live from the cbs bay area studios this is kpix 5 news. thousands of uc berkeley students graduate today at the spring commencement and with the recent labor disputes some are boycotting. details ahead in a live report. should undocumented immigrants be stripped of their protections if they are dangerous felons? the bay area's new sanctuary showdown. a bay area billionaire fired up. for the first time he is speaking out about the beach battle making national headlines. 6 a.m. on this saturday, may 12. we will get started this morning with a check of your forecast. an absolutely gorgeous start to your morning. take a look outside the bay bridge. the water very calm on the bay

this morning. clear skies. nice mild temperatures. temperatures in the low 60s pretty much area wide. so certainly a mild start as you head out the door. your weather headlines, clear and mild to start. warm for your saturday. likely going to be -- well, it is going to be the warmest day over the next week are or so. cooler beginning tomorrow for mother's day as we see the clouds roll in. so if you are heading up to the high country for mother's day, we are likely going to see some thundershowers in the afternoon not just today, but really for the next week or so. we are looking at temperatures mild, in the upper 50s today, near 60 tomorrow, but likely going to see some thundershowers. alameda spring festival, warm, low 70s today, plenty of sunshine for you. your full forecast in just a bit. commencement ceremonies are scheduled this morning at uc berkeley, but the scheduled keynote speaker, u.s. speaker kamala harris, won't be there.

jackie ward live to explain why. >> reporter: yeah, just about 6,000 graduates are expected to walk across the stage today and get their diploma. still there are some students who will be disappointed with today's events and how everything will pan out. hours into the workers strike this week, senator harris broke the news she would not be speaking at berkeley's commencement as originally planned. instead, chancellor carol christ will. senator harris said because of the labor dispute she can't attend. the strike ended early thursday morning as negotiations between the uc system and its workers continues. uc is proposing a 3% wage hike while the employees are calling for a 20% raise over the next three years. >> it's about bummer she is not able to show up for us. we support our strikers and our workers for them to get paid well. >> reporter: senator harris tweeted this week, quote, if we are going to live up to our ideals as a nation it is

critical we focus on economic equality and economic justice. one key is making sure everyone has access to a good job with fair wages. commencement ceremonies begin at 10 this morning. well, new college grads in los angeles had a graduation to remember. their commencement speech came with advice from oprah winfrey. >> the truth has always been and will always be our shield against corruption. our shield against greed and despair. the truth is our saving grace. >> oprah spoke at ucc's school for communication and journalism yesterday. happens to be my alma mater. fight on trojans. she had simple life lessons for the grads. eat a good breakfast and put your phone away at the dinner table. investigators are looking into what caused a deck to collapse injuring two people at an oakland home. it happened yesterday. the collapsed deck had been

attached to the home's second story. firefighters say the dry rot may have been a factor in that collapse. well, the growing popularity of drones is causing a dilemma for outdoor pro sports teams. they say more needs to be done to stop people from flying drones over stadium. last year a drone operator dropped leaflets on a 49ers came and an oakland raiders home game. some are drafting congress to give law enforcement permission to seize or reroute drones flying over stadiums. >> law enforcement, they will conduct the investigation. if there is somebody flying, an egregious act and trying to harm somebody, they will get involved. if it's a recreational flyer, law enforcement has their hands tied. >> santa claire was the first municipality to ban flying

drones over a stadium. this ordinance, the penalties and rapid response have proven to deter subsequent violations. the faa is considering license plates tore drones so they can be more easy i tracked. san francisco's sanctuary status has put it in the crosshairs of the trump administration. now one mayoral candidate says the existing law is a magnet for felons to come to the safe shores of san francisco making it a more violent city. >> reporter: a candidate has turned the sprint to june 5th on its ear again. the petition for the november ballot asks to have violent felons exempted from the protections of san francisco's sanctuary law. a move that would have ensured cate steinle's killer was turned over to i.c.e. she offered the original law as a member of the board of supervisors. >> in '94 i amended it to take

felons out because they were treating it as though felons were in. i specifically amended it to say we are not covering dangerous felons. in 2013 and 2016 debbie campos and john avalos went back, amended it to add serious dangerous felonies, three within seven years. >> reporter: reaction from other candidates in the race was swift. former state senator mark leno. >> sacrifices san francisco valley, in particular with regard to sanctuary city, to perpetuate this trump myth that our immigrants are murders and rapists and child molesters really instills fear into communities, and i think it's not worthy of democratic candidates. >> reporter: district 6 supervisor jane kim echoes that sentiment. >> i was incredibly surprised that the author of sanctuary policy is coming out to weaken our status as a sanctuary city.

