suspects are considered armed and dangerous. anne makovec is there with the latest. >> reporter: there are a few neighborhoods in here right now under heavy police presence, as police try to find these five armed robbers. four men and one woman all considered armed and dangerous. s.w.a.t. teams from four different agencies spent the day going door to door looking for armed robbery suspects responsible for three home invasions. they happened at around 3 am this morning in petaluma on verjeana drive. >> it sounds like these suspects when in kicking doors, tied up on person, pistol- whipped them, looking for marijuana. none of the three homes were selling or growing in any way. >> reporter: five of the suspects took off in a van which they stopped at 101 and san marin. one man was arrested and four ran away. several guns were found in that van and another group of suspects was found in a nevada

costco. three other people were arrested and one got away. several of the suspects are from north carolina. the sheriff's spokesperson says it's part of a trend of black market pot. >> it's cheap and easy to get. there is a lot of it, and they can rip it off here in california and take it across state lines and sell it in different states where it's illegal and make 2 to 3 times the profit. >> reporter: we did speak briefly with the victims of the home invasions this morning. they were obviously very shaken up and didn't want to go on camera. they said they didn't have any pot there but they say there was a grow operation on that property several months ago within the last year, so perhaps these robbers had some bad information. again, five armed robbery suspects still loose this hour. anne makovec, kpix 5.

the east trains are back up and running in fremont after a several hour delay after a fatal collision. according to the agency, a train hit a truck around 6 am between the fremont and great america stations. the person died in that incident but it is unclear why the car was on the tracks . an investigation is underway into a deadly police shooting in oakland just a couple of blocks from the macarthur d.a.r.t. station -- b.a.r.t. stations. >> [ sound of gunfire ] >> reporter: the sound of at least 10 gunshots captioned -- captured in cell phone video. police say the man had a handgun and wouldn't listen to officer's commands before police shot and killed him. >> some time had passed and officers made announcements. it was some time during this course when officers discharge their firearms. >> reporter: oakland police say the robbers went a few blocks from the macarthur bart station around 6 pm.

after a resident called for help saying a man was on the hand. firefighters arrived and found the man had a handgun so they set up a perimeter. >> four officers were involved, none of them were hurt. there was an individual who was shot and killed. >> reporter: the man was shot in this alleyway between two homes. police have not released the man's name and it's unclear if he lived in the neighborhood but some residents tell me they are not surprised the shooting happened here. denis suarez says he has seen his share of shootings and crime in this community of some million dollar homes. >> it's oakland. nothing surprises me anymore. this neighborhood has changed, turned around. almost every house on the block has changed hands in the last 10 years. i have been here 15 years. >> reporter: oakland police and the alameda county police officer investigating what happened in the moments leading up to the deadly police shooting. jessica flores, kpix 5.

the board of directors for b.a.r.t. is set to discuss a fatal shooting involving one of the transit agency's police officers. family and supporters of shirley tyndall who was killed in the confrontation are expected to attend the meeting in oakland. the shooting happened near the west oakland b.a.r.t. station on january 3. kendall was shot after refusing to drop a gun. his family believes he was not given enough time to react. the future of the pathway home in jan bill is up in the air after a gunman held three caregivers hostage before killing them on friday. a spokesperson says the treatment facility may never open again. the residents have been moved while protocols begin. albert wong reportedly told his brother he was angry and wanted to get back at the staff at the pathways home just days before the hostage crisis. tyrone lampkin told the press democrat his brother was kicked out of the program two weeks ago after he was caught with

knives. on friday, the 36-year-old army veteran killed christine loeber, jennifer golick and jennifer gonzales, all of whom help veterans like him . new at noon, a bay area fire department has exhausted firefighters working forced overtime up to 100 hours in a row. the vallejo fire department said yesterday's three alarm blaze is a looming reminder of its lack of staff. as of this morning only three more recruits are training to become firefighters. nine positions are still vacant. vallejo firefighters say long outstanding contract issues are hindering the department from hiring more people . in san jose, a suspect is facing dui charges after leading police on a high-speed chase. the santa clara county sheriff's office says the pursuit started around 3:30 am near 85 and winchester. it ended around 4:00 when the driver of this bright green car came to a stop at a gas station. no one was hurt and no word on what prompted that chase . former raider eldon smith

