i own an apartment that i rent out, i don't benefit from this? >> you might benefit, but not very much. >> corker is a one-time holdout who came around to the bill on friday, but says he had no knowledge of that specific provision and gop leaders back him up on that. democrats say either way, it is a needless giveaway to a thriving industry.

cbs news, capitol hill. well, the white house says north korea was behind a devastating ransom ware attack that locked up computer networks around the world. hundreds of thousands of computers were infected locking up files. then demanding a ransom for their release. the attack all but shut down britain's health service. homeland security advisor tom bossert says last night that north korea was directly responsible. president trump's just released blueprint for a national security harkens back to one of his campaign mantras. >> reporter: president trump unveiled his plan to keep the country safe, stressing one central idea. >> with every decision and every action, we are now putting america first. >> the president plans to protect the homeland with stronger borders, and by targeting jihadist terrorists and transnational criminal organizations.

he's also shoring up defenses against rogue regimes including north korea. >> america and its allies will take all necessary steps to achieve a denuclearization and ensure that this regime cannot threaten the world. >> the president argues effective national security starts with a strong u.s. economy. that means only having relationships with countries that contribute a fair share in trade deals and other international agreements. especially when it comes to defense spending. >> the obama white house declared climate change a growing threat to national security, but president trump's document removes that idea. >> president trump is calling out russia and china as revisionist powers attempting to erode american security and prosperity. >> we will stand up for ourselves and we will stand up for our country like we have never stood up before. >> his plan calls for the u.s. to use its influence to advance american interests and as a

positive force for peace and prosperity in the world. cbs news, the white house. senator john mccain will miss the vote on the republican tax bill, but he says he's looking forward to getting back to work. mccain is battling brain cancer. his doctor says he is responding well to treatment. he returned to his arizona home after being treated for an infection at walter reed medical center. mccain tweeted yesterday, thanks to everyone for your support and words of encouragement. i'm feeling well and looking forward to returning to work after the holidays. georgia power is blaming a fire that caused the blackout at the atlanta airport on a failure in a switch gear. a fire in an underground service tunnel shut down the world's busiest airport sunday. more than 1,400 flights were cancelled and thousands of passengers stranded. delta airlines which has its hub in atlanta says its schedule will be largely back to normal today. and this morning california officials say the massive

another tree is coming after a local tree farm offered to donate a new one that's hopefully healthier. a federal court nominee is pulling out and a review of casualties in puerto rico. those are some of the headlines on the morning newsstand. the washington post reports a federal appeals judge announced his immediate retirement amid sexual misconduct allegations. more than a dozen women have accused the judge of groping them, making lewd comments and showing them pornography. the 9th u.s. circuit court of appeals issued a statement apologizing. usa today reports matthew peterson with drew from consideration after an embarrassing video of his senate confirmation hearing became an online sensation. >> have you ever tried a jury trial? i have not. >> civil? >> no. >> criminal? >> no. >> bench?
