hospital, a second is in custody. this happened about7 a.m. at highland high school in palmdale. the dispute between a 14-year- old student and another student sparked the violence the suspect bringing a rifle on campus and opening fire. >> i talked to somebody that was there when it happened. he said he was in a black hoodie and came out of the bathroom and had the assault rifle or something or shotgun or something and just started shooting. all i know is that i guess somebody got hit in the hand. >> my son texted me there was a shooting and i thought he was joking. i said don't mess around that's not funny. no, mom, for real. i locked myself up. >> police went inside with assault rifles and stuff. >> it's an active investigation. we are continuing to search, serve search warrants potentially. we are following up with the timeline of this. we are trying to determine what led up to this. >> reporter: now, this is video of the suspect being taken into custody near the campus. a rifle was also recovered nearby. student who was wounded is in

stable condition. the brother of the accused florida school gunman is being allowed to serve his probation in virginia. zachary cruz pleaded guilty to trespassing at the parkland school where the shooting took place. in virginia, he will have a maintenance job and electronic angle monitor. cruz's brother, nikolas cruz, could face the death penalty if convicted for the february shooting at marjory stoneman douglas high school. 17 people were killed. the defendants in the ghost ship warehouse fire back in court this morning asking the case to be dismissed. kpix 5's jessica flores was at the hearing and has the judge's decision. >> reporter: michelle, there were a lot of developments in the last hour. first, i want to get you a bombshell here. the attorney for derick almena tells us that almena will testify in the trial set to begin in july. now, as for the motion to dismiss, the judge denied it. but it was some good news for max harris because the judge did signal that harris could

possibly be released from jail and await the trial out on zero bond. good news for harris, bad news for almena because he didn't get the same opportunity here. but here are the co- defendants. we have derick almena and max harris. max harris is the one prosecutors say was the second in command at the warehouse and derick almena is the master tenant. both face 36 counts of involuntary manslaughter one charge for each person who died during the unpermitted dance party in the building. prosecutors say the two men created a may see and death trap. but the defense says their clients are being scapegoated and that there's no evidence that the men were criminally negligent. now, the defense is also arguing that the evidence was improperly secured when the warehouse was released back to the owner. almena's wife was in the courtroom. we saw her crying. she responded as the judge said he is allowing the case to move forward. >> i'm really disappointed that the motion got dismissed today. i don't think that was right.

i don't think that, you know, this -- this whole thing is -- i don't feel that it's just. and -- >> -- >> of course i do. >> reporter: now, almena will not be released on bail. harris' attorney said the defendant could be released with zero bail. that follows a landmark case in which the judge said that alternatives should be considered to jail for those defendants who cannot afford to bail out. so the next time max harris is expected in court is june 24th. that's for that bail hearing. and the trial is set to officially start july 16th. reporting live here in oakland, i'm jessica flores, kpix 5. two auto burglary suspects in san francisco are now in custody. one is arrested this morning near steiner street and geary boulevard. investigators say that the

other was arrested after crashing a stolen car to two police vehicles on o'farrell street. officers shot at one point but no one was hit by bullets. prosecutors from across california are meeting today about the golden state killer case. they are trying to come to an agreement about whether joseph deangelo can be tried in one location for the 12 murders he has been charged with. four more were added yesterday by the santa barbara county district attorney. and they are in addition to eight counts of murder and some 50 rapes. the 72-year-old defendant is facing charges in sacramento, ventura and orange counties dating back to the '70s and '80s. california is pushing to expand protection for undocumented immigrants. in the face of immigration crackdowns by i.c.e., the state senate approved a bill authored by scott weiner that limits what people can be forced to disclose in court about their immigration status. >> if your child or spouse

with the victim of a crime and if an undocumented immigrant were the witness to that crime, wouldn't you want that person to feel safe going to court to testify and to make sure that justice is done? >> senate bill 785 was introduced in response to reports of i.c.e. agents tracking down undocumented immigrants in courthouses. it now awaits the governor's signature. governor brown this morning unveiled his final california budget proposal as he enters the last months of his final term. the proposal calls for $199.3 billion in total spending. $137.6billion in general funds spending and an $8.8 billion surplus will allow more money to go to the state's reserves. the surplus is quite a bit higher than projected in january. >> we're having the longest click recovery in modern history and as isaac newton said, what goes up must come down. this is a time to save for our

future, not to make pricy promises we can't keep. i said it before. i'll say it again. let's not blow it now. >> the governor must now negotiate with the state legislature, which is controlled by his fellow democrats. but still, there could be battles over money allocated for homeless programs, healthcare and the state's two university systems. the deadline for the assembly and state senate to pass a budget is june 15th. president trump will make history when he sits down with north korean leader kim jong- un north korea in singapore next month. reporter mola lenghi says the president hopes to walkway with a deal that would denuclearize the korean peninsula. >> reporter: president trump sound optimistic about the summit with north korean leader kim jong-un during a rally in indiana last night. >> the relationship is good and hopefully something very good is going to happen. >> reporter: the president said:

he wants a deal to denuclearize the korean peninsula or he will walk away from it. >> for everybody in the fake news saying he is going to get into a nuclear war. now what gets you into nuclear wars and other wars? weakness! >> reporter: details of the summit are slowly emerging but it's still unclear if mr. trump will have a private face- to-face meeting with the north korean leader. >> kim jong-un did a great service to himself, to his country, by doing this. >> reporter: the president praised kim jong-un for releasing three korean- americans held as prisoners. they are in good health and undergoing medical evaluations at walter reed. as president trump looks to turn a new page in relations, japan's prime minister says his country will not provide

