holidays as a fire rips through their homes. good afternoon everyone. >> one man did not make it out alive and today our reporter is in san jose with the latest. >> reporter: it has been a grim morning here in south san jose as folks waking up needed to walk past the body of their neighbor. some of these neighbors themselves are having to find temporary homes four days before christmas. >> it is terrible when this happens. obviously it is hard on the family and it is tough on us too. we don't like to see this happening. >> at 4 am neighbors called 911 about smoke coming from this second-story unit. firefighters knocked the flames down quickly but found the victim unconscious on the floor. they took him into the courtyard where neighbors watched paramedics performed cpr for 20 minutes. >> i was just hoping they could bring him back.

government shutdown on democrats . >> now it is up to the democrats as to whether or not we have a shut down. i hope we don't but we are prepared. >> senate majority leader mitch mcconnell began the process of voting on the house approved a spending bill that contains $5 billion for a border wall. >> i support the initial border security and disaster aid, and i am proud to vote for it. >> democrats remain opposed. >> president donald trump you will not get your wall , abandon your shutdown strategy. >> senators passed their own bipartisan bill earlier in the week to keep the government running but no money for the wall and the president rejected that deal forcing the show down. a shutdown could leave one quarter of the federal workforce without paychecks, 420,000 workers would have to work unpaid and 380,000 others would have to stay home without

pay. >> a spokesperson for mitch mcconnell responded to the presidents tweet saying there are not enough votes among senate republicans to use the nuclear option. the white house is downplaying the departure of defense secretary james mattis. he retired resigning the day after president donald trump announced a plans to withdraw troops from syria , a decision he openly opposed in his resignation letter. today the white house says they continue to have a good relationship with lawmakers on both sides of the aisle. >> if we think that indicates stability or strength, everything that indicates knowledge is leaving this administration. >> cbsnews has confirmed mattis was also overruled on an order trump issued to the pentagon to

bring home half of the 14,000 troops stationed in afghanistan. his resignation will take effect january and there is no word on who may succeed him. we are learning supreme court justice ruth ginsburg underwent surgery today to remove two cancerous growths from her left lung. doctors are saying there is no evidence of any remaining disease. last month the justice fell in her office and fractured three ribs. the cancerous nodules were discovered during a follow-up from that injury. she is expected to recover over the next few days. she is the senior most liberal justice on the court. did you feel it this morning? a small earthquake hit geyserville. no damage was reported. this is a live look outside and you can see rain drops across our camera lens at the golden gate bridge. roads are a little wet out there so if you are heading out right now you want to be careful especially for those hitting the roads for the holiday travel.

this was just like yesterday when a drone delayed flights throughout the day. a police officer accused of robbing a bank made his first court appearance this morning. robbed a bank last month and made off with about $9000. he is also facing criminal charges in san mateo county accused of stealing more than $24,000 from an elderly man last year. he is facing up to five years in prison for elderly abuse and up to 20 years behind bars for the bank robbery. police are investigating a violent robbery and shooting near a busy bart station, it happened at the macaurthur bart station around 840 5p -- a.m. and during the attack the gun went off but no one was hit. police searched the scene earlier today for clues and they are reviewing surveillance video.

they are offering a $5000 reward for information leading to the suspect. a trash fire briefly shutdown all lanes on northbound 280 at the 101 interchange this morning. heavy black smoke covered the area as they tried to knock down those flames. the fire was extinguished in about 30 minutes. for the thousands of families in paradise that lost their homes in the recent wildfires the rebuilding process has been difficult but the alameda county sheriff's office has plans to spread holiday cheer called bikes for butte. deputies are volunteering their time and they are loaning four trailers to the project. they are collecting bicycles and toys all donated by local retailers because there isn't enough room and one man is even loading 852 foot-long trailer. >> everybody lost everything so to be able to give christmas to the kids is a good day. >> it has been a moving experience to be a part of that and to give back in this way at

police have arrested a suspect in connection to the disappearance of a colorado mother. her fianci and they have confirmed patrick frazee is now in custody, his fiancie kelsey berreth had been missing since thanksgiving. the mother was last seen entering a supermarket. >> we won't quit looking. >> this comes less than a week after police searched his 35 acre property. he is now charged with first- degree murder. let's take a look at the big board right now and you can see the dow is down around 280 points and stocks are still on track for the worst december since 1931 and of course that was during the great depression. trader joe's is recalling a popular brand of energy bars over fears they were contaminated with peanuts which are not included in the list of
