alabama prison where she spent the last 21 year of her life, but critics say it shouldn't not have taken a celebrity to influence the president's decisions. alice marie johnson is waking up today a freewoman. >> i'm feeling no handcuffs, nothing on me. i'm free to hug my family. >> the 63-year-old great grandmother spent 23 years in an alabama prison for a first-time drug-related offense. president trump commuted her sentence after kim kardashian west lobbied for her release. she called her to tell her the good news. >> she is the one who told me it would happen, was free to rejoin my family. >> kardashian tweets telling her and hearing her screams and cry of joy is a moment i'll never

forget. johnson was convicted in 1996 for drug trafficking. the white house said she accepted responsibility for her past behavior and had been a model prisoner. >> there's lots of injustices that have been done and it shouldn't. take a celebrity to accomplish that. >> senator cory booker says he is concerned about how the president is using his presidency power. >> zach johnson was not treated fairly. >> last month president trump issued a pardon f boxing champion zach johnson and two former contest tanltds on "the apprentice," former illinois governor rod blagojevich and martha stewart. alice johnson was the president's seventh act of clemency. a source tell cbsn the white house is looking at pardoning dozens of people. hena? >> laura podesta in new york.

thank you, laura. ahead on "cbs this morning," we'll speak with alice johnson and how she plans to spend the rest of her life. this morning rudy giuliani is brushing aside his comments that kim jong-un could scuttle next week's summit. speaking in tel aviv yesterday, the former new york city mayor boasted mr. trump's hard lean calling off the meeting after kim threatened nuclear annihilation of the u.s. forced kim's hand. >> kim jong-un got back on his hands and knees and begged for it, which is exactly the position you want to put him in. >> no reaction from north korea yet. giuliani said kim jong-un must understand the u.s. is in a position of strength. the attorney of an arizona man beaten by police say his client was not a threat when the officers started hitting him. four officers in the phoenix suburb of mesa have been put on

administrative leave pending an investigation. jamie yuccas reports. >> reporter: mesa police released body cam video. it shows police officers surrounding robert johnson as he leans against a wall by the elevator. the officers say they asked him to sit. when he didn't immediately comply, they began punching and kicking him. mesa police chief ramon batista said the officers were responding to an emotional domestic disturbance call at the apartment complex. a woman said a friend of her ex-boyfriend tried to break into her apartment. bautista said he order and investigation and placed three officers and sergeants on administrative leave. he's also ordering changes to his department. >> there's going to be a directive we're not to strike anyone in the face or head unless they show active aggression.

>> i don't care what race you are, color, gender, nobody deserves to be beat like that by police officers in this country. >> johnson was charged with suspicion of disorderly conduct and hindering. jamie yuccas, cbs news, mesa, arizona. the husband of designer kate spade said she suffered from depression. spade died in an apparent suicide. in a statement andy spade said kate suffered from depression and anxiety for many years. she was actively seeking help and working closely with her doctors to treat her disease, one that takes far too many lives. spade's body was discovered tuesday. her husband said spade was taking medication. they had been living separately for ten months, but he said they spoke or saw each other every day and that there was no warning she would do this. six children burned by the volcanic eruption in guatemala have been flown to the united states for treatment. they landed in galveston early

this morning. in guatemala, at least 99 people were killed by sunday's eruption and 32 are missing. entire villages are buried in ash and lava. residents say it happened in a matter of minutes. more than 12,000 people have been evacuated. rain and new lava flows are hindering rescue and recovery efforts. the pictures are much the same on hawaii's big island. lava from the kilauea volcano bury and entire neighborhood yesterday. hundreds of homes were covered by the molten rock as the lava made its way into the sea. one neighborhood, vacationland, disappeared. there were 279 homes in the area. authorities say most have been destroyed. in total 400 homes. it shows no signs of slowing down. this morning the golden state warriors are on the verge of sweeping cleveland in the nba finals.

