good morning from the cbs news headquarters here in new york. good to be with you, i'm anne-marie green. president trump says the hard line immigration policies he's pushing have nothing to do with next week's election. he says he can end the constitution's guarantee of birth right citizenship with an executive order. but some say he's off base and the proposal would be a long-shot legal battle. major garrett has more. >> reporter: a week before the midterm elections, president trump said he could end birth right citizenship with the stroke of his pen. >> you can definitely do it with the act of congress, but now th >> reporter: that would mean overturning a portion of the constitution's 14th amendment that says all persons born or naturalized in the united states and subject to the jurisdiction

thereof of citizens of the united states. >> we're the only country in the world where a person comes in, has a baby, and the baby is essentially a citizen of the united states for 85 years with all of those benefits. it's ridiculous. >> in fact, at least 30 countries guarantee citizenship to people born within their borders. and federa ament applie cldre born in the u.s. to undocumented parents. republican house speaker paul ryan said the president cannot change current law by himself. >> you obviously cannot do that. you cannot end birth right citizenship with an executive order. >> reporter: in 2016 he raised the birth right issue on the campaign trail. >> the 14th amendment, i was right on it. you can do something with it and you can do something fast. >> reporter: the debate is in the hard line move to the run-up to the election including sending more than 7,000 troops to the southern border in reaction to the central american migrant caravan making it's way

north through mexico. the size of the u.s. force is roughly equal to that fighting in iraq and syria. on fox news president trump said people seeking asylum would be housed in tents while under review. >> we're going to put tents up all over the place and we're not going to build structures and spend hundreds of millions of dollars. >> reporter: the number of people born to undocumented migrants peaked 12 years ago but declined through 2014 according to latest data. even if the president signed an executive order ending birth right citizenship, it would face immediate court challenges and probably would not survive. major garrett, cbs news, new york. well, in the border state of texas, immigration is a critical issue in next week's election. but not the only one. democratic senator candidate beto o'rourke hopes to beat the

odds by winning the senate seat held by republican ted cruz. a democrat hasn't won a statewide election in texas since 1994. the race has been closer than expected, though the latest polls show cruz starting to pull away. meg oliver has more. >> reporter: on the campaign trail, energized democrats crete congressman beto o'rourke like a rock star. at this stop in san antonio, supporters formed a human chain to help him exit the park. what's your strategy for the homestretch? >> being with people who are going to decide this election. eight different voting stops, every one of them packed. >> reporter: texas is the most uninsured state in the country. now he's within striking distance of republican senator ted cruz. >> we will defend our freedom. >> reporter: cruz is touting booming growth and the biggest

tax cut in a generation achieved alongside president trump. >> the people of texas are common sense people. we won't low taxes, low regulations and lots and lots of jobs. >> reporter: but what was supposed to be a slam dunk turned into the senator turned into a bus tour canvassing the state to secure votes. >> o'rourke is trailing in the polls but leading with campaign cash. raisemorehan $38 million that's almost three times more than cruz and a fundraising record in a u.s. senate race. >> reporter: and early voting in texas is also setting records do you think a democrat has a chance of winning in texas? >> i do. >> reporter: why? >> because i have children that are in their 20s and 30s and they are looking for political change. >> i have to support cruz? >> reporter: why. >> i know what he's like. i don't know o'rourke at all. i go for the sure thing. >> reporter: but polls indicate nothing is a sure thing until all the votes are counted.

meg oliver, cbs news, san antonio, texas. special counsel robert mueller's office has asked the fbi to investigate allegations that women were offered money to make false claims about mueller. mueller's office did not specify what the claims were. reuters reports a professor at a vermont law school, jennifer taub, said she received an e-mail offering her money if she would discuss past encounters with mule -- mueller. she said she never met him. the synagogue shooting is due in court today. the first funerals were held yesterday. president trump visited the tree of life synagogue and a hospital where some victims are recovering.n pisbur jewish community, the president's visit was not welcome. laura podesta has more on that. >> there were protesters to coincide with the president's visit to the synagogue where the shooting happened. and pittsburgh's mayor said he

was afraid that mr. trump's visit would upstage the victims' funerals. funerals continue today for those killed in saturday's mass shooting at a pittsburgh synagogue. joyce feinberg, melvin wax, and irving younger will be laid to rest. >> the entire community feels they have lost their mothers, fathers, and sons and daughters. >> yesterday, four of the 11 victims were remembered, including dr. jerry rabinowitz, ben and arlene scheib were his patients. >> every wonderful word that's been spoken about dr. rabinowitz, absolutely true. >> i don't know if we'll ever find a doctor like that again. >> funerals were also held for daniel stein and brothers cecil and david rosenthal. >> there's a lot of people here have no connection with the rosenthal family, and it's just -- it's a sad day for pittsburgh, but it's a great day for pittsburgh too.

