headquarters here in new york. good to be with you, i'm anne-marie green. well, we could be seeing a partial government shutdown in less than three days if no deal on a border wall is reached between congress and president trump. and that would mean about 800,000 federal employees will either have to work without pay or be furloughed right before christmas. marc liverman is here in new york. what is going on and good morning? >> we are talking about big impacts, somewhere between nine and 15 cabinet level department and agencies would be affected and that would include homeland security. here's what's getting in the way of a deal. president trump appears to be standing firm on his demand for a border wall. last night he tweeted we are building artistically designed steel slats. it will ea

>> we need border security. series of spending bills by friday night or about a quarter of the government will shutdown. last week the president said that's okay. >> i am proud to shutdown the government for border security. >> democrats have held firm againstny new border -- any new border wall money. yesterday the rejected a proposal for $1 billion to fund other issues. >> we cannot accept the offer they made of a billion dollars slush fund for the president to implement his very wrong immigration policies. >> sara sanders said they want to see what congress can pass, but in the meantime they're considering other options. >> he has looked for every one of his secretaries to look for funding that can be used to protect our borders. >> democrats are nixing that idea too. >> they need congressional approval, they're not getting it for the wall, plain and simple. >> if no deal is reached, 420,000 federal employees would have to work through the

ho without pay. anher 380,000 employees would be furloughed. and if friday's deadline is missed, this would be the third government shutdown this year. anyone sending or waiting on holiday gifts, the u.s. postal service wouldn't be affected by a shutdown because it's an independent agency. >> that's a little bit good news. thanks a lot, marc. a sweeping criminal justice reform bill is on its way to the house after the senate approved it last night. the bipartisan was 87-12. it gives judges more decision correction when sentencing some drug offenders and boosts prisoner rehabilitation efforts. also it reduces life sentences for some drug offenders with three convictions to 25 years. president trump pushed for the bill. and said it would keep neighborhoods safer. the house is expected to approve it later this week and send it to mr. trump for his signature. and they banned bump stocks, the attachments that allow

semiautomatic weapons to fire like machine guns. they were used by the gunman in last year's las vegas massacre that killed 58 people. gun owners have until march to turn in or destroy the advices, after that they're illegal. the government estimates as many as half a million bump stocks have been sold since 2010. and president trump has agreed to shut down his charity amid an investigation into allegations that it was being misused. but at the end of the trump foundation doesn't mean that it's out of the woods. weija jiang explains. >> reporter: new york's attorney general is painting the trump foundation as a political and business interest. they say investigators found a shocking pattern of illegality, including unlawful coordination with the trump presidential campaign, repeated andful self-dealing and much more. sarah sanders. >> it's not something we can comment on.

>> reporter: in one instance, the president allegedly used $100,000 worth of foundation money to settle a lawsuit over the height of a flagpole at his mar-a-lago resort and one day after they raised money for veterans in january 2016. then campaign manager kory lewandowski sent this e-mail to an attorney for the foundation asking when they could use the money. at least $500,000 was doled out to groups in iowa just before the caucuses. but money from a tax exempt organization cannot be used for political purposes. candidate trump defended the foundation in 2016. >> 100% goes to other charities. including a lot of military. i don't get anything. i don't buy boats, i don't buy planes. >> reporter: a trump foundation lawyer said the charity h distributed $19 million to over

700 charitable organizations and claimed the group has been trying to close since mr. trump won the election. markus owens is a former irs attorney. >> it was used apparently as a private slush fund for donald trump. so the victims here are the united states government and the taxpayers of the united states. >> reporter: attorney general underwood is moving forward with a lawsuit against the trump foundation which seeks nearly $3 million in restitution and would ban president trump along with three of his children, donald junior, eric, and ivanka from running charities in new york for ten years. weija jiang, cbs news, the white house. well, it might be months before former national security adviser michael flynn finds out his punishment for lying to fbi investigators about his contact federal judge delayed it. he said that he wanted to give flynn more time to cooperate with special counsel robert mueller's russia investigation. flynn was expecting to be spared prison time after mueller praised his assistance in the investigation.

