for some of you the news continues. for others check with us a little later for the morning news and of course it's thursday, august 30th, 2018, this is the cbs morning news. the outpouring of love and respect continues for the american hero who served his country with all his heart. more on the tributes and tears for the late senator john mccain. and a former police officer learns his fate after being convicted of murdering an unarmed black teenager. why some are criticizing the sentence. plus caught on camera, a florida sheriff said the uber driver had the right to use deadly force during a road rage confrontation.

good morning from the studio 57 newsroom at cbs news headquaters here in new york. good to be with you. i'm anne-marie green. the memorials and celebrations honoring senator john mccain will move from arizona to the nation's capitol today. his casket will be flown to d.c. after a church service in phoenix. he'll lie in state under the capitol dome. yesterday thousands said their good-byes. john is here with the details. >> as many as 15,000 people paid their respects to senator mccain yesterday. he was remembered as a man that dearly loved his family and

country. late into the evening senator john mccain's children thanked those that came to the arizona state capitol to pay their respects to their father. >> it's so incredible that you're all here. it really is and i really appreciate it. >> throughout the night thousands of people from around the world waited in 105 degree heat for the final good-bye. >> it's so respectful to be in the presence of someone that served our country for 30 years which is amazing. >> on what would have been his 82nd birthday. cindy mccain, his wife of 37 years and his children gathered for an emotional private service. >> imagining arizona without john mccain is like picturing an arizona without the grand canyon. >> a public memorial service will be held for john mccain where joe biden will pay tribute. >> some of the dear friends i have are on the other side of the aisle. my beloved friend joe biden. he and i would fight. we used to fight. but we were friends. and when it came time to settle

something because we were of good will we could get it resolved. >> also speaking is arizona cardinals wide receiver larry fitzgerald. >> i had a wonderful relationship with him for quite awhile. he's been a wonderful mentor to me. i can't tell you how honored i am to say a few words about a man that everybody loves and respects. >> his body will be taken to washington for a viewing at the u.s. capitol. >> mourners will gather on saturday for a service at the washington national cathedral and he will be buried at the u.s. naval academy in annapolis. >> thank you so much. we'll bring you a special report tomorrow morning of the ceremony for john mccain. and ahead, we talk with senator lindsey graham about mccain's life and legacy the latest high ranking official to leave the trump administration is white house council don mcgahn. he is leaving this fall after

telling associates for months he was looking to leave. he's been the main contact with robert mueller's russia investigation. his departure comes a week after it was reported he was cooperating extensively with investigators. >> don mcgahn is a really good guy. >> president trump announced that don mcgahn will leave his position in the fall after the confirmation hopefully of judge cavanaugh. he was surprised by the president's tweet because they had not discussed it. he was the lead man for the trump campaign but the relationship between the president and his top lawyer has been rocky. mcgahn threatened to re-sign over stress and frustration with the president. he also spent hours being interviewed by robert mueller's

team. the president said he approved the cooperation and isn't worried about what he revealed. one reason he hung on, his role in helping to confirm 60 conservative judges to the supreme court. in february mcgahn reflected on his vast responsibilities at the white house. >> i advise the president from constitutional law to executive power. >> that involves you in just about everything. >> unfortunately yes. >> he joins a long list of high profile white house departures including hope hicks, steve bannon and his first cheer of staff priebus. cbs news the white house. >> in the florida governor's race ron desantis is facing criticism for a comment democrats are calling racist. >> the last thing we need to do is monkey this up by trying to embrace a socialist agenda. >> his democratic opponent is tallahassee mayor andrew gillum, an african american. they said they were directed at

his policies and not a candidate. during a broadcast interview, gillum says he isn't buying it. >> it's very clear that mr. desantis is taking a page from the campaign manual from donald trump. but he has another thing coming to him if he thinks florida voters are going to respond to that. they're sick of it. earlier gillum said florida voters want someone that's not racist and not bigots. he would be the first african american governor. a dallas jury sentenced a former police officer that shot and killed an unarmed black teenager to prison. he fired his gun into a house party killing 15-year-old jordan edwards. the family and prosecutors said the jury let oliver off easy.

he was also fined $10,000. oliver's lawyer said they will appeal. new charges are being filed against the father of a young boy found dead in a new mexico compound. he pleaded not guilty to child abuse resulting in death charges. his 3-year-old son was found dead in a remote new mexico compound. 11 other children were found living in squaller. lesser charges were dropped after they missed a deadline to secure a preliminary hearing. they're being held without bail until a hearing next week. when an uber driver shot and killed a man tuesday morning it was a classic case of stand your ground. >> i say something. >> you know i got a pistol. >> the driver of the pick up thought his girlfriend was inside the uber car and forced it off the road. beck then threatened the driver, robert westlake.