>> shortly after the funerals, president trump and the first lady came to squirrel hill neighborhood. . they placed visitation stones ou tree of life ouomacr of david synagogue. not far away, hundreds lined the streets to protest the president's visit. >> president trump, you are not welcome in pittsburgh until you fully renounce white nationalism. >> the president also visited a first responder at the hospital and last night injured officers anthony burke and mike smidga joined the pittsburgh penguins in a ceremonial puck drop. prosecutors say the suspected gunman, robert bowers, was a rabid antisemite whose hatred drove him to kill. he could face the death penalty if convicted.

>> thanks a lot, laura. a former boston crime boss james whitey bulger was reportedly beat to death by one or more of his fellow inmates. he was discovered unconscious yesterday morning at a federal prison in west virginia. >> any available medic need to respond. cardiac arrest. >> bulger, 89 years old, was serving two consecutive life sentences for 11 murders, racketeering, extortion, and other crimes. in the '70s and '80s he ruled the boston neighborhood known as southy. running a ruthless gang that knew no limits. back in 2006, one of his top lieutenants talked to 60 minutes. >> he shot people, strangled people, run them over with cars. >> he became ann form mant for the fbi and then went on the run and was captured six years later in california after a worldwide manhunt. coming up on "the morning news" now, stealing secrets. chinese intelligence officers are charged in a hacking case.

the u.s. women's gymnastic and chinese agents are accused of hacking. those are some of the headlines on the morning news stand. "the associated press" reports indonesian search crews may have found the aircraft. that crashed into the java sea. the nav says a 70 foot object was located about a hundred feet below thefacee water. they found more bodies and debris yesterday. the boeing 737 max plunged into the ocean just minutes after taking off from jakarta killing all 189 people on board. the indianapolis star reports a 9-year-old girl and her 6-year-old twin brothers were hit by a pickup truck and killed as they crossed the road to get to the school bus. police say lights on the bus

were flashing and the stop arm was extndended when the truck slammed into the children near rochester yesterday morning. another unrelated child was critically injured. >> the school has been warned. this is an issue. they've made complaints, not just them, not other parents. it's not safe to walk a child across a highway. >> police say the driver of the pickup truck, a 24-year-old woman, was arrested and faces multiple charges. they do not think alcohol or drugs played a factor. the san diego union tribune reports two chinese officers in a group of alleged hackers are charged in the u.s. with trying to steal information on commercial jet engines. federal prosecutors say they conspired to hack into the computer networks of private companies in the u.s. and france to steal plans for a turbo fan engine. all the defendants are believed to be in china. and people says the u.s. women's gymnastics team is headed to the 2020 tokyo olympics after winning their fourth straight world championship.

forecast in some cities around the country. on the "cbs moneywatch," ben and jerry's launches a new anti-trump flavor and a green california. diane king hall is at the new york stock exchange with that and more. good morning, diane. >> good morning. general electric cut its dividend again this time to 1 cent. ge also announced as the justice department opened a criminal investigation into a $22 billion charge it booked to its power division. shares sank nearly 9%. but overall stocks climbed on an otherwise solid day of earnings. the dow rallied 431 points. the s&p gained 41, a day after closing at a five-month low. and the nasdaq jumped 111 points. shares of facebook gained

nearly 3% yesterday in the face of a second straight quarter of record-low user growth. mark zuckerberg said to expect rise in costs to moderate after next year. but he warned that growing user interest and private messaging video and safer content would cause costs to drive faster than revenue for sometime. waymo, the electric car company by google, has been granted permission to test its cars without a human on board in california. it will be in santa clara county. the driverless vehicles will be able to cruise at speeds of up to 65 miles per hour. waymo cars have already traveled millions of miles on california roadways, but until now a backup driver had been on board. for these tests, an engineer will monitor the vehicles from a remote locations. remote location. fedex is ending a program that offered discounts for business members of the national rifle association. fedex says the closure of its discount program had nothing to

one of the world's tallest statues was unveiled today in india. the 790 foot bronze statue depicts one of its leaders, sardar patel. he is known as the iron man. the statue is twice the size of the statue of liberty. it cost $420 million to build. there's also a museum and a research center dedicated to patel's life. and with less than a week to go before the midterm elections, there's an intense effort under way to get people to vote. one organization is playing a key role to make sure voters are ready. mola lenghi has more. >> reporter: when all of the votes were counted following the 2016 presidential election, one number stood out. >> about 11% of the american population which is about 21 million voters, did not have the organization called srth