i am proud that we are a city that protects all of our residents regardless of documentation. her proposed changes i think make us less safe. >> reporter: and this statement. london would never support a measure that describes immigrants as murders, rapists, and felons. she is surprised by the reaction of her fellow candidates. in her time campaign, she said san franciscoans have said the policy needs common sense reforms. >> we don't want to welcome dangerous felons to san francisco. that's how i've always felt. a survey poll earlier in year showed that 61% of folks here in the bay area say that local law enforcement should assist federal authorities in cases involving undocumented immigrants who are suspects in

violent crimes. she would need to collect 10,000 signatures to get the sanctuary city ordinance on the november ballot. meanwhile, candidates jane kim and mark leno have released a joint ad to boost their chances against better funded candidates like london breed. what the former mayor thinks about the duo. >> it's the first time that a process has been admitted as a means by which you can tag team the guy who or girl who is at the top. that is what is happening with those two. they can't beat london breed one-on-one, so they are teaming up almost like in a schoolyard. when i was a little card, i was never big enough to beat anybody up, so i always tagged up with somebody else to go after my enemy. >> more on that tomorrow morning with melissa at 6:00 right here on kpix 5. anyone can get the bathroom code at starbucks starting today. the coffee chain now has an

open bathroom policy. the move comes a month after two black men were arrested at a philadelphia store. one of the men was denied access to the code because he hadn't bought anyone. it triggered protests. now some starbucks customers say changing that policy was the right thing to do. i think it makes sense, especially, well, in san francisco of all places. it's going to be very inclusive. so you want to be able to allow anybody to use any kind of bathroom fassi. >> starbucks founder howard shults says it doesn't mean that it's a public bathroom, but stores will hand out the code no matter who asks. it should be one of the safest mailboxes to use. we found identity thieves trying a new tactic at this bay area post office. and a bay area billionaire speaking out for the first time about fighting beach access through his private property. why he says it's not about access but principle next.

some mail thieves are trying a new tactic. we found badly bent mail slots at drop boxes at the u.s. postal service. a man who did not want to be identified told us he thought they looked suspicious and actually reached in and could feel the mail jammed in the chute. he dropped his own bills in, including his $2,200 mortgage payment in one of the boxes. now, a week later he was notified it had been stolen. >> i do not have any proof. i mean, it's not hard to connect the dots that clearly an individual or individuals were able to access it not by

breaking it open, but by shoving their arm in there. >> the postal service told us the boxes would be fixed immediately. the man's bank covered the stolen check. now he is worried about identity theft. a billionaire property owner is speaking out for the first time about the beach battle that's made national headlines and may go before the supreme court. vinod khosla says he is defending his right to control beachgoers passing through his private property in san mateo county. the dispute is over a gate that blocks the only road to martins beach south of half moon bay. the beach is public. the only road to it is on khosla's private property. >> reporter: he is a hero to would-be founders and entrepreneurs, posing for photos after his keynote speech at a startup competition in san francisco. but 30 miles south, folks have a bit of a different opinion of vinod khosla. >> he put up the gate and started arresting surfers.

>> reporter: the billionaire founder of sun micro was at the center of the controversy to martins beach. it's the first time we have heard from khosla on the issue, which he says is not about beach access, but private property. he pointed us to a blog he wrote defending his position and criticizing what he called unfair media coverage. >> you know, open beach access has never existed on that property ever. >> reporter: he explains a former owner allowed access to people who paid for parking. it was a business. but when khosla bought it, he says the state said he couldn't make basic business decisions, things like changing hours of operation or the $10 fee. >> and you know the courts have ruled there is no public access. >> reporter: in a separate suit the surf rider foundation argues even if it is private property, if he wants to close the gate or charge more for parking, it's, quote, development, and khosla should have to get a permit.

