accused of murdering a black teenager. good morning from the studio 57 newsroom at cbs news headquarters here in new york. good to be with you. i'm anne-marie green. well, today the senate is scheduled to hold a procedural vote on supreme court nomination of brett kavanaugh. now, final vote could come tomorrow. following the release of an fbi investigation into allegations of sexual misconduct by kavanaugh, gop leaders are confident the nomination will proceed. democrats are challenging the legitimacy of the investigation. in an opinion article, kavanaugh said he is an impartial judge who may have been too emotional during his confirmation hearing. laura podesta is here in new york. laura, good morning. >> good morning. yes, kavanaugh offered one last of himself, hoping to sway the few undecided senators. two republican no votes could

sink his nomination. supreme court nominee brett kavanaugh is defending his emotional testimony last week. >> this confirmation process has become a national disgrace. >> reporter: in an op-ed in "the wall street journal," kavanaugh wrote, i know my tone was sharp and i said a few things i should not have said. i hope everyone can understand that i was there as a son, husband, and dad. >> i do not know how senator flake and senator collins and senator murkowski will vote. >> reporter: only three republicans and one democrat are still undecided on kavanaugh's nomination. the rest remain split among party lines after reviewing the fbi's latest background check. >> there is no way anything we did would satisfy the democrats. >> in plain english, what i just read, there are hints of misconduct. so very frustrating thidstation. >> reporter: the agency said it conducted nine interviews, and could not corroborate christine blasey ford's sexual assault

allegation against kavanaugh. neither of them were interviewed. president trump rallied support for his nominee at an event in minnesota last night. >> judge kavanaugh will protect, uphold and defend the constitution of the united states. >> reporter: retired justice john paul stevens, who previously praised kavanaugh, told a florida audience that he cannot support the nominee after last week's hearing, saying the political bias kavanaugh showed creates too many problems. anne-marie? >> laura podesta in new york, thank you so much, laura. the kavanaugh nomination has divided the nation. anti-kavanaugh demonstrators gathered on capitol hill yesterday pleading with republican senator. capitol police say they arrested 302 protesters. mola lenghi has more.

thousands have been injured and 70,000 forced to evacuate. much needed supplies are just beginning to arrive. killed a south carolina police officer and wounded six others bragged online about his marksmanship and love for the smell of gunpowder. last night a vigil was held for officer terrence carraway. ♪ david begnaud has more from florence, south carolina. >> reporter: the barrage of gunfire was caught on cell phone video. according to a senior law enforcement source, the shooter was frederick hopkins, a 74-year-old vietnam veteran and disbarred attorney who is known to local law enforcement as an accomplished marksman. florence police chief allen heidler said the officers were overwhelmed during the ambush. >> it is my understanding they didn't know the level of

firepower that they were goir:rh warrant, sheriff deputies were attempting to enter the home because a 27-year-old man who lives there is the subject of a child sex assault investigation. that's according to a law enforcement source. >> officer down at this time. suspect still firing. use precaution. >> reporter: three female florence county sheriff deputies were the first to be shot. and responding as backup, four florence city police officers were also shot. an armored vehicle was needed to rescue the injured. how long was it before your officers were able to be removed from the scene? >> i can't give you an exact time. i can tell you it seemed like it was forever, but it was not. i would guess 30 minutes. >> reporter: sergeant terrence carraway, just shy of 31 years with the florence police department, died from his injuries. his body was returned to florence after undergoing an autopsy in charleston. stephen wukela is the mayor. >> he had the ability to bring a sense of order and peacefulness to the most difficult of situations.

that made him a great cop. it made him a great person. >> reporter: david begnaud, cbs news. jury deliberations are expected to resume today in the case of a white chicago police officer charged with a murder of a black teenager in 2014. prosecutors say officer jason van dyke planned to shoot laquan mcdonald before he got out of his patrol car and that the shooting was unjustified. van dyke's lawyer says he reacted properly to mcdonald who had a knife. in anticipation of a verdict, the chicago police department is assigning an extra 4,000 officers to the streets and canceling days off. apple and amazon are denying a report that china hacked into apple's computer system. according to bloomberg, a unit of the chinese military inserted malicious computer chips inside equipment used by about 30 companies including apple. the chips would give beijing secret access to internal networks. bloomberg reports amazon

"the los angeles times" reports former rap music mogul suge knight was sentenced to 28 years in prison for the hit and run death of a california businessman. knight hit and killed 55-year-old terry carter with his pickup truck outside a burger stand in 2015.

expensive for consumers and businesses. the dow lost 200 points. the s&p 500 fell 23. and the nasdaq skidded 145 points, the biggest loss in three months. jbs, an arizona meatpacking plant, is voluntarily recalling more than 6.5 million pounds of beef due to possible salmonella. the products include ground beef and beef patties shipped to retailers nationwide including walmart. the recalled beef is marked with est 267 on the packaging. it was sold under the name cedar river farms, perfect choice, gourmet burger, grass run farms, showcase at walmart and in generic packaging. tesla ceo elon musk took a shot at the securities and exchange commission. on twitter, musk praised what he calls the short seller enrichment commission. musk had a long feud with short sellers and that's investors who bet a stock will go down.

wilson menashi is known as the octopus whisperer. he started volunteering after he retired and immediately got interested in octopuses. he became the first volunteer to touch them and get used to the suckers on their tentacles. he says octopuses are intelligent and react to what he does. in florida, a phenomenon known as the red tide has spread to beach areas along the atlantic, shutting down some popular resort areas. red tide has already plagued the gulf coast and the rare atlantic outbreak is killing fish and making people sick. manuel bojorquez has more. >> reporter: miami's beach closed due to red tide. an hour north at deer field beach, along with a warning of rough surf, this was posted. >> my throat tickled so bad that i'm constantly -- by toxic algae and prolonged exposure can lead to more serious health issues. you haven't gotten in the water? >> no. >> reporter: why is that? >> there is red tide in the