>> that was a terrible mistake on jason's part because the uber driver not only happens to be licensed to carry a concealed firearm in the state of florida, but he just finished the police academy. >> westlake fired one shot and then called authorities and tried to revive beck. coming up on the morning news, new york's governor andrew cuomo faces off against his challenger and former sex in the city star cynthia nixon. >> plus american passports are being denied along the u.s.-mexico border. this is the cbs morning news. this is the cbs morning news. at the uen tournament after winning in straight sets 6-2, 6-2. it sets up a third round contest for serena against her sister venus that also won her second round match. it will be the earliest they have faced off against each other in 20 years. >> a mysterious substance causes allstate prisons to be on lock down across pennsylvania and passports are being denied across the u.s.-mexico border. months of animosity boiled over as andrew cuomo and cynthia nixon faced off in their scheduled debate. the two meet in the state primary for governor in two weeks. >> the subway system is owned by new york city. >> it's been controlled since -- by the state since 1965. >> can you stop interrupting? >> can you stop lying?

>> both candidates traded insults and passed over policy in the hour long debate.he gs e for a third term as governor he plans to serve four years and not run for president. the detroit free press says the city is shutting off drinking water because of lead and copper contamination. test results found high levels of lead and copper in 16 out of 24 schools that were recently tested. the superintendent says he's turning off the water at all schools out of an abundance of caution while more tests are being done. officials believe old fixtures are to blame and not the water the new school year starts next week. the trump administration is denying passports to americans

along the u.s.-mexico border throwing their citizenship into question. the administration accuses hundreds and possibly thousands of hispanics across the border of using fraudulent birth certificates since they were babies. from the 1950s to 1990s some mid wives and doctors along the border provided u.s. birth certificates to babies born in mexico. some are being jailed in immigration detention centers. all pennsylvania state prisons are on lock downs after employees were sickened by an unknown substance in recent weeks. they began setting sick on august 6th. now all 25 state prisons are on lock down which means inmates are restricted to their cells 24 hours a day. inmate visits are suspended and mail rooms are closed to certain types of mail. still to come, the cleveland browns released a star linebacker after federal prosecutors charge him with insider trading. so at johnson's, we improved everything. we used 50% fewer ingredients. took out dyes, parabens, phthalates and sulfates.

agreement. the u.s. and mexico agreed to a preliminary pact earlier this week. the canadian foreign minister said the talks are at a very for come -- very tense at the moment and they're looking for a win-win for both sides. canada could join the trade pact between the u.s. and mexico by tomorrow. prospects of better trade deals helped push stocks higher. dow gained 6 points and s&p 500 gained 16 and the nasdaq rose 79. the s&p 500 and nasdaq finished at record highs for the 4th day in a row. the clothing manufacturer pvh that owns calvin klein and tommy hilfiger reported an increase. it's working to move back to its premium brand status. the company is also bracing for tariffs imposed by the trump administration.

now about $400 million of pvh products are produced in china. >> the cleveland browns released one of its linebackers after he was charged with insider trading. he used information from people he knew illegal profits. they were aware of his involvement in a financial issue prior to signing him but, quote, circumstances have changed. he has accepted full responsibility for his actions and apologized. he faces possible prison time and further action by the nfl. california could become the first state to require that women be included on corporate boards of directors. the california assembly approved the requirement yesterday. it applies to publicly held corporations with principle executive offices in the state. if it becomes law companies will be required to have at least one female director by the end of next year and up to three by

our top stories this morning, senator john mccain's body will be flown to washington after church services in phoenix. it will lie in state at the u.s. capitol. thousands paid their respects to him at the arizona capitol. family and friends attended a private service where his wife pressed her face against his coffin. mccain will be buried sunday at the u.s. naval academy. >> white house council mcgahn is leaving the trump administration in the fall. the president announced it yesterday calling him a really good guy. he was a key figure in the handling of the robert mueller

investigation. months being interviewed by investigators. the president says he approved mcgahn's cooperation and wasn't worried about what he may have said. a dallas jury sentenced a white former police officer that shot and killed an unarmed black sta teenager to 15 years in prison. that same jury convicted roy oliver of murder the day before. last april he fired his gun into a car leaving a house party killing 15-year-old jordan edwards. the teen's family and prosecutors said the jury let oliver off easy. >> a scuffle over scallops broke out in the high seas. why the french and english fishing boats were pitted against each other. >> there was ramming on the high seas as the dispute over shellfish turned over. english fishermen said french

boats swirled them and hurled insults and rocks to drive them off the scallop beds. >> before we knew it we had around 10 or 15 other french boats surrounding us. throwing rocks at us. flairs. lighting the sky up with flairs so other boats could see us. it was quite an intense moment. >> this stretch of water may be called the english channel but some of the richest scallop fishing is on the french side. it attracts fishermen from both countries eager to cash in on this lucrative delicacy but international rules say the english boats can fish any time while the french are forced to wait until the first of october. it makes french fishermen furious. >> we're trying to get rid of the english, he said because if we let them get away with this they'll clear out the whole area. in the end, the english boats retreated home to port but the english fishermen say if