the judge accused flynn of selling out his country and said that he was ready to send him to prison. and this year's list of the safest cars in the world is out this morning. overall, only foreign cars performed the best except for one american vehicle. keith craig has details. >> reporter: the insurance institute for highway safety crash tested cars of all shapes and sizes to determine the top safety picks. front crash prevention systems and headlight performance were also put to the test. iihs president david harkey. >> so we're very encouraged to see manufacturers continue to produce safe vehicles for consumers. >> 57 2019 models received the top two awards. that's five fewer than last year but they also raised the bar. they must show advanced front crash prevention to earn top safety pick and must meet higher

standards in several categories to be a top safety pick plus. only one vehicle from a u.s. automaker, the chrysler pacifica made the grade. >> we are disappointed that we don't have more u.s. models in the top safety pick this year. they missed like a number of automakers on the headlight rating. they had a few near misses with respect to achieving that good or acceptable rating. >> harkey says improvements are needed when it comes to headlights but he's seen advancements in crash prevention and protection. >> all of manufacturers are stepping up to the plate and making changes where it counts and providing consumers with a good variety of vehicles to choose from. >> the group says that's making cars on the road today safer than ever. kenneth craig, cbs news, new york. coming up on the "cbs morning news," new allegations against facebook. did the social network give tech

[ bleep ]. that's a union pacific train hitting a semitruck in midland, texas, yesterday. the 18 wheeler got stuck on the railroad tracks. the driver got out in time and then he called 911 and there were no injuries, just some spectacular video. there are new data sharing allegations against facebook and there was a tornado outside of seattle. those are some of the headlines on the morning news stand. the seattle times says a rare tornado touced down on washington's peninsula west of seattle. the powerful twister slammed into several neighborhoods yesterday causing serious damage. it tore roofs off homes and ripped trees ogr th o.ouout e buindldings were . power lines were knocked down and roads closed.

they report the tornado hit before a warni issued, but there were no ng cou immediat be reporte s of injuri "the new york times" reports facebook gave tech giants far greater access to your user data than it previously disclosed. the times investigation found more than 150 companies benefited from data sharing deals with facebook, most of the them tech companies like amazon, knell netflix, microsoft and yahoo. they got information like phone numbers, e-mail addresses, searches and likes. some got to see private messages. facebook said in a statement it's winding down the partnerships. and usa today says a texas girl's inoperable brain tumor disappeared leaving doctors stumped. she was diagnosed in june with a rare cancerous tumor and given

stuff. let's start with the federal reserve. it is expected to raise interest rates for the fourth thyme year. it comes as president trump again said it's a bad idea. he tweeted yesterday he hopes the fed doesn't, quote, make another mistake. the fed has indicated forecast of three more interest rate hikes next year but analysts doubt that many will take place. what the fed does today is expected to have a big impact on wall street. the stock market broke a two-day losing streak as technology and consumer staple companies climbed but oil stocks plunged. they hit the lowest level in 14 months. the dow jones industrial average raised 82 points.p 0 s mostly u and the nasdaq gained 30 points. billionaire entrepreneur elon musk unveiled his underground transportation tunnel late last night. some took a ride through an

underground tube in los angeles. they got into one of musk's tesla vehicles and were taken 30 feet below the surface in a wallless elevator. they traveled at 40 miles per hour for about a mile. he says the future system will run about 150 miles per hour and be smooth as glass. and the largest grocery chain is making its way into the driverless delivery market. kroger used a self-driving vehicle with no one at the wheel yesterday to deliver items to a home in scottsdale, arizona. the initial service will deliver grossries in the scottsdale area within about a mile of a kroger-owned supermarket. for the time being, the driverless vehicles will be followed by a car with a human inside who can stop and control it. >> wow, the future is here. >> meet george jetson. >> diane king hall at the new york stock exchange. thanks a lot, diane. >> thank you, anne-marie. >> still ahead, she got big laughs for her work on screen and off screen. we remember hollywood funny woman penny marshall.

our top stories this morning. we're less than three days from a partial government shutdown with no deal in sight between president trump and congress over funding for a border wall. the white house press secretary said yesterday the president does not want the government shut down. they need to pass a series of spending bills by midnight friday to avoid a shutdown. and in a bipartisan vote the senate passed a criminal justice reform bill 87-12. it gives judges more discretion when sentencing drug offenders and reduces life sentences for some drug offenders with three convictions. president trump pushed for the bill and the house is expected

to approve it and send it to the president this week. a basketball coach is giving new meaning to hands-on leadership. jamie yuccas has more. >> reporter: the bulldogs are like any other high school basketball team. except for one thing. this is the mississippi school for the deaf. we talked to the team using sign language and iprs. how do y dribb and sign. >> translator: if you're dribbling you might have to use one hand and then dribble with the other hand. >> no one does it quite as well as the coach. as a recent game, a fan tweeted this video of the coach rallying his team signing whose house? the players signed back our house. >> what was your reaction to the video? >> translator: first,my reaction i thought what's the big deal? that's what i do every day.
