erupted right behind me on campus. this is where attorneys for the four victims just held a press conference. they blame the university and police for not doing more to protect their clients. take a look at the video. this is the one piece of evidence. it shows a woman getting attacked by mass demonstrators. she was trying to see the controversial speaker but never got to because the violence shut down the event. attorneys are arguing that the client's first and 14th amendment rights were violated. it names berkley police as well because one of the clients was allegedly knocked out on city streets. the victims' attorney says the clients had no idea that going to campus would be dangerous and they say police should have known better. >> they knew so much if it required to have 60 extra policemen at the first sign of trouble right here. some person, we don't know yet, we'll find out in discovery,

some administrator told the police and instructed them, against their will is my guess, to retreat inside. they're inside while windows are being smashed less than a year ago. they're looking out as hundreds are being attacked and basically didn't perform their job. >> reporter: uc berkley police set up a time. they didn't want to use the heavy handed approach and go into the crowd because they didn't want to spark more clashes. the four victims are seeking compensation for medical bills and they want the university to change the approach as to how it handles the protests. the university says they didn't have a chance to look at the lawsuit and don't have a comment. leaders will vote on a resolution to formally end law enforcement cooperation with ice. this is after chief ann kirk patrick faced backlash from

critics saying she mislead the public. kirk patrick said an agent from home land security investigations told her the day before the raid that it was part of a human trafficking investigation. it turns out that the undocumented men who were detained had never been charged with trafficking or any other crime. expected action by city leaders follow passage of a bill that limits cooperation with ice throughout california. oak land is in court in a battle over coal within its borders. here is more on the legal issue at the center of the fight with the local developer. >> reporter: the big question here in federal court is does the city have the right to ban coal at the port of oakland? the battle is over a new $250 million terminal at the old army base in oakland. the developer wants it to be a place where coal brought by rail from utah can be loaded to ships headed overseas. the city banned coal at the port in 2016 citing health and environmental concerns. the developer is suing calling

the city's regulation unconstitutional. he says the plan will bring thousands of jobs and that the coal will be transported safely in containers. but there is the contingency of community watch dogs who say no coal is next. >> this is a very vulnerable community, with high rates of childhood asthma. we are concerned about air quality. >> reporter: the city says when it agreed to let the developer build the terminal, the representative said the site would not be used for coal storage and shipment and then changed their mind. >> we believe that a democratic process needs to air this out and that there is no way that this will ever be built. but we hope that it will stop right here with the court. >> reporter: the developer said in court testimony this morning, it's been a lot of work and there is still more work to do. we would like to get to it. the judge has to decide if the city had ample reason to rule that the coal is a substantial

health hazard. >> the trial is expected to stretch into next week. in a few hours a man accused of killing a chp officer is expected in court. the 22 year old is facing second degree murder charges. he is held without bail. investigators say he was driving drunk and high when he was involved in a crash that killed the officer. it happened on christmas eve on the shoulder of 880 in hey ward. a second officer was injured but is expected to be okay. a pittsburgh woman suspected of driving under the influence and causing a crash on a bay area freeway that injured a chp officer. the crash happened just after 6:00 last night on highway 4 near port chicago highway in concord. authorities say the motorcycle officer was at the scene of another crash when the woman hit them. the officer was rushed to the hospital with serious injuries but is expected to be okay. the driver tammy walker is facing felony dui and was taken to the hospital with minor

injuries. walker is held in the county jail in martinez. a police officer in the hospital after this nasty wreck in mod he is a. a man was under the influence driving his pick up the wrong way on highway 99. the officer chased the suspect into a residential neighborhood where he rammed into a patrol car crushing the hood. the officer is in serious condition and the driver was arrested facing several charges. we are learning new details about arrest of a riverside county couple accused keeping 13 children chained inside their home. authorities say the mother of the malnourished adult and juvenile children was confused when deputies showed up at the door 60 miles southeast of los angeles. one of the children, a teen, escaped with a cell phone sunday and called police. neighbors say they had no idea what was going on inside what is now being called a house of horrors. >> the older kids, i thought they were like 12 because they

looked so malnourished and pale. >> i never knew there were kids, especially not 13. >> the children range in age from 2 to 29. the grandparents tell reporters that the parents david and will you's turpin are extremely religious. the children are being treated at local hospitals. we have learned that the former chief strategist steve bannon has been subpoenaed to testify before the grand jury looking into russian election meddling. this is the first time robert mueller has used grand jury subpoena to learn information from mr. trump's inner circle. it is possible that bannon will not testify and that the subpoena is a tactic to get him to talk to investigators. secretary of home land security testified about what she heard thement say during a white -- president say during a white house meeting for

immigration. >> reporter: democrats grilled nielsen about what she heard president trump say during a meeting about immigration last week. >> you are under oath. did president trump use this word or a substantially similar word to describe certain countries? >> i did not hear that word used, no, sir. >> reporter: senator dick durbin was in the room. he insists that the president referred to the countries as expletive holes. >> how did he characterize the countries in africa? >> i don't specifically remember. >> reporter: controversy stalled negotiations to reach an immigration agreement which lawmakers were hoping to accomplish before tackling the budget. now congress only has until friday to cut a deal to keep the government open. >> are they using it as an excuse not to help the president get something accomplished? i think it's a sad day for the country.

unfairly targeted. today marks a major airline for san francisco air bnb host. under new regulation they must start registering with the city. if they don't, air bnb and rivals like home away will not be allowed to have unregistered properties on their site or services. people can apply after today but they are not allowed to rent vacation homes or rooms until registered. san francisco expected to attend a pilot program that would set a limit of two residential parking permits per household in the area. that's half of the current limit. if this plan is successful in freeing up more space, it could be expanded to other neighborhoods. a high surf advisory in place for many miles along the coast. 12 to 14 feet are expected with breakers reaching 18 to 20 feet. we spotted surfers in santa cruz yesterday taking advantage of the monster waves. even though we have the huge

waves, the popular surf competition is delayed. officials were hoping to kick off yesterday or today but now they're holding out for more favorable conditions possibly thursday or later this week. i don't know if you would be able to surf this. i don't know if anyone should. it looks like a bunch of whitewash. this is our live look at ocean beach. we are seeing high surf. the surf advisory expires at 4:00 p.m. we will see bigger surf on thursday or friday along with another storm coming through. there is mysticumming down. we have partly cloudy skies, visibility low along the cost line. that northwest swell is intense with breakers 18 to 20 feet. never turn your back on the ocean. if those are your plans to head out today, you will see quite the sight. half moon bay is down to a third of a mile.

it's improved a bit along the east bay, oak land airport, sfo. i did see slight delays earlier today. visibility is down to a mile and a half. here is a look at the bay. it's 58 in san francisco, 63 in san jose. you are warming up there. that's where the sun is trying to break through. satellite and radar showing plenty high cloud coverage. as far as rainfall, we have it all from overnight. it wasn't much. petaluma, about a 10th of an inch. it was a weak overnight storm but we are watching another one that's on its way. storm number two will be arriving but not until thursday, friday. tomorrow this high pressure will be coming through. we will see partly cloudy conditions tomorrow. here is your futurecast. you can get a good glimpse of that and welcome the sunshine. probably fog in the morning and then things should clear. temperatures will be warmer by a degree or two today. thursday morning is when the
