hoping to avoid a trial but as anne makovec tells us they wouldn't be the only ones he would accountable. >> reporter: it seems almost certain that both men are headed to a full jury trial early next unique. once the judge rejected the plea deals, it was back to the drawing board. >> i'm not happy to go to the trial after all of the bad publicity that my clients received but we always had viable defenses. >> when he had to say no contest to 36 times to murdering people he knew and loved i was afraid it was going to break him. today he looked me in the eyes and he looked confidence. >> reporter: the master tenant

of the warehouse, and harris a party promoters but the blame was on the city. >> this case could trigger significant reform. >> reporter: each man is charged with 36 counts of involuntary manslaughter and faces a maximum of life in prison. with everything on the line. the defense lawyers want the trial moved out of alameda county where they say public perspective is skewed. >> it's motivated by the grief for many of them turning into a desire for revenge and retribution. >> family and friends were in court today. the next hearing is set for september 7th. in oakland, anne makovec, kpix 5.

the lawsuit filed against bart by wilson's family alleges that they failed to provide the highest standard of care. the attack happened three weeks ago. 18-year-old nia and her sister were transferring trains when she was stabbed in the neck. family and friends are honoring a chp officer killed in the line of duty. he was a 19-year veteran of the force. and now a procession and memorial service is underway in vacaville. people paid their respects as patrol cars slowly moved by, escorting his body. he leaves behind a wife and three children. the crash that killed him and the man he pulled over happened last friday on interstate 80 in fairfield. officers say the driver who plowed into the vehicles on the side of the road was speeding and on his cell phone at the time of the crash.

>> we want the message to be sent that your actions have consequences. that answering a phone or sending or answering a text can result in the tragic consequences that we witnessed this last week and that lives can be inalterably changed because of the actions. >> the suspected driver changes two counts of vehicular manslaughter. he posted bail yesterday and is expected to be arraigned next month. thanks to cooler temperatures and lower humidity, firefighters are finally gaining the upper hand on the biggest wildfires in northern california. the carr fire in redding is now 75% contained. more than 218,000 acres have burned in three weeks. and a thousand homes destroyed. the mendocino complex fire, the largest in state history is 76%

contained up from 51% last week. the fires that make up the complex have scorched 375,000 acres. and containment of the ferguson fire is now at 87%. all roads into the park are back open. and yosemite valley reopened to visitors earlier this week. cal fire says there are 10 weeks left in california's fire season. east bay representative eric swolwell is considering running for president of the united states in the year 2020. >> and today, by the stories that i hear and the data that i look at, we are in a trump slump. >> representative eric swolwell spoke to constituents in

cars for delivery... kroger launched the program yesterday.. in a phoenix suburb. kroger says customers can order same.. or next day deliveries.. once the the biggest u.s. grocery store chain is testing drivers cars for delivery. customers can order the same or next day deliveries. and customers can walk outside and pick up the bags. >> new technology has now lowered the rate of stolen cars and auto break-ins. as hena doba shows us, some criminals have figured out how to beat the system. >> eric uses a key fob to unlock his car. it only works in a close range. but two people walk up to his driveway and unlock the vehicle

without the fob. >> i looked at everything from the glove box, that's when i knew somebody had been there. >> they only got away with workout gear. and police are seeing cases where thieves open vehicles without a key. in some cases, criminals are using an amplifying device. if a fob is inside the home. the amplifier can grab the signal. keep your fob inside a metal box or a pouch designed to protect electronics from interference. >> if you can block the radio frequency, you can stop the effectiveness. >> and they have figured out how to steal a fob's signal while using it. morris in the blue jacket uses