>> just like everybody else. >> reporter: even though it's his own private property? >> even though it's your own private car, you've got to get a driver's license. >> reporter: he says the issue is access. >> the surfers just want access to the ocean. >> reporter: khosla argues the state could have bought the property itself, instead letting him buy it and restricting his rights. >> i think he knew everything he was getting into. >> reporter: khosla is taking his case to the supreme court. if it wins, it could ultimately affect the entire california coast. this could set a precedent for coastal access statewide. does that bother you? >> absolutely bothers me, but we need a commission that works with property owners to follow the law. >> reporter: still he says he doesn't want to restrict access, but it's a matter of principle. >> you know, sometimes i'd rather do the harder, right thing than the easier wrong thing. >> reporter: the gate is open

every day from 8 to 5 and has been since last summer. i am told most surfers walk down to the beach when the gate is open. khosla has offered to keep the property open on the same terms as the previous owners, but the county refused. surf rider doesn't think the supreme court will actually ever hear khosla's case. wildlife rescuers statewide are seeing an increase in pelicans in distress. thursday a pelican wandered up to a starbucks in the financial district. another one picked up by firefighters in berkeley and taken to a rescue. the peninsula humane society in burlingame takes in large birds. they say pelicans in southern california have been rushed to shelters recently suffering from malnourish. , hypothermia, and lies. >> we don't know if that's the situation in northern california yet. if so, these are isolated cases. >> the peninsula humane society says the pelican founded -- found at starbucks is doing

better. america has a new number one name for baby boys. the new report shows liam was the number one boy's name among babies born in 2017. the previous number one noah fell to second followed by william, james, and logan. michael fell out of the top ten for the first time since world war ii. as for girls, emma was number one for the fourth straight year. olivier, ava, isabella and sophia. i know little girls with all of those names. sophia rounded out the top five. sofia with an f is 13th. devin is number one among boys. julie placed 518th among girls. i don't think anyone's named our kids that since the '80s. all the top five girls' names end with an a. and olivier, we were gonna name my daughter

area of low pressure to the east of the sierra. that is creating that unstable air mass. instability in the afternoon is going to lead to likely afternoon thundershowers for the sierras. keep that in mind if you are taking mom up there. back here we have got high pressure north flow. that north flow clears out the clouds, keeps us nice and warm. today is going to be a beautiful day and very warm. however, a shift in the forecast for your mother's day. look at futurecast. it tells the story here. starting off clear and mild today. this is 6 a.m. saturday. as we advance on though into 6 a.m. sunday we see the marine layer beef up. the onshore flow increases ushering some of those coastal clouds inland and temperatures will drop because of this. tomorrow likely going to be cloudy and cool for your mother's day. here we are for mother's day morning. big changes in the works. and that area of low pressure, well, high pressure diminishing offshore. low pressure going to keep it cool ushering in that marine

a dragon at walt disney world caught fire yesterday in florida at a passed away. it didn't stop its head from swinging side to side. a disney employee put the fire out. luckily, no one was hurt. the cause of the fire is under investigation. here is vern with a look at sports. >> hey, good morning everybody. don't worry. i'll be telling you about the warriors in a jiffy. i will be talking about it saturday afternoon. the team leaves sunday, but we will address this western conference finals, which can't get her soon enough. and boy, what a night for this fella. dexter fowler. we'll tell you the story about him and his peeps. >> it's got to be huge.

people in 29 states have gotten sick since mid april. half were hospitalized. one person died. health officials say the tainted lettuce was grown in yuma, arizona. a new study finds there are ways to help people with dementia live a happier life. research in the journal of psychological medicine studied more than 37,000 people. it says good relationships with family and friends are linked to a better quality of life. other factors, social interaction, religious beliefs, and being able to manage everyday activities. in the next half hour, an initiative to help mothers who can't pay their bail get out of jail just in time for mother's day. and what a white house aide said about senator john john mccain's battle with brain cancer has his daughter speaking out.

