the past 20 minutes after being shut down for two hours. the systemwide delays are lingering into the afternoon. jackie ward has more on how firefighters rescued the victim with some new technology. >> one person extracted off the tracks using a new tool that most fire crews in san francisco are equipped with. sf fire says this morning a call came in of a person potentially being hit by a train. the person was trapped underneath. the train had to be pushed away from the platform and moved at the track level so fire crews could access the do byen gat andheld nally >> we ve used multiple ca to my knowledge this is the first time we have used it in a train re. irers have used the

gun over the weekend. suspected shooter robert bowers was in a wheelchair making his first appearance in a federal court in pittsburgh on monday. >> the judge advised him of the charges. he is detained in jail without bond. >> police say robert bowers open fire in the tree of life synagogue on saturday killing 11 people and wounding six others. >> the suspect was talking. >> on a website popular with the alt-right he posted a photo of three handguns and wrote jews are the children of satan and he fixated on a group called the hebrew immigrate society which helps refugees from all backgrounds in the u.s. in his last post before the shooting he wrote bringing in invaders that kill our people i cannot sit by and watch, screw your optics i'm going in. you can see the stars of david behind me, one for each person

the objective has always been a little light pushes away a lot francisco says the jewish community needs to continue to spread the the tragedy. last night mourners across the bay area did just that, in tiburon it was standing room only as people came together. there are two more memorial events for tonight at 7:30 in san francisco. one is at positively sixth and another on dolores street. meantime the u.s. attorney general in pittsburgh is seeking approval to seek the death penalty in the case. the two men charged in the deadly ghost ship warehouse fire are placing the blame on someone else. derick almena in max harris faced a judge today, the defendants say that the blame should be placed on the person who installed electrical equipment. it is unclear who that person

is. the two are charged with 36 counts of involuntary manslaughter in the deadly fire nearly 2 years ago. now the defense attorneys for both decided to drop plans to move the trial to a different location. they say that they can still get a fair trial in alameda county. >> i think that people see the prosecution for what it is. a very misguided attempt at deflecting blame from bureaucracy. >> the next hearing is set for november 9. >> this afternoon we have learned another suspicious package has been addressed to cnn for the third time in one week. this one was intercepted at the post office and there is no imminent danger. this comes as the suspect accused of sending last week's package bombs will make his first appearance in court today. cesar sayoc was arrested in florida on friday the same day a package addressed to tom steyer was discovered at a mailing processing facility in

burlingame. the prominent democratic donor believes this would not have happened with someone else in the white house. >> it sounds like you are blaming president trump to some degree for the bomb. is that fair? >> there is obviously no direct link. but i am absolutely associating and blaming him for creating the atmosphere that exists. >> cesar sayoc is accused of mailing out 14 package bombs, none of them detonated but they were all legitimate explosive devices. if convicted he will face 50 years in federal prison. a developing story out of north carolina. one student is dead after shots were fired a high school campus. it happened at butler high school outside of charlotte. another student shot him in the hallway during a fight and he died in the hospital, the shooting triggered a lockdown and parents rushed to campus to make sure their children were safe. >> i was like my child is in

the school. somebody was shot. so you know i was really worried. you know and then i am glad they found the shooter. so i was really worried about that. it is a sad day today. really sad. >> the suspect is in custody. the shooting comes in the wake of a disturbing new data report that guns are sending more than 8000 u.s. children to the er every year, according to a study from today gun injuries sent 75,000 u.s. children to emergency rooms between 2006 and 2014. results show that 8300 kids per year are treated for gun related injuries, this comes at a cost of nearly $3 billion. about half of the injuries were from assaults and 40% were unintentional. 200 people are feared dead after indonesian jetliner crashed into the ocean. rescue workers are going through the debris.

tina kraus has the latest on the search.>> crews find wreckage of the boeing 737 near the fuel slick where the plane went down along with passengers and their belongings like smart phone cases. this indonesian official says my prediction is nobody could have survived. 189 people, including three children were on board on the air flight when the nearly brand-new jetliner crashed into the sea monday morning, 13 minutes after takeoff. the pilot requested to return geinthe irport shortly before waters scattering wreckage for miles. search teams are working through the night to recover bodies and debris and hopefully the black box which could give clues as to why the plane went down. distraught family members are waiting for news of their loved ones and hoping for a miracle.

the safety of indonesian airlines has been a concern for long and they have been banned in parts of the world, europe lifted the ban in june after substantial improvements. the u.s. removed a similar ban two years ago. lion air ceo says the plane that crashed had a technical problem on a previous flight but the issue was resolved. tina kraus, cbs news. >> lion air is the newest but largest airline in indonesia. the last fatal accident was 2004 when 25 people were killed . strike leaders of the campaign to repeal the state gas tax say that ballot title is misleading and today they're taking legal action. the chairman for prop six will be in sacramento to clear up reported confusion on what your vote would mean, the gas tax approved last year brought the cost of gas up by $0.12 per gallon. the money is being used to fund
