later on in the morning. from the cbs broadcast center, it's friday, january 4, later on in the morning. 2019. this is the "cbs morning news." shutdown showdown, the house where democrats now hold the majority passed a plan to reopen the government, but without funding president trump's border wall. investors hold their breath after another steep drop on wall street. so far global markets are mixed. and a sketch of a suspect has been released in the search for a gunman who killed a little texas girl.

♪ good morning from the studio 57 newsroom at cbs news headquarters here in new york. good to be with you, i'm anne-marie green. with a partial government shutdown now two weeks old, congressional leaders will meet with president trump today to try to work out a deal. democrats who took over the house yesterday approved a plan to reopen the government, but without any funding for a border wall. tom hanson's here in new york. you've been following this story, tom. good morning. >> good morning, anne-marie. that could be problematic as negotiations grind on with both sides appearing divided as ever on a deal. >> nancy pelosi, i extend to you this gavel. >> house speaker nancy pelosi and her fellow democrats celebrated their new majority. by passing legislation to end the partial government shutdown. >> the joint resolution is passed. the bill is passed.

>> but the two bills offer no new money for a border wall. without president trump's support, they're likely dead on arrival in the republican-controlled senate. >> we're not doing a wall. does anybody have any doubt that we are not doing a wall? >> lawmakers appear no closer to a deal than when the shutdown began 14 days ago. >> the president has made it very clear, no wall, no deal. >> mr. trump tweeted out this video yesterday and held firm on his position in the white house briefing room while surrounded by border patrol personnel. >> the wall about -- you can call it a barrier, you can call it whatever you want. but essentially we need protection in our country. >> president trump is expected to meet with congressional leaders from both parties at the white house today. it will be their second attempt this week to broker a deal. >> i hope they hurry up and get something done one way or another. let's get in over with. >> just steps from the white house on capol hl one effe

is litter on the national mall with hundreds of federal employees not working, volunteers are left to clean up national parks around the country. and white house officials have suggested now that pelosi is officially sworn in as house speaker, the discussions with congressional leaders may be more successful. anne-marie. >> tom hanson here in new york. thank you so much, tom. the 116th congress is the most diverse in history. women make up almost a quarter of the new congress. more than 100 women were sworn in yesterday, including more than 40 freshman elected in november. they're led by the only woman to ever serve as speaker for the second time, nancy pelosi. the new congress includes the first two native american women and first two muslim women. 25 new members are under the age of 40 and 25 women will serve in the senate. overseas in moscow now, the lawyer for the former u.s. marine jailed in russia for allegedly spying says he's trying to get his client released from prison.

paul whelan was formally indicted yesterday on espionage charges. he faces up to 20 years behind bars. if he's convicted. jan crawford has more on his story. >> reporter: american paul whelan is expected to remain at least until february in this russian prison where he's now being held in solitary confinement. the 48-year-old former marine now head of security for a michigan auto parts company was arrested at the historic hotel on friday. russian media said he was found with a thumb drive and charged with trying to recruit russians who could provide government secrets. his brother david said he was in russia for a friend's wedding. >> it's just inconceivable to all of us that he could be considered a spy, for any government against the russians. >> reporter: whelan's russian lawyer called his arrest senseless and baseless. he said whelan does not speak russian well and has asked for an english speaking cell mate as well as a change of clothes and a toothbrush. former deputy cia director, cbs news national security

contributor said whelan had been swept up in the spy wars. >> i have high confidence that paul whelan is not a u.s. intelligence officer. united states does not send intelligence officers to russia without diplomatic protection. >> reporter: what's most likely at play, russia is trying to get back one of its spies, maria butina. >> the russians want her back and they need to create a situation where they can offer a swap. and mr. whelan is that person, it seems to me. >> reporter: now the state department says it is not commenting out of respect for whelan and his family. mike told us that his arrest should be a warning to any americans traveling to moscow, you do not want to go to russia right now. jan crawford, cbs news, washington. global markets are mixed this morning after a steep drop

on water wall street yesterday. asian markets finished mostly higher after word that u.s. and china will hold trade talks in beijing next week. but in japan the nikkei closed down more than 2% after reopening from the new year's holiday. dow jones industrial fell 660 points yesterday. the s&p lost 62 points and the tech-heavy nasdaq plummeted 202 points. the drop came after apple reported that iphone sales are slumping in china. that has some investors worried about a broader economic slowdown there. apple shares fell nearly 10% yesterday. the company has lost more than $450 billion in market value since its peak last year. investigators in florida are trying to determine what caused a huge highway crash that left at least seven people dead. four vehicles, including two tractor trailers collided on interstate 75 yesterday about a mile south of gainesville. diesel fuel spilled across the

highway sparking a massive fire. several people were critically injured. authorities say that the fire was so intense it damaged parts of the road. the highway was closed in both directions causing huge delays. officials say they're treating the crashes a homicide investigation but did not say why. and we're getting our first look at a possible suspect in the deadly shooting of a 7-year-old girl in texas. authorities released this sketch of a man in his 30s or 40s wearing a black hoodie. investigators say he pulled up along side the car the girl was riding in with her family in houston on sunday and opened fire. janet shamlian has more. >> reporter: for the first time, the photo of a gunman that claimed the life of jazmine barnes. her 15-year-old sister alex sis is talking. >> he was white and had he blue eyes and that was it because had he a hoodie on so i couldn't see his hair or nothing like that. >> alexis says the driver of the red truck captured in this grainy image had a 5:00 show, enedere' af orfrom

