because there is a storm expected on thursday. they're expected to get a large quantity of rain, which he says would fill the cave and create dangerously strong currents. you know, they're holding the water back, for example, at the entrance of the cave, they've actually built a dam. but once the water level gets over the top of that dam, of course, the water's going to go right back down into this cave. it does go downhill into the cave and start filling it up. and of course, then you have boys, remaining people who are inside. their oxygen level starts to dr the air therefore, they have less ygen, and th couldomry dirsihav pectedto this persont

likely to draw attention at his senate confirmation hearing. >> there i no i aca more qualified for this position and no one more deserving. >> reporter: in the east room of the white house, president trump nominated federal appeals court judge brett kavanaugh to fill the seat of retiring supreme court justice anthony kennedy. >> if confirmed by the senate, i will keep an open mind in every case, and i will always strive to preserve the constitution of the united states and the american rule of law. >> reporter: with his wife and two daughters by his side, the 53-year-old said he was deeply honored to have been selected by president trump. >> a judge must be independent and must interpret the law, not make the law. >> reporter: kavanaugh has written roughly 300 opinions as a judge on the d.c. circuit. he supported conservative issues ranging from gun rights to

antiabortion cases and sided against net neutrality and many obama-era epa regulations. kavanaugh worked as an assistant to independent counsel kenneth starr during the president clinton impeachment probe. in 2009, he wrote a law review article, saying presidents should be free from facing criminal prosecutions, adding, an indictment and trial would cripple the federal government. >> are you ready for a fight? >> reporter: at a rally outside the supreme court, democrats slammed the president's choice. >> this is a nominee who wants to pave the path to tyranny. >> reporter: kavanaugh starts meeting with senators today. senate majority leader mitch mcconnell called kavanaugh a superb choice. the senate is expected to vote on kavanaugh's nomination in the fall. anne-marie? >> laura podesta here in new york. thank you, laura. and ahead, first on "cbs this morning," senate mino r,ho

to oppose kavanaugh's nomination. well, today is the deadline for the government to reunite young immigrant children t from their parents at the border with their families. the court order covers about 10a number of reasons, the justice department says just more than 50 will get to join their families. maria villarreal has our report. >> reporter: in court, the government admitted they will not be able to meet a federal judge's deadline to reunite all kids under 5 years old who were separated from their parents at the border. aclu attorneys are suing the government on behalf of migrant families. >> the government is planning on reuniting, at most, 59 of the 102 kids they've identified who are under 5 years old. >> reporter: the u.s. department of health and human services says more than 40 kids will remain in their custody past the deadline. their reason? the parents of nine children

have been deported or haven't been found, 12 are facing criminal charges, 9 others have been released into the country but the government has lost track of them. still, hhs says they are carefully vetting parents to protect child safety. the government also faces a july 26th deadline for the rest of the nearly 3,000 separated minors. >> i'm very worried about her. because i know that she's suffering. >> reporter: mario is one of those parents. he hasn't seen his daughter in nearly a month after they crossed the border illegally. criminal charges were dropped against him, but his daughter remains in an el paso shelter. >> translator: they promised me that when i was set free, that i would see my daughter in two days. it's been 14 days that i've been here. >> reporter: we have been asking, what will happen to the department of health and human services if they don't fully meet that deadline. some of our experts are saying nothing, but it will put the federal government on notice, and the courts will be more closely watching them.

on "the morning newsstand." britain's "independent" reports foreign secretary boris johnson said the brexit dream is dying in a letter announcing his resignation. johnson said prime minister theresa may's plans for a close trading relationship with the european union would leave britain as a colony to the eu. johnson wants a clean break from the european union. may named health secretary jeremy hunt to replace johnson as foreign secretary. "the billings gazette" reports a baby is doing well after he was found buried under a pile of sticks and debris in the woods of western montana. montana's sheriff's deputies arrested 32-year-old francis crowley of oregon saturday night for allegedly threatening people. he said a baby was buried in the woods. the 5-month-old boy was discovered face down sunday morning after spending more than nine hours in temperatures that fell into the 40s. authorities say he suffered some minor scrapes and bruises. crowley has been charged with criminal endangerment. the "washington post"

reports states are launching an investigation into the hiring practices at eight fast-food companies. attorneys general in ten states and the district of columbia are sending letters requesting information about no poaching agreements that block workers from leaving one fast-food company to work for another franchise in the same chain. king, dunkin' donuts, panera bread and wendy's. economists say the agreements prevent workers from seeking promotions and earning more money. and "variety" reports on the death of dam yankees star and gay icon tab hunter. the actor and singer was a heartthrob for millions of teenagers in the 1950s and early '60s. in addition to appearing in hit movies, hunter had chart-topping records, including "young love." he came out as gay in his 2005 autobiography. he died sunday in california from cardiac arrest. tab hunter was 86. still ahead, truth in online news. what youtube plans to do to fight the spread of

after being trapped in rushing waters. the girl became stuck in a storm drain in san antonio after heavy rains on monday. a passing trucker lowered a hose from his big rig to the girl, who tied it around her waist. and then other bystanders, including some nearby walmart workers, lowered a ladder, but it was too short, so they pulled it up as the girl hung on. on the "cbs money watch" now, youtube pledges to fight fake news, and ihop flips back to pancakes. diane king hall is at the new york stock e with that and more. good g, ane. >> good morning, anne-marie. well, this morning, switzerland launched a complaint at the world trade organization against the u.s. tariffs on steel and aluminum. the u.s. has 60 days to settle the issue. here on wall street, investors will begin to shift their focus today from trade issues to earnings reports. in the upcoming weeks, companies unveil their spring quarter report cards and expectations are high. now, yesterday the u.s. major stock indexes posted their biggest gains in more than a

month. industrial energy and bank shares led the way. the dow rallied 320 points. the s&p 500 added 24. the nasdaq jumped 67. youtube says it's cracking down on fake news. youtube says it will make, quote, authoritative news sources more prominent, particularly during breaking news events. youtube says it wants to counter fake videos posted following news events with stories that provide more accurate information. and anne-marie, guess what, all's right with the world. the international house of burgers is back to being the international house of pancakes. in case you had any doubts, ihop admits its sudden name change was just a publicity stunt. the pancake chain wanted to promote its new burger menu, so last month it started using ihob on social media, website and instore promotions, but yesterday the "p" was back. on twitter, they said we'd never turn our back on pancakes, except for that one time we