is due back in court this afternoon. san francisco police say the 28- year-old assaulted a woman earlier this month. smith is charged with domestic violence, assault, false imprisonment, and fought -- and then listen, all misdemeanors. he was released from the raiders a few days after his arrest . governor brown has a strong message for president donald trump ahead of his visit to california tomorrow. in a letter to mr. trump, the governor said, "in california, we are focusing on bridges, not walls." the message came after the president took aim at the state's sanctuary policies after the weekend. >> they don't care about crime. they don't care about death and killings. they don't care about robberies. they don't care about the kind of things you and i care about.>> this week mr. trump is expected to view the prototypes for his long promised border wall being built in san diego. this will be the president's first visit to california since he took office . the trump administration has just been hit with a lawsuit after it canceled

immigration protections for more than 200,000 people from several countries. those countries are haiti, sudan, el salvador, and nicaragua. earlier this year, the president referred to the affected countries with an expletive. the lawsuit filed in san francisco alleges the trump administration unlawfully terminated the temporary protective status, and even though many tps holders have resided in the u.s. for at least 20 years, they will be forced to leave the country if the new policy remains in effect. president donald trump is set to release his plans for new gun policies. the move is in response to the school shooting in parkland, florida. mola lenghi shows us there is conflict over the idea of raising the age to buy assault weapons. >> reporter: nearly one month after the school shooting in parkland, florida, the white house is announcing its plan on

new gun measures. the president's plan would provide rigorous firearms training for some teachers and urges congress to pass a bill to make the federal background check system more accurate. >> the flow of information that goes from local and state courts is updated with real- time information. >> reporter: arming teachers and fixing the background check system, both policies supported by the nra. the president is not asking congress to raise the purchase age on assault weapons to 21 despite previous support for the idea. >> it doesn't make sense that i have to wait until and 21 to get a handgun but i can get this weapon at eight. >> reporter: the president's rhetoric about changing the purchase age has died down since meeting with nra officials. he took to twitter responding to criticism that he dropped the proposal, writing," watching court cases and rulings before acting. states are making this decision. things are moving rapidly on this but not much political support to put it mildly." "getting an age limit passed through congress would be difficult." >> we send our sons and daughters to iraq.

authorities are trying to determine if they are hate crimes. the victims in these cases were black. officers hope nearby surveillance video will capture the suspects. an official investigation is underway into what caused a deadly helicopter crash in new york city. five passengers did -- died when it went down and east river. nikki batiste has the latest from the scene. >> reporter: a 14 member team from the national transportation safety board is beginning its investigation into sunday's fatal helicopter crash in new york city's east river. cell phone video shows the chopper slamming into the water on the east side of manhattan, just before nightfall. moments earlier, the pilot radioed a call for help. >> mayday, mayday, mayday. engine failure. >> reporter: the sightseeing helicopter was chartered. the pilot is okay but all five passengers wearing tight harnesses, were not able to free themselves.

>> it took a while for the divers to get these people. they worked as fast as they could. >> reporter: temperatures have been unseasonably cold here in new york. the water in the east river is still below 40 degrees. two passengers were pronounced dead at the scene. three others were rushed to the hospital and later died. ntsb investigators will look at numerous possible factors for the crash, including the helicopter's maintenance history and data records on board. nikki batiste, cbs news, new york . police say the helicopter was chartered from liberty helicopters. it's a new jersey based company. one of its choppers was involved in a deadly midair collision in 2009, killing nine people on board. the fashion world has lost a legend. giavan shi was part of a group of elite paris fashion designers who redefined fashion after world war ii. he designed the breakfast at tiffany's little black dress