celebrities. hometown houston texans wide receiver hopkins tweeting that jazmine's face reminded him of his own daughters. i'm pledging my playoff check this week to help her family with funeral costs, he wrote. on saturday, i will be playing in your honor, jazmine. >> he emptied out his gun. >> reporter: jazmine's mother who was hit in the shooting on sunday is still trying to understand why the gunman opened fire. >> do you think this could be a hate crime? >> yes. it was a black person and it was a white person doing the shooting. so i don't know if he's out here sick, you know, doing this because he's getting off to it or whatever it is. but he's taking innocent lives and it's not fair. >> reporter: the reward money to

an effort to discredit a congresswoman with an old dance video failed and neil degrasse tyson's show is suspended. those are some of the headlines on the morning news stand. variety says national geographic channel pulled neil degrasse tyson's star talk after sexual harassment allegations against the host. they say new episodes won't air until investigations by claims of two women is complete. which could be within weeks. the renowned astro physicist has denied the allegations. tyson is also hosting a revival of the series cosmos set to air on nat geo and on fox. business insider reports on a new u.s. government warning on people visiting china. they may not return home. the state department said yesterday u.s. citizens should exercise increased caution in china. it cites arbitrary enforcement of local laws and special restrictions on dual u.s./chinese citizens. the warning says china has been issuing exit bans on americans prohibiting them from leaving often without warning.

fortune reports americans will still have to file taxes during the government shutdown but they shouldn't expect a refund. the irs is running on a skeleton staff during the now two-week-old shutdown. if it drags on, early filers won't receive the refund they're expecting. many people rely on those refunds to pay down debt, catch up on bills or make major purchases. and britain's guardian reports that an effort to discredit new congresswoman alexandria ocasio-cortez with a college dance video backfired. the 30 second video shows her dancing on a rooftop. it was made back in 2010 when she was a college student in boston. but instead of embarrassing her, the video's released prompted a huge outpouring of support on social media, some calling her adorable and joyous. the 29-year-old new york democrat was sworn in yesterday. still to come, smartphone psychiatry. how apps may one day help enag

diane king hall is at the new york stock exchange with that and more. good morning, diane. >> good morning, anne-marie. let's talk about that deal first. bristol-myer squib is buying rival cell jean in a $74 billion cash and stock deal. the combined company will have nine products with more than $1 billion in annual sales. celgene would receive 1% of britt to mire plus, $50 in cash for each share they own. they would own about 69% of the company. shares of bristol fell about 13% yesterday on the news while airline stocks took a beating yesterday after delta trimmed its revenue expectations for the fourth quarter. the airliner announced that fourth quarter revenue will rise about 7%. that's a half point lower than expected. the air carrier said sales of higher-priced tickets sold closer to departure less than

anticipated in late december. shares of delta sank about 9%. it's worse the one-day showing since 2012. the cofounder and long time head of southwest airlines herb kelleher has died. he revolutionized the industry by helping to create the low-fare carrier that made air travel more accessible to passengers. he was a lawyer in san antonio when a client came to him in the late 1960s with the idea for a low-fare airline that would fly between big cities and texas. today, southwest carries more passengers in the u.s. than any other airline. he was 87. and while heavy smartphone use has been linked to possibly damaging teenagers' mental health, it's also being touted as a way to detect mental health issues. experts say the digital footprint left by teens could offer clues to their psychological well-being. researchers are testing smartphone psychiatry. a developing experimental app

a lifetime of difference. learn the signs at autismspeaks.org. our top story this morning, president trump is expected to meet again today with congressional leaders to try and work out a deal to reopen the government. hours after taking control of the house, democrats approved a plan to end the 14-day old partial shutdown, but without any money for a border wall. mr. trump made a surprise appearance in the white house briefing room yesterday to reiterate his demand for border wall funding. an effort to trim nearly 2 trillion pieces of plastic from the ocean appears to have gone bust.

carter evans spoke to the inventor. >> reporter: the 2,000 foot long cleanup system left san francisco last september with high expectations. the plan was to begin cleaning up the great pacific garbage patch, a giant floating mass twice the size of texas. but now after months at sea, there are some major setbacks, says the 24-year-old dutch inventor. >> did the pipe itself crack? >> we see a 60-foot section of the 2,000 feet long pipe that has detached. >> reporter: just before the launch, slat took us out on the water and he had some reservations. >> are you sure it will work? >> no. that's what we'll see in the coming months. >> reporter: during that time, the device floated freely with the currents forming a u shape to corral the trash. a skirt about 10 feet deep was supposed to catch the plastic, but that also didn't go as planned. >> the system isn't able to retain the plastic well, so once it's caught we often sometimes see it floating out again. >> reporter: it picked up 4,500 pounds of trash, not nearly enough, according to some
