crash on the peninsula in palo alto. these are live picturings of the -- pictures of the airplane partly submerged. the faa said the aircraft went down about 40 feet offshore of the palo alto airport. you can see the front part of the plane mange led. this happened in the past hour and there were three victims. we have confirmed one fatality. two other victims are being transported to the stanford trauma center. as we get a closer look, it's unclear if the plane was taking off or landing at the time of the crash. the cause is under investigation. and here is a live look at the confirmation hearing for brett kavanaugh, president trump's supreme court pick. so far, lawmakers have been doing most of the talking as democrats and republicans on the committee argue over whether the hearing should be taking place. our reporter jackie ward has

more >> reporter: this is a hearing about who will sit on the highest court of the land. the moment the confirmation hearing for supreme court nominee brett kavanaugh was glavled into session, democrats called to adjourn. they're protesting the trump administration's decision to withhold thousands of documents from kavanaugh's time serving president george w. bush. >> what are we hiding? ? >> reporter: this senator has been in nine supreme court hearings and this is the first time the white house refused to release documents without an explanation. >> i've never had a hearing like this where documents are so difficult to get. democrats strongly object to moving forward when so much of his record remains secret. >> reporter: the chairman turned back the protest, saying

the documents should not be released. >> those are the sort of issues that require according to supreme court some assurance of confidentiality. >> reporter: the mor the -- he said the more the public learns about the record, the less they want him confirmed. dem kratds -- democrats have little hope of keeping him off the befrnl. >> -- bench. >> republicans want to confirm kavanaugh in time to take a seat before the session in october. democrats calling for a delay until after the midterm elections. and john mccain's widow said john kyle will fill john mccain's seat until the election in 2020. he will put the country first just as john mccain did.

off of the streets so they can shoot up in a safe environment. right now people are openly shooting up in b.a.r.t. stations and alleys and leaving dirty needles behind. there's a prototype mock injection site and it had sanitary supplies like needles and tourniquets and trained medical staff on site with nor can to reduce overdoses. the ultimate goal to showing addicts respect to feel safe and get treatment. >> it makes me uncomfortable. but i feel like here in san francisco, we have to be willing to try new things. just because we don't want to see people shooting up and we don't want to see the needles on the street doesn't mean it will just disappear without taking real action. . >> reporter: that is the mayor whose sister died from an overdose. this is personal to her.

bullet this is an uphill battle, even if the governor approves a injection site. -- safe injection site. the government is threatening to federally prosecutor the cities because this is illegal under federal law. new york, philadelphia, and yatd are considering it -- seattle are considering it anyway. >> it seems like a lot of red tape. what is the time line on a safe injection site opening up? >> officials wouldn't give a time line. first, the governor would need to sign the bill and they would need to find a space. the public health clinic where they held the news conference, they would love to open the first site. but the officials say they want to make sure that anybody working at one of these sites would not be facing federal profession, which of course mab threatened -- has been threatened. and there's the issue of funding. we don't know exactly where that's coming from.

the mayor is pretty sure it would not need to come from taxpayers, at least at first. >> we'll see what happens. live in san francisco, thank you. and a stolen tesla led sheriffs of a pursuit this morning. the suspect stole a 2017 silver model x during a residential burglar in los altos. the suspect is in custody. and tropical storm god gordon -- gordon is picking up steam. it threatened more than 8 million people along the gulf coast and expected to make landfall as a hurricane tonight. >> we're tracking the storm in the weather center. . >> already seeing it bringing a lot of rain for alabama, parts of florida. it passed through miami and fort fortlauderdale bringing mren testify -- plenty of rain.

and now the strong rain is along the gulf states. they're bearing where it. and right now, it's headed closer and closer toward new orleans, toward mississippi. this is where we have hurricane watches, warnings, thunderstorm warnings as well. and right now, it is currently still a thunderstorm. as i set this into motion, you can see it could become a gat cory -- gat category 1 -- category 1 hurricane late tonight. staying a category 1 through early tomorrow and downgrading back to tropical storm status. right now, the gusts are pretty strong and moving at 15 miles per hour toward the louisiana, mississippi border and bringing a whole lot of moisture with it. some report up to 12 inches of rain possible. >> and we continue the storm coverage from the gulf coast in mississippi. . >> reporter: tropical storm gordon formed over south florida on monday morning, lashing parts of the sflien

an arm picked up my backpack. the car sped off and hit me. >> the girl was attacked last friday on wheeler and russell streets. the thieves took her backpack with ipad and epi pens inside. police are on the hunt for this driver who plowed into two kids in san jose and took off. it happened last monday. the white car ran a stop sign. a 13-year-old boy broke his wrist and a 12-year-old girl suffered a concussion. both are expected to be okay. today lawmakers will consider an unusual ban on flame throwers. it would ban people from owning, selling, or using the devices. firefighter and residents with permits to own them would be exempt from the ban. violations would result in fines starting at $100.
