good morning from the studio 57 newsroom in historic. i'm hena doba in for anne-marie green. hurricane michael is gaining strength as it moves over the warm waters of the gulf of mexico. here's the latest. michael is expected to become a major hurricane by tonight and hit florida's gulf coastline tomorrow. a state of emergency has been declared in 35 florida counties, from the panhandle to tampa bay. and mandatory evacuations have been issued for some low-lying gulf areas. laura podesta is here in new york. good morning, laura. >> reporter: good morning. yes, yesterday residents spent the day preparing for the worst. and for those who didn't, these final hours are critical to board up and get out. by the time michael makes landfall, experts predict it could be a category-three hurricane with wind speeds of well over 110 miles per hour. gas stations along the florida panhandle are already running out of fuel as residents and tourists evacuate ahead of

hurricane michael. >> we're going to get gas now e ouere. >> reporter: motorists were stuck in long lines yesterday as they waited to fill up their cars. others were stuck in traffic as they evacuated panama city beach. throughout the panhandle, businesses are boarding up, and residents are filling sandbags, wary of a storm surge that could top 12 feet. >> unfortunately it looks like it's coming directly at us. and all you can do is prepare. >> reporter: slightly inland, lisa jones is gathering supplies. >> well, i will go by the store and pick up water and food, packed goods, batteries. got plenty of flashlights. we're pretty set. >> reporter: shelves in some stores are already empty. florida governor rick scott is urging residents along the coast to follow evacuation orders. >> hurricane michael's forecast to be most destructive storm to hit the florida panhandle in decades. this storm will be life threatening. >> reporter: the storm clipped western cuba yesterday, flooding

streets, damaging homes, and cutting off power with downed trees. >> hurricane michael is a monstrous storm. and the forecast is getting more dangerous. >> reporter: warm gulf waters are expected to strengthen michael as it moves closer to the u.s. after hitting the coast, michael is expected to move northeast over georgia and the carolinas where residents are still cleaning up from hurricane florence. >> laura podesta here in new york. thank you, laura. eric fisher, chief meteorologist of our boston station wbz, has more on where michael is headed and what to expect. >> we're continuing to watch hurricane michael strengthen overnight. favorable conditions as it lifts northward. it could intensify through tuesday. the water's extremely warm. there's western wind shear which holdit ieck. storm a little bit,

mid 80s, supporting strengthening and before making landfall. lifting to the north, the landfall is likely on wednesday. close to the big bend of florida. category-three winds. we could be talking about gusts over 110 miles per hour there. then the track takes it across the carolinas and southeast of new england on friday. storm surge a big part of the story. this is a part of the gulf coast that is susceptible to the storm surge. and warnings are out for a broad area where we could see double-digit surge in terms of feet. up to 10 or 11 feet in some of the worst hit areas. if you are in an evacuation zone, it's a good time to leave if the evacs are ordered. watching the rainfall. it's not like florence, but heavy rain will move across the carolinas that could exacerbate flooding that we're still dealing with days and weeks after florence came through. eric fisher, cbs news.cbs is moi e latestn hurrice michl willreom pama city on florida's gulf coast.

now to the deadly limo crash in upstate new york. during inspections last month, other limos owned by prestige limousine were cited for defective brakes, flat or balding tires, and other maintenance issues. the driver in saturday's crash did not have a proper license. last night more than 1,000 people showed up at a vigil to remember the 20 victims of the crash. new york's governor says the limo should not have been on the road. demarco morgan reports. we need multiple ambulances. put medlife on standby. >> reporter: after a deadly crash killed 20 on their way to a birthday celebration, heartache turned to anger. >> the owner of the company had no business putting a failed vehicle on the road. >> reporter: when governor andrew cuomo revealed disturbing new details about the vehicle and its driver while attending the columbus day parade, governor cuomo said the vehicle failed inspections last month. the state immediately ordered the owner of the limo, prestige

limousine, to shut down, noting the driver, 53 years old, did not even have the appropriate license to drive the limo. the tragedy unfolded here on a serene fall day at this intersection. a known danger spot. police say the 2001 -- danger spot. the 2001 ford excursion was traveling southwest in schoharie. it blew a stop sign at an intersection and plowed into a parking lot outside the apple barrel country store. it struck and killed two pedestrians and slammed into a toyota highlander before stopping in a muddy ditch down the slope in the woods. >> the thing that is striking to me and to our team is the unfortunate number of fatalities. >> reporter: robert sumwalt is the head of the ntsb. >> if an entire engine block is moved back and basically crushed, moved back past the driver's seat, that would indicate there was a lot of force and energy involved in that crash. >> reporter: the young party-goers including four sisters were reportedly texting

about the limo's shoddy condition before the crash and originally boarded the supersized limo. federal records show the owner of prestige, shahed hussain had five inspections of his oversized fleet, four pulled from service over the last two years. public records show a man with the same name was an fbi informant who testified in two terrorism cases. authorities did not say how fast the limo was traveling or speculate what caused the limo to run the stop sign. it doesn't appear the driver applied the brakes. prestige limousine released a statement offering condolences and said the goal is to provide answers as quickly as possible. state police have recovered the airbag control module, what would be considered the vehicle's black box. demarco morgan, cbs news, lathem, new york. this is supreme court justice brett kavanaugh's first day on the bench. the court is scheduled to hear arguments in two cases about longer prison terms for repeat

offenders. kavanaugh attended a ceremonial swearing-in at the white house yesterday. chip reid has more. the senate confirmation process was contentious and emotional. that process is over. my focus now is to be best justice i can be. i take this office with gratitude and no bitterness. >> reporter: brett kavanaugh was officially sworn in as a supreme court justice saturday. he joined president trump at the white house for a celebratory ceremonial swearing-in. >> on behalf of our nation, i want to apologize to brett and the entire kavanaugh family for the terrible pain and suffering you have been forced to endure. >> reporter: at the white house, presidnt trump accused democrats of atrocious behavior during the confirmation battle over brett kavanaugh. >> i think a lot of democrats are going to be voting republican on november 6th.