we have likely afternoon thundershowers today and tomorrow in the sierra. temperatures up there near the 60-degree mark for mother's day, upper 50s for today. in the bay area a beautiful sunny saturday. temperatures in the low 70s for alameda. the alameda spring festival this weekend. and for tomorrow, mother's day, that's when things start to cool down. we are talking cloudy and cool and upper 50s at the zoo. free admission for moms. the full forecast coming up in a bit. controversy swirling around this morning's graduation ceremony at uc berkeley because of a recent labor dispute. >> jackie ward is live to explain why senator kamala harris won't be there as planned. >> reporter: yeah, good morning to you both. we spoke to students earlier this week who, of course, are excited for this milestone and to celebrate their achievement, but they are a little bit disappointed in today's change of events. senator kamala harris canceled

her speaking engagement for today's commencement hours into the three-day uc workers strike that happened earlier this week. many employees at the strike said it's not just about what they call the insignificant wage hike uc is proposing. they claim uc has racial and gender inequality issues that the administration refuses to address. for some strikers, it said it meant a lot it have senator harris backing them. >> it gives us hope that the university might listen to them. obviously, they are not listening to us. >> reporter: senator harris tweeted earlier this week that, quote, if we are going to live up to our ideals as a nation, it's critical we focus on economic equality and justice. instead of senator harris, they will be listening to the chancellor's speech at 10 this morning. a growing backlash aimed at the white house over comments an aide made regarding the

failing health of senator john mccain, cbs reporter mola lenghi. >> reporter: john mccain's daughter, meghan, dismissed people who have been critical of her dad over his decision not to support gina haspel's nomination to be cia director. >> my father's legacy will be talked about for hundreds of years. these people nothing burgers. >> reporter: a general told fox business network that torture works and falsely accused mccain of giving the enemy information when he was being tortured while being held as a p.o.w. during a meeting thursday, a source tells cbs news that special white house assistant kelly saddler said mccain's opinion on haspel, quote, doesn't matter because he's dying anyway. mccain is undergoing treatment for brain cancer. as it turns out the general does not have a job. fox business announced it will not be using him on air

anymore. but white house assistant kelly saddler is still working in the west wing. >> i am not going to comment. >> reporter: president trump has been highly critical of mccain in the past, suggesting it was mccain's own fault he was a prisoner. >> he is not a war hero. he is a war hero because he was captured. i like people that weren't captured. >> reporter: mola lenghi, cbs news, the white house. president trump wants to open negotiations with california about fuel efficiency and tailpipe emissions. california has strict standards that they have to meet to sell cars here, and they want to make sure they can sell the same cars nationwide. the president told the transportation secretary and epa administrator to explore talks with california. the goal would be to create a single fuel economy standard into the president is prom --

standard. and on a separate issue, giving private insurers more negotiating power with drugmakers and requiring drug companies to disclose their prices in tv ads. another would eliminate a gag rule on pharmacists. >> our plan bans the pharmacist gag rule, which punishes pharmacists for telling patients how to save money. this is a total rip-off and we are ending it. >> an existing rule prevents pharmacists from telling patients when the cash price is less than the co-pay on their insurance. now, critics of that rule, including the president, say it just benefits middlemen who negotiate prices. well, another black eye for san francisco based wells fargo bank. a federal judge has ordered the bank to pay $97 million to its mortgage consultants and bankers for failing to provide

them with legally required 10- minute breaks during the work day. wells fargo is already working to rebuilt trust with customers over scams involving fake accounts. wells fargo plans to appeal saying the court's decision reflects a misunderstanding of our compensation plan and a misapplication of the relevant state law. mother's day is tomorrow. the sad reality is thousands of women will be spending it in custody because they can't afford bail. here is kpix 5's christian ayers on the bay area push to change that. >> we were crying. she was crying. >> reporter: anita and three of her friends walked into the lobby of santa rita jail last week with $50,000. >> we presented a check to pay for her bail. >> reporter: the woman who was behind bars shocked to find out, because of these strangers, she would be home this weekend. >> she was just like, oh my god, all these women have come to, you know, to see about me, to make sure that i got home

