two publicly decided -- undecided senators. senator lisa murkowski is likely a no vote. it's time to think about credibility and integrity of our institutions.:republican jeff flake says he will vote. before the vote senate leaders presented their version of clothes and arguments. >> everyone is innocent until proven guilty. >> jeff cavender -- kavanaugh presented to the senate -- >> reporter: kavanaugh opponents confronted a senator this morning. while supporters of the supreme court nominee gather to pray and visit at the offices of swing senators. both sides clashed in the hallways. the debate is expected to continue on the senate floor until the final confirmation vote.

the republican summary of the latest fbi investigation revealed overnight revealed agents interviewed 10 people who might have had firsthand knowledge of the assault allegations by deborah ramirez and christine blasey ford. democrats claim the report is incomplete. the fbi limited its scope at the direction of the republicans in the white house. white house press secretary sarah huckabee sanders says the president is looking forward to tomorrow's final vote. the president supports his nominee and wants to see him get confirmed. >> reporter: an official confirms the white house believes kavanaugh will have the votes. asked if they were or lawmakers will change their minds before tomorrow, the white house says if anything if the democrats who should do the right thing and confirm kavanaugh.

>> sources telling cbs news vice president mike pence will be in washington this weekend in case he has to vote to break a tie. crews are making progress on the massive dirt spill that blocked lanes of southbound 680 at brno avenue. chopper 5 was overhead the rack after a big rig overturned. jackie ward is live at the scene. they just opened up some lanes? >> reporter: about an hour ago chp was able to open up to lanes to traffic. now this is as smooth as traffic has been all morning. that is not saying much. the backup is about a mile and a half long. traffic came still to a standstill. this is why a big white -- -- a big rig involved pill --. the rig itself ended up over the side of the embankment. the car chp says caused this is

a white honda civic. it cause the driver of the truck to swerve. that's when the load shifted and cause the rake to overturn. the civic fled the scene and still has an outstanding warrant. >> it was at the beginning of the morning commute. luckily it was when traffic wasn't as typically as heavy. >> reporter: this was actually the second hit and run accident that happened within a matter of minutes. both involving the white honda civic. the first one happened at the stonebridge exit. chp says the civic fled that scene as well. then caused this accident to happen. the driver of the big rig is okay and the other driver who was involved in the first hit- and-run was taken to the hospital with only minor injuries. the slow lane on southbound 680 remains closed. caltrans is working on fixing the guard rail. either replacing it or straightening it up. that is expected to take until at least 2 pm. check out chopper 5's view of the parade of ships.

announcing her decision on brett kavanaugh. >> that didn't even bother to fill in the judge's names on its prewritten press release. they simply wrote that they opposed donald trump's nomination of xx to the supreme court of the united states. a number of senators joined the race to announce their opposition. they were beaten to the punch by one of our colleagues who actually announced opposition before the nominees identity was even known. since that time we have seen special interest groups with their followers into a frenzy. by spreading misrepresentations and outright falsehoods. about judge kavanaugh's judicial record. over-the-top rhetoric, and

distortions of his record and his testimony at his first hearing produced short-lived headlines, which although debunked hours leaders, continued to live on in this spread through social media. interest groups have also spent an unprecedented amount of dark money opposing this nomination. our supreme court confirmation process has been in steady decline for more than 30 years. one can only hope that the kavanaugh nomination is where the process has finally hit rock bottom. against this backdrop it is up to each individual senator to decide what the constitution's

advice and consent duty means. informed by alexander hamilton's federalists 76. i have interpreted this to mean that the president has brought discretion to consider nominees philosophy. where as my duty as a senator is to focus on the nominees qualifications as long as that nominees philosophy is within the mainstream of judicial thought i have always opposed litmus test for judicial nominees with respect to their personal views or politics. i fully expect them to be able to put aside any and all personal preferences and

deciding the cases that come before them. i have never considered the presidents identity or party when evaluating supreme court nominations. as a result, i voted in favor of justices roberts and alito who were nominated by president bush. justices soto meyer and caven who were nominated by president obama. and justice gorsuch who was nominated by president trump. i began my evaluation of judge kavanaugh's nomination by reviewing his 12 year record. on the d.c. circuit court of appeals. including his more than 300 opinions, and his many speeches

and law review articles. 19 attorneys, including lawyers from the nonpartisan congressional research service breached me many times each week. and assisted me in evaluating the judge's extent of record. i met with judge kavanaugh for more than two hours in my office. i listened carefully to the testimony at the committee hearings. i spoke with people who knew him personally. such as condoleezza rice and many others. i talked with the judge kavanaugh a second time by phone for another hour. to ask him very specific additional questions.

i also have met with thousands of my constituents. both advocates and many opponents. regarding judge kavanaugh. one concern that i frequently heard was that the judge would be likely to eliminate the affordable care ask vital protections for people with pre- existing conditions. i disagree with this contention. in a dissent -- judge kavanaugh rejected a challenge to the aca on narrow procedural grounds. preserving the law in full. many experts have said his dissent informed justice roberts opinion upholding the aca at the supreme court. furthermore judge kavanaugh's approach toward the doctrine, a severability is narrow.

when a part of a statue is challenged on constitutional grounds he has argued for severing the invalid clause as surgically as possible. while allowing the overall law to remain intact. this was his approach. >> your hearing from senator susan collins from maine. we been waiting to hear from her about her decision and how she will vote when it comes to judge brett kavanaugh's nomination. right now she is talking about

his stellar career and what she calls a very good record. about certain people who have advised her for the evaluation of judge kavanaugh. i'm talking about bipartisan attorneys who she has spoke to who have given great recommendations when it comes to kavanaugh. also other people who have advised her as well. >> she is a republican senator from maine. many consider her a gop swing vote. as well as jeff flake. we will see, early this morning the nomination process continuing where the senators are voting. 51-49. tomorrow would be the confirmation full senate vote. we will have much more when we come back.

analysts say this is the longest streak of hiring on record. putting millions of americans back to work since the great recession. the labor department says employers added just 134,000 jobs. the fewest in a year. that figure was likely lowered by hurricane florence. the blue angels must be up in the air. hopefully the weather cooperates. >> reporter: we are looking at fantastic weather for fleet week. a beautiful live look with our san jose camera. mostly sunny skies out there. check out our salesforce tower camera out of the bay. you can see the ships out there looking pretty this afternoon. currently temperatures are in the 60s and in the 70s. low 70s and concord and low 60s in oakland. santa rosa mid-60s right now. here is the satellite and radar view.

there is that area of low pressure that brought the wet weather earlier in the week. that will push off to the east. a ridge of high pressure will be the dominant weather future for us. the flow around these two weather features will bring northerly winds for us. we are looking at breezy conditions for the weekend and even dry gusty northerly winds. possibly offshore as well for the northbay hills and the east bay hills. the future cast, we will continue to see the sunshine as we head through the day and through the weekend. highs for today 67 in san francisco. 74 redwood city. 75 for concord. here's the 7-day forecast. looking good for the weekend. sunny but breezy. low 80s inland and sunday looks like the warmer day out of our weekend. inland there, low 70s for the bay and mid-60s for the coast. still warm for the beginning of next week. it is a real live hollywood horror story.
