morning. from the broadcast center in new york city, i'm elaine quijano. captioning funded by cbs captioning funded by cbs it's monday, june 4th, 2018. this is the "cbs morning news." a volcano erupts in guatemala killing dozens as rescue crews struggle to reach areas cut off by lava. there's a push for president trump to testify in the russian investigation, but his attorney rudy giuliani continues to push back, and it could turn into a legal war. >> i do think it's beginning to ing it unless theytart f not coming across with things we start asking for. ♪

and with that movie by an off-duty fbi agent, one person is shot and the party is shut down. now the fbi is investigating. good morning from the studio 57 newsroom at cbs news headquarters in new york. i'm hena doba in for anne-marie green. we begin in guatemala and the deadly eruption of one of central america's most active volcanos. at least 25 people were killed and 20 injured. the el fuego volcano erupted yesterday. it's about 30 miles from guatemala city. it's the second eruption of the year. the volcano sent lava across roads and homes of nearby villages. the area was covered by heavy ash. columns of ash were thrown more than 30,000 feet high. hundreds of rescue workers searched for victims until nightfall.

they struggled to make their way over charred roadways. the search resumes this morning. more than 3,000 residents evacuated. the volcano continues to erupt and officials fear that death toll will rise. in hawaii three people had to be rescued after being trapped by lava from the kilauea volcano after ignoring evacuation orders. the volcano has been erupting since may 3rd and shows no signs of letting up. here's carter evans. >> reporter: that is a huge, huge lava front there, just consuming everything in its path. massive amounts of molten rock and unstoppable nature. from above the devastation is widespread. this is the community of kopoho. authorities have been anticipating that the lava would get here for days. it could end up being the new

lava site. homes and businesses are gone and anything that survives here would be cut off from the rest of the island. residents packed up what they could before the lava arrived. this area known as four corners because it's intersection of two mar ys. lava has covered it all. there's nothing left here and with it, two major escape routes for people in this community. on the ground in leilani estates, lava is still taking out homes. when this one caught fire, a sheriff's deputy on vacation, impervious about the lava, just happened to be there. >> i went around, knocked on the door a couple of times, sheriff's department, and then breached the home. >> reporter: no one was home. the deputy helplessly watched it burn. >> it was bad knowing there's nothing you could about it.

wildfires have forced thousands to evacuate. hundreds of homes are threatened. in northern new mexico more than 30,000 acres have been scorched by the ute fire. in colorado, the so-called 416 fire has burned over 2,000 acres, and strong winds are pushing a fast-moving fire near orange county, california. the aliso fire broke out saturday afternoon. residents there distinctly remember the last big blaze. >> it was back to, dove, a decade and a half ago when we lost over 300 homes here. you always think, gosh, is this the next big one to come through here? >> fire officials say they hope to get control of the fire soon. police iona are an who they psychiatrist.nd killed at leas

tony dokoupil has the details. >> reporter: dr. steven pitt died much as hi lived, wrapped up in a murder mystery. he advised police on high-profile killings including the death of beauty contestant jonbenet ramsey. now police are looking for answers after pitt himself was gunned down outside his office thursday. authorities released this sketch of the suspect described as a white male in a cap. witnesses heard a loud argument, then gunfire. less than 24 hours later a second murder victim collapsed near a bus, apparently looking for help. she had been shot in the head. police followed a trail of blood from the street to a third victim inside a law office where both women worked. >> we have been able to tie or basically determine that the shooting on first street is related to the shooting of dr. steven pitt. >> reporter: scottsdale police

another patrol officer were on duty when he tried to cut off the suspect with his car when he hits him. the suspect suffered scrapes and bruises and was arrested. "the new york times" reports on a study that says many women do not need chemotherapy. there are women who were identified as safely skipping chemotherapy. the findings mean about 60,000 women a year in the u.s. can safely skip chemotherapy. michigan's mlive reports delta air lines is investigating the death of a dog during a flight layover in detroit. an 8-year-old pomeranian named alejandro was put on a flight. he was found dead in a carrier

in the cargo facility at the airport. delta said the dog was alive when the flight attendant checks on him at 6:00 a.m. when the attendant checked again two hours later, alejandro was dead. scientists say leaks connected to nra contractor edward snowden are still leaking out 678. the top u.s. counterintelligence official said journalists have only released about 1% of what snowden revealed. that includes recent reportings on a mass surveillance program run by japan. snowden is living in exile in russia. and the "denver post" reports an off-duty fbi agent who was tansing at a d-- dancint a denver bar dropped his gun and shot a man in the leg. the unidentified man can be seen dancing and doing a back flip. >> he was dancing and right as he did a back flip, the gun fell out and hit the ground and went

administration's steel and aluminum tariffs. the six other members asked secretary steve mnuchin to express their anger and concern over the tariffs. and u.s. reported strong job gains. this morning stocks edged higher despite fears of a trade war. and u.s. stocks posted strong gains friday after a stronger than expected jobs report closings out a shortened holiday week. tech stocks were the big gainers. both the s&p and nasdaq finished thq gained over 1.5% of its value. the potential trade war could hurt the airline industry, according to aviation executives. they say measures that reduce trade and consequently soften the demand for business travel are not good for airlines.

our top stories this morning. a volcanic eruption in guatemala has killed at least 25 people. the volcano exploded yesterday and sent a shower of ash and rivers of molten rock into nearby villages. it's the volcano's second eruption this year. >> and one of president trump's attorneys says the president could pardon himself, but rudy giuliani said that would be unthinkable. giuliani said the only way the president would testify before robert muellers investigators would be if there are strict guidelines and president trump cannot be forced to testify. at the tower of london, an unusual royal tradition has been upheld for more than 300 years. mark phillips takes us inside