for mother's day. >> reporter: this is the second year in a row the oakland-based group is joining other non- profits across the country collecting donations to bail mothers out. last year they bailed out more than 100 women. we are going to bail out more black mamas before mother's day. >> we are tired of this money bail system that keeps people incarcerated simply because they cannot afford to buy their freedom. >> reporter: it's part of a larger movement to reform the u.s. bail system. last year, senators kamala harris and rand paul co- sponsored a bill that would overhaul the bail system. this week google announced it would ban all ads for bail bonds services. facebook followed. >> google has a responsibility to protect our users from deceptive or harmful products. >> reporter: the california bail association acknowledged some reform is needed, but said they have become a target. eliminating the bail industry will not end crime in the country. it will only reduce the options

people have for release. unfortunately, google and facebook have decided to buy into the myths being provided by many of these social justice advocacy groups. anita says this is a question of right or wrong. >> the bail system, to me it's no different than a predatory lender. we have a right to fight against a system that we -- that part of the system we feel is unjust. >> the california bail agents association argues that by supporting bail reform, google and facebook are supporting the elimination of small businesses that are often owned by women and minorities. the association says that banning bail ads would actually make it harder for families to get loved ones out of jail. elon musk wants to ease traffic congestion. his plan to transport cars by underground rail. and it's for sale. your very own bay area chateau. we get a tour of the mention

is taking them all up. the city a new parking st heading to burlingame? people say construction is taking parking spots up. the city wants to build a new parking structure and a housing development on and the nnf parking lot. they believe it will ease the parking crunch, but business owners say other projects in the area have already made parking terrible and they worry about more construction. >> i don't know what we are going to do while they are building those. so again we are still stuck. we have had clients just circle and circle. some of them have even called us and canceled their appointments because they couldn't find parking. >> now, plans call for the housing to be built before the parking garage, but there is now an online petition asking the city of burlingame to build the parking structure before the housing. the city of san francisco is firing back at its central subway contractor in a dispute over miles of rail.

the municipal transportation agency says three miles worth of rail laid between 4th and king streets in san francisco's chinatown needs to be ripped out and replaced. the city says the contractor failed to install high-strength rail and used standard-strength track. in dozens of documents and details obtained by kpix 5, they are arguing over this matter back to 2014. today muni told us it has always rejected the use of standard rail and only signed off on a purchase of it in order to keep the project moving ahead. >> we did accept that they could move forward with the rail installment on the condition that they purchase high-grade rail. >> reporter: at no point did you approve the installation of the regular steel? >> no. this project has always called for high-grade rail. there weren't any contract modifications to change that

fact. >> no response from the construction company. they told our wilson walker that families with sfmta for -- that the fault lies with sfmta. commuters can start riding elon musk's underground tunnels to avoid one of the worst congested roadways -- easy for me to say -- in the country. the billionaire gave a glimpse of what riders could expect. reporter chris martinez has details from los angeles. >> reporter: this is what it could soon look like, zipping 125 to 150 miles per hour through a small tunnel 30 to 70 feet below ground. the spacex billionaire teased the clip on instagram promising free rides to the public in a few months once it get regulatory approves. the high-speed underground public transportation system called loop was dreamed up by the tesla creator as a way to betula congestion.

>> -- to beat l.a. congestion. musk is finding the entire project on his own and says eventually commuters will ride for less than the cost of a bus ticket. the proposed line runs nearly three miles on the city's west side. massive machines like this would quickly dig low-cost tunnels where pedestrians, bicyclists, and drivers could be transported on autonomous electric skates. each would hold eight to 16 passengers or a vehicle and exit points could be as small as a single parking space. loop has two other projects planned for the east coast. chris martinez, cbs news, los angeles. and this video has more than 2 million views right now. this human-like robot can run and jump, and it's really creeping people out. made by boston dynamics, it can

jog across uneven terrain and jump over obstacles. many people online say that robots are just one step closer to taking over the world. and if you need more proof, check out this next robot. it was on display yesterday at a robotics event at uc berkeley. tech companies from around the world were there to demo the latest a.i. products. the company says they can do a lot more than just serve food. >> robots can understand the environment. it draws the map of the restaurant, understands the table number, and when the server asks to go to table one, it finds a safe route, detects the humans moving around, strollers, babies, stops, reroutes, and delivers the food to the table. >> developers say it won't be long before you can see these robots out in the community, your workplace, and even your home. let's take a look at some new sky drone video i shot earlier this week.

