cancer patient is accusing monsanto of covering cancer risks of the product round up. the case is brought by 46 year old dwayne johnson. he is dying of cancer and claims ingredient in weed killer round up made him sick. he worked at the unified school district as a grounds keeper where he sprayed round up. a couple years after working at the district he developed nonhodgekins lymphoma. he is accusing monsanto of covering the potential dangers of round up. they've classified the ingredient in round up as a carcinogen. the lawyer says it's a david and goliath case but he is glad they're fighting the company in court. >> they have never warned anybody about it. mr. johnson made safety decisions based on the label every day and unfortunately has this aggressive nonhodgekins lymphoma. >> reporter: he says in a

statement more than 800 scientific studies, u.s.epa, national institutes of health and regulators have concluded that it's safe for use and does not cause cancer. we have empathy for anyone suffering from cancer but scientific evidence shows that this was not the cause. the outcome of the case could have broad implications for other cases. the lawyer in the case says he is representing hundreds of other cancer patients who have used round up extensively. jessica flores, kpix5. santa rosa firefighters looking for an arsonist. they said someone set 13 fires over the weekend. the first was at hern avenue and the railroad pad just before midnight. fires continued north and went west along the santa rosa trail. >> given the volume of fires, one after another along what we refer to as a walking path we are confident it was arson.

fortunately these are small fires. we don't want whoever it is to continue and the small fires turno something much bigger. >> officials are trying to identify the fire bug. there were no injuries and crews knocked down flames before they damaged homes. police looking for suspects in an early morning shooting. police found a man suffering from gun shot wound before 4:00 by orleans drive. police say that the injuries are life threatening. there's no word on a motive or suspects. firefighters are looking for the source of a one alarm fire. it broke out at a home just before 2:00 this morning. no one was hurt. major damage in the wake of a deadly earthquake in japan. we'll show you the impact in the country's second largest city. >> tesla is forced to answer new questions about a serious malfunction. what they're blaming the sudden car fire on in southern california. >> the morning marine layer is burning off nicely making for a good looking lunch break.

decoration c>>videfrom china, t a look at this. this is the moment a ceiling decoration collapsed onto a packed escalator. this happened at a mountain resort in northwest china. falling debris injured more than a dozen people. several were taken to the hospital and the cause of the accident is under investigation. a deadly earthquake in japan. magnitude 6.1 according to japan meteorological agency. it struck during the morning commute. at least four people are dead including a 9 year old girl hit by falling concrete at her school. more than 300 others are hurt.

there is no tsunami warning. this is the earth quake damage at a wine shop. hundreds of bottles fell and broke. you can see puddles of red wine and shaders of glass around the store. as bay area real estate continues to rise, so do sea levels. that can put tens of thousands of homes at risk. a new report says that 20,000 homes in the region could be flooded out by 2045. the total real estate value is $15 billion. the the report is based on federal figures that show that the sea level could rise almost two feet within the next 30 to 40 years because of climate change. these maps show the predictions for potential flooding by 2045. marin, santa clara, san mateo seeing biggest impact. fast forward another 50 years and this is how it could look by the end of the century. tesla is investigating a fiery model s mystery. tales trying to

blue in southern california. jamie yuccas shows us. tesla is calling the incident extraordinarily unusual. this model s quickly caught fire friday afternoon in in his no accident, out of the blue in traffic. in a statement, tesla says our initial investigation shows that the cabin in the vehicle was totally unaffected by fire. due to our battery architecture. it is designed to protect the cabin in the rare event that a battery fire occurs. >> of course the video footage looks alarming. >> reporter: editor and chief. >> there has been issues with lithium ion batteries in the past particularly around cell phones but electric car batteries are different. it's sophisticated technology. >> reporter: tesla maintains takes extraordinary measures to