>> reporter: majority leader mitch mcconnell. >> what i think this has done for us is provide the kind of adrenaline shot that we had not been able to figure out how to achieve in any other way. >> reporter: in a new cbs news poll, a majority of voters in four states with key senate races said the issue of kavanaugh's nomination makes them more likely to vote. one in five of the people who report being energized by kavanaugh's nomination said they did not vote in the midterm elections of 2010 and 2014. >> the ayes are 50, the nays are 48 -- >> reporter: kavanaugh was narrowly confirmed saturday. new jersey democratic senator cory booker used the kavanaugh confirmation to fire up the crowd in iowa saturday for what some say may be his presidential campaign debut. >> it is not a time to give up! it's a time to get up, to rise up, to speak up! >> reporter: chip reid, cbs news, the white house.

"the new york times" reports a senior trump campaign aide asked a private israeli intelligence

firm in 2016 for proposals to use social media manipulation against mr. trump's political rivals. trump campaign official rick gates reportedly asked the israelis for a plan to use fake profiles, spread false information, and gather intelligence. the information was to be used to help defeat republican primary opponent and democrat hillary clinton. there is no evidence the trump campaign acted on the proposals. special counsel robert mueller is reportedly looking into the proposals. the "washington post" reports president trump says he has no plans to fire deputy attorney general rod rosenstein. mr. trump said the two had a good talk while traveling together on air force one yesterday to an event in florida. the president also said he has a very good relationship with rosenstein. overseas, robert mueller's investigation continues on russian interference. mr. trump says he expects to be treated very fairly in the investigation.

"the san angelo standard tim times" says four men are missing after their recreational vehicle was swept away when raging floodwaters washed out an r.v. park. heavy rain that started sunday night caused the south llano river in junction to rise. that's about 140 miles west of austin. 19 people were rescued. 15 by boat, four by helicopter. another 40 people were rescued when people threw them life jackets and ropes. multiple r.v.s were swept away by the floodwaters. emergency crews are searching for those missing men. and "the san francisco chronicle" reports the bay area's subway system, b.a.r.t., unveiled a new updated earthquake warning system. >> you rapidly detect the beginnings of the earthquake, the first signals at the surface, close to the epicenter. you characterize the area over which the shaking is going to be felt, and then you push an alert out to people who are going to be in harm's way.

re here's a look at the forecast in some cities around the country. ♪ on the cbs "money watch," why more passengers on american airlines could find themselves stranded. and netflix is headed for new mexico. diane king hall is at the new york stock exchange with that and much more. good morning, diane. >> reporter: good morning. stocks on wall street finished mixed in relatively light columbus day trading. tech shares took another big hit. in the end, the dow rose 39, while the s&p 500 split a point, and the tech-heavy nasdaq fell 52, losing ground for the third straight day. a new policy at american airlines won't be welcome news for coach passengers. if a flight is canceled or delayed, american wants to keep passengers on american flights

and avoid rebooking economy passengers on other airlines. there are exclusions including weddings and funerals. agents are told to do whatever is necessary to help elite customers and business class. but the bottom line is it could lead to more stranded coach passengers. facebook is selling an internet-connected camera. the first electronic device with the facebook brand name. the social networking site says portal will make video calls easier and more intuitive. portal eliminates the need for users to adjust positioning or other controls. it uses automatic intelligence to zoom if people move around during calls. meantime, google is shutting down its social network plus because a bug discovered in march may have exposed the personal information of up to half a million users. google didn't reveal it knew about the breach until day. the "wall street journal" reports google didn't disclose

turning to a record-setting night in major league baseball, the boston red sox brock holt became the first to hit for a cycle in a post-season game. the sox beat the new york yankees 16-1 to take a two games to one lead in the american league division series. he singled and tripled in the fourth, doubled in the eighth, and hit a two-run homer off yankees' back up catcher, austin romine, in the ninth to complete the cycle. and a kayaker fishing for salmon on lake michigan found something just a bit bigger yesterday. he says he was shocked when he discovered a four-foot-long alligator. he says he wasn't sure if it was real or a toy. it was real. animal control workers helped rescue the alligator whose mouth was taped shut. they think it was dumped by its owner. it's doing fine and was taken to a wildlife center. coming up on "cbs this

governor andrew cuomo. the limo driver did not have the proper license. prestige limousine says it has pulled its cars from the road voluntarily. a new report by the u.n. carries a stark warning. the world has about a decade to reduce the amount of carbon dioxide released into the atmosphere, or it may be too light to reverse the worst effects of climate change. mark phillips has more. >> reporter: the future is closer than we think and is not good -- unless we do something latest united nations report on climate change. most climate scientists think we're already beginning to see the extreme consequences of a warming world. severe storms, sea level rise, and flooding in the philippines and on the u.s. east coast. other consequences -- crop failure and mass population movement may also reach crisis levels in the next 20 years or so. all this will happen sooner than previously feared, by the year 2030, the report says, if greenhouse gas emissions