their colleagues and family are being tested. the state department says they may have been the victims of targeted attacks on sounds. florida's "sun sentinel" reports two coaches who also served as security monitors at marjory stoneman douglas high school have been barred from campus and reassigned. according to a report one unarmed security staffer failed to stop or question alleged gunman nikolas cruz when cruz arrived on campus the day of the shooting. he radioed to another monitor that a suspicious kid was headed his way. when that unarmed monitor heard the gunfire, he hid in a janitor's closet. also, 17 trees were planted on school grounds yesterday in honor of students and teachers who were killed. the "sacramento bee" reports a suspect accused of road rage has been booked. video shows the man ramming his suv into an unoccupied suv at an intersection on monday.

he was also seen stomping on the vehicle and breaking its windows. the 43-year-old was involved in another incident earlier. he had drugs in his system at the time. the topeka kansas city reports that a man returned a $1 million lottery ticket to its rightful owner. a man left it on the counter in march without knowing it was a winner. a clerk checked numbers and discovering it was worth a million dollars. he called the son of the store's owner. that man tracked down the owner and returned it. he said it was the right thing to do. and "national geographic" said two rock climbers set a speed record climbing california's el capitan. alex honnold and tommy caldwell reached the top of the rock yesterday.

not want trade frictions with the u.s. to escalate. now on wall street times investeders are less worried about a potential trade war. stocks gained for the fourth day in a row. the dow rallied 346 points. the susan koeppen added 23 points, the nasdaq gained 51 points, another for another record. in hawaii, honolulu leaders approved a measure that would institute the first price cap on ride hailing surss like uber and lyft. it would prevent surge pricing. if the increased rates are higher than the maximum set by the city. it ramps up fares during peek times such as rush hour, peek times, and big events. the german automaker daimler unveiled an all electric big rig truck. the freight liner ee cascadia is a trailer with a 250-mile range.

baseball game for charity. a gunman opened fire last june on republican lawmakers practicing on an alexandria, virginia, field. scalise and three others were wounded, but scalise was the most seriously hurt. he uses crutches to help get around. the baseball world is mourning the death of hall of fame second baseman and former st. louis cardinals manager red schoendienst. he was a ten-time all-star with the giants, cards, and braves. he became manager in 1965 and led them to a world series championship in 1967. red schoendienst was 95. and last night the cmt music awards in nashville honored the top country music videos. >> the top video of the year goes to blake sheldon, "i'll name the dog." >> you heard it.

our top stories this morning, alice johnson walk out of a prison yesterday after president trump commuted her prison sentence. johnson was convicted on charges related to a cocaine trafficking operation and spent more than 20 years behind bars. and four mesa, arizona, police officers have been put on administrative leave after surveillance video showed them beating a man last month. robert johnson was leaning against a wall when officers asked him to sit down. when he didn't immediately

comply, the officers started punching. an internal investigation is under way. two top aides resigned wednesday from the environmental protection agency. this comes after allegations that scott pruitt misused his authority. meanwhile another hire by the epa is drawing criticism. angelica alvarez reports. >> they're sending a message. they want scott pruitt out. pruitt picked steven cook to run a superfund task force. he spent 20 years as a lawyer. part of the industry responsible for creating many of the toxic sites he's now in charge of cleaning up. >> if i were a governor or mayor, i would be really concerned that the game of politics is being played instead of cleaning up the sites and

making communities safe. >> reporter: elgie holstein says it's about helping big business, not the environment. >> what is clear is his first choice of appointments is not going to be people who care about the environment. >> reporter: the "associated press" found nearly half of the political appointees recently hired at the agency have industry ties. while environmentalists are concerned cook's job history makes him bad choice for the job, the epa argues it makes his background good for the agency. pruitt's allies on capitol hill say he still has work do. >> it's important that people believe he's a person they can trust and will do the job without influence one way or the other, and i -- knowing scott prui pruitt, i think he will do a good job.