it was a beautiful day. this along the coast in half moon bay. i went out to the san mateo coast near half moon bay over the waters and delivers there. >> gorgeous video. i think it's going to look like that today. going to head out with the drone? >> maybe. we'll see. >> maybe a taste of that video tomorrow. it is going to be a beautiful day. clear skies is what you get this morning. temperatures really going to be warming up though throughout the day today and then a big dropoff for tomorrow. so right now in the low 60s for most spots around the bay. 59 in concord and 57 santa rosa. a look at the satellite perspective shows changes are on the horizon for right now. high pressure in place over the pacific and that is keeping our flow out of the north. that's a warmer dry flow. it's going to keep the skies clear and temperatures warm today. however, this area of low pressure to the east of the sierra, that is what's creating a sort of unstable air mass over the higher elevations and

likely going to see some afternoon thundershowers in the sierra, plenty and sunshine and no clouds just yet. futurecast starts out with clear skies all over the bay and then watch that marine layer really beef up overnight tonight. onshore flow increases tomorrow ushering the marine clouds inland. by 6 a.m. for your mother's day, much cooler. we will increase that onshore flow as well. in fact, quite cool through the next week. the next seven to ten days. weather headlines. clear and calm. mild to start this morning. saturday going to be the warmest of the next week or so. then a cooler pattern begins tomorrow. below average. our temperatures remain below average through the extended forecast. high temperatures for today, however, above average one more day. we are in the low 70s around the bay. mid-80s for folks in the east bay. concord 84, san jose 87, 85 oakland today. all of those temperatures below

>> they stay in the homes where they are loved and they have the basic medical needs that are necessary to keep them healthy. >> reporter: cancer survivor linden nelson can focus on paying her medical bills and not have to worry about her pooches. >> and it's compassion that you feel here. >> reporter: and mark fox, who is homeless, can keep his 8- year-old pet. >> she is gonna have little pups. i can't afford to pay for it all. >> we definitely want to make sure that the homeless people are able to keep their pets with them. sometimes it's the only thing they have left. >> reporter: outside of the clinic erin has rescued pets and emergencies working in the burn unit. she speaks to schools and community groups will proper answer care. she organizes fundraisers like car shows to pay for furry friend's supplies and services. she inspires her volunteers like vet tech michelle. >> she is a great vet tech. a good mother.

disappointed in today's events. just hours into the uc workers three-day strike that started this week senator kamala harris broke the news she would not be speaking at berkeley's commencement as originally planned. instead, chancellor carol christ will. senator harris says because of the labor dispute she can't attend the commencement ceremonies. uc is proposing a 3% wage hike while its employees are calling for a 20% raise over the next three years. >> it's a bummer she is not able to show up for here for us. everyone here as students, we support our strikers and workers for them to get paid well. >> reporter: senator harris tweeted earlier this week if we are going to live up to our ideals as a nation it's critical to focus on economic key quality and economic justice. one key is making sure everyone has access to a good job with fair wages. the commencement ceremonies get underway at 10 this morning.

jackie ward, kpix 5. and 6:55. time for your final 5. the growing popularity of drones is causing a dilemma for outdoor sports teams. >> they want more to be done to prevent people from flying drones over stadiums nationwide. in an example from last year, a drone operator dropped leaflets at a 49ers game in santa clara and an oakland raiders home game. according to "the washington post," some teams are asking congress to give law enforcement permission to seize or reroute drones over stadiums. anyone can get the code at starbucks. they now have a open bathroom policy. it comes after two black men were arrested at a philadelphia store. one was denied access to the code because he hadn't bought anything. president trump says his meeting with kim jong un is going to be a big success. he made the comment at a rally on thursday where he celebrated the release of three americans
