bit later for the morning news and "cbs this morning." frenter in new york city i'm tony dokoupil. captioning funded by cbs it's friday, august 10th, 2018. this is the "cbs morning news." a federal judge orders the return of a mother and child deported and issues a threat to the attorney general. the holy fire rages on in southern california. the flames are moving dangerously close to home, triggering an evacuation order for more than 20,000 people. and a teen is pushed off a bridge, falls 60 feet into the water, and narrowly survives.

good morning from the studio 57 newsroom at cbs news headquarters here in new york. good to be with you. i'm anne-marie green. a mother and daughter who had been deported have been returned to this country, and a federal judge threatened to hold attorney general jeff sessions in contempt if they were not returned. the change in policy would prevent immigrants from seeking asylum because of domestic or gang violence. laura podesta is here in new york. laura, good morning. >> good morning, anne-marie. the aclu was in court yesterday fighting to keep this woman and her daughter from being deported when it was discovered that the mother and daughter were already on a plane to el salvador. the judge ordered their immediate return. in the middle of a deportation court hearing yesterday, the

aclu found out the mother and daughter they were representing were already being deported and on a plane flying from texas back to el salvador. judge emmet sullivan ordered the government to return carmen and her daughter to the united states and called the deportation outrageous. carmen is a pseudonym for the mother and daughter who were denied asylum. >> she was pleading pervasive sexual abuse, domestic abuse, as well as gang violence, and she fled to this country seeking safety. >> carmen and 11 others are claiming domestic violence to get asylum. >> the vast majority of claims we see are not valid. >> reporter: the justice department is not commenting on the case. carmen and her daughter never got off the plane in el salvador.

they were flown back to houston and sent to a detention center in south texas. and attorney general jeff sessions will be in houston later this morning. he'll be heading to the u.s. attorney's office to speak about reducing violent crime. anne-marie? >> lauwyeura podesta here in ne rk. thanks a lot, laura. in southern california this morning there's a desperate battle to save hundreds of homes from a surging wildfire. it's closing in on lake elsinore where an evacuation order has been issued for more than 20,000 residents. officials say the fire was intentionally set. forrest clark has been charged with arson and is expected to be arraigned today. he's being held on $100 million bail. jonathan vigliotti is covering the latest blaze. >> reporter: despite the all out aerial assault, the fire continues to explode in size, a fire that officials say was

deliberately set. >> do you know how this fire was set? >> i have no idea. i had two earplugs in. >> eporter: that was forrest clark's explanation. thousands of homes in lake elsinore lie in fire's path. the city's mayor minced no words. >> i'm pissed, outraged, disgusted one man caused this devastation for no apparent reason. >> reporter: the only question now is how bad this will get. >> at what point is this in the hands of mother nature? >> 100%, all the time. >> reporter: the fire battalion chief said they have not caught a break. this is how quickly entire communities can be leveled when the winds change and roar into neighborhoods. it happened last month in redding and now thousands in lake elsinore brace and hope as

the flames inch ever closer. >> we can't control fire. we can do our best to protect. but this is heartbreaking. >> reporter: jonathan vigliotti, cbs news. well, a college basketball assistant coach has been charged with misdemeanor assault after throwing a punch that led to the death of a tourist in new york city. wake forest assistant coach jamill jones pleaded not guilty last night. police say he punched a man, causing him to fall and hit his head on a sidewalk. he had banged on jones' win co-of his suv looking for his uber driver. jones got out and punched him. jones is scheduled to appear in court october 2nd. the grandfather of a missing georgia toddler who was allegedly kidnapped by his father said his grandson's remains were found at the compound in the desert. authorities were led to a filthy

compound where 11 children were discovered. danielle nottingham has the latest. >> reporter: video of a new mexico desert compound shows the squalid conditions. the remains of a young boy were also found at the compound. the father of three expects said he had no idea they were living this way. remains were also found. wahhaj believes that's his 3-year-old grandson who was allegedly kidnapped by his own father last year. authorities say siraj ibn wahhaj told his wife he wanted to perform an an exorcism on his child. he had trained the child to use assault rifles for future school shootings.

>> i have no idea. i have no idea what his thinking was. to do something as extreme as this, it doesn't make sense. >> reporter: wahhaj senior alerted police when one woman sent a text asking for food. >> right now the children are safe and they're being very well cared for. >> reporter: the suspects are due back in court on monday. the mother of the missing boy is headed to new mexico to assist in the identification process. danielle nottingham, cbs news. in puerto rico, officials now report the death toll from hurricane maria will top 1,400 people. that's 20 times higher than the official confirmed number of 64. maria devastated the island last september. the new death tolles fro a report from congress.ons follow storm. >> all i can say is that there

is no lie, there is no misleading. we always said it most likely will go up. >> the government stopped updating its death toll months ago. the new death toll would make maria the second deadliest storm in nine years since katrina killed more than a thousand people. a yemen strike has killed at least 50 people, more than half of them children. more than 10,000 people have been killed. the air strike was carried out by the u.s.-backed saudi-led coalition. the air strike targeted rebel forces backed by iran, but a bus carrying children on a field trip was hit. the u.n. secretary-general has called for an investigation. the prosecution in paul manafort's financial fraud trial yey a ouofank t its case today. employees told the jury about lies contained in manafort's

a popular pesticide is banned and a vote counting dispute in kansas. "the kansas city star" reports on an election too close to call. yesterday kobach said that he would recuse himself from counting votes after colyer accused him of advising counties not to count some mail-in ballots. his lead shrunk 121 votes after there was a discrepancy between their tallies and what colyer reported. the "washington post" reports a federal appeals court said the trump administration endangered public health by letting a controversial pesticide stay on the market. the court ordered epa to ban a pesticide used on citrus fruits, apples, and other crops.

points. the s&p 500 fell 4 points, while the nasdaq rose 3 opponents yesterday, its agts gain -- eig gain in a row. facebook is banning sites to have blueprints for 3-d printed guns. they said sharing instructions is not allowed under its community standards. last week a seattle judge granted a temporary restraining order to block the online publication of 3-d gun designs. >> now, how about a side of sensitivity with that fried chicken. franchise operator that manages 270 kentucky fried chicken, pizza hut, and taco bells in the united states will provide sensitivity training to its employees. they triggered a decision after a deaf woman said she was mocked as she tried to order food at the drive through. a group reached an agreement with the companies.

here's a look at today's forecast in some cities around the country. [ playing "pink panther" ] it's not every day you see a pink seagull. well, actually it is for the folks who live in barnstaple. it's been walking around the streets for two weeks. it's kind of sad. it's believed someone spray painted the bird. animal officials are working with police to find out what happened. and an investigation is under way in washington state after a teenage girl was seriously u injured when she was pushed off a 60-foot-high bridge into the water below.

a video shows 16-year-old jordan holgerson hesitant to take a plunge off a bridge on tuesday. her friend pushed her. she was hospitalized with five broken ribs and a collapsed lung. >> there was air bubbles in my chest. i could have died easily. >> holgersson said when she hit the water, she couldn't breathe. the friend who push her has apologized. and first lady melania trump's parents are now u.s. citizens. the slovenian couple was sworn in as citizens in a private ceremony in new york city. their lawyer said they didn't receive any special treatment and their daughter sponsored their green card to obtain residency. president trump has ended most calling it chain migration.