any aid to north korea until abductees are released. mola lenghi, cbs news, the white house. >> the white house cautioned that any provocation from north korea before this meeting could jeopardize the summit. on capitol hill, house republican mark meadows is seeking an audit of the ongoing russia probe. the investigation is looking into alleged russian interference in the 2016 presidential election in august. meadows is making a push for a federal audit in hopes to force the disclosure of a three-page justice department memo spelling out the authorized scope of the investigation. google's big developer conference just ended and mother's day of course is this weekend. and that combination is making things especially busy today at mineta international airport in san jose. more now from kpix 5's jackie ward. >> nope, just one way up. >> reporter: typically passengers can easily drop their bags off at the counter and go up the escalator to security. not this morning. at one point, the line for the tsa checkpoint stretched all

the way back to baggage claim making it look more like thanksgiving week rather than mother's day weekend. the people we spoke to said they were glad they gave themselves plenty of time. >> i didn't know it was going to be this busy. but we're on the way to disneyland. >> we got here because of the traffic. it's usually horrible traffic in the morning so we got here early. we are going to chicago. >> my niece told me to come a little bit early because supposed to be here early. >> reporter: mineta knew today would be a big travel day. they tweeted a warning to passengers thursday afternoon saying, don't be late to your gate: tsa recommends arriving two hours prior to departure. while the early-morning rush has passed and the crowds have subsided, mineta is still telling us that they expect it

to be busy here all day long. from mineta, jackie ward, kpix 5. a high school student is in hot water accused of hacking into a bay area school's district computer system. law enforcement searched his home for evidence earlier this week. >> open the door! >> investigators say that a teacher unknowingly clicked on a phishing email which sent the alleged hacker credentials to the mount diablo unified school district system. some students' grades were changed. the suspect an ignacio valley high school sophomore spoke with kpix 5. >> at this point, um, i hope that and i promise i will never do this again and i'm very sorry for all the people that have grades up and down and i'm sorry for the teacher that got hacked and i mean i kind of want to get this out of, like, an experience, like, i wish i, like, could be a i.t.

the company will also temporarily close more than 8,000 of its u.s. stores on may 29th to instruct employees how to better recognize unconscious bias. another case of alleged racial bias making national headlines. a white yale student called police on a black student she found napping in their dorm's common area. the graduate student was questioned by yale police for about 15 minutes and ordered to unlock her apartment door and provide her student identification. >> i deserve to be here. i pay tuition like everybody else. i'm not going to justify my existence here. >> this is private property and we are police officers here. so we are allowed to do our job. >> police say they handled the incident appropriately. yale has admonished the white student who originally called officers. videos of the incident have been viewed on facebook and twitter more than a million times under the hashtag, napping while black. time for a check of our weather forecast. it's getting hot out there. >> it sure is.

it's a nice one out there. wow, let's take you to ocean beach. look at the waves. there is a gale warning out there in the waters which does affect a lot of boaters. but as far as walking along the shoreline, that's not a bad place to be right now. those waves do look ferocious! but winds are also starting to pick up. but we'll have warmer weather out there. it is looking like the winds are already starting to pick up a bit. here's a view of the bay, nice calm conditions and blue skies. sunshine warming things up nicely around mount vaca. look how clear it is up there. 70 degrees already in san francisco. 74 in livermore. 65 in oakland. 75 in concord. and it's going to get warmer. here's a look at your afternoon highs today. 87 in fairfield. napa 86. santa rosa 87. so upper 80s. we also have this wind advisory that's going to start tonight through early tomorrow morning. strong wind gusts across the north and east bay hills all because of what's going on out there in nevada. this low bringing them some rain and some snow. it's going to bring us wind and warm weather for today and

tomorrow. we also may see some sierra showers especially some thunderstorms all possible tomorrow and sunday even into monday because of what's going on there in nevada. here's a look at a great way to spend the weekend. it's going to start off warm on saturday. alameda spring festival mild conditions 71 degrees. and then free admission for mom for mother's day on sunday and sunday low clouds coming through but also cool conditions at the zoo. our temperatures today are above average. they will stay that way for tomorrow, as well. sunday cooling off. monday, tuesday, wednesday, next week look at that, temperatures dropping down into the 50s to 70s. there's a chance we could see a chance of rain. we haven't had that in quite some time. >> rain? >> thank you. let's take a look at the big board right now. the dow is up about 65 points. still ahead, the problems that cause your pets' hair to fall out. we'll talk to our pet expert dr. jill for some advice.

a product for flea and particular control. and she had noticed that her cat had fur loss on its body and here's some photos of that. and she was wondering whether or not it was from the seresto. i would say no in general probably not from that. but sometimes they will have itchiness or fur loss, you know, due to products but i don't really think that's probably what we're dealing with. fleas are an environmental problem. if you are trying to control it, do your environment. it's not that you can't use -- [ dog barks ] >> oh!! it's not that you can't use the topical products it's just that honestfully if fleas are in the environment, the pet will bite it and be itchy regardless of the topical product. the fleas will die but the itch will be there and they will lick and have fur loss. so focusing on the environment
